And then, rather than including condominium associations and homeowner associations under taxpayers or owners for purpose of filing a property tax appeal, which was originally introduced in the bill, the House Amendment 1 provides that an association may on behalf of all or several of the owners, that's what constitutes the association. So, it's just technical in nature and I would ask for an Aye vote.

Thank you very much, Madam President. I would like to concur on House Amendment 1 and 2. So, I will -- and I would certainly hope Senator Fowler is ready for questions over there, he was really helpful on this bill. So, this bill went over, and what was in the bill originally remains, and that was an agreement on -- on some -- some changes in rules for waste haulers and was passed unanimously with no opposition. The bill came back with some additional items on it and this is apparently two years' worth of work to come to an agreement between IDNR and the oil industry. So, there are permit increases for removing liquid oilfield waste from onsite collection sites. The bill increases the application fees for a permit to drill, deepen, or convert wells and create a fee for an application permit for lease oil. It also adds the definition of temporarily abandonment status for liquid oil field waste and adds collection fees per well for each well that's temporarily abandoned. Apparently, there are about four-thousand abandoned oil wells across the United States. Most of them are in the southern part of the State, and there's about twenty-million dollars of federal dollars that will be available to us if we are able to pass this intact. I don't know of any opposition, and truly, this was all news to me and certainly learned a lot from Senator Fowler, who I would be really just thrilled if you would like to address the bill.

It requires individuals hired to work with people in the Community Care Program to complete at least two hours of Alzheimer's and dementia training prior to employment and current employees receive training within six months of the bills effective date and I ask for your support.

Thank you, Mr. President. Ladies and Gentlemen of the Senate. Senate -- excuse me. House Bill 1568 takes police officers and law enforcement officers in the -- who are participants in the State Employees Retirement System and reduces the retirement age for tier two members from the age of sixty to the age of fifty- five. So, this would give State troopers and other law enforcement personnel in the State Employees Retirement System parity with other -- with other tier two police officers throughout the State. 27  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 So, this is currently the retirement age for all of the downstate police officers in the downstate system, as well as the Chicago police officers under tier two, this would create parity. There is also a provision in this bill that allows -- there's internships to account for college credit. Estimates at this point, Senator Rezin, and then, listen, let me just say this, that is a very pertinent point, and I don't want 28  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 to be dismissive of it. You are absolutely right. There is a cost. That cost is -- five million a year throughout the life of this. So, the expected cost to the system of somewhere between a hundred and forty and two-hundred million dollars through 2045, which is the ramp. So, that's the amount of additional unfunded liability that it's going to create. I would just point out, though, as part of this, you know, we -- we talk about recruitment and retention of police officers, recruitment being a big tool. There is much belief that -- that one of the challenges for recruiting for State troopers, which has been very difficult, is this higher retirement age. They can have a lower retirement age in any law enforcement position if you're a tier two. So, this would give them that, it would give them that parity, albeit with a cost. But again, if this is something that is important to the State of Illinois and then it's a cost that we're going to have to bear.

He serves as the principal advisor to the adjutant general on all matters pertaining to warrant officers. His overseas deployment, now, listen to this, his overseas deployment and training missions include Germany, El Salvador, Panama, Iceland, and Hawaii and then he also has graduated from our Governors State University, Florida Institute of Technology, and the Colorado Aero Tech. Thank you, Mr. President. House Bill 5412 makes a primary contractor, also known as a general contractor, liable for the failure of a subcontractor at any tier to pay wages owed to its workers for all contracts entered into, or after, July 1st, 2022. The subcontractor shall indemnify the primary contractor for any wages, damages, interest, penalties or attorney's fees owed as a result of the subcontractor's failure to pay wages. The measure provides enforcement by the Department of Labor under the Wage Payment and Collection Act, which also allows a claimant to pursue his or her claim in court without first going to the Department. Work done by an employee of the State, or any political subdivision of the State, is exempt from this new provision, as well as, any projects where the homeowner is acting as the primary contractor on their own residence. Additionally, primary contractors who are parties to a collective bargaining agreement on the project where the work is being performed, shall be exempt from this Section. For those of you who are familiar, this bill passed in October last year, what has come back and what has been negotiated is very, 40  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 very different. Obviously, for those of you who are in the Senate Executive Committee, I will also be presenting another bill, which is House Bill 4600, that will include also some additional negotiations that we had in order to address some of the concerns of some of the opponents. Yes. So, in the previous iteration that went over in October, residential was covered. The only thing that is now covered in this -- we took out, well, let me state this, we took out, because I remember there was some concerns on your side of the aisle about someone who, if you were a homeowner and wanted to act as a general contractor, that is exempt now. We have also, hold on, the primary contractors who are parties to collective bargaining agreements, that is considerably different. In the trailer, which I will be discussing, we also exempted residential rehab. Now, the only thing a part of residential is new development. And in the -- in 41  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 the trailer I'm going to discuss, we also exempted projects twenty- thousand and less. But in this bill, it's a lot of the residential and the collective bargaining.

