I'd like to introduce to the Senate, Mr. Brandon Banbury. He owns a -- a company called Hailstorm Brewing Company, which is about ten minutes away from my house. Brandon is an engineer by trade, civil engineer, went to school with my sister at the great Southern Illinois University. He's a good Saluki. But more importantly, I'm really proud of Brandon and his company because they were just awarded the -- a gold medal and a gold medal at the Great American Beer Festival for the best beer. It's called Prairie Madness. It's an IPA, and when you waft it, it gives you a citrusy smell. It's hoppy. He also won a silver medal for his 6  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 Maibock, which is a -- light -- a lighter bock. But two of the best beers in the entire country are brewed right here in the great State of Illinois. I want to say thanks to Gene and his son, Josh, Wabiszczewicz, who also operate the company as well. They had a great time in Denver, Colorado. They employ twelve employees and they brew over two thousand barrels of beer and growing. And if you want their beer in your district, come on over here and meet my man. In fact, she's one of my legislative assistants in my Danville office. She has been a very loyal public servant for the citizens of the 52nd District. In fact, she came in at the same time Mike Frerichs came in, in 2006, and has continued to serve during my term as Senator. She has - if you look up here on the right side of the rear gallery - she has a pretty big fan club as well. She has six relatives, including her brother and sister and cousins. Just a terrific lady. So we're proud to have Mr. Legenza here. He's an employer in my district. On November 4th, the Legislative Ethics Commission appointed a special Legislative Inspector General to review the current backlog of complaints and begin any necessary investigations. This bill makes it clear and would allow that special Legislative Inspector General to initiate any investigation for any complaints received by the Legislative Ethics Commission or the Inspector General during the period of December 1st, 2014 through November 3rd, 2017. This is a provision that has been discussed with all four Legislative Leaders. Be happy to answer any questions and ask for an Aye vote.

SENATOR McCONNAUGHAY: Thank you, Mr. President. I'm obviously going to support this. I -- I just find it incredibly unfortunate that we even have to pass this bill today. Had the Ethics Commission been in a position to do its job, we wouldn't be having to backtrack and create an acceptance {sic} to a statute of limitations in order to properly hear complaints that we were misled in thinking that they did not exist. In reality, we've had a backlog of twenty-seven complaints over the last two/three years. And now we are in a position where we have to pass legislation just so we can investigate these claims. I find it unfortunate. I am disgusted by it. I think that we can do and should do so much better. This is a must today. We've got to get this done. But moving forward, we need to essentially rewrite our entire ethics ordinance, because the General Assembly in Illinois has demonstrated again and again that it is incapable of policing itself. As we move forward, we need to take the process of investigating complaints against the General Assembly out of our control. We need to build something that prevents us from tinkering with the outcome of a complaint. If an individual wants to bring a complaint forward and they know the General Assembly has the ability to manipulate the outcome, who's ever going to really come forward and issue -- ask -- file a complaint about how we do business? This is the kind of culture that has permeated this place for way too long. And I ask that 13  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 everybody vote Yes on this today, but I also ask that everybody rushes -- that everybody also work just as hard to rewrite a new ethics ordinance that the people of Illinois can trust in. I, too, support this bill. Also share concerns from the previous speaker that it's unfortunate that we have it. We have twenty-seven outstanding complaints. Each one of those has somebody who has issued the complaint, has a concern. Each one has somebody who has been accused. Not having the investigations does not serve either side well. It's highly unfortunate. So you have all these situations out there where both somebody remains accused and somebody has not gotten a complaint resolved. It's very, very unfortunate that these things have not been brought to fruition for both parties at the table. I -- I certainly share the previous speaker's desire to make sure going forward we really look comprehensively at how this is working or is not working. And certainly on the issues regarding sexual harassment, I think we really need to take a look at having a safe place to report, that women really do feel comfortable or anybody who has a concern feels comfortable doing that. I'm not sure in our entirety of what we're addressing today accomplishes that, so I'm very pleased that we will hopefully have a venue to continue having those 14  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 conversations. Certainly think we need to get on this and I'm glad that the Senate President is bringing this bill forward. Thank you.

