The University of Illinois men's and women's wheelchair basketball teams are in Springfield today to celebrate their respective and impressive third place finishes at the 2026 Intercollegiate Wheelchair Basketball National Championship in Tucson, Arizona. Let's give them a round of applause. Thank you. Something many of my colleagues may not know about the University of Illinois is that our campus is widely recognized as the birthplace of -- collegiate wheelchair basketball, playing an essential role in the development of the National Wheelchair Basketball Association. Because of this, it's no surprise that our men's and women's wheelchair basketball teams demonstrated the full potential of the program's 77-year history of leadership and innovation in sports at the 2026 NWBA National Championships. The men -- the men's wheelchair basketball team, led by -- Head Coach Jacob Tyree, completed their 2025-2026 season finishing a -- finishing strong with an outstanding Final Four run. Pretty impressive. It isn't very often that the community has even one great basketball team to rally behind, but somehow, the '25-'26 year offered Champaign-Urbana and the State of Illinois 3 dedicated, driven, passionate basketball teams who all finished in the top 4 of their respective tournaments. To say I'm proud of the University of Illinois student's athletes is an understatement at best. I'd like to give special recognition to the University Division of Disability Resources and Educational Services for their constant support to ensure students with disabilities are afforded equal opportunity on the University of Illinois campus. I'd also like to highlight Mollie and Jameson's parents, Scott and Mia, up in the gallery. I'll introduce Mollie first. Mollie is a sixth grader at Maryville Christian School. She's involved in drama, choir, cross-country, track, and basketball. She likes singing with Tessitura Music. When she gets older, Mollie wants to be a missionary, a Bible or history teacher, or a financial advisor like her parents. Mollie, Mollie's been… We -- we just had lunch in the cafeteria; she's been up here for a while. Her -- her parents arranged this through some -- some stuff we were doing at Maryville Christian School. But I was picking Mollie's brain. She's helped me out. I have twin boys back home, and she was giving me advice on how to manage them and, and how to take them through the education system. Her -- her brother, Jameson, and I need -- I need everyone from Chicago to stay calm because he's going to play for the Cardinals when he gets older, but -- but Jameson is also, of course, a sixth grader at Maryville Christian School. He's involved in basketball, baseball, cross-country, and track. Thank you, Mr. President and Ladies and Gentlemen of the Senate. I rise to honor the life and legacy of an amazing man, husband, father, and community member, -- Orlando Rivas. For the past year, Orlando Rivas worked as the after-school security person at Buffalo Grove High School, his dream retirement job, after 25 years as a Chicago Parole Officer, in a school as large and diverse as Buffalo Grove High School, it is incredibly rare to find someone who can connect with every student, but that was Orlando's gift. In less than a year, he built meaningful relationships across our entire community. He had a gift of making students feel seen, heard, valued, and cared for, no matter who they were or where they came from. His impact in such a short amount of time was extraordinary. On April 21st, Orlando showed us the true meaning of selflessness and courage. In a split second, while helping students cross the street, he shielded them from danger, putting their, putting their lives before his own. While saving them, he sustained injuries that ended his own e --ended in his own death. His actions were instinctive, a reflection of how he lived every single day, putting others first. Even now, after his passing, Orlando continues to give. As an organ donor, he is saving lives, a final, powerful testament to his generosity and the way he always showed up for others. Orlando Rivas will be forever missed by the Buffalo Grove High School community and Buffalo Grove residents, but his legacy of connection, courage, and selflessness will live on in all of us. And I want to thank the administrators at the Buffalo Grove High School and Buffalo Grove Police Chief, Brian Budds for stepping up. Orlando Rivas was an amazing man, and he should be honored in this way. Thank you, Mr. President. I'd like to continue on to the memoriam of Orlando Rivas, and apologies that this will be a -- a little difficult as the Rivas family is are -- are very close friends. They're -- they're that family that you get to choose along the way in life. You have the family that you're born with, but you're ever so lucky to meet some amazing people that become very close. Orlando was an amazing individual, he was a loving son, father, brother, an absolute joy to be around. His father, Roy Rivas Sr. is someone that I hold very dear in my heart. And when I began to -- to have golf outings I knew that Roy enjoyed to golf. He's retired, and I was like, "Hey, you should, you know, bring -- bring the boys, bring your sons. Boys -- they're grown men, older than I am. But Junior and Orlando, like, let's -- you know, and they would come every year and have an amazing time. And the great thing about Orlando, even if you spent even a little bit of time with him, he had this I -- I can had -- just picture him now, this amazing smile, one of those smiles that, like, was diffusing for folks because you know instantly that that person had a, an amazing heart and a good soul. Sort of a life of a party, someone who, laughter would fill up a room, and you would have to -- it was -- it was -- it was something that, you know, would -- would have others -- also, in laughter as well, and in joy. His - - he lived a very selfless life of serving and helping others, even to the last moment. To extend condolences and trying to 12 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 remind a family that their son died a hero, it's difficult to accept when what they -- he was always a hero, but they would love to have him back. And so, I -- I ask for a moment of silence, and I -- and I -- I thank the Body for taking this -- this time for a great individual. We will miss you.

