It includes the following: it removes "without a permanent foundation" from the definition of manufactured homes and then further expands that definition. It increases the licensing fee from $1,000 -- to $1,000 for all manufactured home dealers. It increases the required bond amount to $150,000 for dealers and expands the circumstances under which the Secretary of State may deny, revoke, suspend or cancel a dealer's license. It adds an updated definition for "developmental and intellectual disabilities", that is the underlying bill to the FOID Act and I could explain that. As amended -- we had modified the definition language for "developmental disability" and "intellectual disability" in the Mental Health and Developmental Disabilities Code. That triggered a -- a bad pun, but that affected the FOID card definition which also has provisions for those with developmental disabilities and intellectual disabilities. I believe the amendment removes all opposition. It passed out of the House unanimously.

This bill will expand the instances in where an interpreter may be needed for parents who are deaf or parents who do not normally speak English, during IEP meetings, multi-disciplinary conferences, 504 meetings, mediation sessions or due process hearings in schools. In current law, these interpreters are only made available to parents during IEP meetings. This leaves parents, sometimes confused and misguided during these other meetings where it's really critical that they understand what's happening. The amendment simply just moves around language to remove ISBE's opposition. I'd be happy to answer any questions and I urge an Aye vote.

Also, as it was amended, the bill provides that the Secretary of State shall automatically process salvage or junking certificates if the applications are probably -- properly submitted by a salvage dealer who posts an annual bond of $100,000. Provides that the Secretary of State may randomly sample automatically processed applications to determine accuracy and may suspend automatic processing if the salvage dealer fails to maintain eighty-five percent rate of accuracy. I just wanted to let the Body know a few things about fentanyl, itself. It's a hundred times stronger than morphine. It knowingly makes drugs more powerful and addictive, it's dangerous, and the only person with three grams would be someone that is pushing drugs. Three grams is quite a bit. Fentanyl is mixed with heroin, cocaine, meth, and sometimes made into a pill form, making many unaware that the drug is laced with a deadly substance. A hundred and fifty people die every day. You can't see fentanyl, you can't taste fentanyl, it's impossible to know if the drug is laced with it. And let me just tell you why, because 26 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 we had a son die of fentanyl, and he had no idea that fentanyl was laced in what he had. So, what I'm saying today is that fentanyl doesn't even compare with any of these drugs, none of them. And I would appreciate you thinking about that before you vote on this bill. Thank you.

Thank you, Senator. I'm just wondering if there might be a drafting error, on this bill. 'Cause I think you said small amounts of fentanyl, but the bill says 3 grams. We know that 2 milligrams of fentanyl will kill, and yeah, 2 milligrams will kill an average size male. So, I'm wondering if this was supposed to say 3 milligrams rather than 3 grams, because 3 grams could kill 1,500 people.

Thank you, Senator. Yes, there is not a drafting error and fentanyl is 10,000 times more deadly than morphine. Often times, people don't even realize that the substance that they're using is laced with fentanyl. And that's, that’s what causes the heartache. That’s what causes the overdoses. This bill is so that those -- 27 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 that people can seek help during an overdose. Someone might not know that they have got heroin, oxycodone, Xanax, cocaine, that’s laced with fentanyl and the first time that they might even suspect that it is, is that their friend is actually overdosing. This bill wants to ensure that those people who are seeking help, regardless of that they don't -- not seek help, because they are afraid that they're -- the material is laced with fentanyl. We want them to call for help and help save a life.

Thank you, I appreciate your passion on this bill and I -- I appreciate what I think you're trying to do with it. But 3 grams of fentanyl, is a huge amount of fentanyl. I could., maybe, get on board with this at 2 milligrams or 3 milligrams. But 3 grams is nothing more than a drug dealer and what we're going to do is pass a bill that allows a drug dealer to get off the hook. I urge a No vote.

Thank you. Thank you, Senator. There, the -- it's the data that has pushed this forward. We've seen increases in opioid deaths. We've seen increases in fentanyl related opioid deaths.
PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator McClure. SENATOR McCLURE: Thank you, Madam President. We certainly have. So, let me just put forth a scenario here, so if a person, a drug dealer, shows up to somebody's house, injects enough drugs in them to kill them or gives them enough fentanyl to kill them. That drug dealer calls the police and says this person is dying, get over here right away. That drug dealer, who just committed a drug induced homicide, would now be immune from prosecution. Is that a fair and accurate statement?

And oh, I'm up. Thank you, Senator. The -- for provisions 29 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 providing limited overdose immunity, where a person who, in good faith, seeks or obtains -- obtains emergency medical assistance.

So, I guess, I mean, wouldn't you say that if the drug dealer is trying to save the person's life that they are making that phone call in good faith and therefore they would qualify to be immune from prosecution?

