Members of the Senate, please join me in welcoming representatives and students from Heart of the City, Waukegan. Heart of the City is committed to providing a just, equitable, inclusive and diverse space for student athletes, their families, staff and for their board members. There are 17 students here today visiting with us and I look forward to joining them after Session. But here's just a high-level number of some of the things they do at Heart of the City. So just recently, approximately 85 boys and girls, ages 15 to 14, were introduced to soccer through grassroots -- their grassroots camp and clinic in our community in Waukegan and 256 boys and girls joined their recreational soccer academy and gained basic soccer and life skills, basic life skills and 172 boys and girls enrolled in their elite travel soccer academy with college and career training components. And yeah, and many of the students, they traveled out of town for the first time. And so, it is a great organization, and so, thank you very much, and again, please join me in welcoming Heart of the City, Waukegan.

I think the sponsor has diligently worked to improve the bill. She's removed most of the opposition from the Realtors. I'm not sure about the condo associations, but here's how I see the bill. Technology changes every day to - we want to be proactive, but I feel like a bill like this goes too far and that establishes standards that may be obsolete when needed. Case in point, there's charging stations in the Stratton parking lot that don't work. They're obsolete. Who knows what the technology is going to be when needed? And to make an industry do this by mandate of State law seems too much. Contractors can do it. They can be proactive. They can then use this technology. Case in point, this iPhone 17 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 cannot be charged with the first type of chargers. There -- It's obsolete. I have to have a specific charger for this. Same thing with electric cars. It's an evolving technology. Most people downstate can't afford the electric cars as they are. Who knows when they will? But when they do, these technologies that we're forcing and mandating may be obsolete. So, for that -- I think we have to consider that the marketplace is the place to decide this. If builders and contractors, condo associations want to do this and avail themselves of the technology, fine. But to mandate it, isn't necessary. Thank you.

I think we should be incentivizing people to put these mandated electric charging systems into residential homes, either single family or multi-family. Give them the incentive to put them in rather than a mandate that makes them spend the money to install them. I encourage a No vote. Thank you.

Thank you. I think this is a well-intentioned idea. I just want to speak to the group from -- from personal experience on -- on this -- on this issue. I work a lot in construction. I work a lot in real estate. And over the last three years, I just want to walk through something I -- I went through because it's the type of turmoil and it's the type of expense that I don't think we want our constituents and our Illinois homeowners to go through. I -- I entered into an agreement with Tesla to build out charging stations that were state of the art across multiple commercial properties. Subsequent to that, Tesla, who probably knows a bit more about this issue than -- than anyone in this room, has had to come in and redo those charging stations, three times in two years because of changes in technology. On top of that, the various cars and vehicles that use this technology don't use the same charging stations, and those different charging stations have to have different energy sources. That is a massive, massive expense. And so, watching the professionals in this area struggle to build out these charging stations in a commercial setting, watching the expense they've gone through and then mandating this on Illinois homeowners, knowing that the technology is going to change, knowing that the energy sources will change, knowing that these various chargers can't even service all the various EV models that exist. 19 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 If you're building a house, how do you know what car you're going to buy a year from now or ten years from now? We are forcing homeowners -- we're forcing contractors to do things based on technology that's not fully evolved, it's not fully developed. And this will be a massive, massive, massive expense on Illinois homeowners. I'm totally for the concept of stubbing this stuff into houses. I'm totally for the concept of making these houses ready for this. But we're going to look really silly when people are tearing out the utility infrastructure of their house two and three and four times over the course of 5 or 6 years. So while this is very well intentioned from personal experience, the experts in this field don't know the answer. I assure you the Illinois General Assembly doesn't know the answer, and I urge a No vote.