Thank you, Mr. President. Senate Bill 2772 creates the (Illinois) Psilocybin Advisory Board (Act). This would establish a 15-member board of stakeholders and experts, with, 15 of them voting and 24 non-voting Members, to evaluate the medical and psychological uses of psilocybin. It requires that the board study the existing laws and framework, regulatory framework in other states, as well as the federal government, to best identify the safety standards and evidence-based recommendations for future policy guidance here in our State. It would charge the board with reviewing scientific research on the safety and effectiveness of psilocybin for treating health conditions such as treatment- resistant depression, PTSD, substance use disorder, and other complex mental health challenges. Psilocybin has been deemed a breakthrough therapy for PTSD, especially for individuals, like veterans and first responders, to help heal their PTSD because of the neuroplasticity of the medicine, as well as the ongoing integration and therapy. Two states currently have this legalization through a healing facility, we're looking at what that might look like for our State. Several other states have filed 29 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 legislation or provided funding for ongoing clinical services. Even the federal government is looking to roll back some of the regulations on this in order to have, more access to this. Supporting this bill allows Illinois to lead with evidence, oversight, and -- innovation in addressing a complex mental health challenges. And with that, I'll open up to questions.

However, as we discussed, this bill is much broader than just psilocybin task force, it also explores other synthetic psychotropic drugs and the like. These -- these treatments have shown incredible efficacy to save lives, so having the professionals around the table to create the -- create the -- the right framework so that Illinois can be a national leader in this space is very exciting. So, I -- I support this bill and would urge an Aye vote.

Just last month, President Trump signed an Executive Order expanding research and access to promising treatments like Ibogaine. And for those of you who are unfamiliar with that, I seriously suggest looking into it cause it addresses also serious mental illnesses. And the national momentum, whether you're red or whether you're blue, shows that we're moving in the right direction by putting the care of our first responders and veterans above politics. I don't believe this is a partisan issue. I think the men and the 31 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 women who protect and serve our communities, whether that's police officers, firefighters, and veterans, deserve effective and safe tools, and -- and we can provide that to help them heal from the invisible wounds that they carry, that being PTSD, severe depression, and anxiety. These illnesses don't discriminate by party, badge, or uniform. So, I ask for an Aye vote. This is something that at our national level, regardless of the -- or the discussions that we have problems with and -- and the divide that we have in the way we talk to one another today, heck, if it's signed by the President, this should be something that's simple to get behind here, as well. So, I urge an Aye vote, Mr. President, thank you very much.

To that point, I am asking for my colleagues on the other side of the aisle to support this. Not only has our President indicated some support for this, but other states have looked at this. The reason I have worked so diligently with the other side of the aisle is because this impacts your constituents, too. The bill, the third amendment changes the other endogens to just evaluate it. So, when Senator Hastings talked about Ibogaine, for example, that is one of the endogens that we would like the State to just look at. There is no recommendation for it. There is no additional language to say anything to look at what the -- what the States and the federal government is doing. The rest of the bill all focuses on psilocybin. And so, I would ask for us, I -- I think it would be in short order if we did not watch what our federal government is doing and these states are doing. But we know the effectiveness of psilocybin, and that is what this advisory board is really tasked with. So, while it might be feelings that, oh, it's broader than that, it really is not. And I filed that third amendment to show that to you guys, that this is something I hope you all can vote for because people's lives literally are depending on it. I ask for an Aye vote.

