Number one, they won the math contest in the State; number twog they've won the reqional, and are goin: to the Nakional Scholastic Scholarship Bowl in New Orleans a little later on. And the FHA chapter will be going to Anaheim, California: to participate in the nationals out there. And for a hiqh school that only has two hundred and twenty kids in ik, I think that is just fantastic. Wlth that, I Would like to introduce Mr. Allen Price, who's the princkpal of the hiqh pchool. and also the father of one of our pages over here, Martha Price. Where are -- Where did you get to? He entered the Australian Poreign Service kn Canberra in 1959, and then took a year's leave of absence to do a master's degree at' Stanford University. Returning home, he resumed the Foreign Service, and interspersed with time at home, he had overseas assignments in Laos, Tanzania, Thailand, Henyag Belgium. The amendment establishes State minimum wage rate increases on October lst of each of the next three years, resulting in a four dollars and fifty-five cents per hour State rate on October lstr 1991. I would oppose this amendment. I find it hard to believe that anybody would want to take this, the syphilis test, out of our current law. We find syphilis is a disease that is curable with penicillin. There are many cases that are -- of syphilis and gonorrhea that are found through these tests, prior to marriage. The disease is eminently curable. The -- there is no real expense involved. And I find it hard to believe that you'd want to remove a test like this, Where there is a cure for the disease. And many people are -- are -- many, many cases are found during premarital testing. 80th of those things are not true regardin: the AIDS test.

Senator Marovitz, if you will check with the Public Health Department, you will find that there were eleven cases found in the entire year. The Medical Society is on board with this amendment. You found twenty-eiqht cases of AIDS. What this amendment does is rewrite the 1aw in Illinois regarding energy assistance in al1 of its forms - IHEAP, IRAPP, assistance for people on Public Aid, assistance for people that are not on Public Aid buk do qualify under the federal guidelines for a 29 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day May 16, 1989 low-income person. A11 of this is incorporated into one bill and DCCA hopefully will be the lead agency and every -- all the energy assistance will be funneled through DCCA. There is a tax ' on this bill, a computer software tax to generate enough money to pay for the energy assistance for the people that are involved in this program. I must tell you right nowy that I do want to publicly congratulate and thank Senator Maitland, on the Republican side, for the work he has done on this bill. He has shown tremendous diligence and worked very hard with others on the Task Porce to make some kind of a bill in this General Assembly . This, I1m not saying is the final product, and I don't think Senator Maitland thinks this is the final product, but we wanted to move the bill forward and get things on the road. Thank you, Mr. President. Amendment No. l deletes everything in the bill, and substitutes thls language. It permlts the Winnebago County Board to permit the Winnebago County Nursing Home to admit a number of residents, equal to no more than twenty-five percent of its licensed capacity -- a number of private pay residents. It disallows the Winnebago County Nursing Home from transferring or discharging current residents, whose care is reimbursed by public aid or social security solely for khe purpose of admitting a private pay person. This was requested by the Winnebago County Board. Theydre more than a million dollars in debt. And it's one way that they hope to alleviate some of their financial problems.

And an agreement Was entered requiring the county to admit public aid patients prior to admittkng private pay patients. And according to that court order, the entry of this decree shall in no respect prevent the county board or the County of Winnebago from modifying or amending without leave of the courte the admission policies of the nursinq home when so required or authorized by changes in the law. And otherwise they -- they asked us Eo go back, you know, ko the LegislaEuree and change the law if they wanted to overturn that decree.

And -- and 1et me just say, from the outset, that we are still working on this amendment -- mean on ehis bill, but I'd like to move the bill to 3rd Reading, and at the appropriate time, I will move it back. But what this amendment does, it extends the prison industry to -- it allows them to sell some of Eheir goods on the open market. It establish some guidelines for doing that, to ensure that it does not enter into unfalr competitlon wlth the private sector. It also expands the prison industry's authority to enter into joànt ventures with private enterprise. And I would move for its adoption.

Senate Bill 13 is similar to a bill that we passed in the Senate last year, and the House, in its lack of wisdom, failed to pass it on 3rd Reading. This is a 1aw and order bill, and what it does is to allow a full-time attorney in the employ of a company, who is fired because he fails eo break the lak, to have a cause of action for his discharqe. The -- Illinois State -- the President of the Illinois State Bar Association has endorsed this bill. The language is in keeping with one of the subcommittees of the Chicago Bar Association in the in the formulation of this. We have tried to address such concerns as -- attorney/client privilege -- and we 've addressed that through a -- provision regarding discussions in chambers, rather that on the floor of the courtroom, and there's a high burden of clear and convineing evidence that is built into this. As I understand this, this would protect a lawyer in a situation where he was ordered by his employer to do something illegal, refused to, and tben fired for refusing to break the law.

