Thank you, Mr. President. House Bill 3786 is an initiative of DHS. Provides that when an employee of a mental health or developmental disability facility is under investigation for an alleged abuse, that employee shall be barred from any further contact with the recipients and {sic} (of) services of the facility. What the bill basically does is, if you had an employee of a facility that was allegedly in charge of -- or charged with abuse of a -- an -- an -- a individual, if there were several other employees that were on the same shift, all three would be taken out of service. If one of those employees later was found to be, like, on vacation that day and obviously was not there, the current law states that all three employees would be out of service until the investigation is over. What this bill simply does is allow that person that they know was not involved to go back to work, which helps with DHS staffing and helps with that individual that they know were -- was not involved in the incident. Thank you -- thank you, Mr. President. House Bill 3 -- 3914 seeks to remove barriers to assessing {sic} employment with the State of Illinois for minorities and marginalized persons. Specifically, it requires CMS to take positive actions towards addressing systematic {sic} (systemic) racism in the State hiring process. "Positive action" means proactive -- means proactive leading action to identify statutes and policies which impedes access to {sic} (and) opportunities for minorities and marginalized individuals to gain employment with the State of Illinois and to seek legislation and make policy changes. It further requires each State agency to establish the goals of increasing diversity on interview panels in order to increase State employment opportunities provided to women and minority persons. Lastly, the bill requires increased State employment career counseling opportunities for individuals who are in arrears on their child support. Mr. President, I also -- I would also like to read this legislative intent pursuant -- from IDOT. It states the measure makes changes to Section 8b-4 {sic} (8b.4) of the Personnel Code which currently allows the Director of CMS to allow for the rejection of applicants on eligible lists who fail to meet specified requirements, such as age, physical and psychological conditions. However, the factors are antiquated and can act as an impediment for the hiring of certain protected classes; therefore, we strike them in the bill. However, it is not the intent of this 10 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 legislation to prohibit the use of bona fide occupational -- qualifications for positions that require them. For example, if an individual applies for a position that has a bona fide occupational qualification, such as being able to lift thirty-five pounds, and the candidate cannot meet that requirement, this revised Section would not require the agency to offer employment or to hire that individual. Likewise, if there is a federal statute or policy that has a drug-free provision, those requirements may also be taken into consideration. As an example, IDOT has federal statutes and policies for certain positions that require compliance in drug -- with drug-free policies and there - - and this amendment to the Personnel Code does not change those federal requirements.

Thank you. Today is a day of action against anti-Semitism. Hate has no place in our community, our… Thank you. Hate has no place in our community, State, or world. I'm proud to represent a community that thrives on its diversity. With the rise of anti- Semitic acts, we cannot stand by and watch it happen. We cannot let the voices of the few drown out the voices of the many. Anti- Semitism and violence are not acceptable, and we need to work together to reassure that that comes across loud and clear. After the horrors of the Holocaust, the world vowed to never allow anything like it to happen again. But recently, anti-Semitic and 13 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 hate crimes are on the rise. This past year saw the largest rise of violence rooted in anti-Semitism in decades. Assault, harassment, and vandalism against Jews remain at a near-historic level in the United States. According to the ADL, the American Jewish community experienced the highest level of anti-Semitic incidents last year since tracking began in 1979, with more than twenty-one hundred acts of assault, vandalism, and harassment across the United States. In these past few weeks, incidents have been reported of a Jewish man wearing a Star of David necklace being physically and verbally assaulted; another Jewish man attacked in Times Square; and crowds shouting "Die Jews"; not to mention a synagogue in my community being vandalized. We can't let these acts continue to happen. And silence is inaction. We must stand in solidarity against hate and bigotry. We must show those who espouse anti-Semitic, racist rhetoric, or violence that their actions are unacceptable in our world. We must make it clear that no form of hatred or prejudice will be tolerated. We stand together knowing that an assault on one of us has an impact on all of us, and it will not be tolerated here - anywhere. Hate is unacceptable and inaction is inexcusable. Let's set the example by standing up and speaking out. Together we are strong, proud, and steadfast in our diversity and our commitment to living in peace. Thank you.

