This is the bill that we ended with yesterday that took about an hour. And I filed a motion to accept the Governorfs recommendation for change against my better judgment. But recognizing that the underlying bill is very worthwhile, I have decided to agree to accept the Governor's recommendation. The underlying bill would prohibit the issuance or renewal of a license to practice 1aw to any person Who has defaulted on a student loan. In addition, it sets up a -- a cooperation between Illinois and other states to allow for other states to withhold professional licenses when Illinois loans aren't repaid. Thank you, Mr. President and Members of the Senate. Senate Bill 830 deals with the studded tires for emergency firefighting vehicles and ambulances from November 15th till April the 1st. They - especially rural fire districts - feel very strong about this. Most of them are -- are manned by volunteer firemen. And when there's snow or ice in the forecast, they can 't get them to come in and put the chains on. Yes. Thank you, Mr. President. The -- we fve seen this legislation before. This is the Studded Tire Legislation, and there probably is some merit in what -- in what Senator O'Daniel wants to do herez but the Governor has vetoed this, and I think for a good reason. The problems that occur with studded tires and what it does to the roads is quite detrimental. And wefve -- in our analysis and I'm sure on most everyoneps, the county superintendents of highways are opposed to this. The Department of Transportation. Township officials. Other units of local government are concerned about this, because of the damage that it does to the local roads. And I think that that in itself is -- is good reason to sustain the veto and -- and support the Governor on this provision.

And I know enough about construction and I think the Department of Transportation, too, that this isn't a serious -- doesn ft do serious damage to the roads. And I would move for the override.

Once again, -- feel compelled to -- to rise in opposition to the amendment. think the idea of having NIU presence in Rockford is a very good one. What I am arguing for here is that we go a little bit slow - slow enough so that the Board of Higher Education can -- will have the appropriate time -- appropriate opportunity to study this. I would point out to everyone that we passed a bill, Senate Bill 1443, which calls, in factz for a feasibility study to be made. My -- I plead with you - - this feasibility study now is just -- just starting. This bill was just approved as of the first of September. Let's give the process the opportunity to work. If that feasibility study is completed quickly - and I don't see why it could not be - why it should not be - and a positive report is forthcoming as a consequence, khere would be then the opportunity to make this appropriation in a supplemental. So at this time, once again, I would ask for a No vote.

Well, in -- in deference to the previous speaker, rise in support of this. would respectfully submit that yesterday we - if memory serves correct - we appropriated the money to buy the Normal school for ISU, and the school district wasn 't even agreed on that one. In this case, we have a school district in total agreement. We have the business community very actively promoting this. This would provide a consolidation from many other locations throughout the Rockford area. It's a very rational plan in a -- a good way to utilize an access school building in an intelligent manner. I'm confident that any study that comes up will recommend this plan vigorously. And I see no reason why we shouldn't approve it at this point and go forward.

I -- I would just add, in listening to this debate, one of the critical concerns we should all have when we do something like this that might override a decision by the Board of Higher Education, is whether or not what we're about to do creates any kind of a conflict between public and private higher education - whether or not we are allowing a public institution of higher learning to do something that is already being done in the private sector. In this particular case, it is my understanding that that is not the case. What Northern Illinois University would be doing by virtue of our action here today is in no way in conflict with anything that is being done by the private sector higher education facilities in Rockford. Itls a much-needed use of graduate facilities. I don't see any reason why every now and then this General Assembly can't assert itself. We don't have to say that the Board of Higher Education is always right. Every now and then, I think we ean establish a priority here and there, and would suggest on this one, it's a good time to do And I would agree with Senator Holmberg on her motion to override. Now what it is is that we don't know what pollutions are being fed in the underground waters. And what it is doing is going down and it's coming downstate. So I Would just remind al1 the downstate Legislators that they should vote for this, so that 13 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 64th Legislative Day October 19, 1989 we in Chicago don't kill them off. So we really need this study. So I ask for a favorable vote.

Thank you, Mr. President. Believe it or not, this does look like a Cook County issue, and it does have some significance, but anyone who knows groundwater - and many of us who follow it - you know, the groundwater flows south: gang, and so this groundwater is not really killing people who live on the south side of Chicago, but it could be a little dangerous if you lived in Kankakee or Iroquois, or you started headin: south. Now if you don't mind drinkin: dangerous groundwater, that's your business, and I wouldn't really want to tell you what you ought to drink or not drink. But, we do have a legitimate problem on the southeast side of Chicago, and this groundwater issue is significant to the City and everyone who fits within that stratosphere of the water moving south, and it probably is a good idea that we study this water.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I would point out two things to the Members of the Body. First of all, there was a substantive bill, House Bill 789, which would require that this study be made, and I would like to point out to you that this bill Was defeated in the House. So there -- there is no substantive legislation which would require this study. The second thing that I would Want to point out is that, while this motion has been filed on a two-hundred-thousand-dollar reduction, that the total cost of this study is -- has been estimated at a million and a half dollars to be spent over a period of -- of four 14 STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 64th Legislative Day October 19, 1989 years' time. So this is not -- youfre not voting on a two-hundred-thousand-dollar item , you're voting on a million-and-a-half-dollar item. That's what the study is for, Senator, to find out what what this pollution and what -- what are we putting in our groundwaters. We know that in this section of the City of Chicago in the southeast side - that the highest cancer rate -- rate has been measured among white males. White males is the highest cancer rate of anywhere in the State of Illinois. So there's something wrong, and there's something wrong with the water or the air or what. We want to start to take a look at it. And we're asking for a mere two hundred thousand dollars, just to determine how we can keep these nice-lookinq white males around in the Skate of Illinois.

