We lost nine to six, but I do want to congratulate Frank Watson and Dick Kelly, the -- the -- co-captains and the whole team that played. They were outstanding. They did a great job. And I know that the next year wefll finally win one from the House. In the same breath, want to congratulate retired Senator Peter Miller, who was at the game last night, used to be our coach. Peter Miller today is eighty years old, and I just want you al1 to just rise and join me in wishing Peter J. Miller a happy eightieth birthday today.

Mr. President, Ladies and Gentlemen of the Senate. Today is Fla: Day. It was exactly two hundred and twelve years ago on June 14th in 1777, When the Continental Congress first established a national flag for the United States of America. With thirteen stars and stripes depicting the states and the colors red representin: hardiness and courage, white representing purity and innocence, and blue representing vigilance and justice, the new flag was a fitting symbol for a young nation full of hope. Since the year 1777, our country has undergone great change and the flag itself has changed w1th it. Most notably, thirty-seven stars have been added. Yet one thing has always remained the same. The American Flag is the most recognizable symbol of freedom, justice and liberty on the face of the earth. In nearly every corner of the world, an American Flag can be found flying . Whether over an embassy in Moscow, at a military base in the Philippines, on a Navy battleship in the Persian Gulf, or in our own front yards, the flag proudly represents our country: our way of life and the principles of democracy. Since the inception of the national flage has always been considered patriotic and respectful for Americans to display the stars and stripes, especially on Flag Day . In memory of our founding fathers and the men and women who have died defendin: our country, we encourage all Americans to prominently display the flag outside their homes and businesses today, on Flag Day. Recent global events have given Americans an additional reason to display the -- the flag this year. Half a world away, youn: men and women are sacrificing their lives daily to achieve the same freedom that we often take for granted here in the United States. A1l of us have been touched by the events in Beijing recently, and we share the grief of the tragic loss of 4 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4# 1989 life, and we support the goals of the protesters. It is obvious that to some degree, the students in China have used our own country as a role model, as evidenced by the replica of the Statue of Liberty, the shouting of Revolutionary War slogans, and even the quoting of our beloved President, Abraham Lincoln. As Americans, we have a responsibility to reinforce those students ' belief in what they are fighting for, and to inspire them to continue kn their struggle. Exercising our freedom to display the flag in honor of their cause is one small way we can do that. The modern flag as a national symbol is an invention of the Chinese. This year, we should not only use that invention as a tool to show our respect for the United States, but also to inspire others around the globe in -- in their quest for freedom. It also include in there a increase in the personal exemption from one thousand dollars to twelve hundred dollars for the first year, and the second year it Would be fourteen hundred dollars. The provisions as they relate to the bill as it originally came over to the House remains the same. Anythin: in this as of thak .0 -- 0 -- 046 increase in tax will go to the General Revenue Pund. Also included herein is also a local property tax increase whlch will -- which will call for a ten percent rebate to the property tax -- from the distributive fund to the property taxpayers throughout the State of Illinois. Thank you, Mr. Presidentz Ladies and Gentlemen of the Senate. I rise in strong opposition to Amendment No. l as offered. I think we have to, as we should, responsibly deal in the real world . We have been talking about the need for an income tax increase for about the last four and a half years, and I have sat through interminable meetings with the leaders and the Governor and in caucuses, talking about a proposed tax increase, be it permanent, be it forty percent or fifty percent or whatever. We are confronted here, Mr. President and Members of the Senateg.with a bill that has come from the House, for the first time in the memory of man, with majority approval, that calls for a temporary less that one half percent increase in the income tax to meet the needs of education and local governments, and indeed, Senator Jones or any other Member has an alternative plan, I wish they would offer it. We have House Bill 602 immediately following this bill, and I suggest that khat was put there deliberately to afford an alternative. If, indeed, there are alternative suggestions, let's try it. But I think we are -- we are less than responsible if we don 't afford ourselves the opportunity to vote on House Bill 490 in its pristine form, so that we can send to the Governor. I would urge opposition to Amendment No. 1.

Mr. President, we really haven't had a chance to review this one, obviously. I have a copy of what I think is the amendment, in my hand. Senator Jones, would you go through this in detail again? What is the tax -- the scope of the tax increase, and how 8 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 are you distributing the money are is this half a cent or whole cent or -- you know, we're a little confused over here.