Many people may not be aware that the terms of that sale can really greatly differ from 34 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 physical goods. Consumers may have a license to access the digital good, to the terms of service that the seller can change at will. What this bill is tries to improve, transparency in the process and requires sellers to meet several disclosure requirements, and includes a list of all the terms and conditions of the license to use that digital good, including circumstances under which the license may be revoked, and notes that the license may be for a digital good that is modified from its original version. We worked with all the stakeholders, involved in this process, we addressed their concerns. I'm not aware of any opposition and ask for an Aye vote.

Mr. President, this is an initiative of the Illinois Municipal Retirement Fund. It really does two things. The first thing it does is really enhance standard, proactive, good governance measure to ensure the fund operates at the highest level of integrity, and it does that by preventing anybody who's earned service credit as an IMRF employee from serving on the IMRF Board And then the second thing it does is actually loosen up a bit of the requirements, and it amends the IMRF article of the Illinois Pension Code to provide a technical change. Today, a retiree who 36 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 must sever employment with all IMRF employers, before they're able to draw an annuity, and IMRF felt this was too restrictive for employees seeking to allow employment in an area that's not part of the original job. And so that backs off that requirement and allows a bit more flexibility. So, for example, if a person retires from one job and wants to start part-time, they have that option as opposed to waiting for that severance to occur across the board.

Thank you, Mr. President. Senate Bill 2891 does 3 things. First, requires animal shelters to register and document microchips in their adopted animals. Second, requires them to 39 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 disclose to potential, adopting families any violent behavior or other incidents that they are aware about the dog, including whether or not the dog has been deemed dangerous under the Animal Control Act. And then lastly, it prohibits agencies from adopting out any dogs that have been deemed vicious under the Animal Control Act. There was some initial opposition, but this amendment we just adopted does remove that opposition. I really do want to thank both the animal control agencies and the animal welfare -- welfare organizations for coming to agreement on this bill. And so, the new family would get that microchip information, and I think presumably would be able to then use that in case the -- the dog ever gets lost while it's in their care and custody. So that, that information will continue with the new adopted family.

Senate Bill 939, an Act concerning education. 3rd Reading of the bill.

