Basically, if we are going to take out the AIDS test out of the statutes: which has 28 cases, then thereês really no logic to keep the syphilis test is, which has -- just had 14 -- couples that were discovered with syphilis.

What this amendment is, is an amendment khat will afford the members that are aldermen: city council menbers: the city clerk, treasurer and the mayor, the opportunity to have an executive pension same as we have here in ehe General Assembly. Same one that we passed for the Cook County Board of Commissioners, same one we passed for the Meeropolitan Sanitary District, and I move its adoption.

How's it financed now?

It is financed by that local unit of government. It is not a mandate as such. That local unit of government Would have to, by resolution, decide whether or not they want to: participate in such a system. This ts permissive legislation, and thatfs a1l that it does. There is -- are no State monies involved.

But as I understand, what youdre doin: is setting up a pension plan for the aldermen and elected officials for the City of Chicago. Is there a question, is there no pension plan for those people now? Other than IMRP?

The Chicago Municipal Pension Systen, which they can parkicipate, but in the same bill that the Members of khe Ceneral Assembly passed tWo years ago, which we did for the Cook County Board of Commissioners and the Metropolitan Sanitary District, this this is the same identical legislation that passed for those individuals.

Has -- has there been any official request by the City of Chicago to add this provision to the pension code?

As I indicated, this legislation does not mandate that they do such. This legislation is permissive leqislation. If they so desire to do it, this would gkve them authority to do so they so Wish.

So if you consider an elected aldermen an official in the City of Chicago, and they request the Senate to do something, then to me it is official.

Well, okay. Thank you. So I have to assume from that that there 's been no official aetion of the council or -- or the administration requesting this plan. I We're in a difficult position when people from Chicago ask us to approve a pension plan, and welve had no idea or no opportunity to discuss it prior to this tiRe, and I -- I would suggest, Mr. President, that We have a roll call on this amendments if you please.

A1l it does is -- is set forth the necessary legislation of pension code so if they so desire, they would have to act on their own in an official capacity by resolution, lndicating that they Will participate in ehe pension systen. Now as it relate to the aldermen of the city council, yes, several aldermen have made this request year after year after year. And if your alderman did not personally come to you With this, you know, maybe, you're not in communication with him, Senator Dudycz. But this does not mandate that khe city council take action, it does not mandate that the State pay for it, al1 it does is set up the perimeters whereby if they so desire, they can act and pareicipate in executlve level pension: which the Members of this Body voted for the Counky Board and the -- and the Metropolitan Sanitary District two years aqo, and I move its adoption.

Thank you very muchy Mr. President. I appreciate your courtesy. Committee -- Amendment No. l to Senate Bill 27 does three things. First of all, it changes the threshold back to the ninety-fifth percentile. It now currently is at the ninetieth percentile. It also changes the amount of the maximum award to one bhousand, one time, instead of the five hundred for a two-year period. It does -- it makes this just a one-year program. The 16 STATE 0F ILLINOIS 86th GENENAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day May l8, 1989 -- the dollar amount is the same. And finally, makes a number of technical changes that make no substantive change in the bill, and I would move, Mr. President, for the adoption.

To be more specific, the local ordinance called for, I believe, a seven percent interest rate cap on bonds in that school district, and the bonds were sold for around nine percent. The eourt ruled that the seven percent statute was more specific and therefore prevailed. As a result of that case, there is now twenty billion dollars in bonds that have been issued throughout the State of Illinois that have a cloud over them, and we're trying to satisfy that problem. There have been meetings and discussion on how to best approach this, either With a general approach, and or a specific approach. We 've decided in the Amendment No. to this bill to assume both approaches, and what wedre doing basically is validating the Allendale issuance of the bonds. We are also validatin: the omnibus interest rate act which should satisfy the questions, or pokential questions on the twenty billions dollars that is outstanding in the State of Illinois in bond issuances. And we bring in other omnibus bond or debt aces and validate them. I would attempt to answer any questions on this amendment, otherwise, I would move for its adoption. There are no fees increased. Actually, What it does is it allows ihe clerks of the court to be able to collect the original fee that was designated on some of these civil cases. What's happening in the real world is the a 1ot of the clerks are getting Water bills, for instance, that are not being paid, and the municipalities are going ahead and, in effect, saying, ''A1l riqht, if you pay the water bill, you won't have to pay the clerk 's fees,'' and the clerk has already gone through all the trouble of setting up the case, and what have your and they're saying, ''You know, that's not fair.''