It -- it doesn't protect him, it gives it allows him to sue for his damages.

Yeah. The reason for the bill is khat there was a case in Illinois. Called -- called -- no, it's not hypothetieal; it's an actual case Herpster versus North American Life Insurance Conpany, and the courts made a terrible decision, and We want to correct

What it does is include homeless youth and youth emergency shelters under the Child Care Act. The Director of the Department and many other social service agencies have been working on this serious problem in the State of Illinois as relate to our runaway youth and teenage homeless youth in the State of Illinois. And by placing this amendment in Ehe Chlld Care Act. 1* glves the Director the discretion of setting up the demonstration product -- the demonstration home for these homeless teenaqe youth in the State of Illinois. The runaway situation, Senatory has been a dilemma for laW enforcement and parents and everybody else because, essenkially, over the course of the last decadey because of some federal requirements and everything else, 1aw enforcement and parents have been unable to do anything other than to sort of hold the runaway for a few hours and try and urge them to go back home or into a proqram. And there are some -- crisis intervention services that are offered noW to them. What will khis bill do to the runaway in a practical situation that the erisis intervention people do no* currently do?

Well, one of the things the blll would do is set up a temporary shelter to deal w1th: not only the runaways, Senator, runaway youth - you got different categories. You :ot the runaway youth khat may be just a temporary runaway for one day. You have runaway youth that's been on the street for maybe three or four months. Then you got that hard core youth that's out there. And what this bill would do is give *he Department of Children and Family Services the dtscretion of setting up a teen-age shelter that would network with other agencies to atkempt ko :ee those youngsters back to their original home. We -- We looked at this this problem, not only here, but we Went to Qalifornia, Los Angeles, San Diego: and looked at some of the types of homes that they have in tryin: to deal with the homeless youkh. And you can't mix them with the adults. And ehen you can't mix some hard core youngsters With the first-tine runaways. So this bill is designed to -- for the Department to set the home up, to network with other social service agencies, and attempt to get those children back to their original home.

But there's nothinq in -- in the bill that would allow DCFS or the these pilot projects ko - I don't want to choose a poor word, but coerce or force these people. It would just be an opportunity that would be offered?

And I notice in Section 10-6, harboring a runaway, it's got: Any person, other than an agency or association providing crisis intervention services as defined in the Juvenile Court Act, or an operaeor of a youth emergency shelter, as defined in the l05 STATE 0F TLLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 3:th Legkslatkve Day May l6: 1989 Child Care Act, who, without knowledge or consent of the parents -- minor's parents or quardian knowingly gives shelter, to a minorr and so on and so forth: is going to be guilty of a Class A misdemeanor. Now, what you rre saying that these shelkers do not necessarily have to notify the 1aw enforcemenk or parents? Is that the idea?

No. That is not what Ilm -- I'm saying. When I mentioned runaway youth, that is just part of the problem. We have -- this legislation is designed to deal with khe homeless youth, the homeless teenagers. And in some instances you do get that runaway youkh for the first time. And currently, right now, someone were to take them into custody, they could be -- they could run into problems themselves. What this legislation is desiqned to do is give the the Department the discretion of setting up demonstration projects in the State of Illinois, where in if they did get a runaway youth, they would noE be in violation of ehe law .

As everyone knows, I think, the Constitution of Illinois requires that Governor and Lieutenant Governor run as a team in the general election, and then provides that the General Assembly may: if it chooses, provide for joint nomination. I don't think I have to remind some Members here of a rather unfortunate thinq that happened in my party a couple of years ago. It could happen to anyone. I thlnk the main thing, though, is that the Whole idea of that office really was to be a helpmate to khe Governor, whoever the Governor might be. And I think this helps to confirm that that will, in fact, be the case. I might mention that this Body, the Senate, passed the àdentical bill last Session by a vote of 52 to 4. think there was widespread support for it then. And I believe the widespread support still exists. I would be happy to answer any questions.