Thank you, Mr. President. So, this is a bill that came about two years ago when, Ashley Peden went to a school board meeting in Christian County to talk about what happened to her daughter. And 44 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 Ashley herself is a teacher. And I became aware of what happened to her daughter after seeing social media posts and seeing video from the school board meeting. And I met with Ashley and her daughter, and I met with Chad, who is Ashley's husband, and obviously the -- the father of the daughter. And I was told what happened. And essentially, over the course of a week, her little girl, was attacked in a sexual manner by a much older boy. She's a 10-year-old. She was attacked over the course of a week by a 14- year-old. Nothing happened at the school. That was never told to the parents what was happening. And when she got off the bus on Friday, she was raped. So, police were called, the boy was charged in juvenile court with rape, and that process, of course, takes time. Meanwhile, even though the 14-year-old admitted what he did, he was still allowed to go to school with the 10-year-old. And the family had to go to court to get an Order of Protection against the 14-year-old boy to keep him away from their daughter at school. Eventually, the school could no longer comply with the Order of Protection, and so they -- they had to expel him for that reason. Now, Ashley, Chad, and myself went through our laws and discovered that if you bring brass knuckles to school, and you have the intent to use the brass knuckles at school, and if you don't use the brass knuckles at school, you are expelled for at least one year. But if you sexually assault another student in a school bathroom, there is no automatic expulsion or suspension. Now, after I filed this bill, it got a lot of publicity, and then I was introduced to someone from Senator Tracy's district. And I'm only gonna talk about cases I'm allowed to talk, but we've gotten permission from the families. I'm not gonna say the names in that, in that case, but their very young daughter was raped on a school bus, got an 45 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 STD. So, there's no question what happened. Much older student not suspended or expelled a single day. The daughter, as part of a school safety plan, was forced to change her schedule, change her lunch hour. She eventually had to go to private school on the family's dime because of how painful it was and how terrible it was for her to be at school on a lunch hour that didn't have her friends anymore, in classes she didn't wanna be in, all because she was raped on a school bus. And then I was introduced to Jessica Johnson and Amaya Blair. And we had a press conference, and both Jessica and Amaya were there. And it's one of the most powerful videos that you can see because Jessica, who's Amaya's mom, was standing with her, and you could see -- you could see the pain. So, at Amaya's school, there were, there was a student walkout that was organized, and it was to protest sexual harassment and a sexual assault that took place at the school. And the students felt that it was not appropriate to allow the student to continue going to school based upon what had happened at the school. After that walkout, months later, Amaya was raped in a classroom by another student, and 16 years old. And I just would like to say to both Amaya and Jessica, thank you to them for speaking out because it's very difficult. But in that situation, the student who attacked Amaya was not suspended or expelled a single day. And so most schools do the right thing here, but in a lot of cases that I continue hearing about, the school is not doing the right thing, and that is why this bill is necessary. And I was giving a talk to students on this -- on this Floor a few weeks ago, and afterwards, a male student came up to me, because I talk about my bills and what's important to me and what I'm trying to do, and he said, "Thank you for this bill". And he -- he described a situation that 46 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 happened in his school district. And it's a continuing thing right now, and we get people calling our office, and they meet with us, and I'll -- if I need to get into some other stories, I will. But, this bill is -- is really important, and it's going to, it's gonna be needed, and it's going to help survivors of sexual violence, who are having a hard time as it is after one of these situations, let alone having to go to school and see the person who did that to you right there all the time. And so that's why this bill has been filed. And, essentially what the bill does is if a student sexually assaults or attempts to sexually assault another student at school or at an event related to school, they're expelled for at least a year. And if they commit nonconsensual sexual conduct, they're expelled for at least six months. And both of the definitions for a sexual assault and sexual conduct are already in our Criminal Code, so we're not reinventing the wheel here. And the expulsion process is also already in our laws, and that would that's what would be utilized. So, with that being said, I would like to thank colleagues on both sides of the aisle for the discussions that have taken place over the past two years. This bill has changed significantly, and I would be happy to take any questions.

And my situation in my district happened a few years prior to the situation in Christian County. My constituent was four years old -- four years old in the back of a school bus, harmed, sexually assaulted by a 14-year-old. And this bill gives the school boards, the school districts, all the school administrators, the direction and the tools they need to address these situations. My four-year-old constituent, she got an Invest in Kids scholarship, and her parents spent a lot of money in court for protections of -- of court - orders of protection, to go to a private school that was completely unfamiliar with her, to her, and then she, went to that school till eighth grade, and then she was homeschooled because she was so traumatized by the whole thing. Because in a small town, everybody knows everyone, and she never felt safe or comfortable going to the public school after that. She's doing well now, but we need to protect our children, and -- and we need to help our school boards and, and school administrators, as I say, have the tools, have the direction. Now, the perpetrator will have education. There are alternative schools, and most importantly, they will get the counseling they need in these alternative schools. They will perhaps learn how evil their behavior was. And I'm just grateful that we've gotten this forward and that we can protect more children. The student from Flossmoor that was here, she is still traumatized, and it's been years since it happened. And so any, it -- it just to see your perpetrator in school regularly is just continuing the trauma. So, I appreciate the efforts, and I certainly hope you all can support this very important bill, and I urge an Aye vote. Sure. So, the bill outlines you have to comply with Title IX 51 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 and that is a whole process where there are lots of protections for anyone accused of doing anything. It's a federal law. And also, you have to go through the normal the expulsion process laid out under the gross disobedience or misconduct part of our law. And you also, it has to -- has to -- you have to comply with the Americans with Disabilities Act. And all three of those entail quite a bit of protections for anyone accused of doing anything.

