So for that reason, Would object to the amendment, and ask that the amendment be defeated.

Thank you very mueh. I've just talked to the -- the people from the Chicago Title and Trust. And my feeling is if this amendment does not qo ony the chances of having this bill passed are -- are -- are going to be a little -- a lot more difficult. This amendment doesn't really do anything except clean up some language that Chicago Title and Trust feels they absolutely must have. Otherwise there's going to be a hidden lien. There is an honest Jisagreement of opinion, it appears, between the Realtors on the one hand and the title insurance industry and the mortgage bankers on the otber, as to Whether this -- this amendment is necessary. 0n -- on the merits and on the substance there doesn't seem to be any reason not to adopt the amendment. And, in fact, for reasons stated by Senator Fawell, it appears that it will enhance chances of the bill's ultimate passage. And I therefore move its adoption.

Senator Geo-Karis offers Amendment No. PRESIDENT ROCK) Senator Geo-Karis, on Amendment No. SENATOR GEO-RARIS; Mr. President, Ladies and Gentlemen of the Senate, my amendment tries to clean up some of the very bad portions of this bill. It requires the following three elements to be found by a judge before convenins a statewide qrand jury: a) The investigation must involve more than one county; b) The investigation and indictment cannot be effectively earried out by a county grand jury; and The investigation must focus on particular offenses. Several state's attorneys have expressed coneern about the way the statewide grand jury can be manipulated by a politically-minded Attorney General, whether he's Democrat or Republican, to run up numbers of indictments of cases more appropriately handled by local grand juries. The bill, as sent from the House: has these same flaws and is without any speclfic critetia for convenkn: a statewide grand. jury. And it allows, two -- my bill would all for my amendment would allow for consolidation of indictments returned by a local grand jury and a statewide grand jury, if the presiding judge determines that this would be appropriate for trial. Three, requires the Attorney General to prosecute an indictment returned by the statewide grand jury, unless the state's attorney agrees to prosecute the indictment. The bill, as drafted, allows *he AkEorney General ko dunp indictments on state 's attorneys, who may not be in a position to effectively handle the trial of them. And four: my amendment amends the powers and duties of the Attorney General to speaifically give him authority with respect to statewide grand juries. The bill, as drafted, is defective, because it does not provide the Attorney General with such authority . Thank you very much, Mr. Presldent and Members of the Senate. rise in strong opposition to this amendment. The bill, as it is presently constituted, now requires the Attorney General to petition the Supreme Court of the State for appointment of a circuit judge to preside over any statewide grand jury. The AG must show cause to the appointed judge why a statewide grand jury should even be impanelled. This means that the AG must first have probable cause to believe that certain individuals are involved in narcotics trafficking and a narcotics-trafficking conspiracy in that region of the State. The region must include more than one county. Any state's attorney in that reqion can appear at the show-cause hearing and convince the judge that a statewide grand jury investigation is not necessary - any state's attorney. The judge decides whether the grand jury should be convened. Senator Geo-Karis' amendment, the one wefre talking about right here, would require that the AG obtain the consent of all state's attorneys in the region before the judge should even impanel a statewide grand jury for whatever reasonv including a politieal reason includin: a political reason. One state's attorney in a multi-county region could veto a statewide grand jury. This amendment Would emasculate the statewide grand jury 1aw and prevent prosecution of serious drug-trafficking cases our State. Senator Geo-Karis would have you believe that this bill cuts the state 's attorneys out of the process. Let me tell you  STATE OF TLLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 21y 1991 how the stateds attorneys are involved in the process and not cut out of the process. This bill involves the state's attorneys throughout the whole process. The bill requires the Attorney General to notify the state's attorney that he's calling for a statewide grand jury investigation. It requires the Attorney General to obtain the consent of the appropriate state's attorney before granting immunity to any witness. It requires the Attorney General to get the state's attorney's permission to have the statewide grand jury impanelled in his county. It permits the State's Attorney to assist the Attorney General in the grand jury proeeeding and in the subsequent prosecution. There is no need for this amendment. It Would severely curtail the Attorney General's power under this bill and create an adversarial relationship between the AG and state's attorneys. The bill now provides for cooperation and coordlnation between the Attorney General and the state's attorney. Letfs keep it that Way and vote No on this amendment.