Senator Plummer, as I -– I know, you asked that question in Executive, as I stated, this is not -- this is normal practice. We always run trailers at the same time as -- as a similar bill.

Thank you, Senator Plummer. Again, the part that I mentioned in this particular bill that is different, is when you act as the general contractor and you own your own home, you are exempted. You also failed to mention the -- if you have a collective bargaining agreement, that is also exempted. So, those are the two big changes in this particular bill.

So, I'll give you a great example, Rivian. The Attorney General prosecuted Rivian for not paying its workers. They used -- the subcontractor hired another subcontractor, another subcontractor who didn't pay folks they had hired, prosecuted those folks and prosecuted Rivian and they got a settlement. The problem is, to your point - what you're asking, Senator. A lot of people don't have resources here. This is giving hardworking people, who also live in our communities, the opportunity to have another way to get paid. I think the problem that's being missed and I had a great discussion with the previous speaker in Executive, is this is to help the people who aren't getting paid. I'll use another example. The staffing agency reforms, we heard countless times how the staffing agencies were going to go out of business because of the reforms. Same situation, weren't paying people, weren't, you know, and -- and folks were being left behind because they weren't being compensated. The reforms passed. Have you seen a staffing agency close? Nope, they continue to flourish. Actually, it had the desired effect. The good staffing agencies report the bad actors, immediately. Because you know what? There are good contractors out there who do the right thing. Why can't everyone follow that same standard and do the right thing? Long winded answer, but wanted to get to that.

So, that's a great question, Senator. They offered that, but right now, primary owners are already, under current law, held liable. So, I think there was a lot of confusion from the opponents of what current law did, didn't do, compared to this. All this does is add another avenue for someone to seek to be reimbursed for their lost wages. What was brought up was vetted through the Department of Labor and the Attorney General, and they felt it was duplicative of what is already in current law under the Wage Payment and Collections Act.