Does the bill do anything to ensure that disciplinary hearings are conducted by officers who have received appropriate training to appropriately and fairly apply the legal standards for mandatory expulsion provided under SB 9-3-9?

As I said, you just go through the normal expulsion process under gross disobedience or misconduct that's already in our laws right now. So, this isn't changing anything.

At what time in the process does the parent or the guardian of the child get brought into the school to be notified that their child has been accused or has been stated that there has been an -- an accusation of an incident happening to them?

Again, that's part of the process. There has to be a hearing, and the parents or guardian have to be present, and the school board has to outline what the accusations are, what the evidence is, and they have the ability to appoint someone to investigate it. That's all outlined in this current law.

What happens after the year of expulsion, and if the child is expelled versus going to an alternative school like Senator Tracy and Preston spoke earlier about during that expulsion, what kind of services are given to that child?

Well, first of all, if a student is expelled, they can still, under this law, they can still go to an alternative school. So, it's not, you asked if they're -- they're expelled or go to an alternative school. Those things can happen at the same time. What services each alternative learning center has is probably specific to those learning centers, but I think from the -- from the ones I visit in my district, like a safe school I was just at in Effingham, they have a lot of resources and tools to try to help students that are having behavior issues to try to give them the services and support they need to correct the behavior.

You heard the sponsor say that school districts already have the ability to expel students for a year. You heard the student - - you heard the sponsor talk about the age of the student. You also heard that there's a process in place that needs to be followed. If your child- many of you on this Floor have children- were accused by someone, if a student said, "So and so did this to me," at what point exactly does the teacher go and ask the student that was accused? What if that was your child? What if that was your child that was accused? The due process: how are we protecting our children? What happens with this child at the end of that year? They come back to the school year. They come back to the school district, and they've been out of school for a year. What we know about people who abuse is that they've been abused. What happens to that child we're sending him home? We may send them to an alternative placement. It's not a requirement. Right now, schools are allowed to expel students. There's no need to continue to -- to find punitive ways to attack our -- our -- our children. Instead, let's take the cases, case by case. There is no need for this bill. That's a very great question. So, the way the bill's laid out is it's a year or six months. However, language has been put in there that says that the hearing officer, superintendent, and board shall consider whether the student was unable to understand the nature of the student's conduct because of age or because of disability. And in those situations, they have discretion to, if they choose to, modify the expulsion. Senator McClure, I served on a school board of one of the largest school districts in the, in the State, for four years, and I'm obviously a sponsor of this bill, but because this bill could be construed as controversial or may lead to litigation, I think it's important that we run down a line of questioning here that maybe in the event of litigation occurring, they can reflect back on the discussions we had in this chamber and -- and understand the full understanding of what you're trying to do. I'm going to go to page 12, paragraph 5. Not to get overly 56 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 in-depth here, but this bill imposes a requirement for a one-year minimum, but it immediately allows the superintendent and then the school board to override this on a case-by-case basis. Why does it include a mandatory minimum and then go ahead and further allow for an override to be built in subsequent to an allegation?

Because if you look at the weapons statute involved, that I talked about a little bit earlier, if you're caught with a firearm or if you're caught with brass knuckles, you're expelled for a year. That language has been worked in for it to be something that can be changed on a case-by-case basis. The reason for that is to make sure that it would withstand any lawsuits any -- any federal lawsuits. And so, it was changed to -- to, and it's actually more generous in this than it -- is in the weapons statute, to comply with what some advocates asked for.

Thank you. And so, what specific criteria, standards, or guidelines must the superintendent use when deciding to modify the one-year expulsion?

That would be in their discretion, and emphasizing it's a case-by-case basis. You know, some people have presented some pretty wild scenarios to me, and they've asked just to be able to 57 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 modify if, you know, an alien ship strikes at the same time, and this, that. So, I think that's needed for that reason. The only thing that the board has to consider when deciding whether to modify the expulsion is they have to take into consideration the age, if the child was not old enough to understand what they were doing, and they have to take into consideration whether or not the -- the perpetrator has a disability, and because of that disability, they couldn't understand what they were doing. So those are two things that they have to consider if they're looking into modifying an expulsion.