The current bill calls for an increase of approximately, I think it's eighteen percent or .046. The amendment increases that amount to .075. It also makes the tax permanent. Itld be a permanent tax, rather than a -- a surtax increase. It increases the exemptions from one thousand dollars per individual to twelve hundred dollars for the first year, and that exemption would go up to fourteen hundred dollars for the second year. Also they would call for a ten percent property tax rebate. From the distributive formula there -- be rebated back to those properey taxpayers throughout the State, and this would be -- be a permanent rebate, but the tax -- but the tax increase itself would be permanent, rather than just a temporary surtax for two years.
PRESIDING OFFICER: (SENATOR DEMUZIO) Further discussion? If not -- all right. I beg your pardon. Senator DeAngelis. SENATOR DeANGELIS: Senator Jones, could you give me the last three numbers of your -- amendment? The last three digits.

Senator Jones, his your amendment, Senator Jones, is not 9 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 necessarily a bad idea. There's nothing wron: with attempting to do what you want to do. But I get the feeling that the reason this amendment is being offered is because there's -- the line of communication are not open, and people are not responding to what some Senators are sayin: should be responded to. Now if I'm wrong about that, you can indicate so in your closing remarks, but the fact is, we should be sittinq down and discussing this issue together. We should be talking about what we want to do for our respective communities. There's no question about it, and get the feeling you don't think that's happening. NoW I may be wrong about that. Did you say I was wrong? I didn't I didn't hear what you said. Ohz you said I am wrong? Well I'm not Wrong about it as far as I'm concerned, because I think there 's a lack of communication going on around here, and we've got to straighten that out before anything is going to happen for the people in the community that need our help. Don't forget about them. They 're the ones that need our help. And this amendment, unfortunately, is not the right approach at this time. We can work it out, Senator Jones. You and I together and every Member in this Chamber can work it out. But not the way you want to work it out at this time. Senator, do us a favor. Withdraw the amendment and let's get on with the business, and we will sit down together and communicate and do what has to be done.

Thank you. This seems a little anticlimactic after that kind of an assault, but, Senator Jones, I'm just trying to figure out what the -- the impact of this amendment would be. You have mentioned, I got the components properly, we bave seen, wedre looking at the language for the first time. We have no chart of how much it would raise and how much it would remove. But you're 10 STATE 0F ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 talking about an increase from two and a half to two and three quarters percent, or are you adding on three quarters of a percent to three and a quarter percent for individuals? That's the first question.

Well, Senator Netsch it is equal for the individuals as well as corporate. But what I'm doing is this. The current legislation call for an increase of about a little less than one-half percent. What this bill -- What this does is increases that amount to three quarters of a -- of a cent.

Al1 right, so -- so you are going from two and a half to three and a quarter percent for individuals, basically. That is what you dre okay, and comparable on corporations. And then you are making it permanent, and then you are providing an increase in the personal exemptions. assume only the individual exemptions or also the corporate exemptions?

Meaning individual, gather. And then you are providin: a ten percent property tax rebate from the Local Government Distributive Fund. Couple of things Iîm not clear about. And along with that, I need to ask one more question. Have you increased the Local Government Distributive Fund proportion at all, and have you earmarked any of this money for education, or does it just generally go into the general funds?

Well, answering the last portion first: the bill, as it came to us# will remain intact. That portion going into the Trust Fund for education, as well as that portion going to the local units of government. The -- the -- the figures, that you want me to give you, don't have those figures, because I just worked on this last night. If -- to put this together to make it a more palatable tax, the one that would help the educational system . The current legislation that we are amending, that portion remains intact. The only change in that, really, is the -- the permanent tax rather than a temporary surcharge.
PRESIDING OFFICER: (SENATOR DEMUZIO) Senator Netsch.
Yeah. Well, I -- this is# I'm sure, part of the problem of -- of trying to absorb something like this when we are seeing it for the first time, but I am seeing language, for example on Page 34, that talks about one-third going to the Education Assistance Fund. Is that because of the change in the increase in the tax? But it -- you're -- what you 're representing is that it comes out the same as it would under 490. Now I'm not sure that's true, but that's -- I understand you 're -- well, what then would be the net revenue to the Statez and what would be the net property tax abatement or property tax relief? Yeah, I -- I don 't mean to treat lightly of this, because there are some interesting ideas here, but I guess what I'm sayingy Senator Jones, is that there are some very dramatic changes in what you are proposing that we are seeing literally for the first time and sort of sight-reading here on the Floor, and we have no fiscal analysis and no revenue or budget analysis to go with it, and it seems to me that it makes no sense at al1 for us to buy into an amendment like that when we don 't really know what we are buying into .

