Thank you. So, there is a worker shortage that we're all aware of. We're trying to get people back to work. I'm trying to cut down on the red tape that's going on at IDFPR because it's taking too long for my constituents to get licensed to get to work. So, I heard from a lot of constituents, there was a lot of support from other Senators who also heard. There are -- people that are concerned like nurses, pharmacists, accountants, doctors, not being able to get their certifications quickly. So, this requires IDFPR, this Senate Bill 670, to complete licensing in 4 weeks, as opposed to, sometimes it's taking months to get through. I just wanted to commend the sponsor of this bill, as someone who prosecuted these cases and saw what real courage is for children who've been betrayed by the people they are supposed to trust, to sit up there on the stand and speak to a crowded courtroom. To have the ability to clear the courtroom, except for media, which I understand the bill allows, as it should. Gives a little bit of peace of mind to these brave witnesses. And so, I just wanted -- I wanted to ask my side of the aisle to make sure that we support this bill. This is an initiative of the Illinois Hospital -- Health and Hospital Association and it basically extends the sunset from December 31st, 2022, to December 31, 2027, for the income tax credit for -- to for-profit hospitals. hospital owners, equal to the amount of property taxes paid by the hospital, or the cost of free, or discounted services that the hospitals provide. The bill also makes a permanent -- makes permanent, the sales tax exemption for non-profit hospitals equipment -- and materials by removing the sunset provisions entirely, and I know of no opposition and I would ask for an Aye vote.

Thank you, Madam President. So, Senate Bill 2993 is an initiative of the Alzheimer's Association, Illinois Chapter. It does three things. It amends the Alzheimer's Disease and Related dimensions -- Dementias Services Act by striking the Act's repeal date. It also ensures ongoing uninterrupted training of professionals with direct access to dementia and Alzheimer's patients. And it affirms that no further assessments of the training requirements are necessary, as the law is working as envisioned. There are no opponents and I ask for Aye votes.

The bill before you simply adds two new members to a Permitting Task Force that was created as part of that legislation. The new members of the task force shall be one statewide organization of municipalities and one member of an association representing automobile manufacturers. The goal of this legislation is to prevent students from falling far behind on repaying student debt. It says a few things. First, it says official transcripts must be provided to a current, or potential employer, upon request. It also says a hardship policy must be put in place if a student has to withdraw during the semester. Hardships include things like a serious injury, or illness, or a mental health condition. And it also says if a student's debt is sent to a collection agency, it cannot be used against his or her credit score. I know of no opposition.

Senate Bill 3465 is an effort to allow -- to address the teacher shortage that's going on in the State of Illinois, but specifically here in the Chicago Public Schools. It amends the Chicago Teacher Article of the Illinois Pension Code by allowing retired teachers to return to work without affecting their annuity and this is through -- it's open for a window between now and June 30th, 2024, in subject shortage areas. So, this would allow retired teachers to return but the school must qualify as a subject shortage area. There's a number of metrics where they must post the position, they must tender offers to legally qualified certified teachers, and if they are unable to find them then teachers would be allowed to return to their work without affecting their annuity. Particularly, during the pandemic, when they've been helping with food relief and housing and a number of other things. Essentially, it amends the Illinois Treasurers Act with respect to the Illinois Higher Education Savings Account, known as the Child's Saving Account. It makes provisions for, should the Treasurer's Office have additional funds, that bonus deposits go to accounts of households that have limited financial security, and that there is a data reporting requirement that focuses on collecting information on who is taking up these accounts, who is claiming them by geography, race, ethnicity, and financial status. The one-hundred-and-forty-day limit will begin on July 1, 2022, and sunset on July 1st, 2024. After July 1st, 2024, retired teachers may only be reemployed for one hundred and twenty days. The Legislative Ethics Commission has been deadlocked for four months now. So, today I filed this resolution appointing former federal Judge McCuskey to serve as the Legislative Inspector General. He has a stellar resume - an incredibly well qualified candidate - having served on both the federal and State court benches, having served - appointed by a Democratic President, confirmed by a Republican Senate. I know that the Members of our caucus who know the Judge think incredibly highly of him, and I stand behind his credentials. I'm happy to answer any questions you may have to the best of my ability.

We're seeking to remedy those and move forward with a very well qualified Legislative Inspector General.

Senator, I'm not aware of all of the ins and outs and hiccups that occurred in the Legislative Ethics Commission, and I want to refrain from doing much of a postmortem for the sake of the reputation of the members who were considered. I know that the search committee could have, under the statute, advanced three candidates, but chose not to for whatever reason. I understand that there were -- I'm going to refrain from -- suggesting any motives on behalf of the committee. I'm aware that the Legislative Ethics Commission had to ask for the third candidate because they weren't satisfied with the -- the two candidates presented. But there have been far too many hiccups. Again, the irony is this process is intended to avoid the very situation we have. A protracted vacancy in the Office, the important Office, of the Legislative Inspector General. We seek to remedy that with an incredibly well qualified candidate and one I hope will get unanimous support from the Senate.

First of all, the search committee advanced three qualified candidates, recommended by the search committee. Two initially, the third under the statute in response to the request of the Legislative Ethics Commission. Nothing that we are doing today, nothing that the Commission has done so far, contravenes the statute. A deadlock at the Ethics Commission leads to a protracted vacancy in an important office. We're seeking to remedy that today. I hope you will vote Aye. That is not my closing, Madam President, but I wanted to make sure the record corrected those misstatements.