Mr. President and Ladies and Gentlemen of the Senate, let me point out a few things that my opponent on the other side has not pointed out to you. First of all. under eurrent law, the Attorney General cannot act in criminaliters without the consent of the state's attorney. The same should be true of the statewide grand jury. Only in this cases -- ln khis way will cases that truly should be before *he statewide grand jury be -- be quaranteed. If any state's attorney does not consent, the Attorney General ean still obtain a statewide grand jury if he can show good cause why the grand jury should be convened over the objeetions of the stakefs attorney. The seeond change is that a circuit judge from a circuit where the statewide grand jury is sought to be eonvened: is to be appointed to eonsider impanelling the grand jury. The bill, as drafted, would allow any eircuit judge to be appointed regardless of where the stte is that the grand jury will be. In other words, a person can be riding With someone who uses cocaine and this person not knok the party is using cocaine, ean be picked up in Lake County, Illinois. and if the Attorney General sees fit, he can go to the -- ask the chief judge for a judge in Carbondale, Illinois, and get him and have the situs -- of the grand jury meet in Carbondale when the people are from Lake County. Thls is Wrong. There is no notlce that the Attorney General has to give to a state's attorney before he goes ahead and goes to the ehief judqe and asks for a judge Eo give him a statewide grand jury. think that my amendment makes safe:uards in the bill, beeause I'm aqainst drug pushers as much as anyone, but I do want fair playr and don't want to see these state's attorneys emasculated by a 13  STATE OF ILLINOIS 27th GENERAL ASSEXBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 21, 1991 political football. Thank you very much, Mr. President, Members of the Senate. 14  STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGDLAR SESSION SENATE TRANSCRTPT 48th Legislative Day June 21# 1991 This amendment returns the bill to its original form but takes into account the provisions that Senaeor Hawkinson just talked about, Which removes the requirement that the witness before the grand jury must be given use immunity. Senator Hawkinson's amendment cleared that up, and he uas absolutely correct. That should be treated as a separate issue, and we -- We have dealt With that in Senator Daley's bill Senate Bill 822. This amendment also deletes the provision that the AG must prosecute other offenses that arise in the course of a felony narcoties offense. This provision's not necessary, because the multiple joinder requirement of the Code of Criminal Procedure provides that a prosecutor must join all collateral offenses arising out of the same conduct as the principal offense. This means that if a grand jury is going to indict an individual for drug traffickinq, and the evidence shows that the individual was involved in a conspiracy to commit murder, the prosecutor must move for a murder indictment as well as the narcotics indictment. This is a very important amendment and, I think, will go a long way toward dealing with drug trafflcklng in our State.

Senator Marovitz has moved the adoption of Amendment No. to House Bill 9 -- 316. Discussion? Senator Geo-Karis.

Senator Rock and Members of the Senate, this amendment knocks out my amendment. This amendment deletes my changes. It restores the bill to nearly the same form it came over from the House. It does incorporate the lmmunity provisions from Senate Amendment 2. Then, it's a dilatory amendment since is deleting the changes that I have in my amendment. It leaves the b11l in a defective form. The language is too loosely drawn and has minimal protections for conflicting investigations with state's attorneys. allows the state -- the Attorney General to seek the convening 15  STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 2l# 1991 of a stakewide grand jury by only showing a judge it is necessary. It deletes the requlrement of the violation to be investigated involve more than one eounty. There's no protections in this amendment for people who could be innocent. And therefore, I move that this amendment be defeated.

