Senate Bill 89 amends the Insurance Code to update the liquidation provisions of the (and) account for insurance companies that handle cybersecurity -- cybersecurity claims. The bill provides the insurance companies order to liquidate after January 1, of 2023, shall not be obligated to pay more than 500,000 nor the obligations that exceed 50,000 for the unearned premium claim or refund under any one policy. There's no opposition and I seek a favorable vote -- vote.

Thank you, Mr. President. This bill is about phone spoofing. So, when you get those terrible phone calls that say they're from your friend, or your church, or your bank, and they really aren't, they're really something else. This bill is trying to prevent misleading caller information from going through. Though, Senate Bill 160 requires, also, that these automated telemarketing calls immediately state the business of the organization being represented, that they prompt the person called to confirm whether the person consents to solicitation, either by this call or selection of a number on the phone, or if the person called, does not consent to solicitation, the business or organization must refrain from calling that person over and over, and over again. So, my bill was passed last year with unanimous bipartisan support, and I'm hoping you can also continue to support this bill.

Thank you, Mr. President. Senate Bill 1230 amends the Animal Welfare Act by providing that the definition of "dog dealer" and "animal shelter" do not include a person who sells dogs at retail to the public. It also defines "at retail to the public" to mean the selling or offering for sale, whether by appointment or otherwise, animals at a brick-or (and) -mortar establishment that were obtained from breeders or brokers for compensation and were not bred on its premises. This is quite simply a cleanup bill of the puppy mill ban bill that was passed in the last Session.

Thank you. This bill was actually, we -- we talked about this in the last Session. As you know, it takes some time to get things moving legislatively, at times. The problem was, is the puppy mill ban was supposed to make sure that we didn't have pet stores obtaining their animals from these large-scale breeding 18  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/23/2023 facilities that we know as puppy mills. Then there were most of the stores understood that, closed down. There has been a few establishments that have decided that, in order to skirt that law, they would no longer call themselves pet stores, but they would call themselves dog breed -- dog dealers to try to actually skirt the law. So, this was brought forward as soon as we were able to.

I'm not sure I understand what you're getting at. It was actually the Department of AG who enforces this, who came to us and said, "If you do this, you will clear up that loophole." So, not addressing you selling animals from your farm at all.

Yes, I would appreciate an Aye vote on this. I -- I do want to say that we are not - it's not that we're harming people's ability to get pets, because you can get a pet from a shelter. You can buy a pet directly from a breeder for a lot less than that expensive mark up and sort of predatory loan practice that was used by these pet stores. So, we're certainly not restricting that. And as far as the welfare of the animals and going after breeders, I would welcome you to present that legislation. But it's not going to help in this case where we heard from this breeder who said they source ninety-percent of their animals from Ohio, as we're Illinois we have no jurisdiction over Ohio and their breeding facilities. I'd appreciate an Aye vote.

What this bill does, is that, for school districts that have more than 525 certified teaching staff or participants that they -- and they decide to offer a 457-plan other than what TRS already offers, they have to offer more than one to make sure there's a competition, that those teachers are not just given that one alternative. Thank you, Mr. President. One moment. As amended, Senate Bill 1291 makes changes to the Illinois State Collection Act and the Code of Civil Procedure to provide that if a State agency fails to provide a debtor with written notice and a demand for payment of any debt owed to the State agencies within five years of when the agency's right to collect first accrued, then the State agency is barred from attempting to collect that debt. This five-year limitation does not -- does not apply in the case of fraud, nor does it apply to taxes, fines, or fees. The bill also adds a ten- year limitation for State agencies attempting to collect outstanding health benefits premiums from covered employees. Mr. President, a little background on the -- on the -- this case. Young lady in my district worked for Ameren for 22 years. She left Ameren to take care of her kids, she got on general assistance. Thirty years later, she received a bill saying that she owed a bill from the 1990's. Her life had changed. She was divorced, she was on a fixed income, she had retired, and all what this bill looks to do is say, if there's an issue, you have five years to go after that overpayment, but you cannot do it 30, 20, 30, 40 years later. You cannot reach out to a private collection agency and impact somebody's credit after five years. I know of no opposition.

Senator, yes. As long as that person had been notified by a letter, phone call, they've been contacted within those five years, and that debt then still would have to be mitigated. You -- you have the right to dispute it. You can go through appeals. We have a process for that. What we're just guarding against is, showing up 10, 15, 20 30 years later, saying you owe this bill.

Senator, through the -- through technology and particularly, in – in, this will primarily deal with overpayments and DHS, and in -- in particular, they think with technology already having addresses, even in this case, 30 years later, they were able to contact this lady, they'll be able to, pretty much, contact her.

So, Senator Rose, those are two different things. The debt, as I previously indicated in committee, and as I indicated here, was a general assistance, a welfare issue. The ten-year amendment came to CMS. They -- they were in opposition, they wanted to slide neutral, and so that ten-year limit -- look back limitation is when someone is separated from an agency, they file a grievance, and while they've been separated in a grievance process, their health insurance is still being paid, and that person who filed a grievance then is reinstated back to whatever agency they were working for. It gives CMS the opportunity to reclaim their -- that person's share of the benefits while they were separated from the agency.

This legislation creates a two- year pilot program to provide 8-milligram naloxone nasal spray kits to licensed community substance use providers and public health departments in five counties. Under this legislation, DHS will be required to collect data, including the number of people who survived an opioid overdose due to the 8-milligram spray. Currently, the 4-milligram spray is available to emergency medical service providers, but in many cases, the dose is not enough to save individuals, and they need more than one spray.