Your question, I think, is whether or not he appeared before the four-member search committee with one member appointed by each of the four Legislative Leaders, that independent process. He did not. He was interviewed by the Legislative Ethics Commission, I think, under the same circumstances as the other candidates were interviewed. I don't -- I think they all were interviewed via a remote process. I'm looking at what the Member of the Commission on our caucus -- so, he was interview by the Ethics Commission in the same way. But I would also point out there is nothing in the statute that says the Legislative Ethics Commission is limited to advancing a name that was advanced by the search committee. Similarly, there's nothing in the statute that says the General Assembly is limited to appointments referred by the Legislative Ethics Commission. We are dealing with a fundamental breakdown in that process. You want to focus on process. The process has resulted in deadlock vote after deadlock vote, and no Inspector General. So, if you were serious about ethics, you would vote with us to confirm Judge McCuskey.

They shall not have been convicted of any felonies, they shall have a BA Degree, and have five or more years of experience in certain agencies, including as a State or federal judge. I think Judge McCuskey clears those by leaps and bounds, and his repetition and his work on behalf of the Supreme Court, and the other commitments he has made, including having been before the Senate before for confirmation as the Chair of the Illinois State University Board. I don't know what more you're looking for.

We have a public trust problem in this State as it is, and here we're about to have the legislature pick its own watchdog without any citizen oversight. The person responsible for investigating lawmaker misconduct and corruption is about to be hand chosen by the very people that he's supposed to be watching over. It's no wonder that the people of Illinois have lost faith in government, because of the lack of accountability that exists, even in this process, is just solidifies their belief. We have a process in place, in statute, that calls for an independent citizen search committee to review, vet, investigate, and interview candidates and given their informed recommendation to the Legislative Ethics Commission. That statutory process is being completely skirted. A process, I should note, that the candidate himself says is required by law. That a candidate who has been a 100  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 83rd Legislative Day 2/16/2022 federal and State judge says his reading of the law would require of us. It is dumbfounding to me that this Chamber would fast forward through that process, putting their very candidate in a circumstance that he insists he shouldn't be involved in. Republicans have continuously advocated on following the recommendations of the citizen search committee, throughout this process. We have even offered to bring the search committee back, so that they could do their due diligence on Mr. McCuskey, vote to ensure independent oversight and citizen oversight of this process and of him. Do you have that public trust that's necessary? Our simple and reasonable request has been denied. Doing it this way was clearly not in the legislative intent behind the law originally. Clearly, the law was designed so we don't have politicians choosing their own Inspector General. With all these scandal, corruption charges, indictments that we have witnessed in recent years, we have a responsibility to the people of Illinois to restore trust in their government. And that begins with accepting a qualified Legislative Inspector General candidate that's gone through the appropriate citizen oversight process. To completely ignore that process set forth in statute, is not simply a disappointment, it's just plain wrong. We can do better than this. Let's do what the candidate, himself, says we must do. We made an offer to make him an Acting Inspector General, and while he goes through that process. That's what he said, he would prefer to do. Until Mr. McCuskey's request is honored, I encourage us all to vote No. Thank you.

I don't know that it requires an FBI background check to reach that conclusion. But again, your caucus seems to have much more information than ours does about the process and what was applied to other candidates. I don't know why you have that information, I don't know how you have that information, but you seem to have more than we do.

I'm not going to speak about process. I'm going to speak about Judge McCuskey. I think I'm correct in stating that I probably know him better than anyone in this room. He's from Central Illinois. I've known him for many, many years. And I trust he's probably listening, and after this kind of a discussion you wonder why good, qualified, honest, decent people like this would even want to subject themselves to this kind of a thing. There is no more ethical or more moral person that I can think of that -- for this job than Judge McCuskey. He was ratified by the United States Senate under Republican control back in the 90's when Bill Clinton was President. He received unanimous support out of committee, a unanimous vote on the Senate Floor. He was vetted by more than one FBI agent during that process. He has served well on the federal bench, on the State bench. He is well respected by people of all kinds of political persuasions. You 108  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 83rd Legislative Day 2/16/2022 know, this is a good, decent, honest man, you know. And I will say this as a friend, if I, and I don't intend to do this, but if I were to ever go astray and have - do things that are ethically not consistent with this Body, Judge McCuskey would not hesitate but to hold me accountable for that. I say that as a friend. And so, all the discussions we've heard about what if and what if and that, we are so darn lucky in this Chamber and in -- in this State to have people like him that are willing to step forward. And again, all of us be warned, this is not somebody that's going to look the other way. He is going to look and tell you exactly what he sees. Just like he told the committee, you know, this is a good, and decent, and honest man and I think we should vote Yes.

First, one of the prior speakers raised this sinister possibility that Judge McCuskey had something on his record at the Judicial Inquiry Board. We've updated our review of those materials and there is no founded complaint against him. I would point out also, anything shy of that is constitutionally sealed. So, Senator, you can rest assured that we have checked him with the JIB and there is nothing to be concerned about. So, we'll take that stain off his record. This -- this -- this debate took an unfortunate turn. So, I'm not going to bite my tongue. You know what I find offensive? The Republican Members of the Legislative Ethics Commission saying, if we don't get to pick our handpicked Inspector General, then nobody gets to pick an Inspector General. If we don't get to advance on the veteran of the Rauner 109  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 83rd Legislative Day 2/16/2022 Administration with a deep partisan streak, then you can't have an Inspector General. The reason we passed these laws, is to make sure there is no gap in the Office of the Inspector General. I have lived through that. We don't want to do that we want a well- qualified Legislative Inspector General. Judge McCuskey fills the bill. I dare you to vote No.