Mr. President, and Members of the General Assembly. I represent one of the highest concentration of skilled trades union men and women across the State of Illinois. I will say that wage theft and payroll fraud are two of the most complicated things to track, but when you look at the impact that it has on our State, it is very important to take note that out of the -- according to 2020 data, five-hundred and thirty-seven six-hundred and eighty- three thousand total construction jobs. Out of those, eighteen percent or ninety-seven thousand three-hundred and twenty suffer from workforce payroll fraud. And that includes everybody in the State of Illinois, whether you live in southern Illinois or northern Illinois, they suffer from it. There's a social cost to that. A social cost, which means it's the cost that's spread out over everybody. So, for the families of those visiting -- visiting here today, it's important to recognize that those costs are born to you and your families and that cost for the State of Illinois is a hundred and eighty-six million dollars that we do not receive in the State of Illinois because of payroll fraud and wage theft. 51  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 I want to make note of a previous speaker's comments about the American dream. The American dream of starting a business in your garage, having the entrepreneurial spirit to make something of your business. Well, there's an alternative side to that American dream. It's about that kid who didn't grow up with anything. It's about that kid who didn't have a pair of jeans, who had to fight for every little inch to make sure they can get a job, whether that's being a laborer, whether that's being a painter, whether that's being a carpenter. That may not apply that -- that American dream that the business owner or the -- the person who -- who's a multimillionaire, multimillionaire now is a CEO of a company, they may have forgot all about what it was like to be the little guy. And you know what stinks the most, is when your American dream is crushed by some subcontractor who operates with greed and wants to take your money away from you. That's what this bill does. It holds those people accountable. It holds those people accountable who kind of don't care about the little guy, who don't care about the working-class person and that's why an urge an Aye vote, Mr. President. The same arguments being made here today were made about the staffing agencies and how they would close. They haven't closed, they flourished. In addition to the fact, it has had the opposite effect where they've called out the bad actors because everybody wants their industry to be the best. Wage theft is wrong. Corrects a drafting error, adds an exemption for rehabilitation work on residential property, three, in an effort to insulate small businesses, add a twenty-thousand-dollar threshold requirement for a project to be subject to the prime contractor liability provisions, and four, adds a statute -- three- 55  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 year statute of limitations for complaints filed with the Department of Labor and for civil action in court. Current statute of limitations for civil action is ten years. Lastly, the measure creates, hold your --- hold your horses, a task force to consider innovative ways to bring bond reform in the construction industry. Correcting some drafting errors, as well as assuring that we protect the allocation of associate judges across counties, notwithstanding changes, or otherwise be dictated by the census results. And finally, completing the process by which we would populate the new subcircuits in Cook County based on our efforts nearly thirty some years ago. And I think that is partially addressed with this bill. So, as - - as amended, the bill - the motion would create the Illinois Industrial Biotechnology Partnership Act. You may recall it from last year. I'd be a little surprised, but you might recall it got through this Chamber last year and then took a while to meander through the House. But it shall try to set up funds inside the State to encourage the expansion of industrial biotechnology and bio renewable sectors. The bill would provide for a process for the appointment of membership to the -- to the partnership. I wouldn't call it a task force. But nonetheless, members of a partnership, and also provide an incentive grant program. We have an unbelievable potential in this State with all of the agricultural that -- that we provide. I mentioned this, in a bill a few weeks ago, that most of you have a couple hour trip through mostly cornfields and at least one stop at Wally's, but those are veritable gold mines of what we could do if we invest in those areas. These jobs that are not outsourced, right here in Illinois, and the things we can do with it to also help with -- with some of our power issues. I'll be glad to answer any questions. It clarifies that retail net metering customers may receive an additional rebate for installing an energy storage device. It extends the sunset on the prohibition of Ameren and ComEd offering retail broadband service through their smart grid infrastructure for five years. It makes a technical change to the Energy Transition Assistance charge to enable the full collection of this charge. It clarifies that the greenhouse gas emitting generators who are called upon or called on to continue operations by a regional transmission organization may continue to emit CO2e and co pollutants, rather than greenhouse gases, after their zero emission deadlines. These things have been going on for a decade and probably beyond that, as well. I represent a district where there are multiple interstates, I-80, I-57, I-355, I-294. And if you -- if you go to the -- the -- the strategy that's been crafted by our State, its presence in terms of increasing the number of Illinois State Police Officers, its coordination, coordination between local law enforcement officials and agencies and technology -- and technology is what's going to assist us as a State to achieve our mission by implementing that strategy and -- and expanding the cameras to these counties. And -- and -- and in Senator Feigenholtz' previous bill, expanding these cameras to across the City and the suburbs is important to doing that. This area or this -- this circumstance that we find 93  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 ourselves in with increased shootings on the expressway, is very troubling. And I -- and I want to make mention of a shooting that took place last year as a family was headed home from the Sox game. She didn't even know she got shot and she got shot in the abdomen and, you know, and -- and -- and she died on her way to the hospital. It's -- and it was a shame. These cameras are so important to achieving our objectives, because one shooting is more than enough and people should have a reasonable expectation of safety on the expressways to which they travel. And these cameras and the expansion of these cameras by this bill will do just that. I urge and Aye vote. Thank you, Mr. President.