Senator Jones, the ten percent property tax, is it a rebate? You pay your bill and you get khe money back? You get ten percent of your municipal tax bill back?

That tax that come through the Distributive Fund for local units of government that's collected by the county , and ten percent -- ten percent of what this tax generates, and you know there is -- there is growth, so therefore the -- the tax rebate 13 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 will increase as this increase. So therefore it would be rebated based on ten percent of the funds that this amendment generates.

Well, the -- it calls for a ten percent of what that unit of government would receive in these funds through the distributive formula. It calls for ten percent of that amount to be rebated back to the property tax owner. Now if the property tax owners, whatever that portion is, that's what they 'd be rebated.
PRESIDING OFFICER: (SENATOR DEMUZIO) Senator DeAngelis. SENATOR DeANGELIS: Well, do you realize how much that rebate would be? Do you know what would be, roughly?

That goes in to the distributive formula, for local government. You have not tampered With the distributive formula, or have you left it as is, or have you changed that also?

I could not be certain on that one particular point, Senator.

I apologize for rising a second time, but I -- I think it's important to point out that this truly is a dramatic alternative, as Senator Netsch so rightly pointed out. Senator Jones is proposing a higher rate of increase, and he proposes to make it permanent. And I -- while I applaud him for his effort, I wish he would do it on some other bill, and I urge opposition to this amendment.

Well, in closing, let me say this. The needs of the children aeross this State are not temporary needs; they are permanent needs. If we are talking about doing something for educationy then we should -- we must put the money where -- put our money where our mouth is. We cannot make it a temporary tax, because in 15 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4: 1989 order for schools to start the necessary programs to -- to enhance the educational opportunities of our children, we must make sure that the -- the -- the -- the revenue and the funds are there. This is essentially what this bill does. It Will give us a permanent tax where those who are planning the educational opportunities for our children, they will know that the funds will be there, and not have to depend on us in 1991 to try to increase the taxes. I move the adoption of the amendment.

Thank you, Mr. President and Members of the Senate. This amendment reduces the tax from 2.96 percent to 2.75 percent. In others words, it cuts the increase approximately in half, and gives all of those dollars to Illinois schools. Let me begin in explaining this amendment, by pointing out to you that, as far as I can tell, the bill before you is a political equation. It is an attempt to balance political interest. It's an attempt to try to take care of the Mayor of the City of Chicago, plus some other cities along the way, While at the same time, wedre trying to take care of our schools. What my amendment does is take the kids out of this political equation. Let's place the school children of the State of Illinois as our top priority. Right now, what you have done by the bill before you is place kids on an equal footing with city council members across the State. With squad cars. With street sweepers. With furniture for aldermen. We may need some of those things back in our citiesy but why would we be doing thak right alongside the needs that have been expressed by our Illinois schools? Cities have multiple sources of revenue. Schools do not. Schools rely on the regressive property tax. They need State aid much, much more than the cities across this State. How many years have we seen the lines of people who work with our children in the schools formed to seek our assistance here? When's the last time you dve .seen a line of municipal 18 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 officials even asking for these dollars? Until, of eourse, it Was offered to them in this political deal to take care of the City of Chicago. I don lt understand how we could have heard so much rhetoric over the years, especially this year, about ''Fund education firsty'' and f'Priority one planso'' Let's put education right up there at the top. And then a plan comes to us which absolutely obliterates ''Fund education first.'' This is ''Fund education next to funding things that haven't even asked to be fundedo'' That doesn't make any sense. This is no time for a Qhicago bailout. It's not time for a bailout of any city, many of whom have balanced budgets, many of whom have multiple sources of revenue. This is a time to place Illinois kids first, and that's what this amendment does. Nothing more than that. And I would urge its adoption.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I rise, again, in stronq opposition to Amen'dment No. 2. This was discussed, at least to a certain extent: in the Revenue Committee. And frankly, Senator Kustra, I'm a little surprised that the Chicago-bashing would take a public forum . This amendment does nothing more than House Bill 490 currently does for kids. In addition, House Bill 490, unamended, recognizes that the cities and villages across this State are in dire need of additional revenue - whether for capital infrastructure projects whether for public safety - certainly -- certainly in an attempt to avoid or obviate the need for any additional property tax increase in virtually every city and county in this State. I don't think it's a good idea to cut the local governments out, and I don't think anybody else will agree. I am normally want to rise on this, but I am surprised by the sponsor since we share some local municipalities, who have expressed their interests -- who have expressed their interests to me, and therefore, I assume, to him, of their desire that 490 pass with an inclusion of a need for those villages to receive income to meet their pressing infrastructure needs. Senator Kustra , we share two of those. They've expressed that to me. If they haven't ko you, I'm sure I can get them on the phone real quickly.

