Senate Bill 647, when it was before us, said that the interest that was earned on investments - the funds that were held by the Illinois Agriculture Loan Guarantee Fund and the Illinois Farmer 6 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 62nd Legislative Day October 17, 1989 and Agri-business Loan Guarantee Fund: would remain in the fund , instead of the money going to General Revenue . is estimated that it would divert about l.8 millions dollars from the Funds to General Revenue. We'd like to leave it in. The Governor said he'd like to have it go into General Revenue. I think that it 's much better that we leave it in the Ag -- the Loan Guarantee Fund and the Ag-Business Loan Guarantee Fund for further investment . Thank you, Mr. President and Members of the Senate. Senate Bill 1093 provides the funding for the Illinois Small Business Innovation Research Phase TWo Assistance Program . This was a bill that passed out of the Senate without opposition. It passed out of 7 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 62nd Legislative Day October 17, 1989 the House without opposition. In this bill We have identified the funding source. It would be appropriated from the Technology Innovation and Commercialization Fund, which was appropriated one million dollars in the last two yearfs, but only used ten percent of that fund. I believe that many of you have received letters from those industries that have participated in SBIR. In short, it gives small business an opportunity to compete, and tap those federal dollars that are available. This bill does that. I -- I would urge -- the approval of this bill.

But, in fact, and I can quote, the language that it does is it assists small business who has seek to -- apply for the Federal Phase One Small -- Small Business Innovation Research Grant. That doesn't effect the area between after the businesses receive that phase one funding, and when theydre attempting to fill that gap to get on to the larger funds by phase two. And there's no funding identified. The -- the second bill, House Bill 2656, says that DCCA can make loans or grants to 8 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 62nd Legislative Day October l7, 1989 businesses that have received Federal Phase One Small Business Innovative <sic> Research Grants as a bridge. Again, it identifies no funding source. What our bill does is give the specific charts to DCCA to meet this need in Illinois where we have ranged fifteen out of twenty states -- low. And it provides the exact funding Sou rce .

In the last two years only ten percent of those dollars have been used. What I'm suggesting -- and what we discussed in committee, is that four hundred thousand dollars be tapped from that left over amount, that has been rolled over two years in a row.

And we already have legislation that's been signed that permits this, and we do have, in fact, authority to fund this under existing legislation.

SENATOR SEVERNSS It is, in short, language that we lifted from the State of Missouri where that same law has worked very well . ln fact, in the State of Missouri, this languaqe has permitted the total rennovation -- or -- what is commonly referred to as the Laclede 's Landin: area, Union Station and elsewhere . It is a bill that does not cost the State of Illinois a single dime, but insteade provides our city councils, and our local governments, and our economic development foundations the additional tools they need to go in and attract, and keep business. I -- I was surprised by the veto, and would urge adoption of this bill.

Welly our staff has pointed out to us# over here, Mr. President, that theredre probably several problems with this piece of legislation. They list them as follows: it is raeher vaguely draft, particularly in the Section of the bill that deals with giving corporations the power of eminent domain - not sure what's going on here. Furthermore, they point out that there, apparently, are no limitations on the amount of property that can be included in a metropolitan re-development area; nor are there specified caps of any kind. Furthermore, -- apparently local governments , under this provision, can freeze tax bases for all units of local government without their approval. And I understand that there STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 62nd Legislative Day October l7, 1989 was no discussion of this particular item at the time that it was pending here, before us.

And particularly Reverend Bailey, Who has been the head of much of this program, has had tremendous success. I would ask for your support to override this veto -- of a very successful program , and a very small amount of cash.

Senator Marovitz, is this one of the bills where we're going to get tough on gangs by automatically transferring fàfteen and sixteen years olds from juvenile court to criminal court? Is that one -- is that one of those packages?

Well, this bill does automatically transfer, or did automatically transfer, fifteen and sixteen years olds from juvenile court to adult felony court, if they dealt drugs in public housing projects, or brought weapons - guns - offensive weapons into the projects. The Governor's feeling, and I really disagree with the feelinçz was that the automatic transfer provisions were too harsh. We have automatic transfer in our safe school zone that we passed. We mirrored that in and around parks. 29 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 62nd Legislative Day October l7, 1989 We tried to do the same thing with public housing projects. The Governor felt that the automatic transfer -- provision was too strict, because there are a lot of juveniles in public housing projects: and that this would be too harsh on them. I really disagree with that, but rather than take -- than jeopardize the entire concept, unless the Body wishes differently, I -- I would initially, at least, move to accept the Governor's changes.

Senator Marovitz: I Wish you would change your mind. It seems to me that these are exactly the youngsters that aren't really youngsters, they're old beyond their age: and they should be automatically transferred to criminal court. I -- I don't think that we should coddle these people who are: allegedly, of an age that they should go to a juvenile court. I think they should go to criminal court and be treated like adults, because the crimes they commit are crimes that adults commit. And I intend to not vote to go along with the Governor. I think the Governor made a mistake on this proposal.

Thank you very much, Mr. President and Members of the Senate. This is an issue that's been around here for a couple of years. And it involves the purchase of Normal Community High School by the State, which will increase the size of the campus at Illinois state University. The Governor had agreed with us that this was a proper action two years ago, in that it was eighteen acres of land and a rather substantially large building that would provide additional classrooms for Illinois State. The one thing that had to happen, of course: is that the school district had to vote in the affirmative on a referendum to build the new high school. They have, to this pointg not done that, but it's still very much on the agenda. And it is my desire -- and I believe communicated very -- very poorly with the staff as they analyzed this bill. They simply thought since the -- the referendum failed, that it ought to drop , and -- and I would conclude that that's not the proper action. We prefer to have this here, so that when the high school is authorized for sale, the State can enter into this agreement. I would appreciate very much your affirmative vote on this motion.

This is a restoration of two hundred fifty thousand dollars to from the Ag Premium Fund kto the Orr Research Center over in western Illinois. There was some confusion during the last Session, Where it Was placed in two different appropriation bills -- from different -- GRF or -- or from Ag Premium . This happens to be the one, two hundred and fifty thousand out of Ag Premium, and I would solicit your support.