Again, I -- I want to echo the sentiments of my colleague, Pacione-Zayas. You can learn outside the classroom. You don't have to always be in the classroom to learn. And education should be dynamic. It shouldn't be static. You should be able, in some instances, kids don't have any other way of getting to, maybe a museum that doesn't that -- that only has limited hours, and -- and it's not open on the weekend. I know in my district, there's the Katherine Dunham Museum, there's the Miles Davis - where he grew up, museum. And those -- those aren't always open on the weekend and -- and -- and to experience the myriad of opportunities that belie them in their -- in their -- in their cities, in their school districts. And so, it's not an unexcused absence, it's an excused absence. So, the whole fact that the kid is not physically in a building, does not limit the fact that that student is actually out there learning. I want to again, thank the Senator - Leader Hunter for what she's done. She's listened to all of the concerns that were raised in -- in committee. She's made changes to the legislation. I felt it was so appropriate following Leader Hunter's civic events bill to mention that yesterday, Senator Villanueva and I, were joined in the Capitol by one of those individuals whose wisdom, commitment, and talent have literally poured into hundreds of doctoral, masters and bachelor degree holders in the area of educational policy studies at the University of Illinois, Urbana- Champaign. Dr. James D. Anderson, or "Doc", as his students call him, is one of the most sought-after historians in our nation. And I had the honor of him chairing my dissertation committee. Whether he was serving as an expert witness for Supreme Court cases on education, a contributor and participant in educational PBS documentaries, senior editor for the History of Education Quarterly, or an expert lecturer for international audiences, such as at the American Education Research Association, we are honored that his academic home has been the University of Illinois at Urbana-Champaign for nearly 50 years, as he prepares for his 105  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 retirement. His scholarship focuses broadly on the history of the US education, with a subfield in the history of African-American education. For much of his career at the University of Illinois, he was the chair of the Educational Policy Studies Department with appointments in African American Studies and the College of Law, and since 2016 he has been the Dean of the College of Education, after serving as a Presidential Fellow for 2015 to 2016 school year. While his honors include being elected to the Academy of Arts and Sciences, the National Academy of Education, and numerous lifetime achievement awards, his unequivocal contribution to the field is manifested in the mentorship and unconditional support in the numerous scholars, many of whom are scholars of color, who are considered the foremost leaders in education across the country, in our universities, public service, and school districts. Also, provides that there shall be a procurement preference for goods manufactured in Illinois, if two bidders have certified that they will provide U.S.-manufactured goods. It also speeds up the Procurement Policy Board review time on extensions or renewals. It also requires the Capital Development Board and the Department of Transportation to prepare quarterly reports on the status of change orders. It includes the following provisions: creating the Wellness Checks in Schools Program to help screen for mental health conditions, increases the outpatient add-on rate for hospitals with more than five-hundred outpatient psych services to help children under nineteen, allows coverage for midwifery services and acupuncture under Medicaid, increases the spouse resource allowance and maintenance allowance for individuals whose spouses go on to Medicaid for long term care and phases this in over a ten-year period to align with the federal level. It increases rates for behavioral and maternal health services, increases the amount allocated for dental rates for children and adults. Creates the CNA Intern Program, which helps us with our CNA shortage that we have right now, implements provisions to prevent individuals from losing Medicaid coverage and increases funding for non-ambulance transportation search -- 119  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 services such as Medi-car and adds coverage for non-citizens forty- two to fifty-four years old, who are -- have income at or below a hundred and thirty-three percent of the federal poverty level.

Well, Senator, this isn't the -- the only thing in this bill that was outside the Medicaid working group, the -- the provisions that deal with the -- making it -- the -- making it easier to avoid dispendious enrollment for the Medicaid Program were the product of the healthcare coverage expansion group that met over the summer. Thank you, Mr. President. This bill, as amendment -- amended, reforms our laws to prevent the -- the commission of organized retail crimes. It is an initiative of the Illinois Retail Merchants Association and the Office of the Attorney General. The bill defines "Organized Retail Crime". Organized Retail Crime is a new type of crime that was identified by the Attorney General's Task Force. It targets the biggest offenders, those stealing for profit, not those engaging in petty shoplifting. New types of crimes like this require new tools. The language of the bill gives prosecutors updated tools to disrupt the organizers of the criminal enterprise. Organized retail crime is the theft of retail merchandise with the goal of reselling the items for profit. House Bill 1099 recognizes that organized retail crime is a multi- jurisdictional issue. Organized retail crime would cover smash and grabs, we've all seen those images of store security cameras catching perpetrators rushing into a retailer and destroying the 124  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 retail property or threatening retail team members while stealing a great amount of inventory in a short period of time. The bill also includes the provisions of the Integrity Notification and Fairness in Online Retail Marketplaces for Consumers Act -- the INFORM Consumers Act, which is also a federal regulation. This does not go into effect, though, until January of 2023. The proposal requires online marketplaces to verify the seller and the goods offered for sale and the seller to provide contact information. The action will help law enforcement find those monetizing stolen merchandise, which often funds illicit activities, including gun, drug and human trafficking. The bill looks to reduce human trafficking by removing the funding that is garnered through sales of stolen merchandise. This then defunds human trafficking. Based on information from the Attorney General's Organized Retail Crime Task Force, Organized Retail Crime rings can be mistaken for isolated incidents, committed by low level offenders. However, organized crime rings are often behind these incidents. These rings operate across county and State borders. So, the AG's Office Task Force found that organized retail crime is often a multi-county crime. A multi-jurisdictional approach will help law enforcement agencies investigate organized retail crimes and trace thefts to the source through communication among public and private entities. It's not a victimless crime. The office of the Attorney General has found that retailers are raising concerns about the safety of employees who confront thieves or customers who are bystanders when these crimes are committed. The sustainable public safety doesn't come from overreliance on arrests and incarceration. It comes from addressing the underlying issues that lead to crime, addiction, homelessness, and poverty. 125  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 With the community support investments, we are making this Session, we hope that we should be on the way to achieving that. This was a highly negotiated bill and I want to thank the stakeholders, my colleagues on both sides of the aisle, IRMA and AG and staff for their perseverance. We haven't been able to -- wouldn't have been able to do it without them. Our fundamental job in government is the safety of our citizens and I wonder if there are any questions on the bill.