Well, thank you, Mr. President. think the point of this amendment is simple. It gives money where money is needed. Over three hundred and sixty million - whatever the exact number is# it goes to schools. Any time somebody fashions a bill that is going to give dollars to local officials, who don 't have to go out there and take a vote on it - I assure you, Senator Carroll, you're going to hear from your local officials, just like I'm going to hear from mine. That isn't the issue here. We have to make tough choices in this General Assembly. We have to decide who really needs the money. I don 't feel authorized to spend more of my taxpayer dollars than is absolutely warranted. And what you have done with the proposal before us, is qive away taxpayer dollars to lower priorities. Let's discuss those issues later. We still have three weeks left in the Session. Let's just make sure that this bill is nothing more than a ''Fund education first - fund education top priority.'' Mr. President, the key question, I think here, is whether or not there's qoinq to be some property tax relief as a part of any income tax increase. What this amendment does is to provide property tax relief within the framework of the one-half cent increase. A lot of people thought maybe that was impossible to do. This is a plan that does give property tax relief within that framework. It does the following things: first of all, it leaves intact the one-quarter of a cent increase -- that has been earmarked for education. I think we probably al1 like that. The second thing it does, it says that the one-quarter of a cent increase that will be qoing to the cities and counties, that half of this is going to have to be shared back with the taxpayers in those communities. Those cities and countkes that levy a property tax increase would have to abate one-half of the new money that's coming their wayz and this will provide approximately a hundred and eiqhty million dollars of property tax relief throughout the State of Illinois.

I don't think there is any one of us in this Chamber, and I dare say there's probably no locally elected official, who will not stand and wave the flag and say. ''We're in favor of property tax relief.'' To do otherwise is folly. But by virtue of this amendment, Senator, if adopted, you know what you have done. You have then required a 36-vote majority for passaqe of this bill, and 70 in the House. No chance. And I Would presume if you are following the dictates of your leader, who said so eloquentlyz ''I Want to kill that suckerg'î -- this is the amendment to do With. donlt see anything wrong with affording the locally elected officials the option -- the opportunity, if they can responsibly, governmentally abate taxes and afford some tax relief. We will by virtue of 490 unamended, afford them that opportunity. But to mandate that for every dollar they receiveg fifty cents has to be given back in tax relief, simply ignores the fact that these, too, are responsible people. And they, too, have some, as Senator Kustra so rightly put some tough calls to make -- some tough judgments to make. But we ought to let them make them. This amendment would preempt home rule. But I can tell you right now, the people in my county do want some property tax relief. And I'm a mayor. And I have a conflict. And if I'm Willing to tell you this, I'm voting my conscience because: as a mayor, I still feel that my people would want their money returned to them , not put in the city council's hands.

Well, first of all, Senator Rock, I didn't intend to be the hatchet man around here. But even after we adopt the amendment, there 's still a hundred and eighty million dollars of new money that's going to flow to our cities and our counties. A hundred and eighty million dollars that they weren't askinq for, or weren 't counting on at the time that this Session started. So I don't think a hundred and eighty million dollar windfall is all that bad. Mr. President and Members of the Senate, Senator Rock will be delighted to know this amendment is not preemptive. This amendment, simply, would provide that the entire tax rate increase revenue would go to fund schools. When I came down here the first of this yearz I eame down here with the thought in my mind that this was the year of the crisis in education. That the schools in Illinois needed money. They -- we needed formula reform. We needed to address those concerns. didn't hear from any of my municipalities. And I'm not, by the way, going to engage in any Chicago-bashing. I think Mayor Daley has done a pretty good job, so far. It seems to me, his direction has been to cut the waste out of spending in the City: to get rid of those phony contracts. I salute him. Ifd like to see that kind of attitude everywhere in the State. Simple fact of the matter is that a large share of the municipalities in this State do not have financial problems. We're throwing money in areas that it's not needed. And Wedre taking the money away from areas where itds desperately needed . I would also point out to you that the -- the promises that have been made on the basis of the passage of this bill were contingent on the passage of a cigarette tax. That cigarette tax has not moved an inch that I can tell. That's a seventy a hundred and seventy million dollar hole in the Speaker's promises. This amendment would fill that hole - would see that that money went to education. Without this amendment and without the passage of a cigarette tax - which is nowhere moving or some other revenue source - which has not to surface at this point - all of those letters that were sent out to the education people are worthless. If, in fact, education is priority one, you're for khis amendment. If you want to put education first, youlre for this amendment. If you're for padding patronage rolls - building up bureaucracies hiring people for frivolous jobs, guess youdre against this amendment. The simple fact is we came down here to help education. As one of my mayors said to me, ''I don't know what we 'll do with the money. But if you send it, I think we can find a way to spend ite'' That's not a priority. That's not the way we ought to do government. If the cities have legitimate concerns, they should come down here and we should address them. They weren't down here. They didn't know they needed money till they got the letter from the Speaker. I have to admit he did a pretty good job of convincin: 'em at that point. Let's put education first. Let's put a1l this money for this increase into education: not into the cities. If the cities have a legitimate case, let them present it, and we'll address that as a separate issue.