If Ehey're already eligible for this medical assistance, I don't see why they should be cut off and the county would have to pick -- pick this cosk up. And this it's my understandinq it only applies to those individuals who have been previously determined to be eligible for medical assistance under the Public Aid Code. So, in fact, we would be paying it anyway. And I don't know Why We just don't afford us -- why khe State doesn't afford us the opportunity, at the local counky level, to -- to take advantaqe of that. Wedre told that by 1990 there's qoing to be some hundred and fifty-five thousand people that are going to have to comply with the Act under current salary structure of thirty-five thousand. A1l We're doing is raising that from thirty-five thousand to forty-five thousand. Wedve done this over the years. It started out at fifteen thousand. We raised it to twenky thousand, then to twenty-five. A couple of years aqor in 1983, we raised it to thirty-five. So I think that it's -- raising it to forty-five is proper now . SENATOR WATSONI Well there's, right now, some hundred and eighteen thousand employees that are employed by those levels of government that are required to file. They -- as I mentioned in my openin: remarks, that's going to be raised to some hundred and fifty-five thousand by 1990, if this bill âsn't adopted.

Mr. President, think we should really look very carefully at whak we're asked to do here this afternoon. When the Ethics Legislation was originally passed, afker mueh heated debatey it was ko be inclusive. And if you recall that when we al1 run for our eleetions, many of our ethic statements are thoroughly analyzed: and rightfully so. Now we're coming up with an exclusion for State employees, units of local government and school districts: saying if you make over thirty-five thousand, we -- you won't have Eo file anymore. Ik Will be forty-five thousand thatdll be the new threshold. I think this is a step in the wrong direction. We, as the Membership of the General Assembly included many, many years ago, of including and makin: sure that the sun shone upon a11 of us. And at thirty-five thousand dollars, I don't think it's an annual Wage that should be raised. And we dre talking about 1990, a hundred and ftfty-five thousand people having eo send in an Economic Interest Statement. I'm not sure who's qoing to sift through al1 those -- a11 that paperwork, but I just think that this is really a step in the right direction. A1l we're trying to do is keep up with -- somekhat kith inflation over the period of time since 1983 -- was the last time that this tbreshold was raised. I see no problem with it. Thank you, Mr. President. This bill is similar to Senate Bîl1 34, and Was given to me by the County Board Association. And what this -- this bill does, as amended, it requires the Department of Corrections shall reimburse the counties for each person committed to county custody at a rate of forty dollars per day for each day served over thirty days, with a maximum of -- to be eligible to -- the maximum amount per a prisoner that counties would be eligible to receive would be thirteen thousand two hundred dollars, you know. And my feeling about this legislation is that the Department of Corrections is almost making mini-prisons out of our -- out of our county jails. And I think it's probably cheaper for the counties -- for the Department of Corrections to keep prisoners here and pay this than it probably Would to build a neW prison. But I think, you know, if theydre going to demand a11 of the upgrading of the jails and all, they have to pick up part of the cost of this.

You know, it's -- it's a good idea, except tbat, very fzankly, we -- wefre not going to be able to afford a1l this. Pranklyr these are minor offensesr if they are put in county jails, and not felons. And I think we ought to quit krying to do this. And I would suggest that we vote No.

And, in effect, they were making us mini-jails, and shifting that cost on to the counties. However, I don't think that it's fair to make the State pay for someone who is simply waiting in a county jail, waiting for trial. And that's my question. Does does your bill -- someone who's waiting a hundred days in a county jail or longer, if there's a continuance that the defendant asks for -- if khae person is waiEing in *he county jakl for trial, and is -- and may never be sentenced eo khe Department of Corrections, but then receives a sentence for -- for tîme served or something, and fs slmpiy there because he is waiking Erial, I don't think the State ought to have to pay for that. The Department of Revenue has noW signed off on this bill. There was some concern abouk what was eligible and what wasn't. And I think now it's been clarified and -- and the Department of Revenue doesn't have any problem with this now.

So, they weren't allowing they Weren't allowing the sales tax exemption on -- on some of these rotary mowers. They thought maybe they Were used for other purposes other than that. And -- and it is a -- this is just clarification.

Thank you, Mr. President. Let me just briefly explain the purpose of home equity. Home equity is to provide a insurance meehanism for existing home owners, no makter whether they're white, black, yellow or green, within a certain district that had been approved by the voters wikhin their respeetive area to be part and parcel of a home equity program. And they: in turn, go to a board, and the board be given an assessment on the property. Then khe bill that we passed last year was .l0 of the assessed valuatkon would go into an insuranee pool. That pool will only be used if a person who is - and that's With the clarified language in here - makes a qualified sale on his property, and if itls below the assessed valuation that was assessed When this originally was proposed, then a triggering mechanism would pay the difference. This ls a piece of legislation that was modeled after the Oak Park ordinance: Which Was debated on this Floor extensively last year. I don't believe that there is -- there hasn't been a precinct that I know of where it's been made available, that lt's been rejected. And it's -- covers b0th black and white areas in my community, and it's been approved in both.