What you said was you're all for stubbing this in, but we don't want to put in outdated technology that could be quickly outdated. Good news, that's all this bill does. It simply requires a connection of a pipe so that 20 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 if someone wants to connect a charging station, that that pipe is there, there will be no wiring run through it. There's no requirement, there's no charger set up. It -- It is optional for the unit owner to install as they see fit. All it is simply doing is making sure that that -- the infrastructure, the stubbing that you said is there so they can put in the wiring. If they put in the wiring and the technology changes, that conduit is there, so they can rip that out and put in new. If they want to wait for the technology to change, they can wait and put in the technology as it changes. So, it is exactly what you were hoping for. It's a good bill and I -- I respectfully urge everyone to vote, Yes.

I just want to alert the people who are opposed to this bill that we have building codes that already require conduits and that is all we're doing. We have walked this legislation back from being EV ready to being EV capable -- capable to save people money. Because if you had to retrench into a building after it was built, you're putting about a 75 percent additional cost on that. And it -- it is incumbent upon us to have these conduits in so that when people are purchasing homes in the next 30 years, that there are less -- going to be less and less automobiles that are running on gasoline. General Motors is going to be eliminating and they're going to stop building gasoline vehicles about 2030. And Ladies and Gentlemen, that's tomorrow. So, I would appreciate an Aye vote on this barebones bill. And it is a -- an anomaly that - there is - family history, it's an heredity issue that those families that have that in their family history can and should be doing DNA testing before the pregnancy to determine if there is a risk for this -- health -- anomaly as opposed to afterwards. We're spending $15 million just to let a family know that their child has MLS and when it could have been prevented by doing DNA testing ahead of time. So, again, my concern is, is this the best use of $15 million of Medicaid monies on a -- after the fact, as opposed to before a fact issue. So, I appreciate the sponsors work on this. And again, I'm just concerned about the cost and the fact that this is not going to help prevent this from occurring or help those families that this is going to occur to that we need to be encouraging prevention instead and encourage DNA testing for those people who have that in their family history. Unfortunately, in Illinois right now, the opinion of the Secretary of State and the Attorney General's Office is that engineering services are not a valid or authorized purpose for not-for-profits. And so, what this bill does is expressly authorizes engineering services as a valid, not-for-profit purpose. Thank you, Madam President. Senate Bill 325 amends the Freedom of Information Act. It is an initiative of the Attorney General's Office. I think we understand that when a dispute arises over a denial of a freedom of information request, the attorney general's Public Access Counselor often steps in and mediates that dispute. Something that's happened in recent years is that parties to those disputes have then been turning around and issuing a FOIA on the Attorney General's Office to get copies of the records that are being disputed and judged by the Public Access Counselor. This puts the Attorney General's Office in a very awkward position to have to potentially deny FOIA requests for a second time. And it also creates a situation where public entities are reluctant to submit their documents to the Public Access Counselor because they're afraid that they will be accessed during the course of this dispute. So, this would eliminate that problem, shield these 32 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 deliberations by the public access counselor from FOIA. The director shall submit a report beginning on February 1st of 2024 and each even year thereafter detailing the assessment of the Governor and this General Assembly. The report shall include the annual State maintenance, the security costs of said properties, the properties at fair market value, the estimated demo and remediation costs and attempts to sell the property and recommendations. This creates The Sustainable Ownership and Surplus Property Environmental Cleanup Fund, which shall be used by the director, subject to appropriations for the purposes of demoing or demolition or environmental remediation costs associated with the surplus property and I ask for an Aye vote.

Senate Bill 646 is a bill that seeks efficiencies to create a task force for a Healing-Centered Illinois to design at a State level comprehensive and equitable strategies to address trauma and promote healing. It will build on the work of the Whole Child Task Force, the Children's Mental Health Transformation Initiative, the Illinois Children's Mental Health Plan, by developing shared language and common definitions, ensuring that there's meaningful inclusion in this task force of young people, parents, survivors of trauma, residents who have engaged with our system. It will do an environmental scan of current training and capacity and training needs, identify what data is needed, a process for collecting and aggregating such data, and it will ensure that there is sort of another scan of resources that are being invested so that we can have alignment and coordination and not be working in silos. Senator, thank you very much for this legislation. I -- I rise in having concern that the Governor's Office and others will staff these task forces. We have seen other task forces created and they have languished. Do you have means to put pressure to make sure that this task force is actually fulfilled?