Thank you, Mr. President. House Bill 26 essentially is a bill that looks to increase access to the online resources for students with disabilities. All students, including those with disabilities, within the State of Illinois, which comprise basically almost eighteen percent of our students, are entitled to what we call FAPE, free appropriate public education. And with many students still learning online and that modality still probably being in existence for some time into the future, this bill extends existing provisions in Illinois law and ensures that web services are accessible to children and young people with disabilities to online curriculum providers. The non-compliant 24 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 tools that are currently out there that some school districts are using can be a barrier to us ensuring the free appropriate and public education they are entitled to. And web accessibility encompasses all disabilities that affect access to the web, including auditory, cognitive, neurological, physical, speech, and visible -- or visual disabilities. So the World Wide Web Consortium, known as the W3C, creates guidelines that are called the Web Content Accessibility Guidelines. And essentially what this bill would be doing is ensuring that these third-party providers meet those particular standards, the vendors, by August of 2022, and the regional offices of education will ensure those -- compliance. I urge an Aye vote.

Thank you, Mr. President. House Bill 88 is an initiative by the Chicago Coalition for the Homeless, Shriver Center, and Heartland Alliance. It amends the Public Aid Code to prohibit a person from being ineligible for Temporary Assistance for Needy Families program based on any conviction for a drug-related offense under State or federal law. TANF, the Temporary Assistance for Needy Family {sic} program, provides temporary financial assistance for pregnant individuals and families with one or more dependent children. TANF provides financial assistance to help pay for food, shelter, utilities, expenses -- and other expenses. Some of the supporters are the Chicago Area Project, the Chicago Southland Economic Development Corporation, the Chicago Jobs Council, Greater Chicago Food Depository, and the League of Women Voters of Illinois, the Mayor's Office for People with Disabilities, the Latino Union of Chicago, and the Metropolitan Family Services programs, as well as Safer Foundation and -- and the Youth Job Center. We know that individuals reentering the community have a difficult time finding housing, employment, and educational opportunities. This drug felony ban is yet another barrier to reunite families. Illinois repealed its SNAP felony drug ban in 2014. That was an initiative by Senator Haine. This bill stops the continued punishment of people who have served their time. This ban is a twenty-five-year-old antiquated and racist policy and it's directly linked to the failed war on drugs of the 1990s. It is subject -- it subjects a subset of people to a life sentence. And I am open -- we have no opponents that are -- that 26 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 are known -- no know opponents of this bill. Thank you. Senator, I know we talked a little bit about this in committee and I certainly understand what we're trying to do in helping those individuals that may have had drug offenses who are now reentering. We certainly want to help them to become successful. The problem is, we're lumping everyone under the same category, including those - because this says any drug felony - so those individuals who have been repeat drug dealers who are coming out with a high recidivism rate. The fact that we're going to turn around and -- and make them eligible for a monthly cash stipend I think is the frustration. And when this was originally passed - I think it was Senator Haine - that was one of the concerns, because of the high recidivism rate and the concern of rewarding those who were not drug users, but drug dealers who have poisoned and killed so many of our children with their drugs. The fact that we're going to reward them with a cash incentive is the part of this that's a frustration. So I -- again, I -- I -- I wish this was more tightly drafted where it was helping those individuals that had an issue with a drug offense. But when we go to the level that this goes to is where I think it's a frustration 27 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 for us, it's a frustration for the victims' families and for law enforcement that -- that we'll reward people that have committed such a serious crime against our -- our children before going to prison. Again, maybe you can just respond to why -- why we didn't craft this to help those not -- help those with drug problems as opposed to drug dealers.

Thank you for the question, Senator. Well, this -- again, it -- this is an -- an initiative by the Chicago Coalition for the Homeless, Heartland Alliance, and several other organizations, as I've -- I've said. And it's hard to be -- really be able to think about who is a drug user, who is a drug abuser, and who is a drug dealer, you know, because a lot of times you may find someone with drugs on them but they're actually a drug user or they're an abuser or they've been put in a position where they have to do what they're doing in order to get their next drugs. So we want -- what we want to do is help people who are coming back from prison enter -- reenter community, give 'em a chance. If they're going to recidivate, they're going to recidivate whether we do this or not. But if we can give the support to them at this time, when they first -- when they're first getting out and they can reunite with their children - 'cause they have to have children. They have to have children and they have to -- or either be pregnant in order to even be eligible for it. So in order to help people get back I think this a -- a -- a small measure that we can do to help them get back, because the small amount that we pay on this is far less than what we pay for them to go back to prison. 28 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021

Again, I guess, with all due respect, we know from the conviction whether or not they were convicted of drug dealing or drug using. And so, in this case, we're talking about those who were drug dealers, those who were preying on our young people. That's a whole different group than the victims who were arrested for using drugs that are the ones I think you're talking about wanting to help. I'm just, I guess, more -- more concerned about rewarding those individuals who were preying on our children like they did with -- with that. And I think because of that, the fact -- without that clarifying language, I would have to, I guess, request a -- a No vote until we can get this language tightened up. But thank you for the time to answer the questions and for your work on this.