Thank you, Mr. President. So, the bill, despite what's been said, the bill does have some pretty amazing parts to it. The INFORM Act, which specifically goes toward online third-party marketplaces to verify the seller and the goods offered for sale. That's a very important part because it's going to reduce the demand, which will reduce crime. If we don't have the demand for these products, we're going to reduce the crime. So, I think that's a really important piece that, maybe, we haven't talked about enough, but we need to talk about this. It mirrors an agreement that was reached on the federal level by stakeholders and currently sponsored by Senator Dick Durbin and Congresswoman Jan Schakowsky. It also defines what organized retail crime is, so that prosecutors and judges can understand how to put that together and charge appropriately. And what we're trying to do with the bill is to get to the big fish. We don't want to get the little fish. We're not interested in little shoplifting, things like that. We want to get to the enterprise. And this, we think, with the language that we changed is going toward the manager, the 133  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 recruiter, the organizer, the supervisor, financing specifically these acts. Basically, they are self-made un-serialized firearms.

Thank you for that inquiry. So, based on that, what we have put in this bill is language consistent with ATF practice, as it is now. We're following federal law and it says if you do go back to page 2, it says for models of firearms in which multiple parts provide such housing or structure, the part or parts that the director of the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives have been determined are a frame or receiver constitute the frame or receiver. In other words, it means that the ATF makes that determination, and they make the determination on every model that is presented. And they make the determination, depending on whether or not, which one is that the upper or lower is doing more. So, it can either be the upper or lower, but that determination is made by ATF now and they are following federal law. And that our language incorporates is consistent with federal law.

You know, Senator, I don't want to dig down -- down in the weeds where you're taking all of us tonight. I'll just say that our language is consistent with ATF language because it is evolving with each new model. So, that might be a new model that you had us go to on our phones to Google. Thank you. I welcome the opportunity to close. I just think it's quite ironic that for people to talk about public safety and carjacking and we just heard, recently, retail theft. Many individuals use these ghost guns in the perpetration of that kind of violence and that affront to innocent individuals. So, you can't say that you're for public safety, if you're not willing to remove some of these guns out of the market. More and more, we are seeing the tragedy caused by violent crime in our neighborhoods. The rapid increase of untraceable guns in our State is what drives this problem in -- not in Chicago alone, but it's beyond Chicago. And I say that this is why the time is now to act. And you cannot say that, to get a ghost gun, we see individuals who are domestic violence abusers or mentally ill and just the basic criminal that you're trying to stop with the carjacking. They have these ghost guns and the investigators and the police and law enforcement is not able to solve the issue of the crime because they're untraceable. So, if we really want to talk about public safety, we need to vote for this bill. And I ask for your vote. Thank you.

But let me run through a few of the highlights in the -- in the -- in the bill, Mr. President. 150  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 Transfer of twenty -- twenty-five million dollars from the -- from the Audit Expense Fund, increases the maximum annual transfer from GRF to the University of Illinois Hospital Services Fund, extends the annual transfer from GRF to the Partners of -- for Conservation Fund, increases a one-time transfer to the Rebuild Illinois to implement the intent that initial license fees collected under the Sports Wagering Act, authorizes HFS to direct transfers from the Health -- Healthcare Provider Relief Fund and other specified funds of amounts attributed to time-limited enhanced federal match -- Medicaid match for home and community-based services, includes the transfer of -- includes the increase -- it increases or, I'm sorry, it includes the transfer - the typical transfer we have done in the last several years, the transfer between line items from two to four percent, various finance changes in the Article increase the Opioid Remediation State Trust Fund, extends through fiscal year 2023 the -- the reduced match requirement instituted provide greater flexibility for local tourism, creates the Serve Illinois Commission Fund, It also increased the -- the three year extension on I-Lottery for the Illinois Lottery, also increased -- includes the extension through fiscal 2023 of the current practice of allowing the Personal Property Tax Replacement Fund to be used for the Illinois Community College Board base operating grants and Department of Public -- Department of Public Health -- local health protection grants to local health departments. You will see that as a change that will happen in this budget because we are -- we are responding to the concerns from local governments. In addition, we have -- I'm and I'm -- I'm -- I appreciate, and thank you for pointing out what we already know on this side of the aisle, is that those programs that helped us and came from the federal government, they're working. They're working because you see our economy bouncing back. You see jobs being created. You see businesses being created. So, thank you. Thank you for pointing out to us that what we are doing is working. Again, Senator DeWitte, I dispute the classification and characterization that municipalities have been ignored. As I mentioned to you, there is an increase in local government distributed funds in this budget that we will debate in a moment. However, and what I did talk about was the investment in the American Rescue Plan dollars and the other associated Coronavirus 154  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 relief -- relief funds that we have talked about. There have been -- there have been infusions of cash and investments in -- in local governments and in other and other entities. Local governments have been -- have been infused with cash to a -- to a great degree. So, I would refute the characterization that local governments have been ignored, because if they, as you mentioned earlier, if there were -- if they were given the same percentages based on what we - the changes we have made and the changes we are making, they are right at the same percentages, Senator.