Thank you, Mr. President. I'm -- I'm going to oppose your amendment. But there's one point that you made in your argument 25 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 that I think we really need to clarify and have on the record, right now. Admittedly, there is no cigarette tax immediately in sight. We keep looking for to surface from Senator Philip's desk over there, but it has not as yet. Even if it surfaces, we suspect it will not be at eighteen cents. Governor, I -- We think, you should be aware of that, perhaps. But there's one other thin: that -- that makes a lot of difference in terms of the equations for this yearfs and Fiscal '90's appropriations. And that is, that the Bureau of the Budget has increased its revenue estimates approximately two hundred and fifty to two hundred and seventy million over a two-year period. That is covering the rest of Fiscal '89 and al1 of Fiscal '90. That more than makes up for the entire cigarette tax, even if we do nok adopt a cigarette tax at all, because it was estimated at only about a hundred and eighty million dollars. So that the idea that there is a fundamental flaw in the amount of money available to fund the budget, quite apart from the 490 surcharge, I think is just not correct. There is additional money there, that has come in from the growth in revenues that were a little higher than BOB expected, although I would have to say the Economic and Fiscal Commission project them correctly. So that even if we don't 9et a cigarette tax, that gap is not there in the budget. And I think the record ought to be very clear on that.

Thank you, Mr. President and Ladies and Gentlemen of the Senate. 1, too, rise in opposition to Amendment No. 4. We spent a good deal of time this morning, many of us, discussing the FY 190 appropriation for the Common School Fund, and for elementary and secondary education across the categorical qrants, and the operations of the State Board. We will, this year, be spending 3.6 26 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 billion dollars on elementary and secondary education. assuming the Governor signs the bill at it's current level. This is an attempt again, it seems to me, while not ill-intended, but an attempt to -- to force us to a roll call, that that really everybody understands isnlt going to go anywhere. We had a great deal of argument, if youfll recall, about Senate Bill 200, which said very simply that half the new money - whatever the State gets - half of it goes to education. And we had a heck of a time passing it, as I recall, here. And it's still lying dead in the House. This is too much. It's very difficult to vote against additional money for education. But the fact is that 490 will afford education a reasonable increase, and will at the same time recognize that there are needs that can be met by the local units of government. I would urge opposition to Amendment No. 4.

Well, Senator Netsch: I -- I think I detected a gurgling sound behind me. I think, based on your remarks, the cigarette tax is sinking further. I would argue with you, despite those revenue projections, that there still, in fact, is a need that's unmet at this point. But I've been around here long enough to know that funny things do happen in the Wee hours of the last days of June, and that is always a possibility. The principal thing, though, that I'm trying to accomplish with this amendment is, as I said, ''Let's make education a priority hereo'' The cities have not come to us with a need. They have not told us what khey're going to do with the money. We have really no idea what theydre going to do with the money. And I'm not talking just about the great metropolis on the shores of Lake Michigan. I'm talking about the towns in my district and throughout the State. I have no letters telling me theydre for it, or what theylll do with the money. I've 27 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June 14, 1989 talked to many of you. You don't know either. But we do know that the school systems in this State, from Chicago to southern Illinois to western Illinois to northern Illinois, are hurting. And they're hurting badly. And we do know that the money allocated in this bill, without amendment, isn 't going to begin to address the needs, or begin ko keep the commitments that we dve made to education. I would suggest to you that this bill with this amendment still does not live up to all the promises wedve made in this Body. Without this amendment, this bill is a bad joke for education in all parts of the State.

