This bill creates the Vegetable Garden Protection Act which establishes, that notwithstanding in any other State or local government law, that any person may cultivate a vegetable garden on their private property or another private property with the owner's permission. State and local government may adopt general regulations, provided that the regulations do not preclude or specifically regulate vegetable gardens. But if -- if it's allowed in terms of other reasonable setbacks and things then you can have a vegetable garden, yes. And -- and they can also regulate the height of it.

It can be regulated as -- yes, it can be regulated as long as it's not regulated because it’s a vegetable garden. So, in other words, if there are setbacks and things like that, yes that -- that does apply. But if you say, we're not going to allow vegetable gardens, well then that's not permitted.

And, I'm sorry, Senator Koehler. You know I dearly love you. This is an issue that we have seen in many committees for several years prior to this. Is this a single incident that this bill has resulted from?

I don’t think the bill is a result of a single incident, but, yes, there is a single incident in which kind of garnered a lot of publicity. But again this -- this does not limit a community's ability to be able to regulate zoning setbacks, height restrictions, structures, whatever. It just says that you cannot discriminate by calling something a garden. So the height of the garden, all those things that pertain to anything else in -- in city codes is still enforceable.

It's my understanding that where this issue really came from was a structure that they called a hoop house, where they were 7 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day 4/23/2021 trying to grow vegetables underneath it - that actually was the reason this whole incident came up is because the city was trying to limit this hoop house being erected on the property. Well, again, that was what kind of galvanized the publicity initially on this, but I don’t -- I don't think this law was written just with that in mind. This is written just to protect the rights of anyone in the State to be able to have a vegetable garden. And I'm not even going to opine on -- on whether or not this would protect or relate to that incident you're talking about. Because again, this is very clear, that communities can still regulate based on zoning, based on structures, based on all the other things in their code. They just can't say that because it’s a garden, it's, therefore, illegal.

I represent mostly home rule communities, where I would think we wouldn’t have any zoning of vegetable gardens to begin with. So, I don’t want to suddenly be letting my people -- my people suddenly regulate vegetable gardening. So, I carried this bill last year and have come to the conclusion that this should be no different from municipalities than the ordinance on temporary signage that had to go to the Supreme Court where we had to be told you can regulate temporary signage but you can't regulate temporary signage based on the message or the aspect. And what Senator Koehler's bill does, is says municipalities you can regulate things under zoning, you just can’t regulate them differently for different reasons. So, in that regard, I will be supporting this bill. Thank you.

So this bill doesn't -- doesn't speak to that issue per -- per -- per se, it -- what - - what Senator Wilcox just said is exactly what this bill does. It just says you can do all kinds of things in terms of your ordinances. You just can't do it to say that it -- that you're not going to allow vegetable gardens. So -- so it -- it -- it's really agnostic in terms of that particular story that we're talking about.