It continues to implement the changes that we are making here in the State of Illinois to improve the quality of life for families in this State. Thank you, Mr. President, Ladies and Gentlemen of the Senate. I stand before you to present House Bill 900, the fiscal year 2023 budget. But before I get started, I think it's on the details of the budget. I think it's important to remind everyone how far we've come. On November 8th, 2017, as a result of a manufactured budget crisis, Illinois had a build back log of sixteen-billion seven -- sixteen-billion, six-hundred and seventy-million -- seventy-five million dollars. We owed millions of dollars to creditors both inside and outside of the government. We were paying our bills over two-hundred days late and our State's credit rating hovered just above junk status. But we took bipartisan action to turn this story around, to turn this State around and put ourselves towards -- on a path towards fiscal stability. Two years ago, we began our battle with a global pandemic. A pandemic unlike anything most of us have seen in our lifetimes. We were sheltering in our homes with our loved ones. We were worried we wouldn't have the things necessary for -- like food and essentials for our families. Local restaurants and businesses were struggling to make ends meet. First responders were facing new dangers to 165  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 save others. Everything was uncertain, unpredictable, and unknown. The outlook looked bleak. But as Illinoisans, we were determined to persevere. We paid our bills and we focused on giving the support to those who needed it most; resources for our first responders, for our businesses, for the unemployed, resources for schools and for our children to return to in person learning, resources to help hospitals care for the sick. We focused on giving essentials and support where it was needed most so we could keep our State whole while we weathered the storm. So, as I was thinking about all the good that was in this budget and all the help it would provide our State, it struck me just how far we've come. Who would have thought that two years ago we would be where we are today? So, let's talk about where we are. Businesses are starting to bounce back. People are returning to work. Our kids are back in the classroom. Frontline workers in the healthcare industry are seeing a reduced workload. And through all of this, we have paid our bills on time. And seeing not one, but two credit upgrades. It seemed like a return to normal is within reach. So, let's talk about normal look -- what normal looks like moving forward as we turn to the fiscal year '23 -- '23 budget. A budget that is based on forty-six billion five-hundred and forty-three million dollars in revenues, and it's matched with forty-six billion four-hundred and ninety-four million dollars in spending. Several of the highlights of this budget include: twelve billion twenty-three million dollars in education funding, which includes nine billion seven-hundred and eighty-nine million dollars in K through 12 Education, 2.2 billion dollars in funding for Higher Education, 8.8 million eight-hundred and forty -- eight billion eight-hundred and forty million funding for Human 166  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 Services, two-hundred and for -- two-hundred and fifty million dollars for Health -- for the Healthcare Transformation Program, five-hundred and forty-three million dollars for long-term care rate reform, sixty-two million dollars for the implementation of solar rate adjustments, thirty-two million dollars in wage increases for direct service providers, a hundred and twenty-nine million dollars for the Home Services Program, which allows individuals with disabilities to stay in their homes, a hundred - - an additional one-hundred and sixty-five million dollars for the Community Care Program to fund a rate increase for providers, two- hundred and forty million dollars for the Illinois -- for the Reimagine Public Safety Act, forty million -- forty-four million dollars for home delivered meals, an increase of fourteen million dollars, seventy -seven -- seventy-seven million dollars for the Foster Homes Program, which supports youth in DCFS care, sixty- six million dollars for the hospital -- the Hospital Health Equity Access Leadership Grant Program for Safety Net Hospitals, fourteen million dollars for breast and cervical cancer screenings, a hundred and fifty-eight million dollars in funding to support to men -- the men and women who have valiantly served our nation, for the funding for the Department of Veterans Affairs, 6.3 billion dollars in public safety funding, including 2.2 billion dollars in GRF funding for public safety agencies, an increase of eighty million dollars in the Criminal Justice Information Authority, nineteen million dollars to fund three State police cadet classes, which will provide an additional three hundred State troopers, thirty-three million dollars for a Law Enforcement Camera Grant Program, ten million dollars for a Law Enforcement Officer Recruitment Retention Pilot Program, and 1.7 -- one billion seven- 167  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 hundred and seventy-six million dollars for General Services, including two-hundred and sixteen million for the Department of Agriculture and one-hundred million dollars for broadband equity access and deployment for broadband expansions. This budget funds education, healthcare, public safety. It funds our pension liabilities and it continues investing in our priorities. Thank -- thank you, Mr. President. Let me again, I need to address a few of the things that I heard from my friends on the other side of the aisle. One, I -- I -- I'm -- I'm struggling and I'm a I'm a bit offended by the notion that we stood by and did nothing while families were struggling. Two years ago, at the end 173  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 of the Session, I remember the Senate President standing at his desk and recounting a list of items that the Members on this side of the aisle engaged in: activities to support families, not by - - not just by policies, but by actions, food giveaways and PPE giveaways, and sanitizing giveaways, and being right there on the frontlines with families. So, to suggest that we have done nothing is patently false. We continue to engage in policies that improve the quality of lives for all citizens of this State. And I have said to you before, and I will say to you again, if you join us, we welcome you. But to sit and say that -- that we have not done anything, is just not true. Second, to say that we somehow kowtow to some woke -- woke agenda, if you want to continue to engage only in culture wars, that's what will happen, but if you want to have real policy debates, we're willing -- willing to have those with you. Come aboard with us. We are willing to do that with you. But, then also, there was a discussion about increases in spending and somehow that we have not engaged in spending that invests in communities. Nearly ten billion, with a "b", ten billion dollars in funding for public safety initiatives alone. That does not even include the fiscal '23 budget. Now, the fiscal '23 budget includes funding for cameras, it includes funding for new officers, it includes funding to -- to invest in recruitment and retention activities. All the things that you say you support, but you will not vote for them. All the things that you say that you -- that you -- that you want, but you will not stand up and support them with your vote. You can't have it both ways. Either you support law enforcement with your words and let your -- your words meet your actions or you don't. Secondarily, there was a contention that somehow, we are not allowing, or being able -- 174  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 investing in allowing our young people to go to schools and we're not investing in families. There's more money in this budget -- as I open them -- as I led with my opening, over twelve billion dollars in education funding. What does that include? It includes funding -- funding for K through twelve dollars in the classroom, but it also includes things like the Monetary Award Program that lets low-income students find a pathway to college into a better life. Those are things that you say you support. Join us. But then also, we have talked about the spending that is going on and not investing in good fiscal stewardship. This budget includes a billion dollars into our rainy-day funds. Say that again, a billion dollars into our rainy-day funds. So, you say we're not being good fiscal stewards, but our words are matching our actions. This budget builds on the -- the -- the work that we have done to pay off our bills. We passed legislation previous -- earlier this Session that has now paid all of the bills that the State of Illinois has. Nearly nine-hundred million dollars in group insurance bills, two-hundred and thirty million dollars in -- in College Illinois bills, three-hundred million dollars in pension costs, which will save us a billion dollars in -- in pension --in interest costs over the life of our pension system. Join us, in being good fiscal stewards. Mr. President, with that I ask for an Aye vote.