Also, may I just add that the bill covers drug users, drug abusers, and anybody who got convicted of drugs. Thank you, Mr. President, and thank you, Ladies and Gentlemen of the Senate. Sometimes I say that wrong. House Bill 117 is the expansion of Illinois Secure Choice Savings Program. You might all remember that we did pass this identical bill out of the Senate. This is the House version. It makes some changes and expansions to the Secure Choice Savings plan. It allows now -- instead of just applying to employers with more than twenty-five employees, it would expand that to include all employers with five or more employees. It allows auto-escalation of contributions - auto-enrollment and auto-escalation - and clarifies that penalties -- it clarifies the enforcement language, making clear that penalties will only be assessed after a complete year of noncompliance. So it kind of relaxes some of those penalty provisions. And it -- it -- it brings this movement from twenty- five employees down to five employees over the period of a couple of years. The first phase being September 1st, 2022. The second phase, September 1st, 2023. This is a -- a great program. There are really some wonderful things that are going on with this. There's eighty-five thousand workers in Illinois who are now saving for retirement that would have otherwise had no opportunity to do so and they've amassed more than fifty-five million in total retirement savings. This provides this for so many more people 35 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 and allows them to save properly for their retirements. And we share a lot of the -- the same passion for saving for retirement, as we've talked many times. The -- the concern I have about this bill is that it is a mandate on small business and it is not optional for them, so they -- they must comply with this. It's optional for the employee whether they participate, but it's not optional for the -- the business. And I am concerned about the penalties you mentioned. I'd be much more comfortable if it did not have penalties associated with this bill. So I would encourage a -- a No vote. Thank you very much.

Ladies and Gentlemen, nearly half of all Illinois private-sector employees work for businesses - let me repeat this - nearly half of all Illinois private-sector employees work for businesses that don't offer a retirement plan. Nationally, nearly fifty-seven million Americans do not have any access to any type of retirement savings whatsoever. One-third of Illinois retirees rely on Social Security for ninety percent of their retirement income. We have a retirement crisis that affects the budgets, as people who are not well saved for retirement become a burden on our budgets and they drag down our economy, as retirees are not able to spend and spur our economy in retirement. Secure Choice addresses that. And the work that was done on this bill has removed the opposition. Thank you, Mr. President and Ladies and Gentlemen of the Senate. House Bill 417, as amended, is a pension reform bill for the Chicago Park District. The Chicago Park District, like some of our other pension systems, long ago was given an insufficient funding formula and, as a result, the funded status of that pension has declined year after year after year, as the employer is limited in the amount of contributions by law that it can contribute to the fund. What this does is this takes the best practice and modernizes the system by adopting what is called an actuarially required contribution. What this bill does, and this is an initiative of the Chicago Park District, it gives them a four-year ramp to actuarially required contributions - the first year being twenty-five percent of the required contribution; second year, fifty percent; third year, seventy-five percent of the actuarially required contribution; and in the fourth year, one hundred percent of the actuarially required contribution. It's a thirty-five-year ramp to a one hundred percent funded fund. Additionally, in order to offset the ramp and the -- the low level of funding that currently exists, the Park District will make a forty-million- dollar, one-time supplemental contribution and the bill allows the Park District the permission to authorize the sale of pension obligation bonds at a maximum of seventy-five million dollars a year, or a total of two hundred and fifty million dollars. Now, this is important - there were some questions on this in committee - these would not be in lieu of the employer payment, but they would be supplemental in order to front-load the system to allow them to get assets in, protect against a market downturn, and take advantage of interest rate arbitrage. This is a good practice, 40 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 but it's only a tool - it's not mandating that you do it. Finally, it would make one change to employee benefits. It would create - - create a Tier 3 for the Chicago Park District. The Tier 3 would simply reduce the retirement age to sixty-five while increasing the amount of contributions, and any new employee hired after January 1st, 2022, would be in Tier 3. Any employee that was Tier 2 would be given the option of transferring to Tier 3. That is the sum of this bill. Let me repeat, this puts the Park District on a financial path to one hundred percent funding in thirty-five years. It is a good bill and I know of no opposition. I ask for an Aye vote.