Thank you for your question. The genesis of this task force came from a working group that was composed of stakeholders with a history of advancing initiatives and research to mitigate the impact of trauma. Those members include Lurie Children's Hospital, the Illinois Justice Project, ICJIA, ISBE, the Lieutenant Governor's Office, Department of Human Services in Chicago, beyond. They have secured some resources to help staff, but ultimately, this is an initiative that is coming out of the Lieutenant Governor's Office, and I have had the honor of serving on several of her task forces, some as large as the one that we're proposing and have been able to see action actually come out of them. So, I don't really have concerns because I've been in this working group now for the past year, and I think it's going to be a great opportunity to have a public and private partnership.

Yes, this does the same thing as actually my first bill in the Senate. When I came in 2007 when we took Peoria County, which was the taxing entity that at that point admitted Peoria countywide. This will take right now the taxing bodies are just Bloomington and Normal. And so, this will expand it to the whole taxing body being McLean County. So, it will reduce the taxes of the residents of Bloomington and Normal and it will increase the taxes of the -- the county. It's the same amount of money. It's just spread out over the whole county. It's -- it's really an issue of -- of fairness and equity because the airport is -- is really the -- the economic engine of that area. You have to have a vital airport to have, you know, dynamic community.

Do the new members of this airport district know they will be receiving a tax increase as part of this reorganization?

Yes, I believe they -- they do. This has been an issue that the -- the airport currently has been pursuing for some time. So, I'm assuming if people were paying attention that they would understand that right now the 75 percent of the of the taxing body is -- is Bloomington and Normal. So, they will still pay the bulk of the taxes in this, you know, an owner of a -- of a $175,000 house would pay approximately 100 -- approximately $55 a year. This legislation gives us another tool in our toolbox to protect our friends and family members by allowing the Office of the Inspector General to place employees who did not report abuse under the code of silence on the Department of Public Health's-health care worker registry. It is a public registry for those found committing or covering up abuse and neglect. I ask for your support on this legislation.

Thank you, Madam President. As you all know, emergency vehicles such as ambulances and rescue vehicles, they need to arrive on the scene of emergencies, and they often travel quickly to get there. And this is an initiative, as a result of a tragic accident that happened in my district. In fact, a bright young leader in our community, Donald DJ Stallworth III, was hit and killed by an ambulance. And I didn't say this in committee because it was just too emotional for me to say this, but it happened right outside of my District Office in Waukegan. And so, to honor this young man and to ensure that we don't have tragic accidents like this again, that's why I advanced is bill. And so, it gives me honor to say that with this amendment, we are naming this bill the 72 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 Donald DJ Stallworth III, Act. And also, what this does, because we worked with a number of key stakeholders, and we removed the opposition to this bill. So, the Illinois State Ambulance Association, the Illinois Fire Protection District, the Associated Fire Fighters of Illinois and the Illinois Fire Chiefs Association, they are all on neutral. And they were all prepared to speak in favor of this initiative in committee. So, one of the things I want to share is that this bill, as amended, requires the ambulance or rescue vehicles to have documented training in place and know when during certain emergencies you should have the siren and the lights on at the same time. So, it allows them to make that decision. But through training and I know of no known opposition, and I urge an Aye vote. Thank you.

This legislation will help to ensure that those populations and those who are at high risk for liver disease have access to preventative screenings and preventative care that can save their lives. Specifically, this legislation would require that Medicaid, private insurance plans and government employee insurance plans cover preventative screenings for those between 35 and 65 years old at high risk for liver disease. We know from the CDC that liver disease is the ninth leading cause of death in the United States. It is often a silent killer that oftentimes does not present any symptoms until it is in the late stages and unable to be reversed. So, I just want to thank Chairman Harris, Senator Syverson and others on the Insurance Committee that working with me on this legislation, as well as the Illinois Health and Life Insurance Council that helped us to put forth an amendment that would ensure that this is for the ages of 35 to 65. Those are the folks that are most at risk of -- of advanced liver disease. And it also would ensure that we do not have these apply to those that have high deductible plans that would preempt them from being eligible for health savings accounts. So, that amendment has been added. And I would respectfully request an affirmative vote on this legislation, and we'll take any questions. Thank you, Madam President.