Thank you, Mr. President: Ladies and Genelemen of the Senate. I rise in opposition to the bill for two or three reasons. The first is sort of a philosophtc one - to say that a train station that's not quite in your township, but right across the road , is not an asset, is probably not a realiskic assessment. But that isn't really the issue, because we could argue either side. There's a practical problem of the bill. The Department of Revenue is opposed. And If11 read a little bit of it, because this is a very legitimate problem. I don't know hoW Revenue is going to do it. The Departmenk of Revenue is opposed to the legislation because would require that we track which businesses in each of the townshlps are still subject to the RTA sales tax, and whieh businesses in each of the townships are not. The Department does not have lnformation to do this. Currenkly, businesses are identified by the Department, according to county and incorporated municipality. For these businesses that are nok in an incorporated area, the Department would have no way of determining whether or not they were located in an affected township. Given the sheer volume of businesses in the the collar county area, attempting to track this information kould be alnost impossible. In addition, errors regardin: proper distribution of l27 STATC 0F ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day May l6, 1989 the monies would be possible. From a practical point of view, the bill is unworkable. From a philosophic point of view, it's up one, down one, doesn't really matter. But from a practical point of view , you basically can't do it, particularly when you have municipalities that are crossing township lines etc., which, in those collar counties, happens quite reqularly.

We were concerned about the bi-state issue in our area, and we allowed for townships to opt out by referendum if they so wished, if they don't have this service. I supported the bill in in committee so the gentleman could have the opportunity to debate it on the Floor. But now, in reality, what we're doing is, we're making a total erosion of the RTA Ack. And, unfortunately, it's -- Ilm sure that a1l of us can probably remember the fact When the RTA Was created, and Bob Blair took a defeat over in the House as a Speaker. And a couple other friends on the other side of the aisle lost, as well, in McHenry County . What wedre doing here is -- when we created the RTA, it was for the purpose of creating a unified system in a six -- l28 STATE 0F ILLINOIS 86th GENERAL ASSCMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day May l6, 1989 northeast area of -- ln the six counties of the norkheast area of the State of Illinois. And now we're having Will County being exeluded for certain townships because there are no buses, supposedly, governkng that area. The next area will be McHenry, and possibly Lake. Then you're going to have a justification as far as the elimination of some federal funding. I don't know of the -- anyone from the RTh/Metra who could really support this, because of possible loss of funds. I do know when this bill came out of committee, I heard on WBBM Radio that their RTA board is now talking about extending services to this section of Will County, and possibly McHenry. Maybe this bill had this kype of an impetus. Bu* for one, cannot support it on the Floor now' because, in fact, I personally believe it's an erosion of the RTA Act. It's going to seriously affect Ehe possible loss of federal funds. If you look at the RTA'S plan for the region, you may find that there are plans to extend servlces to some of those small townships that are now currently not receiving services. So as industry moves and jobs move to the suburban areasz and that is the trend, and it seems to be no indication that there is going to be any changes in the futurer there most certainly will be a need to expand public service - transportation service - to those particular areas. And if we stop collectin: the taxes: then there will be no possibiliky of providing for those services. You can't say that wepre going to stop collecting the taxes and then put in the service. And then after the service is inw we will now start retaxing you again. So I think it is just ill-advised at this time. And I -- I rise in opposition to the bill.

Now, I tell you, they -- probably only a feW townships will opt out. Some of those townships in mx district have contributed over the last sixteen years. Now kt's not much money . It's *wo hundred khousand dollars one of them has contributed. Qwo hundred thousand dollars. You say, Well, you know that's not much money. It's a 1ot of money to those folks in a little town -- a liktle community. And they donlt see an RTA bus. And they arenit about to see an RTA bus . And no matker what you hear, they 're still not going to see an RTA bus or a rail line or anything else. And what this legislation seeks ko do is to prohibit a new potential route, or if you would, well or sand or gravel pit from being drilled within twenty-five hundred feet of a community water supply, if that source lies within a 131 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day May l6, 1989 floodplain and is adjacent to public Waters. The EPA has Worked on this language as well. And to the best of my knowledge and ability to the -- interpret the language, it does say that it simply prohibits that -- khat drilling within twenty-five hundred feet of a community water supply. Well, thank you, Mr. President. This bill is a bill khat affects veterans of Illinois. It passed the House in the lasE Session. It was held in our Senate Rules Committee last year. It would authorize the Secretary of State to issue special license plates to veterans for use on passenger vehicles and for pick-up trucks. As you knowz we -- under the existing law: there are a number of special license plate recipients that ke grant these special plates to. Accordin: to the projections by the U.S. Veterans Admînkstration, it would probably be applicable to about 1.2 million veterans who reside in Illinois as of March the 31st of this year. And it slmply suggests that the fee schedule remains the same for the speeial plates as it is now, but it affords the veterans the opportunity to -- to have a special plate as well. And I would seek your support.