Yeah, thank you. And, Senator Martwick, thank you again for your work on this bill. There's a lot of good provisions in here. The Chicago Park District pension fund needs some reforms. It's only twenty-nine percent funded and it's been mismanaged for a number of years, so I'm -- I'm -- I'm glad that you're -- have done a lot of work to try to attempt to reform this. But the provision that I'm really concerned about is allowing them to issue bonds for pension payments. You know, giving them the opportunity to borrow money is really exchanging one liability for another. I would really prefer that if -- if they were going to be able to 41 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 pay back bonds that they've borrowed money for, why not just put that debt service into the fund, and -- and to your example of in lieu of, so it wouldn't be replacing a pension payment that they're obligated to, but it'd be an additional. They could take that same debt service and put it right into those funds. And I feel that this has an opportunity, at least a risk, associated with rewarding bad behavior. And finally, I would just say I have a concern about what it might do to the credit rating of the fund, making their debt - if they ever did borrow - making their debt more expensive because their credit rating may drop. I'm not sure how the credit rating agencies would view this. So I would urge a No vote. Thank you.

I -- I would just point out in closing and in response to the Senator who spoke prior that this is not -- does not require them to bond, and while the idea that they could just simply put the money in, what bonding does is it allows the front-loading. They -- allows you to put that money into the pension systems, bring up your funded liability and protect against a downturn in the market. You can't do that incrementally and have the same effect as if you're able to put it all in at once and make an even finance. It's a tool for them to use and the idea that you would deny them reform because they have an opportunity to a tool that they may or may not use based on the financial expertise of the employer is -- is not a good decision. Thank you, Mr. President. HB 3100 requires the training curriculum for mandated reporters of child abuse or neglect to include implicit bias. It specifies the tasks to be completed in 50 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 the training, how the training will be developed, and what entities are authorized to provide implicit bias training. Senate Floor Amendment No. 1 confirms that the implicit bias section created under this legislation is intended to be contained within the mandated reporter training currently required by Department of Children and Family Services instead of in addition to the currently required training. Currently, the Abused and Neglected Child Reporting Act requires mandated reporters to complete an initial mandated reporter training within three months of their date of engagement in a professional or other capacity. Under ANCRA, a mandated reporter means any person, based on their profession, required to immediately report child abuse or child neglect to DCFS when they have reasonable cause to believe that a child known to them in their profession or official capacity might be an abused or neglected -- neglected child. The training required under HB 3100 must be included in the current mandated reporter trainings. Mandated reporter trainings provided by DCFS are available online for free. The training takes about one hour to complete and the trainings currently include pre- and post- tests to retain the information learned. I would be happy to answer any questions.

51 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 Yes, we heard this in Judicial {sic} (Judiciary) Committee and we heard a witness and, at first when I -- I previewed this bill, I thought, "Mandated reporters - they're professionals; they're trained. They are mandated reporters for a very important reason." Their task is to report signs of neglect, evidence, abuse. They are frontline barriers to prevent -- protect children. And I couldn't understand what bias had to do with it. And -- and we listened to the witness that testified and -- and she said she had been reported for neglect, had to go on family medical leave, and her child was traumatized because she was late to pick him up. I didn't ask if this had been a pattern, or whatever, but let's face it, we want mandated reporters first of all to err on the side of caution to protect children. We have been after DCFS and the horrible reports of them not acting soon enough. What happened in Lake County to the little boy that was buried in a shallow grave after DCFS had been to his house time and again, for neglect, for unsanitary conditions, and then he was murdered by his parents. Or the little girl found in the couch south of Joliet. How many times had DCFS been called and, yet, this little girl died inside this house because of who knows what happened, but somehow she got placed inside of a couch, suffocated, whatever. Those are the type of situations we've always got to err on side of caution and protect. Mandated reporters are professionals. Let's not presume they're not going to be doing their jobs. That's exactly what they're supposed to be doing. They've got to err on the side of caution, not, as one of the witnesses says, "We need to take a pause, we need to take a pause before dialing for reporting." And that just seems totally wrong to me about what mandated reporters are asked to do, to ask them to add a layer of training on top of 52 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 something they're already trained to do. What they should be doing is protecting children. There may be some mistakes made along the way, but let's face it, what mistakes -- what choice do we want the mistakes to be on the side of? We want 'em to be on the side of caution, not that they paused and waited like the situations I talked about. We want 'em to pick up the phone and make the call and sort it out later, but be responsible and report if they have reason to believe something's wrong. It doesn't matter what color, race, creed, gender a child is. We want the reporter to err on the side of caution. This training makes no sense. So, for that, I -- I'd ask for an Aye vote. I think our reporters need to do their job. This is -- just doesn't make sense to me. Thank you.