Thank youz Mr. President. The idea behind the study of the water in Lake Calumet is that the Lake Calumet area is one of the most contaminated areas in the State of Illinois. Yet the federal government has not put it on the Super Fund List, so we are unable to get federal funds to clean up the site. Federal funding should be available at ninety percent of the total cost of the million dollars of cleanup, and that's what we're trying to do by having a study to convince the government. The study is to convince the federal government that this site does have groundwater contamination that will cause health problems. That is the determining factor by the federal government in determining if the super fund site can be cleaned up, or if a site should even be a super fund site. So based on that, we are trying to get a funding proposal through the Legislature. The bill that Senator Etheredge spoke about being defeated it was defeated. It is now on the Recall List. It Was tWo votes short of passing. It's my understanding the bill will come up again today - the substantive bill - and I've been assured that it would pass. So I think that that is not an issue, the substantive proposal. But what we would like to do is try to get federal money. And this is a small amount of seed money to put out there to bring back millions of dollars to clean up one of the most contaminated sites in the State of Illinois - this site at Lake Calumet. Thank you.

In the Daily Calumet there was an article and a study on it. I think that we need to start somewhere. We must make a beginning. Wedre talking about two hundred thousand dollars, Which is really not much for something of this magnitude. The upper flgure was mentionede that's over a six-year period - will take over a six-year period. And yes, I would imagine it would eventually go up to the figures that Was quoted by the Senator. But I think that somewhere we must make a start, and this is the appropriate point to make -- spot and time to make that start. I ask for a favorable vote.

The fact of the matter is, this is Ehe only institute that is engaged in the training of workers to abate or encapsulate asbestos. And we have, in fact, appropriated money to them in the past for the purpose of getting it up and running. I think it was viewed mistakenly as simply another one of the many legislative add-ons that the Governor saw fit to cut, with the hope that we would reconsider the eight cents on the Cigarette Tax . This should not have been in that category. By nobody's definition was this a legislative add-on. And it's something, it seems to me, that if wedve asked Organized Labor ko engage in the setting up and -- and running implementation of this institute to train workers to abate asbestos, we at least ought to afford them the wherewithal to do it. And so I would ask your favorable consideration, and ask for an Aye vote to restore this two hundred and fifty thousand dollars, the item veto of *he Governor to the contrary notwithstanding. It's for 3.8 million dollars. As we know, there has been dramatic decline in enrollment, at a number of institutions, of minority students. SENATOR MAITLAND: Thank you very much, Mr. President and Members of the Senate . Once again today, I rise in -- in opposition to this motion. And let me -- let me say: also, that -- or initially at least, that in this particular line item there was a substantial -- a substantial increase in the recommendation by the Governor. Originally, had amounted to about -- about forty-eight percent. What Senator del Valle has done here is to change the line item to cover a number of other areas. And yet, the report that both he and I worked on, the Minority Access to Higher Education, suggested separate line items for -- for this, and -- and indeed, we are not - - we are not doing that. So what -- what happens here is the increase that the General Assembly passed out of here in the Spring was some two-hundred-and-seven-percent increase over the preceding year. And thatîs pretty doggone good by -- by any standards, and the Governor simply took it back to a forty-eight percent increase. Let me -- 1et me share with the Body, as we discussed yesterday, and about the need for access to higher education by minority students in this State. In the report that Senator del Valle worked so hard on, the point was made that we ought to increase -- or the funding for higher ed ought -- or at least five percent go to minority student retention. And you can argue that point or -- or -- or -- on either side, but that's the point that was made. But that can't be, Ladies and Genklemen of the Senate - only the money that's in Higher Education. Senatorg long before you came here - in 1985 this General Assembly passed Educational Reform Act of '85, whose major thrust Was the very 21 K.. STATE OF ILLINOIS 86th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 64th Legislative Day October 19, 1989 issue that you and others have been discussingy to prepare students those students who are at risk of academic failure - for entrance into college. And this year, finally, Senator, in addition to the money that we are putting in with -- in the budget -- within the budget: we increased those line items in the State Board 's budget substantially to the point that approximately a hundred million dollars is going to at-risk students in this State. So to stand before this Body and ignore what this reduction has done is absolutely not true. We are making a good, honest effort to prepare minority students for access to higher education. And I would suggest that We qo along With the Governor's reduction in this -- in this line item, come back next year, and once aqain, Senator, discuss the issue and move forward.

And this is the last bill, and it's this last hope for us to do anything about that. Senator Maitland. We will have a working task force - three members from each of the caucuses - to attempt to grabble with that weighty problem.