The problem I have with this bill is someone has to make up the difference of the fees that are not being required to be paid. For instance, I represent Adams County. Adams County -- their amount of fees in the last year or maybe the previous year is $22,000. That is a significant amount that somehow that county and that entity of government through their taxpayers, is going to 80 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 have to make up. This bill does not have any means testing. A wealthy parent can be able to have a child go through juvenile proceedings and never pay a penny. I don't see how that's fair to the taxpayers. That child, that parent are incurring these fees. They just don't have to pay them. And as we noted in committee, $22,000 represents about half the cost of a probation officer's salary. It's significant to that county. And I think if we structured this bill differently, it would make a lot more sense. I realize it was a Supreme Court recommendation from a task force. However, I don't think they took into account who's going to pay it. Some -- there's cost, there's cost and where and who is going to pay it. And it's falls on the county and then it falls on the taxpayers. And that isn't fair to those who could pay that are not going to be incurring any cost when ultimately they're responsible for that child who is incurring these fees. Thank you, and that's why I'm a No vote.

So, this bill basically phases out the e-learning plans and still maximum of five days per year, no change. So, this amendment removes all known opposition by requiring public hearings or remote plans, and it keeps the language regarding contractors consistent with the current status that we have today. Thank you, Madam President. This bill seeks to address problem gambling online. As you know, a couple of years ago, we for the first time in the State, put in place online sports wagering. What this bill does is require the companies that provide us those apps have information that is readily available, for the user to get help if they have a gambling problem, it will be done in the form of a hot link that will appear on their smartphone. They'll be able with one touch to hit that button and hopefully get help. I think we all know that gaming has brought a lot of money into the State Treasury, about $1 billion a year. I think we would all acknowledge that that brings with it some responsibility for those of us who are policy makers. And I think we need to ensure that part of that responsibility is making sure people who have problems with gambling can easily get help. And that's what this bill seeks to do. I ask for your support.

Thank you, Madam President. This bill would require that if an employer receives a no match letter from any federal or State agency that an employer must notify the employee. This bill provides an employee with 30 days of unpaid leave to allow the employees to correct any discrepancies with the agency's record. The bill further prevents an employer from basing employment decision on correcting the discrepancies. I would also like to add that this particular language has been in effect for the last five years in over 80 health care facilities across the State of Illinois with collective bargaining agreements. And also, these rights are only activated if an employer takes adverse action towards the affected employee. I urge an Aye vote.

Thank you so much, Madam President. Senate Bill 1710 as amended, provides that any responsible entity of any publicly owned bike trail is required to erect permanent signage alerting pedestrians and cyclists of vehicle crossings at least 150ft before the crossing. The bill also requires that the responsible entity erect temporary signage, alerting pedestrians and cyclists of damage to the trail, maintenance being performed, or other temporary hazards along the trail. This is legislation that is directly in response to cyclist fatalities that we've seen over the last couple of years, which are on the increase. What really motivated this legislation for me was when a famous German architect was actually killed two years ago -- on a road that just simply lacked proper signage. So, I think that this will be really a good step in the right direction for cyclists who need to be able to know that there's a vehicle crossing, but also for those that are motorists who will want to know that there is a bike trail coming up so that they can yield and give the cyclists a chance to yield and cross -- cross the road intersection. So that is -- that is the legislation before us. And I wanted to also point out that for the record, it is not the intention of this legislation to create any new exposure to liability on the part of those responsible for maintenance. It is simply to clarify that if they become aware of a trail condition that is dangerous for users, they will take reasonable steps to alert users. And so, I know of no known opposition at this time, and I would take any questions and respectfully request an Aye vote. Thank you, Madam President.