His name is Mr. Billy Lawless, who is a restaurateur, a prominent restaurateur in Chicago. And he happens to have the same title that we have. He's a -- he was appointed a Senator in Ireland by the Taoiseach in Ireland. Thank you, Mr. President and Members. I think we've heard a -- a lot and -- and read a lot over the last few weeks about sexual harassment in the Capitol. Today I bring before you a resolution that -- that truly is the product of many women, who worked over the weekend diligently, and I want to thank them and thank them for honoring me in -- in allowing me to carry this resolution. So SR 1076 creates the Task Force on Sexual Discrimination and Harassment Awareness and Prevention. The task force reflects the Senate view that this is critical to continue the conversation on preventing and responding to sexual discrimination and harassment and that appropriate legislative changes must be made to maximize legal remedies and protections for those victimized by sexual discrimination and harassment. The task force will hold its first 18  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 meeting by December 15th and will make comprehensive recommendations to the General Assembly no later than December 31st, 2018, with interim reports encouraged to ensure the task force is making progress. We are serious about this. We believe that more needs to be done. And this is something that, going forward, we must do a better job. I would appreciate an Aye vote. I am happy to entertain any questions, but I think we all in this Body know the seriousness that this issue must be taken with.

PRESIDING OFFICER: (SENATOR TROTTER) Is there any discussion? Any discussion? Senator McConnaughay. SENATOR McCONNAUGHAY: Thank you, Mr. President, and thank you, Senator Bush. I look forward to working with you on this task force. And again, as I said earlier, it's unfortunate that we even have to do things like this. But I also want to offer some words of caution as we all, you know, get excited to start a task force that's going to talk about this. I want just -- and it's not -- it's, I think, was beyond your control. But a little concerned that we have our own task force and the House has a different one. Lot of people in this town believe that that is a recipe for failure, that -- that we will never actually get to a solution when one Chamber works very separately than the other. So I -- I hope that that's not the case, but I put that warning out there that we need to be diligent in our efforts on this to ensure that we -- this actually results in legislation that moves this State forward as it relates to sexual harassment. My second caution on this is, the resolution doesn't - I -- and I apologize, I didn't have a chance but to read it very quickly - doesn't say a lot about the Ethics Commission 19  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 and -- and it is imperative that this task force also talks about the Ethics Commission, because it's likely where any complaint about sexual harassment is going to go. And as I said before, we have to change the way our ethics ordinance or Ethics Commission actually operates to ensure that when an individual comes forward and files a complaint that they know that there won't be retribution, that it won't get swept under the carpet, that it will be legitimately, responsibly administered, and the case will be evaluated by a trained professional who is in no way influenced by a single Member of the General Assembly, and eliminates the ability for anyone in this building, whether in the Senate or in the House, to be able to control the outcomes on any complaint that comes forward. So I just -- I'm just offering that caution. Those are things that I think are really going to be important to also talk about as a part of the task force.

Thank you, Senator Bush, for bringing this up. Thank you, Senator McConnaughay, for saying what you just said. I want to add some clarity to some of this. Our resolution contains a identical line that talks about the two separate task forces working together. It was one of the main concerns we talked about, because we really do want to ensure that this is a follow-up to what the substantive statutory changes would be as a first step. 20  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 There was no way to dig deep and go into best practices and really get at this problem the way we need to in forty-eight hours when this stuff started rolling. So the good thing about the task force is that it does show the -- the seriousness of both Chambers to look at this and the absolute participation of the women in the Legislature as participants about this, because one thing we do know is there cannot be a bill largely about us and for us without us. So that task force is going to be critically important and this is, I think, our way to hold everyone's feet to the fire as to what happens next. So I'd like to say thank you to Senator Bush for bringing this forward. We have a lot of work to do. The point of today and what we will take up tomorrow is that this is just the beginning.

House Bill 1479 removes a provision in 3904 requiring the Director of Women's Division of the Department of Corrections be appointed by and with the advice and consent of the Senate. This is a product of an agreed -- an agree -- an agreement between the Chambers and between the sponsors. Representative Juliana Stratton promised that she would do this. She was able to get it out before we ran out of town -- I mean ran out of time, not ran out of town. Yes, thank you, Mr. President, Members of the Senate. This concurrence motion comes over from the House this afternoon. They passed this 117 to nothing. The bill would require lobbyists and State officers and employees, including Members of the General Assembly and legislative staff, to receive sexual harassment training. It also clarifies the procedure for making complaints of sexual harassment against State officials, General Assembly Members, State employees, and lobbyists, and allows the appropriate ethics commission to adjudicate these claims. And there's some specifics that I would point out. It amends the State Officials and Employees Ethics Act and the Lobbyist Registration Act to expressly prohibit sexual harassment. It clarifies that the Inspector Generals {sic} have the power to investigate complaints of sexual harassment. Clarifies that the Legislative Ethics Commission and the Executive Ethics Commissions {sic} are empowered to review reports of sexual harassment from Inspectors Generals {sic} and make recommendations, rulings, and administrative fines. It allows the jurisdictional authority for the Senate or the House to impose discipline, including discharge. Requires all officials, Members, employees, and lobbyists to receive sexual harassment training. It requires governmental entities and lobbyists to adopt a policy prohibiting sexual harassment and requires the ethics commission {sic} (commissions) to post on their websites the procedures for reporting an ethical violation and to accept complaints via email. And it creates a sexual harassment hotline at the Department of Human Rights. Mr. President, under this legislation, will someone subject to monetary fines for ethics violations under the State Officials and Employees Ethics Act, including sexual harassment, be permitted to pay that fine out of political campaign funds?