Thank you, Mr. President and Members of the Senate. Senator Rock, this amendment is not intended to be a hostile amendment in any way. But what I do seek to do by this amendment is reallocate fifty percent of the money that would be raised under this plan. For several years nowg the Speaker has said in his public comments that he saW no need for any new State revenues, particularly to fund education. He 's made a dramatic change this year, and has recognized that education does need an infusion of new money. But he surprised a11 of us by giving half of the new money that he 28 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 would raise to cities and municipalities, most of whom have not asked for any money and were not expecting any. So what seek to do by this amendment is -- is recognize that if we dre going to pass anything here, if there's going to be any new revenue: the Speaker is going to see to it that the City of Chicago gets something. And that's a political reality. Under this amendment, the City of Chicago would get about forty-seven million dollars instead of ninety-five million dollars. It's my understanding that theydve raised, or that they lost, about seventy million in federal revenue sharing. And it seems to me to make no sense to replace that with ninety-five million in Skate revenue sharing. But it isn't only the City of Chicagoy it's every other city and county in the Stake. So what this amendment does is reduce by fifty percent what the Speaker would give to local units of government, and distribute that money to other important needs in State government. Now I passed out a -- a handout. And for those of you who may follow along, I apologize, because there's a typo in here. The top part of this thing refers to three hundred and twenty-six million dollars, and it is actually three hundred and sixty-three million, that at the present time goes into the Local Government Distributive Fund in this bill. What I would do is, first of all, reduce the share of the new revenues to Local Government Distributive Fund from three hundred and sixty-three million to 181.5. Just half. I would allocate that half in this way - 23.5 million to restore the blind and elderly exemption. Now most of us have voted for that, but we really haven 't put the money in there. This would provide the money. Fifty million, Senator Netsch, to fund -- to fund pension -- unfunded liability in our pensions, your Senate Bill 22, which apparently requires about ninety-nine million dollars a year. Here's fifty of it. And we would put -- of that fifty million, we 'd put thirty million in the Teacher's Retirement System . Badly underfunded. We'd put ten 29 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 million into the State Employees' Retirement System. We'd put ten million into the State University Retirement System. Furthermore, the bill provides some tax relief. It would allocate sixty million dollars for property tax relief. And would double the residential income tax provision and tax relief that we afforded to our citizens a few years ago. The last thing that it would do is allocate forty-eight million dollars for Medicaid increases to allow the State to increase those nursing home fees, reimbursements to hospitals, and so on, that we a11 so badly need . I offer it as a compromise. Many of us whodve looked at the Speaker's proposal like the idea that it's a modest increase in the income tax. We like the idea that it helps fund our schools. But we can't live with the idea that it gives that much money to cities and municipalities, most of whom have not made any requesk. So I offer this as a compromise position. I think it's reasonable.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I rise in opposition to Amendment No. 5. And yet appreciate the, at least, the offer of compromise. I think, however, we can do - should do - virtually everything you say here. Director Mandeville has indicated there's an additional hundred and seventy-five million dollars he just pulled out of his sock last week. The Governor has plenty of money. What you are doing here is you are taking a temporary surcharge and building in permanent property tax relief. And I'm not so sure we want to do that. In addition to that, we have bills on the Calendar we have, in fact, even voted in the Senate, to restore the blind and elderly exemption. We can at any time increase the pension funding to attempt to whittle away at the unfunded liability. Property tax relief, as I said, is 30 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 going to be considered on a whole host of other bills. And Medicaid increases, I've already passed Senate Bill 150 out of here and the Governor has proposed an increase for those providers. Well-justified, I might add. So I guess what I'm saying ise again, we ought to have the opportunity in this Senate to vote on House Bill 490. And I keep hearing from the other side that nobody 's asking for this money. Every year I have been down here since 1971, there hasn't been a mayor, a county board official who hasn't been down here looking to increase the local distributive share. If you don't believe it, turn around and ask the Chief Executive. Every mayor that's come down here has asked for an increase in local distributive share. I don't care how big khe town is, or how small the town is. So that argument really doesn't - - doesn't wash . Now We have the opportunity, given the fact of federal cutbacks, to afford some much-needed relief to these cities and villages. And I would urge that we keep House Bill 490 in its pristine form y and give us a chance to vote on it. I urge opposition to Amendment No. 5.