Senator Marovitz, when you say that there is no eavesdroppinqr didn 't ke pass a bill think it was Senator Barkhausen's bill that allows for drug cases -- eavesdropping electronic eavesdropping? And wouldn't the Attorney General, who is the chief attorney for the State, would he not have the right to do what Senator Brookins asked you if he would have the right to do?

Mr. President, at risk of clouding the issue even further, in response to the last point, I think needs to be made clear that regardless of what some of us would like our laws to say , that the only personnel who have authority to apply for a -- an order authorizing eavesdropping are state's attorneys' personnel, either under the existing law or this bill that's before us or any of the amendments that's before us. This subject has nothin: to do with eavesdropping. One of my main misgivings regarding this amendment is that I'm -- I'm told that it does away With the provision that 18  STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legkslative Day June 21, 1991 would allow for the statewide grand jury to have jurisdiction over other criminal offenses that might be uncovered in -- in the process of investigating a drug offense; so that in the situation Where that happened, then a separate grand jury woutd have ko be convened by the State's Attorney to prosecute the separate offense that might come to light in -- in the process of investigating the drug offense. And I don't think that's a step that Ne want to take here. So, would -- I would urge opposition to this particular amendment.

Al1 right. Question is the adoption of Amendment No. 3. Further discussion? Senator Marovitzr to close. SENATOR MAROVITZ) Well, the intention of this bill and the intention of this amendment is to allow for multi-county prosecutions ën drug trafficking offenses. I don't think that anybody in this Chamber would disagree that the number one scourge on our society is drugs. And that's what this bill and this amendment is intended to do. The amendment reduces the Lottery FY'92 request from the State Lottery Fund for payment of prizes and awards by thirteen million dollars and approprlates thirteen mlllion from the State Lottery Pund to -- for deposit in the Common School Pund in the Common School Fund. The intent of the amendmenk is to reduce the Lottery prizes requested by the amount equal to the Lottery projecticn that unclaimed prize money will total thirteen million in PY f92. Rather than impart an unclaimed prize money dlrectly into the Common School Fund, the Lottery currently uses unclaimed prize amount to ingrease existing prizes, creating special funds or undertaking special promotlons. The Loetery somehow canft get its story straight on how much unclaimed prize money it has used in any given fiscal year or how much of the 41 ? . I I Gross transfers is 20. 5 million, but actually only two point five I I million was transferred . Every year it has been reduced. But the I I I previous Lottery has stated that 10.1 million in unclaimed prize I I money was used in FY'91 to generate 16.3 milllon in gross Common l I school Fund transferred in Fy'90 The above eharts show a l . I I decrease of -- of a hundred thousand ln unclaimed prize money used I I in that year - an increase of seven hundred thousand in the I I transfer that money was supposed to have been generated. Lottery I 1 earlier estlmated that unclalmed prize money would total 12. 8 I I I million in FX '91. Now it says the aaount will be eiqhteen I I million. Which number is eorrect? Alsoe if the numbers in the I I above charts are correct, they show a dramatie decrease in the I Lottery effectiveness in using unclaimed prize money to generate i I qreater transfers. From the net proflt of thirty-one million on a ! I fourteen million investment in 189: the estimated net for FY'9l I I has drapped only -- dropped to only 2.5 million on an eighteen million dollar investment. Given that trend, it is nat unreasonable to assume that the thirteen million in unclaimed prize money projected for FY'92 would generate no net increase in transfer or that the gross transfer could even fall below the thirteen million. I am very much in sympathy with what the Senator is tryinq to do. 1, too, Would like to see more money placed into the Common Sahool Fund. However, I would suggest to you that the adoption of this amendment would have precisely the opposite effect. These monies are used to sweeten the pots and to encourage, generate interest and encourage more people to participate in the -- in the Lottery and also to promote some of our existlng games. If we were to take these monies away from the Lottery, what we do is to reduce the sales of Lottery tickets and therefore, ultimately, we reduce the amount of money that goes to the Common School Fund. I would remind everyone that this was a -- an amendment that was defeated in committee, and we certainly should not be about the business of adopting this amendment on the Floor. I would respectfully request the Senator to Withdraw the amendment; but, if he is unwilling to do so, then I would request everyone to vote No on the amendment, because we are penalizing the Common School Fund by its adoption.