Yes, you were kind enough to let me know you were going to ask me that question and I researched it and therefore my answer is that it is not the intent of this legislation or current law to allow someone who has committed an ethics violation to pay ethics fines with campaign funds. Under Illinois' campaign finance law, campaign funds may not be used to satisfy or repay any debts other than loans made to the committee, loans made to the candidate on behalf of the committee, or loans to repay for goods and services purchased by the committee under a credit agreement. Use of campaign funds to repay personal loans is not permitted. If at any point an ethics commission, the State Board of Elections, or some other entity determines that this prohibition does not 34  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 encompass ethics fines, I will support legislation that would close that and change that outcome.

Again, I want to thank the Senate President. I know there's been a lot of work in a short period of time on this bill and really appreciate the fact that he sought a lot of input and really helped make amendments to this bill I think to improve it. I -- I -- clearly, right now, we don't have anything that even has sexual harassment as part of a -- a policy that we as General Assembly Members are held accountable for. So doing this and having training on it, I think is incredibly crucial. The concern that we have talked about is that this isn't necessarily sufficient - it's necessary, but not sufficient. And I understand that the intent here is to have the sexual -- sexual harassment task force really take a look at best practices and make sure we're putting in place a mechanism to make sure that women do have a safe place to go and report issues. And with that, I have -- much greater confidence in moving forward with this bill as a good first step and really appreciate all the work that's been done on this. PRESIDING OFFICER: (SENATOR MUÑOZ) To the bill, Senator. SENATOR McCONNAUGHAY: Thank you. Thank you, Senate President, for bringing this bill forward. And when you think about where we were just a mere week ago, we certainly have come a long way in this conversation. But I think my concern is -- and I'm -- and I'm going to vote Yes for this, because I think it's important to take this first step. But I -- I am a little troubled that, here in the Senate, we have not had the opportunity to have a robust discussion on this issue. Certainly, I don't think that the female legislators of this -- of this Chamber have had an opportunity to really -- well, they've - - we've been given a chance to participate in offering amendments and things of that sort, but we need to have a -- I think a very public discussion that -- that we invite the general public to participate in to make sure that whatever we do to respond to sexual harassment in this State is the best gold standard of anywhere. The -- the -- the scandal that sort of has broken out here in the past week as it relates to this has put a dark mark on all of us and -- and -- so we need to do this. But I just hope that as we move forward that the task force that we've put together, that I talked about earlier, that it is not just window dressing on this; that it is in fact meant to bring us to a bill. I also am very concerned about the fact that we're doing one task force and the House is doing something different. It really makes me very suspect as to whether or not when the dust all settles and 36  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 the national conversation about this is toned down, will we sincerely be aggressive in addressing sexual harassment in this State. And while we're at it, there's no way you can have this conversation without talking about our Ethics Commission, how we approach ethics complaints in -- in the General Assembly. And I have said it many times over this past week, we have demonstrated an inability to police ourself. And so as we move forward with this task force, I'm -- I am, on the record, hoping that we are very, very serious about a major overhaul to how we police ourselves and we change to a method that allows the general public, the people of this State, to know that there's a process in place that is not tainted or manipulated by the General Assembly. I -- again, I'm going to support this. I encourage everybody in -- in this room to support this. But I also hope that we do not forget the seriousness of this after the heat dies down. Thank you.