Senator, is there any process in here for how victims and their families will be involved in the override process outside of attending a school board meeting?

Well, as I said, the bill says that you've got to be in compliance with Title IX, and Title IX involves the victims, their families. It's a whole process that's, as I said, established by federal law. And in addition to that, I would just suggest that the normal expulsion process, if there's anything in the law that would provide aid to either side, that's untouched. Those, those would still be present if this law gets triggered.

Is there anything in this bill that prevents any favoritism, say, towards the star athlete, towards the -- the -- I don't know, the spelling bee champion, whatever that may be? Is there anything in that bill that prevents, or policies that the school board must take in order to provide the -- the oversight on the superintendent for the recommendation of an expulsion or a modification of expulsion?
PRESIDING OFFICER: (SENATOR AQUINO) Senator McClure.
Good. That's a good question. It -- it, I mean, the, we -- we would make the assumption here that, this should be unbiased, and I think the modifications by the superintendent and the school board, voters can make a decision if they felt that something bad happened because of their decision. They can then take that into consideration. So, there is accountability there, but other than just the letter of the law as it stands, I don't address bias in the bill. But obviously, the intention here is that every student is treated the same, and both -- anybody accused and any victims, we have to be fair to both sides, and the process should not be biased in any way, and that's certainly the intention of the bill.

Mr. President, I have a few more questions. Whether it's via an appeal, new evidence, or a Title IX process, or in the event that it's tried in a criminal court and it's found that the person's not guilty of the crime.

Well, the criminal court is separate from whatever the school does, and that's a much higher burden, obviously, beyond a reasonable doubt. So that's, those two things are unrelated. You can be found not guilty, but still, more likely than not that you did something based upon the evidence. So that's, those two things are unrelated and separate. Whatever the process is currently in place for students who get expelled, if something is found to be inaccurate, and it's revoked, and they're come back -- coming back to school, whatever the current process is, Senator Hastings, that would be the same process followed here because this is a normal expulsion under -- under the -- the statute as it currently exists.

Again, that's laid out under the already existing expulsion. You've got to have a hearing. You've got to notify the parents of the accused. You've got to lay out what the evidence is there. You've got to provide a statement as to this is what we did, this is why we did it, and here's our level of reasoning. You've got to give them a chance to respond to that, and then as I said, the superintendent and the school board can then oversee that, yet again, on a case-by-case basis.

I -- I stand in support of this bill, Senator. I just wanna make sure that we go through these -- these -- this line of questioning. It's -- it's essential to do that because this recording will be reflected on in the event that this occurs in another school as to what the intent of this law is. So, I appreciate your diligence in answering that question. I will say that if you look at the -- the lineage of, of how, whether it's, brass knuckles, a billy club, your language is consistent with that. But I do find is also consistent is that there is an 61 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 opportunity on a case-by-case basis for a superintendent, that being a check and balance to whatever -- whoever the person bringing the case forward is, and then there's another check, that being the school board, to determine whether or not that superintendent has made the right decision or right recommendation for a mandatory minimum expulsion. So, I appreciate you adding that language in there. I do have some concerns, though. This is a serious allegation. It's an extremely serious allegation here, and when I asked the question about evidentiary standards, you reflected back to what is the existing -- what's in the existing law, and the existing law is process. It's a process. It's not standards by evidence to which courts adhere to. It's not. It's and -- and the -- the trier of fact in, is -- is generally a school board or members of the school board reviewing the case-by-case basis. So, that does bring me some pause, but I also think that you also have -- you have two different lanes you can -- you can -- you can look into, or you -- you can investigate or have, one being the criminal process, one being the school process at the same time. And both, through those processes, I'm sure, is an expansive investigatory process. But what I what I will say is this, is that sexual assault, any sexual assault, any violence whatsoever, in school shouldn't be tolerated. And serving on a school board for 4 years, and seeing some of the best entrepreneurs, but they were drug dealers in the wrong line of work, you know -- you know, they needed an alternative school. This is a totally separate subject, and it's just inappropriate. So, I thank you very much for bringing the bill, and I urge an Aye vote.