So implicit bias training being added to this bill is just going to make sure that those who are mandated reporters take pause; that they understand what kind of bias they're bringing to the table. As a school social worker, I witnessed time and time again some of my colleagues think through the idea of -- of reporting and not viewing some of these -- the implicit bias that they brought to the table in wanting to make those reports. There's a 2020 study by Chapin Hall: So educators 53 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 -- while educators have submitted the most maltreatment reports, for example, only eleven percent of those reports made by educators were substantiated. In New York, in -- 2010, 55.5 percent of the removals made in Nassau County were of Black children. By 2015, after they utilized blind removal, it went down to twenty-nine percent. This is a good bill. It's good legislation for all mandated reporters and I urge an Aye vote.

Thank you, Mr. President. House Bill 3317 is dedicated to the memory of Colton Miller. The bill creates the Domestic Violence Task Force to establish a consistent, uniform statewide system to protect victims and survivors of domestic violence, while holding offenders accountable. The task force is charged with conducting a comprehensive review of the process, operation, and enforcement of current domestic violence laws across the State; identifying gaps in the process, operation, and enforcement of those laws; developing recommendations to address those gaps; and, 56 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 finally, establishing a framework for specialized protective networks for victims, treatment options for victims and offenders, and specialty courts for the accumulation of specialized domestic violence skills for courts. The Floor amendment does create a provision that addresses a concern from someone on the committee regarding a review of the conditions of bail in cases involving domestic violence. We did take that out; that the committee would not be addressing that. But, overall, this bill comes to us from someone who was -- whose son was killed while she was -- Cassandra Miller was battered and, at the same time, her ex-husband came into their home and killed Colton, their eighteen-month-old son, and also killed himself at the same time. Cassandra Miller survived; however, she is living to tell and advocate for breakdowns in the law that she saw as somebody who was a victim of domestic violence. And Cassandra has been an advocate on this topic. And I ask for an Aye vote for Colton's Law. And my hope is that the findings from this task force will help us to understand not only what is -- where the breakdowns are out there for members and victims of domestic violence so we can make sure that we protect them in the future. And ask for an Aye vote.

Yes, in committee, we certainly thought this would be a -- a good bill. The problem is with the definition of family member, and it includes a lot of important people that should be, but in the definition of family member, it's anybody else that's perhaps a family relation or has a -- a -- feels like they're a family member. And, granted, it's unpaid leave, but I think it's a 58 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day 5/27/2021 stretch too far, because even when you have unpaid leave, if you're an employer in a bakery or whatever small business you may be operating, you're going to have to hire help to fill in that slot. And -- and in situations, from the -- when you have a family member that's murdered, I can't even begin to imagine the stress. And - - and we heard from a witness whose son had been murdered. And it's -- it's horrific. And -- but it's a stretch perhaps too far to have somebody that thinks they might be like a family to that member, and -- and because of that loose definition, I -- I -- it was why we couldn't support it in committee. And so I think it's important to understand, and -- and if that part of the definition had been left out, we'd be in total support. But, with that, I can't support it. Thank you.

The bill updates the circumstances in which infertility exists to, one is, a failure to establish a pregnancy or to carry a pregnancy to live birth after twelve months of regular, unprotected sexual intercourse if the woman is thirty- five years old or younger, or six months if the woman is thirty- five years of age or older; number two, a person's inability to reproduce after {sic} (as) a single individual or one with a partner without medical intervention; or, three, a licensed physician's findings based on a patient's medical, sexual, and reproductive history, age, physical findings, or diagnostic testing.

Madam President, my second motion addresses the procedure for passing bills on the Agreed Bill List. The Agreed Bills List has been circulated and will be printed on the Calendar. Starting Tuesday, the Secretary's Office will have Vote Intention Sheets available. On these sheets, you can mark whether you wish to vote "No", "Present", or "Not Vote" on a particular bill on the Agreed List. If you fail to do so, then you will be deemed to vote "Yes". I repeat, if you fail to mark a "No", "Present", or "No Vote" on a particular bill on the list, then the roll call will reflect that you voted "Yes". Each Senator must file his or her marked list no later than noon on Saturday with the Secretary of the Senate. If you fail to file a list with the Secretary, then the roll call will reflect that you voted "Yes" for each bill on that list. With leave of the Body, I move that we adopt the process I have described. And -- and I do want to correct for the record, Madam President, something that I said. I believe I said that the -- the process would begin starting Tuesday. I meant to say the process begins starting Friday.