Sheila Ryan came to work in the Senate in 1981, starting as a legislative assistant to long time Senator Art Berman of Chicago. So, that means that when Senator Rose rises to speak, Sheila is responsible for transcribing word, for word, for word, even when they aren't real words. She's worked for five Secretaries of the Senate, making each of them look good and keeping them on track. Sheila is known for her strict attention to detail, taking her job seriously as she reads every bill and amendment to check for accuracy and make certain the Senate's actions are what really winds up in our bills. So, tonight, Sheila will say goodbye to us after finishing her 42nd Session. She has worked a career's worth of late nights and long days on behalf of the Illinois Senate and the Senators who have served in this Chamber. So, in honor of the 15th anniversary of the Smoke-Free Illinois Act taking effect, the joint resolution asks for IDPH to provide a data brief on the impact of the Act since 2013 by 2023. This resolution also states the importance of continuing to protect the Act and working to strengthen it.

House Bill -- I'm sorry, Senate Bill 157 does the following: it allows EDGE Credit - it allows for a newly created corporation with no current income tax liability to receive the EDGE Credit, it allows for a Film Production Tax Credit, it creates a Live Theater Production Tax Credit, it exempts biodiesel, renewable diesel, biodiesel with blends over nineteen percent from sales taxes, it extends the sunset date for sales tax exemptions, creates a hospital exemption, creates an Organ Donor Credit, it creates a property tax and income tax rebate, it has a freeze of the current Motor Fuel Tax, it allows for REV incentives for battery recycling and reuse manufacturers, battery raw materials refining service providers, it expands the Earned Income Tax Credit by two percent from an amount equal to eighteen percent of the federal Earned Income Tax Credit of twenty percent, it creates a grocery tax exemption, it creates a school supply sales tax reduction, it has breast pumps exemption, has a coal and -- coal and mining equipment exemption, it also transfers one-billion dollars of GRF to the Budget Stabilization Fund and two-hundred million dollars of GRF to the Pension Stabilization Fund, it increases the credit from two-hundred and fifty to five-hundred dollars for educator's classroom materials, it provides a tax credit of up to one-thousand dollars to agritourism operators, and it creates a Parking Excise Tax. And, Mr. President, I will answer any questions.