Very similar structures were all over in other - - other people's yards. So, this merely standardizes it. The ordinances could be enforced on what could be put on people's property. Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 208 is the initiative of the Treasurer's Office. It expands the Secure Choice Savings Program Act to include employers with five or more employees, allows the Secure Choice Savings Board to establish automatic contribution increases of up to ten percent of the employees' wage as part of the default savings option, and clarifies that penalties are applicable for full years of non- compliance instead of partial years. For the employers who become 15 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day 4/23/2021 subject to this Act pursuant to SB 208, enrollment deadlines for those between twenty-five and fifteen employees shall be no sooner than September 1, 2022. And the enrollment deadline for employers with five to fifteen employers {sic} shall be no sooner than September 1, 2023. So, Ladies and Gentlemen, this bill is an expansion of what the Treasurer did a few years ago when he established Secure Choice and -- and what that is to create good retirement savings options for people whose employers do not offer that. A few years ago that was established at twenty-five or more employees. We're seeking to expand that to make sure that -- that the vast majority of our employees that are out there who are working for employers that do not have in-house retirement savings have that same access that we need. This is best practices. This is the right thing to do for the people who are working, to give them those options. It is the right thing to do for our State and for our economy, as we ensure that people have retirement savings as they reach their golden years and do not have to rely on -- on future budgets to get through in their golden years. Now, I -- I would just note that with the amendment and with -- we did an amendment on this bill and we negotiated very -- in very good faith with the business community and such the vast majority of the business community has been removed as opposition to this bill including - so, the Illinois Chamber of Commerce is no longer an opponent to this bill. The Illinois Manufacturers' Association, the Illinois Retail Merchants Association are no longer opponents to this bill. That -- that does not mean that there is no opposition, but I would suggest that it is a very small percentage of the business community because this is the right thing to do. Yeah. Thank you. I really like the concept of the Secure Choice Program. I think it's a good program. And I like the idea of encouraging people to save for retirement. I also appreciate this sponsor's willingness to negotiate and exempt the smallest of businesses. That was a great change and I -- it's appreciated. It did remove some opposition, but not all. NFIB is still opposed. And my concern is that it imposes a mandate on the small businesses. It's not optional for the businesses to participate. The employee can opt out but the business cannot. And it imposes penalties for non-compliance. For that reason, I'll be a No vote and I encourage a No vote.

I'd like to think this is a kind of a peace of mind bill for people who run nursing homes. This is brought to me by HCCI. And I’ll just give you some of the rational, the State is seeking to double the nursing home bed tax. Without a rate floor in place, there's no guarantee that facilities will benefit from the increased tax. The latest federal regulations governing Medicare -- Medicaid managed care indicate that States are permitted to establish rate floors, and eighteen other States have adopted such measures. We ask that Illinois join those eighteen other states across the nation to establish a rate of -- a rate floor at the fee-for-service rate at the time the service is rendered. I'd be happy to answer any questions.

I -- I appreciate the leadership that Senator Koehler has brought to this issue and certainly there's no group that has suffered more over the last year as results of COVID than long term care. And I understand what he is trying to achieve by giving them that assurance during these very difficult financial times - that they be assured that there's a floor there. And so, it kind of puts us into a quandary with this -- with this issue. That being said, again, I understand what the -- what the sponsor is trying to do, and I think the Members on our side it -- it probably makes sense as a way to get some assurance for those long-term care facilities that -- that they will be paid at that floor rate. It is something though that the Department does oppose and they have concerns that it sets a precedent that could affect other contracts throughout the State. So, I just wanted to share some of those thoughts. And, again, Senator, thank you for the time you took to work through this and explain it through committee where there was an open process for everyone to discuss the issue. Thank you, Mr. President.

Senate Bill 968 amendment is a -- a gut and replace amendment which seeks to clarify that only medically necessary Pancreatic Cancer screening will be covered by all health insurance providers in the State of Illinois. Also, it updates the effective date to January 1st, 2022, to better align with the benefits plans. So, as amended, as I mentioned, this will cover -- ensure that medically necessary Pancreatic Cancer screening is covered by insurance companies. And I would just like to add, I believe that all of us have either a loved one, a family, or a friend, neighbor who has succumbed to Pancreatic Cancer. Pancreatic Cancer is the third leading cause of cancer related deaths in the U.S. and would be the second leading cause of cancer related deaths in 2030. And according to the Pancreatic Cancer Action Network, Pancreatic Cancer is one of the deadliest cancers with the lowest -- lowest five rates -- survival rate at 44 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day 4/23/2021 just ten percent. Thank you. Ladies and Gentlemen of the Senate, you know how listening to a song that you like takes you back to a simpler time. I'd like to take you back to 2019 and talk a little coal ash. In 1086, what we're trying to do -- and this is an initiative of the Illinois Environmental Law and Policy Center. And essentially what it does is, when we passed that bill, in a bipartisan basis, I would remind us, the coal ash bill in 2019, we at that point didn't have State rules and we assumed that the federal rules would be written first. That was not the way it worked. And so under the Coal Ash Pollution Prevention Act, when it was completed, it tried to eliminate the option for Illinois coal plant operators to avoid the requirements of State law if a future federal permit regulating coal ash ponds became available. Currently, no federal permit exists. So, under this bill - I'm sorry, I'm being distracted by these voices behind me - under -- under this bill, it would eliminate that potential loophole that would allow coal 47 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day 4/23/2021 plant operators to avoid the requirements of the State law because now, I think as of April 15th, State law now -- State law and rules now exist. Thank you so much, Mr. President. I think this is probably one of the most important pieces of legislation we're going to see this day. Senate Bill 1247 actually makes changes to the Herptiles {sic} Act and it establishes that they may only be taken by hand or other methods established by administrative rule. And it changes some of the permit frees -- fees to go into the Wildlife Preservation Fund instead of the Wildlife and Fish Fund and it creates new provisions for the department to be able to invest -- investigate Herptile diseases. In addition, it clarifies some rule. It changes the statute of limitations under the Act from two years to three years for felony offenses or one year and six months for a misdemeanor offense to bring the Act in line with the Criminal Code. I would ask for an Aye vote.