He was concerned that Where leqislators or other public officials, but legislators specifically, have to engage in a 1ot of activities that involve trying ko bring businesses into kheir areas for economic development, that one part of the language of the bill might have put that in some jeopardy. We thought not, but just to make sure, we have clarified that where a legislator is acting on State business in connection with economic development, that there is nothing ko be concerned about. Thank you, Mr. President. This amendment establishes a new permissive procedure for processing absentee ballots ae the suggestion of the committee. The new procedure is made permissive so that an election authority may continue to process the absentee ballots as currently done or by the new process permikted herein. Senator Kustra had some questions on it the other day . I think I talked to him in private. I don 't know if there's any any questions. If so, will be glad to answer them .

I don't know if they ever voted me, quite frankly. NoW When you say, and I wasn'e too happy about thatg because it's one time on my perfeet record that shows that I did not vote in a primary. did vote in the primary. I know that; know who voted for, but it didn't show up, because those judges did nok record it. But noW you're telling me youdre qoing to do it in one location, and expect my card to be marked to show that I -- don't believe it. Itlll never happen. It's nok a good idea . IE jusk gives all the more opportunity for an Election Commission or a County Clerk to forget abouk thosee put them in the waste basket, not count them . There are going to be more, more and more chance of more errors, and itfs not a qood idea at all. And I haven't had one County Clerk or one Electton Commission come to me or Write me a letter and say this is a good idea.

Certainly in 67 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 32nd Leqtslative Day May l8, 1989 Cook County I can't envision anything really more damaging than this kind of an amendment. At least we have some accountability, whether -- whether the -- our votes are counted or not, as Senator Philip said. At least We have some way of knowing what ballots were returned and whether or not -- in those precinctsz the -- the ballots were actually counted. -- I just -- I can't think that this is a good amendment at a11 for Cook County, and I would have to stand in opposition to this amendment.

Welle number one, Senator, Cook County does not want to be part of this. That's the reason we put in the permissive 'lmay.'' In the committee amendment: we said that it shall happen this way. Cook County doesn't want it) there are other counties that don't want There are some counties that want to give it a try. Other counties Want to see if it's going to work for them. My county wants to do it. And so it's up to them; if they choose to do i*, why -- <hy should they not be allowed to do that? I think the issue is in Cook County or any other county that doesn't want to do it; I'm sure that that county has control of its oWn actions, and they can either do it - there is still provision in the law, the law still remains the same - thak they can do it their current way. A11 khis bill does is allow them, if they choose to, to do it a Way that doesn't handle, rehandle and misuse, lose: absentee ballots.

As far as Cook County, I have worked with Senator Lechowicz, who raised the question in committee that the Election Board of Cook County does not want the -- the bill with the ''shally'' - with the requirement. This languaqe of ''may'' took care of the Cook County Election Board, and know of no opposition to this bill. The -- the County Clerks' Association has said, in effect - Mr. Leibovitz: the County Chairman of Rock Island County - 'lWe want khis ko go through, because you can try it works, then welll do Webll probably be the only county that'll be doing this, but that is the attitude of the County Clerk's Associationy and I ask for your support.

Senate Bill 1000, as I'm sure everyone knows, is that bill which proposes to chanqe the primary election date for the election ko be held in 1990. I submitted a copy of it to the State Board of Elections and asked kheir staff ko offer any recommendakions they ïight have. Two reconmendations Were made to change tWo time frames to accommodate the shorter election period that is proposed. Neithery seems to me, cause anybody any difficulty. Currently, under the law the County Clerksf are required to submit to the respective county chairmen, marked or make available I should say, marked polling lists after the primary. We just reduce that kime from sixty days to thirty days to aceommodate that shorter period. In addition, we -- we also impose the responsibility on those judqes who seek ko retain kheir judicial office, the responsibility to make a declaration; and a1l we do is change the deelaration dake again to accommodate khe filing date, so that if a judge is going to run for retention in the general election, he would have to declare that in May, as opposed to December, khich he eurrently does. I know again of no opposition, and I would move the adoption of Amendnenk No. 1.

I would be slad to. In JCAR Committee, excuse me, in JCAR Committee about a month ago, an objectkon was brought to the Lottery because they -- they put in place a new game without going through, I guess, the necessary forty-five day waiting period and that type of thing. The Lottery tells us that that's -- it's impossible to not -- you know, theydre really tying their hands if we don 't allow them to change games When it is very necessary to do so. They say thaty for example, last spring they determined it Was necessary to drop the Lotto 7 game, because it was doing very badly, and they implemented Cash 5. Timeliness, they say, is very important in getting with these games. Sometimes another state, a nearby state institutes a new game and it is very popular, and if We can't act with quickness, we could lose a 1ot of revenue. This bill simply allows them to do that. Excuse me. And iE also provides that Ehe Director of the Lottery may issue directives in order to address security and operational changes that arise from time to time. That's a1l it does. We brought the objection in JCAR CommiEtee; khe suggeskion was made by the JCAR staff they get legislation to implement the objection or the recommendations, and this is attempting to do that.

