Thank you. Senator, I have a bill that we're working out, along with the Attorney General Raoul, regarding making sure that we have a committee that looks at disabilities. When we -- now that we have the new additional money coming in from the federal and State government, we have the ability to build out our infrastructure. I think it's important that we have a committee at the table looking at those issues to make sure that money is spent to make sure that our transportation, especially in Chicago, is handicap accessible. So, that bill will be ready in the fall. After negotiating we got tripped up in a few concerns, but we'll certainly bring that bill in the fall. And I look forward to working with you on that issue. Senate Bill 1435 provides that at a time of the application to operate under a single license a hospital located in a county with fewer than a hundred and twenty- five {sic} inhabitants may apply to approve -- apply for approval to conduct operations from more than one location within contiguous counties in which both facilities are located, provided the second county has fewer than thirty-five thousand inhabitants. Ladies and Gentlemen, this is for a hospital in our area who's trying to do the right thing by merging. Currently, we're just cleaning up some language that will allow these two hospitals or the one hospital to merge with the next county over and it is an initiative by a hospital in my district. But what it does is it provides some protection to a person that is in good standing on a lease or mortgage agreement and it provides some protection for their parking vehicles should the parking owner -- the -- the landowner need to remove the vehicle. So, with the amendments, we stipulate that the vehicle must be operational. We provide some protection for liability for the – landowner, should they need to relocate the vehicle temporarily. And I believe we've worked out all of the issues in this bill. Senator Murphy, I know you've worked a lot on different aspects of this bill. One thing I'm -- I'm wondering is - with all the amendments, I'm trying to -- and some that withdrawn and some that are in effect - does the -- the -- owner of the facility have -- he -- he is required to text or contact through email or otherwise the -- the tenant, correct, that he's going to move the vehicle?
PRESIDING OFFICER: (SENATOR HOLMES) Senator Murphy.
There's -- there's a provision in this bill that the owner of the vehicle would have to be notified and that the landowner would receive some indication that they were -- received the notification of the need to remove the vehicle.

So, it does require an affirmation from the tenant that he got the -- the communication. I'm just wondering, because I know you brought this bill because you had a -- a situation that 14 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2022 resulted in a horrible result for a tenant and he was out of the country, actually. Now what happens if -- if the owner doesn't hear from the tenant because for a -- a possible reasons a tenant is out of the country, doesn't have access to communication or, too, what I'm thinking might happen sometimes is the tenant just fluffs it off. He doesn't think it's a valid communication or -- or the like. Will that -- what happens in that instance?

Thank you. We've provided a provision that a landowner could relocate the vehicle temporarily, restore it, and we've removed the liability for them and provided some protections. Secondly, as long as a good faith effort was made that the notification was granted, the landowner would still be able to remove the vehicle with a three-hour notice.

So, if I'm understanding correctly, if the landlord makes a good faith effort, then -- and it has to be done three hours before the -- the car is moved, then there's no repercussions that the tenant didn't respond back?

That's one of the negotiations that occurred that we would allow the vehicle to be relocated after there was a good faith effort. If there is absolutely no response, the landowner then 15 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2022 would give another three-hour notification that your vehicle is being towed. So, it's thought that has provided ample opportunity for the car owner to respond.

And then the second thing was the – that the vehicle has to be operational. So, how do we define operational?

Operational means that the vehicle would be able to run, that it is -- has the opportunity to operate on a street or within a parking lot.
PRESIDING OFFICER: (SENATOR HOLMES) Senator Tracy.
So, if -- if the battery's dead then it would be non- operational. I'm just wondering how the landlord would prove that it was operational or not operational?
PRESIDING OFFICER: (SENATOR HOLMES) Senator Murphy.
Well, within the course of the notification, I think that a landlord would be able to tell by a physical sighting if the vehicle was going to be operational. I -- I -- I think that common sense comes in play that you can determine if a vehicle - if the tires are all flat - the vehicle is not operational. If there's a layer of dust then the vehicle with the flat tires is not 16 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2022 operational. And after they have given this good faith effort that is over a significant period of time, then the vehicle could be deemed inoperable.

Are there penalties in the bill for the landlord that doesn't go through those steps or that the tenant -- says he did not go through the steps.

I just want to implore my colleagues to support this legislation because it provides an additional layer of protection for someone that is in good standing in a lease or mortgage situation. If they are continuing to pay their lease and they come back -- and the leases included their parking spots and they come back and the vehicle is operable. They have some protection that their vehicle will still be there when they go to use it and it's not been sold for salvage and crushed and destroyed. So that's why this -- the purpose of this bill is to provide that additional protection, additional notification to someone that is in good standing on their lease or mortgage. So, I would ask for a favorable vote.

Like many of you, we are hearing from our educators, our superintendents about the challenges of meeting all of the mandates that are currently in statute while they're also dealing with the pandemic. They're trying to make their schools safer, they're trying to close the learning gap, but, yet they still have many of these mandates that, in their opinion, are important but they're asking for a reprieve just for this year until they've made it through and that they're 19 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2022 -- they're on the backside of the pandemic. Again, this bill started with many lists of mandates that came from my superintendents as recommendations for mandate relief for this year only to help the schools and free up some of their time. And, as you can tell, it's just -- it's been whittled down to one particular area. But this area has been negotiated by the Members that had concerns at the beginning, and this is the way that bills should be. So, Advance Illinois and the State Board of Education are neutral on the bill, and many others support the bill. And this was on the agreed bill list, so I'd ask for your support. Thank you, Madam President. Senate Bill 1145 seeks to provide a mechanism for those parents whose students are in college that are not eligible for any other type of tax credit. So, in Illinois, we make this huge investment in our kids K-12 and then we watch them walk out the door to higher institution -- higher ed institutions in our surrounding states. And often it's just a thousand or so dollars but it's the difference between attending an Illinois State school or one in our bordering -- in one of our bordering states. So, this would try to equalize that. It starts with providing a thousand-dollar credit for those that our six percent above poverty level and it's graduated so that the higher income level receives a lower percentage of the tax credit. It will not impact anyone's 529 Plan, 529 is a savings plan that is outside of what this tax credit would provide. It only impacts a small amount of Illinois taxpayers for the much larger amount of those taxpayer's that have college eligible students. So, the COGFA numbers are reflective only of the total Illinois taxpayers and not for those college eligible families that would be eligible 26 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 93rd Legislative Day 3/9/2022 for the tax credit. It's related to off back -- off track betting parlors and the changing landscape of horse racing here, in the State, due to the closure of Arlington Park. OTBs are traditionally anchored to the -- their parent tracks. We're down to two tracks in the State, Hawthorne and Fairmount Park, and so we need to change the way those OTB licensees are distributed because of the -- that change. As I said, there's been negotiations between the tracks, the horsemen, and actual video gaming terminal operators to get them into agreement. As a result, there's no opposition to this bill. I'd be happy to answer any questions and ask for a favorable vote.

I appreciated his consideration of my proposed amendments which were implemented into this legislation.