That's a national grassroots organization that has a chapter here in Illinois that works to fight sexual violence on campus and to advocate on behalf of victims. This bill would require each institution of higher ed to conduct a climate survey of its students which would help determine the extent of sexual violence on campus and provide administrators with some clues on how to better attack that problem. Thank you, Mr. President, and Members of the Senate. Senate Bill 1721 will help municipalities deal with blight. Deal with these properties that are -- vacant, and tax delinquent properties that bring down neighborhood property values, and just perpetuate in this blight system. It's a chronic problem in my community and I'm sure in many of your communities as well. This bill basically does three things: it helps municipalities intervene and save these 62 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day 4/23/2021 abandoned properties earlier, allows municipalities and counties to partner with land banks to maintain and manage these properties so they can be saved, and the third major provision reduces the cap on interest rates on unpaid property taxes to twelve percent which is aligned with other government penalties. This will help encourage property owners to stay in their homes and again reduce this perpetuation of blight that we see in many neighborhoods. Happy to ask -- answer any questions.

I also want to point out the two major organizations that represent municipalities and counties, the Illinois Municipal League and the Illinois Association of Counties both representing local governments are in favor of this bill. They support what's trying to be done here, and that is increase the tax base which will improve local governments' revenue long term. This bill amends the Department of Commerce and Economic Opportunity Administrative Code to establish criteria and guidelines for what we are calling State-designated cultural districts. And essentially what State-designated cultural districts are attempting to do is to preserve distinct historic and cultural identities of a specific geographic area. Municipalities or 501(c)(3) nonprofit organizations identified by the federal government could apply for this designation. It also amends the Illinois Library Systems {sic} (System) Act by increasing the per capita rates for the Secretary of State Library Equalization Grants due to an increase in funds for these grants for the FY'21 budget. This would increase the per capita grant for public libraries from a $1.25 to a $1.47. It increases the school library per pupil amount from 75 cents to 88 cents. So I know of no opposition. This is an initiative of the Illinois State Board of Education. It will make multiple changes to the School Code and Criminal Code to ensure the Illinois State Board of Education has access to critical information to further support safe and healthy learning environments. It will require districts to provide identifying educator information and details about the types of misconduct they may have engaged in. Will streamline and speed up the processing of misconduct cases by ISBE. It will empower ISBE to take targeted actions on educator misconduct cases. It includes offenses included in Article 9 of the Criminal Code as those eligible for license suspensions including homicide. Requires school boards to notify TRS when an employee has been convicted of crimes defined in Section 16-106 of the Pension Code. Requires additional information to be submitted to the State Superintendent for violations of contractual continued service. This legislation passed out of committee unanimously.