I, too, support this bill and -- and I -- I want to reiterate what I said this morning. The task force that we are forming is meant to be serious in nature and it's also meant to protect men and women that might be victims of some kind of unwanted treatment. I think that -- look, this is a really easy time to talk more about politics than issues and policy. And I want to say thank you. I know that there were people that worked very, very hard over this 37  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 last weekend with the Senate President to make sure that there were amendments made to this. This is a good first step and Senator McConnaughay is right - this does need to be taken seriously. But that's why we have to make sure we're policing that process and making sure that we're a part of it and watching it going forward. But I -- I want to be clear that I wouldn't have brought that resolution forward today if I didn't absolutely believe to my core that this is a serious look at this issue to make sure that men and women, those that are accused and those that are also - what's the opposite of being the accused? It starts with an A. It's one of those days - whether you're the person that's being accused or -- or you're the supposed perpetrator. Both of those people need to be protected. So, anyway, I just want to urge everyone to vote Aye and just know the task force is serious and -- and I hope that we're going all work together on that.

I just want to say, this -- this past week, I think, has definitely been an eye opener for all of us. And this is certainly a story that has hit the national headlines, as well as everywhere around, and everyone has a very strong reaction to it. And then some came out and you look at something like Senate Bill 402 and you say, "Oh, my gosh, look, they're rushing into this." But it 38  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 was very important that we address the issues that are addressed in Senate Bill 402. It -- I think it was very responsible of us to behave as quickly as possible as a reaction. However, I think we know as we look at this topic, this is major. There are a lot of moving parts, there's a lot to be considered, and if we rush in because of a situation and in a couple days throw together a piece of legislation without getting the input from everybody we need to be getting the input from and sitting down and carefully considering it and coming up with a measured response, you will hear when we talk about this that people are saying what we actually need to talk about here is not just a piece of legislation, it's a change in culture. Well, a change in culture isn't going to happen overnight with a piece of legislation. It's something that's going to take a very thoughtful approach. It's going to take a great deal of time. And the task force that's been created is going to create that opportunity. So I want to say when it comes to 402, it is an absolutely essential interim step that we're taking during this time. And, Senate President, thank you for bringing it. But I also want to take time to thank Senator Bush for bringing the task force, because I think that's where we're going to be able to research what other states are doing, what the best practices are, and approach this and deal with it in the most responsible, comprehensive, and long-term manner, and finally address that big question of changing the culture. So I urge everybody to support this bill.

And this deletes the liability provision in the bill. It passed in both Chambers, it was vetoed by the Governor, and we overrode it in the Senate. What they needed to do in the House to address that issue to come to a compromise was they ended up taking out these -- the penalty for it, where it was basically a Class A misdemeanor. And that's the change we made in agreement with what the House Republicans wanted in order to pass the bill in the 40  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 House.