I don't think wedve come up with the exact dollars and cents fiqure and things of that sort. But, you know, shouldn't we be doing other things for veterans that are siqnificantly more important than consistently going -- coming up with these license plate bills? And I suppose, beside the cost, and -- and just because I think we have so many different veterans groups that Would like to segment the driver's license plates under a11 these circumstance, nok to mention I don't what the heck this was doing in the Public Health Committee, because We, generally speakingy don't handle the public health matters of license plates. But I would like to bring up What I think is probably *he most significant problem that we have With these varying license plates - and that is a police problem. According to the State Policey khat -- their concern is that it is a constant problem because of *he variations of these plates that we're constantly puttin: on the streetz that law enforcement officers cannot necessarily get IDs from witnesses or even they themselves have trouble in IDing these plates, because you don't know where they come from. And you 've got to have these vehicle IDs if you're going to be able to, you know, take these in court and trace down people. Two questionsy Senator Demuzio. 0ne is, have youdve -- if you dve given some consideration to makinq khis amended to make it effective in '92 at the request of the Secretary of State, due to the five-year rotation of plates? As you know and I know, the plate that goes on your cars has a life expectancy of five years and you add the stamp. And secondly, is there an additional fee which we did charge, I don't know if we still do, but we used to charge an additional fee for vanity or special plates when we aaopted Ehls several years ago. Does Ehak apply ko khis special plate for the veterans?

Well, it's my understandinq that it kas erroneously referred to that committee. Bue ik was deeermined khat those individuals were just as qualified as any other committee to hear this partieular bill. And thereforez since there Was some deadlock with respect to this Senate, it had to repose in that committee. -- I felt very confidenk that on the unanimous roll call -- that it managed to come out of there. And if they were serving on Transportatkon or some other comtkttee, we'd probably have been in the same boat.

Well, Senator, we we provide these kind of plates to Prisoners of War, the Illinois National Guard, the U.S. Purple Heart recipients and et cetera, and 1, frankly, don't understand, you know , your rationale for coming down so hard on the veterans of the -- of the State of Illinois. There are only twenty-seven thousand. And they should be afforded that opportunity. And if you want to do anythin: else, why don't put your oWn bill in?

My next questkon, Mr. President, was twenty-seven thousand veterans? I probably have that many in my district alone. don't know where you're coming up with those figures, but I think that might be erroneous. One thing that I I was a sponsor the first bill I ever passed, when I was a House Member, was a Prisoner of War license plate bill. First bill I ever passed. So - - I have no problem with the -- thank you. Thank you. I'm not against veterans, but I tell you - let me just read to you what We've got now comin: in regard to special plates. University of Illinois license plates, county sheriffs' -- county sheriffs' license plates, Purple Heart handicapped license plates, personalized recreational vehicle license plates, Constitutional Convention Delegate license plates, Gold Star license plates, l40 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 30th Legislative Day May 16, 1989 honorary discharged veterans license plates, dishonorable -- no, Pearl Harbor survivor plates. You know, I'm not opposed to this kind of concept, but the proliferation of this just qoes on and on and on. And Senator Topinka brought up an excellent point. The law enforcement community is having a real dilemma out there in trying to cope with the number of plates that are identical numbers. So I you know, understand Where youdre coming from . As I say, I'm not against veterans, but I think you have to someday say enough is enough. And I think this day is now. And I'd urge a No vote.

just -- I just think that this -- this bill was given to me by the Veterans of Illinois. It's supported by the various veterans organizations around the State of Illlnois. It's not some idea that I came up with. It is something that they are very much interested in. And I would hope that We could do something that Senator Topinka indicatedz something more meaningful for veterans. Like we opened up their -- all their offices this past year after the administration elosed them. That's one of the definitive things that we did in this General Assembly, and simply to afford them the opportunity to have this distinction on their car or their vehicle seems to me to be a small -- a small token of our appreciation to them, too. And I would urge your support.
