The -- this bill provides for notification for township road commissioners when a piece of ground is annexed. The bill, as originally introduced, would have null and voided the annexation without the notification. This takes that provision out and just requires the -- the cities to notify or assume liability for lack of notification. It's a compromise the Municipal League Worked out with the Township Officials. I think it puts the bill in good shape.

I I was just curious because wedre -- welre -- wedre kind of -- wedre having trouble in some counties geeting highway superintendents, and I didn't want to compound the problem by changing this classifkcatkon to make it more stringent. Because I know, at least, in the County of Greene, for example, they spent at least the last two or three months under a mandate from the Department of Transportation to hire a highway superintendent who had the qualifications. And if weere only just changing the title, I'm hoping that -- does this mean that perhaps that these people would be entktled to more money? It would be more difficult for a person to be a engineer versus a highway -- a sorry -- a highway - whatever the title is now? Highway superintendent, yeah.

On these township attorneys - and for a moment this has nothing to do with my attorney situation, I1m just aware of some of the eomplaints - in terms of who actually controls these attorneys. We have had people complain that, frankly, the attorney ends up working strictly for the president or# you know, supervisor, and then iqnores the board. And that -- weive had some real internal fiqhts that have been brought Eo my aEkention. What I'm wondering is, could this in reality be in response to the fact that the boards are complaining that -- that they aren't able ko control these attorneys? What's qoing on? Because we don't want to end up having the board having one attorney and the supervisor havinq another.

I don't really have a question, guess, just don'k understand why we're taking authority away from -- usually the township board has five members, so we dre going to make our five township board -- board members mad at us and make the supervisor happy, I guess: Senator Kelly. It doesn't make -- it doesn't make sense to me to give a1l of the authority to the supervisor, because the attorney also serves the assessor, as well as the board, as well as the supervisor. So I1m not sure why we're qiving a1l the authority to the supervisor. Of course, the board may be of a different party than the supervisor, as well. So downstate we certainly have those problems. You probably have 'em up there too, Senator. But I -- I don't see any real reason Eo do Ehis. And franklye doesn'k sound like the Township officials gave you much of a reason for doing it either: Senator Kelly. Maybe at the meeting they voted on this there were more supervisors present than board members. That's about the only rationale -- I see here. So I -- I don't see any reason to change the laW myself, so I'm voting No.

Under the o1d law, the township supervisors and the township board Were the ones who, in effect, appointed the -- the township attorney. In reality, it was usually the township supervisor who went out and found the attorney, and -- and the rest of the township board Went basically along with it. Township boards still have something to say about it. Number one, theydve :ot to -- it goes with the advice and consent of the township board. In the second placez theydre the ones that have the power of saying khether the guy's going to get paid or not. So it seems to me that this is a logical way to go. If the township -- township officials want the bill, I don't understand why there should be any problems with it. They have spoken to me, as Minority Spokesman of Local Government. They seem to a1l agree that this was the Way to go. Assessors and road commissioners never have had anythin: to say about who they should hire as an attorney to advise the township board.