…as it relates to a topic that is not easy to talk about. This resolution - and we're going to have another one that comes that's just as important right after this - House Joint Resolution 83 provides that by supporting this resolution, Members of the House and Senate are committed to changing the culture of sexual harassment in Springfield and politics in Illinois. It's important that we do this last piece on this topic today because we've had a number of people stand up and talk about how it doesn't matter how many bills we pass as to whether or not this gets addressed. So I'm going to tell you a little story, and I hope that there are people in here who can hear this little story, because it goes to the disconnect that people see when we say we want to end the culture and there are enough folks walking around that still don't know what "it is" that they're not supposed to be doing. So when I was younger and I was just starting out and I was -- it was my first lobby contract. It was the very first time I had ever pitched a client and landed the deal. And I knew at the time that you eat what you kill, so if I could land this contract, then I would be able to get paid for this. It was a contract, so there was no HR to go to. So I'm feeling really good and I'm at a luncheon and there's about twelve people at the luncheon. As we sit around the table, the head person on this bill told me that the only reason that I was there was so that we could put my beautiful black breasts on sale. Right. Now, I was just starting out. I hadn't gone to law school yet. I had absolutely no power 43  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 to speak of. I just had one client in my pocket that I was trying to work. That was an example of a conversation that crosses three different things. It was generational, it was racist, and it was sexist. It's how you can have racist behavior that can become sexualized and sexist behavior that can become racialized when you're dealing with women of color. I didn't know there was any place that I could have gone to say anything about that at the time. So I did what many, many, many women do. You make the situation go away. You change the topic of conversation. At that point in time, I got up, I excused myself from the table, 'cause it was humiliating. It was literally, truly humiliating. Luckily for me, there were two people at the table who jumped up and came to follow me and said, "Come back, come back to the table. He didn't -- he didn't mean it. He talks like that to everybody. Don't worry about it, Toi, it's -- it's not that big a deal." And I didn't want to come back to the table. And the reason I didn't want to come back to the table is 'cause I was humiliated in that moment. But you do what you have to do to keep working, to put one foot in front of the other. I had no -- if you could have told me then that I'd be sitting as a Member of this Chamber today. Truthfully speaking, enough time had gone by, I'd forgot about it, because there's so many instances over the course of our lives where you just do what you have to do to keep making a way. It's across all industries. It's when you go to college. It's in your first job. It's in your -- it -- it permeates a part of our culture that just is. But that doesn't have to be. So this is a hard conversation, it's a complicated conversation, it's a complex conversation. But nothing will change if we do nothing, number one. It's also not an impossible conversation, which is what the 44  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 point of the task forces are for. I heard a quote about the word "impossible" - that nothing is impossible, even the word itself is "I'm possible". There was a time, decades ago, when somebody who looked like me wasn't possible in this Chamber. But today, I'm possible, which means I'm a part of a stream of history. I'm a part of a conversation that we all get to have here on this Floor that talks about all issues and sexual harassment - actually, let me back up - harassment, discrimination, in all of its forms, including racism, that are rooms in the same house that's time for us to tear down. Nothing that we're attempting to do here is impossible. It is extremely necessary and the first step, besides the housekeeping bills that we did today, the things that we have to do, like statute of limitations and putting in an IG and making sure it's in the Code of Ethics and dealing with campaign funds, all those things that we could do quickly. This resolution says that all of us are going to commit to taking this seriously and understanding that talking about one person's pain doesn't -- does not negate another person's situation or lived realities. So when we're talking about all these things that we need to eradicate under the Capitol to make this a safe place for anybody to be, it's because we are all acknowledging that we want all people who have a call to public service to have a place and a role in this building in all of its iterations. Whether you're an advocate, a lobbyist, a Member, someone who's sitting in the gallery, people who are sitting at home listening right now, we all have a role to play in this democracy and we need your talent and we need your brilliance and we need all of your possibilities, because this is where we make laws. So this conversation is not impossible to have as hard as it may be, but it is necessary. Eleanor Roosevelt 45  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 said, "You have to {sic} (must) do the things you think you cannot do." This is one of those times. And for all the people who didn't think that it was okay for you to say something about this, there's another pretty cool Congressman sitting on a floor in D.C. who said, "I'm reclaiming my time." And that's what we're going to do with this. It's well past the time to think about what's possible. This could be political, but the magic of politics isn't talking about how bad things are right now. It's about what we want in five years, what we want in ten years, who do we want to be in twenty years, and I, for one, am tired of having to warn young women when they start working here about how to protect themselves. We're done with that. So this resolution is an acknowledgement that while we see and hear all of the #MeToo stories and the -- the fact that the #MeToo was actually started by an African American woman named Tarana done ten years ago without the benefit of social media. A black woman said that so she could tell other people that there were folks who can hear you and who see you and who believe you. She didn't have the benefit of Snapchat and Facebook and Instagram and all of the various ways we communicate today that made this thing go viral the way it did. So today what we're saying is that pretty soon these "Me Too" stories are going to end and we're going to move to "No More". This is the last piece of legislation that we'll take up today on this topic. I appreciate your indulgence, 'cause I know it's been a long day. But I also choose to believe in the possibilities, and we're just getting started. Due to the significance of the matter, I think it's appropriate to ask for a roll call vote. Taking a cue from what we've been able to accomplish today in the Illinois General Assembly as it relates to sexual harassment, I thought it was only apropos that we also look at House Joint Resolution 86, which also -- along with every lobbyist, legislator, staffer, or campaign worker, to commit to doing a better job of eradicating the culture of racism that persists within State government. We know that racism exists in society and State government is just a reflection of that society. The reason I think that's important is because we want to make America as good as its promise. And sometimes we forget that in this United States how long it has taken us to make "We the People" mean people that look like me. Condoleezza Rice once said, 47  STATE OF ILLINOIS 100th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 80th Legislative Day 11/7/2017 Americas -- "America was born with a birth defect" and that birth defect "was slavery". And in this country, we have not had an honest conversation about race and how the race has conditioned a disparate impact on many of the citizens of this United States. So, like my colleagues today who've taken an historic step in saying as a State we'll -- will not tolerate racism, discrimination, or sexual harassment, I would like you also to join with me, going on record for a record vote on this issue. And I thank you.

It requires that consultants with pension -- with pension funds -- that work for pension funds disclose whether they have any financial relationship with any firms that they either fund or recommend to be funded. It's a -- an apparency {sic}, open disclosure bill that -- we had hearings a few weeks ago and some of my colleagues contested -- testified to the fact that no one, even -- even on the consulting side, said that they were opposed to transparency. So I would ask for your favorable vote.