First, sexual assault is not okay. Violence in our schools is not okay. The situations that have happened in Senator McClure's and Senator Tracy's districts are horrible. In those cases, though, the school board could have expelled the children in that situation. The school board chose not to act. My concern with the bill is that by mandating school boards automatically expel students, not because of the situation, but because of fear of not following a State mandate. Rape and attempted rape, they may be more clear; there may be evidence. But there's a lot of aspects that could be very nuanced. For example, two seniors are at prom. They have consensual sex. One of the seniors goes home, and their parents find out. The parents now go to the school board and demand that the other consensual participant be expelled. Under this law, they should be expelled automatically. Another example, a child who does not know better has been abused by someone in their home, repeats that behavior in the school. Now, automatically expelled, to go home to their abuser, and no longer have a teacher or an adult at that school who can do the Title IX reporting and help that child. These are some of those nuances, on top of the fact that people could be falsely accused. We would want our local school board members to be able to evaluate those accusations and those nuances on a case-by-case basis, and not feel fear or 63 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 compelled to automatically expel simply because of our State laws, especially if they don't have an ability to send to an alternative school, or treatment, or protections of victims who may also be experiencing that abuse at home. And unlike a possession of a weapon, like brass knuckles, where there is no nuance- you either have it or you don't; there is clear evidence; there is not always clear evidence of two children who are giving testimony with no witnesses and no evidence. We need our locally controlled schools to be able to make decisions for their students and not feel railroaded by the State. If this bill mandates investigation or response, especially focusing on help and treatment for all involved, I would be a Yes on this bill. But to automatically expel and remove local control, I unfortunately need to be a no, as we would not want children who are falsely accused expelled, or victims themselves not receive the help that they need. Thank you. First of all, I do appreciate the discussion, the passion on both sides on this issue. I do have to correct one statement that was just made. All activity that's applicable under this section is non-consensual, and that's, that is overwhelmingly clear. So, if it's a situation where there's a prom and two kids have consensual sex with each other, this, that does not trigger this. So, I think that's important to say. I also there was a very good article in the Chicago Tribune about this bill and they do emphasize that everything has to comply with Title IX requirements, which have been narrowed, according to the Tribune, during this current administration, to provide more protections to the 64 STATE OF ILLINOIS 104th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 100th Legislative Day 5/7/2026 accused. And Title IX has to be complied with, as a part of this bill. But another thing that was talked about in the Tribune article, which I hadn't heard of, is that there was a, a series called Betrayed that identified nearly 40 instances of sexual attacks at Chicago public schools between 2004 and 2018, many cases in which schools ignored red flags and didn't act appropriately. And I did, I wouldn't think this bill would be necessary. It's been said that the schools could have expelled these students. That is absolutely correct, and most schools do that. Most schools do -- do the right thing. But some schools don't, and it's a -- it's an overwhelming -- it's not an overwhelming number, excuse me, but it's enough of them to where I do think it's time for us to take action. And as I spoke about when I introduced the bill, I've had to, I've had the honor of meeting with a lot of wonderful young people who are trying to fight to change laws to protect them and their friends. And we had a- I'm not going to get into names, obviously- but we had a 15-year-old girl who came to see me with her attorney and with her mom. And when she found out that her rapist was not going to have anything done at all, she had a panic attack, and they had to call an ambulance for her. This bill is for her. This bill is for Jessica Johnson and Amaya Blair, who so bravely are willing to publicly speak out to change our laws. This is for Ashley and Chad Peden, who so bravely are willing to come out and speak of changing our laws. It's for the Illinois Coalition Against Sexual Assault, who represents victims all over this State, who have very passionately supported this -- this law, and it's for our kids in this State. I -- this legislation is lead -- it -- it has to do with lead service line -- streamlining lead service line replacement. We worked with environmental groups, trade groups, as well as our municipalities, to -- to work to streamline lead service line replacement given the dangers of lead, but also the deadlines that have been put in place to replace the large amount of hundreds of thousands of lead service lines in our State. I would ask for an Aye vote.