Friends, I want to thank everybody for this nice debate at 3:10 in the morning, but people across the State have suffered, whether it's losing their jobs, having to stay at home and work, adapting to using new technology to put food on the plates for their family. Our teachers have struggled. Our healthcare workers have struggled. Whether you're poor, rich, Black or White, you live in Chicago or Cairo, everybody across our State has struggled. We're slowly recovering from one of the most severe public health crises that our State, country and world has seen in the last century. And now you have the chance to help people, everyone, everyone across the State. This plan uses our revenue growth on one-time tax relief that is fiscally disciplined. It's responsible, it's fiscally disciplined. It's been lauded by credit agencies across the country. And this relief plan fits into a balanced budget that produces a surplus. The math is shown here. The Savings and Relief Plan prioritizes families, giving them the much needed and much deserved assistance they need. It's their money, not the government's. We're providing ninety-five percent of taxpayers with a one-time tax refund. Let me repeat that for those in the back, a tax refund. It's their money, not the government's. We're giving homeowners relief because when the government has extra money aside, those dollars should be returned to the taxpayer. It's their money, not the government's. We're addressing inflation and the skyrocketing price at the pump by suspending the one percent State grocery tax portion and the gas tax. People's pocketbooks are hurting. Working class families are struggling. We must do something about that. We've created a back-to-school State sales tax holiday to prevent -- to help families pay for school supplies. Thank you, Mr. President, Ladies and Gentlemen of the Senate. As amended, Senate Bill 1975 is a package of property tax reform, reforms that predominantly benefit senior citizens and veterans. This includes the following: number one, it directs the Department of Revenue to study the impact of the veterans with disabilities homestead exemption on the property tax base in certain counties, number two, between tax years 2022 and 2027, permits an automatic 232  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 renewal of homestead exemptions for persons with disabilities by the Cook County Assessor and any other county that chooses to permit their assessor to do so, number three, it adds optometrist to the list of medical professionals who can diagnose a disability for the purposes of the homestead exemption for persons with disabilities, number four, beginning in 2023, completely -- and completely exempts the property of the surviving spouse of a veteran whose death was service connected, number five, eliminates the reapplication -- reapplication requirement for veterans with service-connected disabilities of one hundred percent, number six, increases the senior citizen homestead exemption in the collar counties to match that of the senior citizen homestead exemption in Cook County, number seven, increases the general homestead exemption in the collar counties to eight-thousand, from the current amount of six-thousand, number eight, changes the income threshold for the senior assessment freeze to the same qualifications for -- so any senior who participates in programs such as SNAP, LIHEAP or AABD will meet the income threshold for that freeze, instead of it just being a level dollar amount, number nine, establishes an alternative aggregate extension base for school districts. This is the bill that Senator Gillespie worked so hard on and was carrying with Representative Walker. Again, what this does is, it does not change the PTELL extension caps. It just permits - it creates a tool where local taxing bodies will not be punished for not taxing to the maximum, so, it gives them an incentive to not tax to the maximum in years that they don't feel that they need it without being punished in the future. Number ten, requires all school districts to disclose their cash reserve, and number 11, extends the sunset on certain interfund 233  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 transfers, prioritizing school districts most in need to June 30th, 2026, and that's currently June 30th, 2024. This bill left the House quite late. A lot of work being done on this one, left the House at 10:45 and it passed on a Floor vote of 110 to 0 with one person voting Present. First, the bill 234  STATE OF ILLINOIS 102nd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 109th Legislative Day 4/8/2022 amends the definition of race in the Act, to provide "race" includes traits associated with race, including, but not limited to, hair texture and protective hairstyles such as braids, locks, and twists. And second, the bill also amends to -- amends the Act to provide a uniform standard for the prevention of discrimination in schools, a type of public accommodation and traditional public accommodations such as stores, restaurants, parks and movie theaters. Currently, two standards apply. Students have a right to access -- a right of access to school facilities, goods and services, while consumers have a right to full and equal -- enjoyment of facilities, goods and services. And I ask -- I wish to adopt this amendment. I concur with the amendment.