If 490 goes out, the way it is, as requested by the President of the Senate, and the Speaker of the House, we will have essentially raised revenues, includin: the growth that we have and the takedown of the current balance of about a billione six hundred million, maybe a billion, seven hundred million. And as we do that, we go back home and we say, ''Welle you now what? We had all that money, but we allocated the money for the mentally ill on the same basis as if there was seven hundred million. We did the same thing with our pensions. We did that with the blind and elderly. The only people that we took care of as if there were a billion: seven hundred, is local 31 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 government and education.'' The very two units who depend upon property taxes, and at the same time that we're raising this income tax, we are doing nothing about those property taxes that are going to go up. And believe me Senator Netsch, they're gonna fly out of your area like crazy, because those assessments shot up there. Senator Kelly, we just went through it in our area. All because we have been presented with a proposition that finally passed the House of Representatives. Making a monumental move in public policy because we are concerned that that one Chamber may not approve of any changes we miqht make. have to tell you, there's only one justification for a tax increase in this Session, and that is to brin: more equity into the fundin: of education, and I know a lot of educational people up tbere are gonna cheer for this tax increase, but let me tell you, tWo years from now, you will be facing a problem of far greater debts than you have today. Because the one thing that that tax increase doesn't do , is bridge the equity gap. In fact, it makes it even worse . And as far as local government is concerned, yesy I got a call from every mayor in my district. In fact, I even got a call from the kown I live in, the mayor, who very sheepishly said, ''Aldo, would you support the bi11?'' I said, ''Anita, youlre talking about abolishing the property tax in our towno'' She said, ''Yeah, would you please support the bill?'' And I thought afterwards that the power we 're giving to local government is like going up to your kid and sayinq, ''I'd like to increase your allowance. Do you think you'd take it?'' And, the answer would obviously be, ''yesp'' Senator Rock, I can appreciate What you're trying to do, but I got to tell you, if 490 goes out of the Chamber as it is, you can kiss off property tax relief. You can kiss off help for the developmentally disabled . You can kiss off help for al1 these other things that Senator Schuneman has in his bill, because I'm gonna tell you, there will be -- the next thing is, we got a tax 32 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Leqislative Day June l4: 1989 bill already, let's not do anything else. I think we need to put an amendmenk on 490, and we ought to leave this issue open. For those of us who are very much interested in assuring that more revenues are there, give us some options.

Briefly, Mr. President and Ladies and Gentlemen of the Senate . I'm not the kind of a Senator who sends out newsletters. I'm out all the time and I poll my people all the time, and can tell you right now, they will not want me to vote for an income kax increase, unless it is coupled with some property tax relief. They want me to help education, and I think this amendment does help education, 'cause this amendment did not cut down anything from education. As far as cutting it down from local governments, I'm willing to face that too. Because the final -- final ground on this thing is, what are we doing for education? What are we doing for the property tax owners who have been -- property owners, rathere who have been saddled with great bills of property tax? In our county, we pay on the assessment of one-third of our market value, and that's higher than what you'd pay in Chicago, I can tell you that right now. And I think this is a good bill, and think it's a step in the right direction. And furthermore, it does provide for the pension funding of the teachers, retirement system, which we need, and wedve promised for years and haven't really done, and I think it's a good amendment and I urge its passage.

Well, thank you, Mr. President. Just a couple of remarks. In response to the idea that -- mayors have asked for money, well, of 33 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June 14, 1989 course they have, just like the other public officials in Illinois, they'd a11 like to have more money to spend . But when we 're talking about people askin: for money, I'm talking about people asking for money. I'm talking about parents of children, who come to me and say. ''Our educational system isn't adequate. Please do something about it.'' We ought to have ordinary citizens of a community coming to me and saying, ''Please give our Mayor more money to spendy'' for a variety of reasons. That's not happening in my district. Now it may be happening in yours. We each have to vote our own districts. But I'd like to make this other point, too: that, sure, We've been voting for a variety of things around here. We vote to fund the pension systems, but we don dt get it done. In the final analysis, it doesn 't happen. We vote to give some property tax relief, and somehow that can't happen. And these other issues that are in this bill -- but one thing about this bill, it earmarks the money. The bill earmarks the money. So I think you -- that we would all have a much better assurance that the new revenue 's going to do what we think it's going to do, if we adopt this amendment. And, I guesse finally to my to my downstake Democrat friends, you know, I really don't think we should allow the Speaker to dictate everything that we might consider here. Certainly his bill deserves our consideration and we should work with him, but, if, in fact, you agree with me, that half of all this new money is too much to give to municipalities and counties, then I would urge you to support this amendment.