Senator, thank you. I apologize for the delay. Someone who is perpetrating homicide -- murder, that is not in good faith. And they would not -- and so calling, in good faith, that would just not, no.
PRESIDING OFFICER: (SENATOR LIGHTFORD) Senator McClure. SENATOR McCLURE: Thank you, Madam President. I think I'll just speak to the bill. Thank you, Senator.
PRESIDING OFFICER: (SENATOR LIGHTFORD) To the bill, Senator. SENATOR McCLURE: So, I want to talk about a few things. So, the Senator is correct, this a crisis right now. Opioid deaths are sky rocketing. The main culprit now is fentanyl. It's extremely deadly. I'll - - I'll rehash a little bit of what Senator Turner and Senator Bryant said. If -- if a person has 3 grams of fentanyl on them, 30 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 they are a drug dealer. As was pointed out, it can kill fifteen hundred people. And fentanyl is so dangerous and deadly, that people can OD just cleaning up fentanyl scenes. So, I don’t know why we're going to allow for a drug dealer to come over, supply someone with enough drugs to kill themselves, and then, when that drug dealer calls the -- calls for help, they are now immune from prosecution because they made a good faith effort to try to save this person, they failed, and so therefore you can't charge that person with drug induced homicide. I don't think this is the right time to be giving those kind of people immunity from prosecution. Another troubling aspect of this bill, is that currently, the way the law works, is that if someone is dealing cocaine, and they lace it with a little bit of fentanyl, and at the time of trial, they'll test it to see whether or not fentanyl is there. And if it is there, they tack on 3 years to a sentence in the Department of Corrections. This now makes that more difficult to prove because it adds language, that not only would he have to test positive for fentanyl, the drug dealer would have to know, would have to be aware that it was - - contained fentanyl. And the problem with that is that now, these drug dealers are going to have a lot less liability when they supply these deadly drugs, because they can get on the witness stand and say -- or have someone else testify that, I didn't know that this -- this contained fentanyl. I had no idea. So, it takes away from, yep, we tested this drug, it contains fentanyl, you could have killed somebody, so you are getting 3 years to… Okay, yes, it contains fentanyl, but did you know it contains fentanyl? Remember these are the drug suppliers, these are drug dealers, these are the people that are supposed to know what's in the drug. So, to make 31 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 it more difficult to prosecute fentanyl drug dealers, and also giving them an immunity here, based upon the extreme amount of fentanyl that they are allowed to possess, is bad right now. And I don't think this was done with bad intentions. I think that Senator Ellman's trying to address a real crisis here, but unfortunately this bill will make it worse, at the worst possible time. So, I'm going to vote No on this bill. I encourage everyone to, because guess what? I want to stop fentanyl and I want to stop fentanyl drug dealers and I want to stop these people from killing our communities. Unfortunately, I believe this is going to make things worse.

You know, I just, very quickly, on one point, you know, we do have a crisis with regards to fentanyl and deaths. And -- and, you know, these -- these people are not knowingly ingesting fentanyl, but the product that they're acquiring is being laced with it. If we want to get serious about combatting that and -- and -- and getting at people that are lacing these products with fentanyl, to add the element known, or should have known, to the prosecution, to raise that burden in holding one accountable for those actions, that is a giant step backwards in accountability. I think that this bill, while you have a lot of good intentions, 32 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 Senator, in this bill. That is a big step backwards in holding the individuals accountable that are causing and wrecking travesty and damage throughout this State, and wrecking families with -- with these tragedies. So, I would just ask, you reconsider that -- adding that element to this, to the weight of what a prosecutor must prove in holding someone accountable. It's a step backwards and I would certainly, based upon that alone, urge a No vote.

Yes, Senator Ellman, you've heard the debate and I know in committee, we asked if you would consider amending the amount of 3 grams of fentanyl, and I believe you indicated you wouldn't, but after understanding that you could have broad support for this bill, would you consider amending it to reflect, not only, Senator Currans suggestions, but also the amount of the 3 grams, because whether or -- the way it's worded, it doesn't matter if it's a total full 3 grams of fentanyl or just a portion of fentanyl, but those are the things that we would have broad support for, if you could change those.

Thank you, I want to make sure that the record is clear. The 33 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 language is not 3 grams of fentanyl, it's 3 grams of a substance containing fentanyl. And as Members have said, right here on this Floor in the last few minutes, often times, people don't know if the substance they have, even has fentanyl. So, much less 1 milligram, 2 milligrams, within that 3 grams. This amount was discussed with prosecutors and law enforcement, to see if it was something that they could live with -- in this language.

Right, but as I said, it isn't clear, and it opens the door for a very unintended consequence. So, that’s what I would urge, is that you pause, make amendment, we can make a good bill much better that would have broad support. Thank you.

Just -- just talking about this, really hurts my heart because I really haven't discussed this with anybody outside of my family. I had a good friend, TJ, just last year. He had been fighting a drug addiction for years and he had went a whole year without using any drugs at all. We were celebrating him. He went back to his hometown to get his driver's license and -- and some other things that he needed to get. And he stopped by this -- this hotel where 34 STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 106th Legislative Day 4/5/2022 they were selling cocaine. And he went in and he got it, it's on film that he went in, he walked in, he got the drugs, he came back to his car, he smoked it, and then he drove away and within minutes he drove back to -- to -- he drove back to the parking lot because he knew something was wrong. And he got all the way out of his car and he was stumbling and -- and there was a guy there that saw him. And -- and -- and he, my -- TJ eventually figured out that he couldn't get back to where he -- he had bought the drugs. So, he just stumbled back to his car, and he sat in his car and then he was moving and then all of a sudden, he just stopped moving. And the guy that was working there saw all of it. And he said he wouldn't call the police cause he -- he was afraid that they may think he had something to do with it. We're talking about -- this is a young man that had promise. How many lives have we lost because nobody said anything because they were afraid? If somebody is dealing drugs, they going to get caught eventually because they know who is the person who made the phone call. They know if the person is still dealing with drugs. They know that. We got to save lives while we can. People need help. They don’t, -- they don't need to just die on the street like a dog, because nobody was -- was brave enough to call the police. So, I -- I salute the sponsor on this bill. And I -- it is my prayer that - - that none of you ever lose anybody like that, who meant so much to so many people. I just urge an Aye vote, because I think it's time for us to do the right thing when it comes to lives. Let's get away from this whole thing about punishing people -- punishing people.