Thank you, Chair. Senate Bill 1440 is an initiative from the sponsor. When someone buys a car or a home in Illinois, they often begin getting these final notice letters regarding warranties, protection plans, insurance, and more. Senate Bill 1440 amends the Consumer Fraud and Deception Business Practice Act, to provide that it is unlawful practice, under the Act, to knowingly mail or send a postcard or letter to a recipient in the State, if the postcard or letter does not disclose all affiliations and that it is a solicitation for sales or goods or services and that it is not a bill. This does not apply to current or -- clients or customers. It provides that all disclosures must be located at the top of the letter or postcard in bold-face 14-point font, and in a clear and unambiguous language. So, the amendment reinstates the insurance from one million to 500,000 thousand. It would change the language requiring every application for licensure to include a list of all employees of the timber buyer, and so, that would be transparent and the Department is very enthused with this legislation. When we passed the bill that consolidated the downstate fire pension systems into a single investment fund, we made corrections to those funds in order to avoid a - what was considered a safe harbor problem with Tier 2 benefit structure. Department of Human Services is about to expand and do one in Peoria and East Saint Louis. Thank you, for your question. If I may address the last comment, this is statewide, the program. There's no preferential treatment. It is means tested. You have to meet a particular economic threshold, which is 250 percent of the federal poverty line, which means for a family of four, you're making about $69,000, which, in certain parts of the State, that's very difficult to live in. The point is, is that with these 500 dollars for example, in the Cook County example, usually these guaranteed income pilots are between 500 and 1000 dollars a month for a period of twelve to twenty-four months. Nobody's going to become a millionaire off of this. And more than likely, these individuals are using these funds to pay for very basic necessities, such as, child care, rent, holding off on medical expenses, supplies for school and work, transportation, all of these things. This is not free money. More than likely, the majority of these people actually, if they are not working, it's because they're not working because they're disabled and they're unable to work. And so, for 43  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/23/2023 this particular purpose, because I served on the task force in the City to really study this, this makes a significant difference in the lives of individuals who are struggling to just make ends meet. This is not a get rich quick. This is not any type of scheme. This is not unfair. What's unfair is that you're not able to make a livable wage in most parts of this State. And this is just a simple project to be able to ensure that you can have basic needs met and move up mobility wise.

If you study the individuals who take up this particular benefit, as I mentioned, they are working and they are unable to make ends meet. Do they - are they responsible for the same number of dependents? Do they have a disability? Do they have 44  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/23/2023 economic upward mobility? You cannot compare just randomly two individuals. You have to look at the set of circumstances and conditions, the resources that they have available for them. And in this particular case, because of the data that we do have, they are working. They just can't make ends meet and this is meant to support their economic mobility.

Each program that is developed has their own criteria. The one that was referenced earlier in Cook County. The criteria is that you meet an economic threshold of 250 percent. The data that we have so far from Cook County is that, if individuals are not working, because most of them are, but if they're not working, it's because they can't work due to disability or age or some other reason that's preventing them from work.

It is actually a temporary gift, and it doesn't prevent them from getting other public services and benefits. Thank you.

Thank you very much, Mr. President. Senate Bill 2013 is the initiative and response to the death of three seniors in an affordable housing building in my -- in my district last spring in Rogers Park. A situation where heat index exceeded 80 degrees, it was really hot, and these three seniors died unnecessarily because air conditioning was not operable in their place of residence. So, this -- this legislation is intended to do a few different things that I think will help us prevent -- prevent future tragedies; number 1, this legislation would apply to any housing that is financed under the Illinois Affordable Housing Program that would have to meet a minimum standard of living requirements in order for a program applicant to be eligible to receive funding to acquire, construct, or rehabilitate housing. Specifically, cooling standards would be required such that that housing must have cooling and dehumidification systems capable of being operated independently from the heating system. Also, that newly constructed housing must have permanent air conditioning, so that we again can -- can save lives when -- when it gets really hot. And any housing that is refinanced by the State of Illinois would also have to have that cooling and dehumidification systems installed. The legislation also would require that whenever, you know, we've seen a lot of instances of heating that has gone out in affordable housing and residents, in one instance, went 7 days without heat in -- in the City of Chicago, so this legislation 70  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/23/2023 would require that any heating outages would have to be rectified within 24 hours again, so, that again, our affordable housing residents can live in safe and -- and dignified housing conditions. And then the -- the other key change here is this legislation simply recaps existing requirements around affordable housing, such that, maintenance and upkeep, particularly for our seniors, would be maintained on a regular basis. And so, IHDA is in support of this legislation. There are no opponents, that I know of at this time, and I would respectfully ask for an Aye vote. Thank you very much, Mr. President.

Specifically, it amends the Code of the Criminal -- Code of Criminal Procedure to provide that a person released from a penal institution cannot be charged any outstanding fines, fees, or taxes, or other costs arising from a criminal proceeding involving them for the first year after their release. This is a - this is a simple measure that is intended to, again, help those that have been incarcerated, who have paid their debt to society, come back to their communities and have time to find a job, find access to housing, find health care, and reintegrate with their families. It's just such an important, just measure of help that we can offer people that we know our society has not been kind to people who come back to communities and oftentimes can't find housing and can't find jobs and go right back into the penal institutions. And we know from ICJIA that in 2019, of the 30,000 people who were released from prison, a 3rd of them had recidivated within three years. The -- the last order of business for the day is to compile the Agreed Bill List. I do want to thank our Republican colleagues for the work in 108  STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 3/23/2023 assembling an Agreed Bill List. If you fail to do so, then the roll call for each bill on the Agreed Bill List will reflect the vote you cast on the Agreed Bill List Order. So, as an example, if I do not file a vote intention sheet and then I vote Yea on the roll call for the Agreed Bill List, the roll call for each bill will reflect that I voted Yea.