Now when the Speaker crafted, or drafted, or maybe craftily drafted -- House Bill 490, he certainly raised the point that local government was in very dire need of some additional consideration and assistance. tend to think that part is correct. What we 're saying, is that townships are not getting any part of this new money, under the Local Government Distributive Fund. And Amendment No. 6 does opt them into four percent of that fifty percent of the money that would be going to municipalities and counties. The actual dollar figure in the first year of the bill, would be about twenty-six million dollars of that three hundred and sixty million, that is going throuqh the LDGE. And it was determined by a prior Assembly that the townships should not share, khat they have local taxing authority, and they have: frankly, tbe opportunity to raise their taxes locally to provide those kinds of local services. If we open it up to townships, you dre gonna open it up to a whole host of other governmental units. And I think the policy decision, when made, was a good one . We have lived with it, lo, these many years, and I don't think this is the opportune time to open up the Local Government Distributive Fund to townships in any percentage. And so I would urge opposition to Amendment No. 6.

Yes. Thank you, Mr. President. This Body, the Illinois State Senate, what we're all about is making policy, predicated on decisions and under these particular times. Well, to me, townships certainly deserve the consideration that we in the past have awarded to counties and municipalities. As a matter of fact, certainly in downstate Illinois, this is one of the most critical needs, at least in my district and many others that I know of, the fact, when we have some declining or stagnant equalized assessed valuation, there is just no way for these townships to survive without some additional State support. Thusy for those very reasons, I certainly encourage adoption of Amendment No. 6.

Thank you, Mr. President. Amendment No. 7 is actually an amendment brought to us by the Illinois Farm Bureau and it's rather a mini CHIEF program. I can go through the various parts of this amendment, which are rather complex, and it is a very lengthy amendment, but does -- I can -- the salient points of the amendment certainly give the same -- roughly the same dollar figures to education. There is money in the -- the amendment for Local Government Distributive Fund, but there is also approximately five hundred million dollars in property tax relief. And not to mislead any of you folks, this is a little greater increase than what House Bill 490 contains. actually increases the personal income tax by three quarters of one percent. And with that, I would be glad to answer any questions.

Well, Mr. President, as the sponsor has said, this is a kind of a mini CHIEF plan. don't know, maybe it's just one of the indians at this point, but we'll find that out. This is property 37 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 tax relief, and even though we know the origin of the bille I think the one thing we want to make clear is, that it's not just a farmer tax relief bill. Very clearly, therels about five hundred million dollars of property tax relief that's a part of this proposed amendment. I think we've got to concede the point, first of all, that no organization has worked any harder than has the Farm Bureau, on behalf of some additional funding for education. And I think that fact should be recognized by everyone on the Ploor. Wedre talking about property tax relief that comes out of the educational fund to be replaced by the money that's going to be raised through this taxation program. And ninety-four percent of that, and I want to make this point very clear, ninety-four percent of that property tax relief will not be going to farmers. It's distributed over a1l of the taxpayers of the State.

Yhank you, Mr. President and Ladies and Gentlemen of the Senate. I would ask Senators Woodyard and Rigney and Maitland, this a perfeck amendment for House Bill 602, which is next. because it is not exactly the CHIEF Program, and we have discussed the CHIEF Program at some length. I've had Mr. White and his emissaries in my office over the past couple of months, and told them honestly, that I could not support the CHIEF Program . Although, it Was indeed, Well intended. This is not the CHIEF Proqram, because there is no formula change. It appears to cap the schools' operating tax rates and replace that local money with State revenue, and I don 't know what the impact of that is. But the fact is, is a true alternative to House Bill 490, and would ask you to withdraw it, please, and we will immediately go to 602, and consider this, and the amendment, in my judgment, will go on. But I have to oppose it on this basisr as Amendment No. 7, 38 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 46th Legislative Day June l4, 1989 because it is a permanent tax increase of a greater maqnitude than is House Bill 490, and I havenft yet determined what means, or what will mean, if we are capping the schools' operating tax rates. I don't know how that translates. But with no formula change, this cannot be the CHIEF Program. What I am saying to you, sir, is that this is a true viable alternative. It should not be an amendment ko House Bill 490. It should qo on a parallel track, and let's see whods voting for what. So I would urqe opposition to Amendment No. if you persist, buk I would ask you to please pull it and welll go to 602 immediately -- and you can offer it to 602.

And instead of having al1 of them cluttering up the counter, the idea of the Chairman, Senator Smith, myself and Senator Topinka, was to put them all on one bill. ïou know, that's -- that's all we 're trying to do here.