Well, this Was not the intent. You know, JCAR - you a member of JCAR, Senator, and we did object to the rules: but we did not agree to this type of legislation. Now, if -- if -- if the Lottery want to be exempt from the Administrative Procedure Acty and for them to -- to implement games in rule and not follow the dictates of the General Assembly, We have problems along those lines, so this amendment -- this anendment is not -- not the one that we discussed in detail. We did not suggest they seek legislation. We suggested that they come back and amend kheir rules as such, so that they would fall within the guidelines of the Administrative Procedure Act. Am I correct?

But this is somethin: that we did not agree to in JCAR, it's not a recommendation, and I Wish you would take it out of the record until such time we could have time to discuss this.

Well, Senator, first of all, we're not exempting the Lottery from the Administrative Procedures Act. Welre only exempting, by this bill, game rules that they can -- saying that they can change game rules and what ganes they're going to offer, without having to go through the extensive Waiting period and the -- and the promulgation of rules procedures that we have to go through for other things. Wedre not changing their other -- anything else. As far as khe recommendation of the committee, I was there, and as remember the recommendation, I mean the objection was to them doing this: and I -- I recall saying and hearing said ln the committee that day, that you should go back and get legislation to allow you to do this. That's What the -- the Lottery is now attempking to do# to exempt themselves just for the game rules part of their -- their act. Just to exempt them. As far as holding the bill or taking iE ouE of Ehe record, Senator, would be glad to that if we were back a couple of weeks or even last week or something, but we're not; we 're very close to deadline, and I really would hate to do that at this point.

Now this is the first time that they are promulgating rules for this particular Department. When they were under JCAR, there were not rules, and the reason why I suggest that you take it out, because there are many, many other problems as relate to the Lottery, as you well know: in the promulgation of its rules, and they -- they don't want to follow the Administrative Procedure Act, and you know and I know when we discussed this issue in JCAR, so I think in the best interest of the Lottery, that you take this out until such time we have the time to work out the necessary problems.

I have some very serious concerns about whether the Lottery should be that fully exempt from some of the time constraints and other constraints of JCAR. But I think it probably is just as appropriate to raise those on final passaqe, so I will wikhhold -- I -- jusE a word of warninge thoughe that I - I don't like what you're doing.

90 STATE OF ILLINOIS 86th GENERAL ASSZMBLY RCGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day May l8, 1989 Amendment No. l to this bill - by the way, this the Department of Ag bill - and it amends: first of ally the Pesticide Act to provide a one-time one thousand dollar penalty for violation for those who illegally sell pesticides. The second thing it does is ko further clean up and clarify the Illinois Grain Dealers Act. Ik allows the Director to assess a monetary penalty in the case of a violation of the Act, and it also anends the Warehouse section that the Director may require the warehousemen to post addition collateral security when they fail to meet grain storage minimums. I think those are the -- the main things that are contained in Amendment 1.

This amendment stems from a longstandin: problem which the consumers of legal services have had trying to seek recourse in the legal profession through an agency called the Attorney Registration and Discipline Comnission. While the ARDC is involved in the business of licensing and disciplining attorneys, they really aren't prepared nor designed to deal with those conflicts between clients and lawyers who simply can't agree on whether or not the client was well served. This bill creates an office within the Attorney General's Office called the Leêal Servlces Consumer Protection Division. Thak division would be qiven the aathority to investigate and arbitrate complalnts against attorneys, issue subpeonas, bring actions, report to the ARDC and appropriate 1aW enforcement authorities when there's been a violation of law, and issue an annual report to the Governor. Thank your Mr. President. Senate Bill 1391 is a bill that basically cleans up the Public Contraets -- so-called Bid-rigging Ac* ehat We passed last session. The Municipal League and some of l17 I STATE OP ILLINOIS 86th GENERAL ASSEMRLY REGULAR SESSION SENATE TRANSCRIPT 32nd Legislative Day May l8, 1989 the other local officials looked over it again and found a few more places that they thought needed some clarification. One, for example, the bill as amendedy the amendment prohibited only bidding on contracts by someone who had previously been convicted of a -- an offense involving bid-rigging or whatever, and their point is that it should prohibit contracting. It's not just the bidding process we're concerned about, it's actually getting a contract. It nakes it clear that the procedures involving minority programs, include the local ones, as well as the federal and State, and involves several other clarifications that the Municipal League had requested on behalf of a number of the local government officials.