So, this legislation would apply to any entity that owns a bike trail in Illinois. So that could be IDOT. It could also be - - IDNR. It could also be forest preserve districts as well.

What is the anticipated cost of doing this and have those funds already been allocated?

The cost would depend on the number of signs that are -- that are needed to actually be erected. The number of signs are already up. So that's the good thing. We explored potential funding sources, and we know that ITEP would be a good source for a number of these signs.

Okay. So, I'm just a little confused then. We're requiring the signs to be put up. They either have to put the signs up at their expense or they have to find someone else to put them up.

I thank the Senator for the question. When we worked on the legislation, IDOT and IDNR did not bring it up as a concern. But I think the consensus was that the signs would be relatively inexpensive and that ITEP grants and a number of -- of grants from the federal government would easily cover the cost of signage that would save lives.

So, what if the signs come down then -- sign is not there. Someone stole the sign. I'm only saying that because we have a road called Marlboro Road and that sign keeps disappearing. What happens if the sign disappears? Who's liable?

So -- so again, the -- the spirit of this legislation is encouraged that Park districts and localities to do what they probably already want to do. If, you know, we have instances where signs are stolen or fall down, I would expect that those jurisdictions would -- would repair them just like they do all other road and trail maintenance. And so, that would be my response.

So, a part of this confusion is as a result of the FDA legislation that the State cannot change. We're just adopting what the FDA says.

I think, and this is where part of the concern is, that we have to follow the rules, which is why the purpose of the legislation. But -- but the -- the concern is if an individual doesn't get tested, they may be purchasing one of these units and then finding out it doesn't solve the problem, then go in and get tested, find out that they need a higher level and they've wasted a lot of money buying a lower-level megahertz or Hertz guideline without having been tested. So, I -- I hope they put some warnings on those or somewhere to help explain -- explain the difference, because it can be confusing for, I'm sure, many seniors trying to figure out what's acceptable, what can be purchased at the store versus what is not purchased at the store that you have to go through and get a prescription for is going to be, I think, very confusing for people to get through. But again, this legislation is -- is -- is -- is fixing federal law. So, we have to do it. But again, I think it's going to raise some concerns for -- for seniors. So, thank you. It provides that if a minor is engaged in the work of vlogging with a private right of action to ensure that the Vlogger reports the required documentation to the Department of Labor. The amendment decreases the required percentage of compensation that must take place in the trust fund for the benefit of the minor. The prevailing minor must be awarded actual damages, punitive damages and costs of these actions. And the amendment clarifies that this Section only applies to vloggers minors engaged in the work of blogging and the Department of Labor, and it has an effective date of January 1st, 2024. The reason this is an important bill is that this becomes precedent setting. No other state in the -- the United States has voted on this, so we would be the first. But it came to my attention by a young woman who is 15 years old from University High School in Normal. She presented her idea to both myself and to Senator Linda Holmes. And I want to thank Senator Holmes for being a co-sponsor of this. But it talks about what happens with children when their parents use them for monetizing their video activities, whatever it might be. So, this takes place if parents seek to monetize the videos that are 103 STATE OF ILLINOIS 103rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day 3/29/2023 produced by their children. And it says very simply that if a child is used in a video for this monetized purpose, over 30% of the video, then there has to be a trust fund set up for 15% of those monies that have received by that video in a trust fund. The beauty of this bill, and I think this is where the importance is of it being precedent setting, is that even though the Department of Labor becomes a place where the parents have to file the information that they have done, what's required in this bill, the State does not -- the enforcer of this. What this does is it sets up a pool of information so that the child, once they turn 18, if they feel like they've been abused and that their parents have -- have used them to generate money for -- for themselves, they have a right of action. They can sue. They can have damages and legal fees paid for. I think this is a good bill and I'd be happy to answer any questions.

And any time they're in an industry like this, especially where you can raise an awful lot of money at a very young age before you're legally old enough to technically be out there working. So, it's up to your parents to protect you.