I'm saying this is a clear message to every citizens in the State of Illinois that wedre interested in education; that we spenE the money to do that; that we passed Lottery in the first place to contribute the money to the education fund of the State of Illlnois, which is called the Common School Fund. Number one, this money is spent, I'm told and Was told in committee, to promote the Lottery - to do advertisement, to do extra advertisement. Every year, I've said 43 . -.. J .  STATE OP ILLINOIS 87th GENERAL ASSEMBLY REGDLAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 1991 in appropriation, that -- the advertisement budget for the Lottery has gone up, up and up. It does what it's supposed to do. It does what we are obligated and pledged ourselves to do - give money to the educational fund and for the children of the State of Illinois. I urge an Aye vote.

Last year - and we do understand 51  STATE 0P ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 21, 1991 j we do have a different arrangement this year; we have a different Governor - but there's a lot of things that happened last year that I think we should talk about somewhere down the line with the Department. There are a number of no-bid contracts that the -- the Department entered into last year. As an exampley the ARC group of Chicago secured a hundred and nineteen thousand no-bid contract Eo produce a half-hour pilot program for the proposed television series ''Down the Roadf'. Williams Kuebeleck, of urban California, secured a ninety thousand no-bid contract to study the best option for hotel development at North Point Marina. Seidman Was -- was awarded a twenty-nine thousand no-bid contract to determine whether it is feasible to privately finance over -- overnight lodging. We just Want to make sure that this type of thing doesn't happen. Wefre Willing to sit down and talk with the Department -- sure that those things are done. If they are done, they're going to be done on a bid procedure.

If DCFS operate the shelters and are able to maintain the client census of twenty-five or below, they will be able to claim federal reimbursements. And I don't think that we Want to lose that. The reason that the shelters may be overcrowded, as the Senator has indicated, is because there's a dire need for these facilities in the City of Chicago and in the area that they are located in. There's a dire need for Let me just give you a little history of what we are attemptin: to do as respect to the mental institutions where we closed them and we said that we were going to fund those in community organization, in the community, where these people could be better treated. This is almost the identical same thing. We now notice that we have cut back the funds on funding any community centers, et cetera. And I don't think it take a rocket scientlst or a genius or psychiatrist to go to one of the cities, even here in Springfield and see people eating out of the garbage can and walkin: backwards down the street. That is multiplied a thousand times in the City of Chicago. I am saying to you, yes, thak we are able Eo say Khat we are going to transfer these and do it by private shelters and fund private shelters, and say to you that next year wedll be here cutting budget to go into private shelters. I say that we need to keep control of this, we need to help these shelters, we need this in the City of Chlcago and in the State of Illinois. Now we are taking money aWay from them. Secondlyz youth service providers are not under the four and a half percent Grotberg-mandated increase. This is a group that isn't under the Grotberg provisions and this is more than 4.5 percent. Number one, We can't find foster care parents any more, because most of the women are workin: and very frankly it's it is very difficult to -- to have foster parents. The ones that we do get quite often end up adopting the -- the children they have in foster care and then Withdraw from the program. The other -- the other thing is: if we put this the community services which is sort of like our fifteen hundred boardsz we quite frequently -- we will keep these children on the straight and narrow and we keep them in their own homesg which is really what we sbould be trying to do. I think this is a good amendment, and think we ought to support

Thank you very much. This restores twenty-seven thousand seven hundred dollars into the Prison Review Board. I'm doing this at the request of former Speaker Bill Redmond, and -- and the Review Board. Right now they have two cars that have got a hundred and six thousand miles on it and, by the time they turn them in on Marchy they will have over a hundred and fifty thousand. These -- the Prison Review Board by law must go to the various prisons all over the State. They drive and the staff drives. There has been some question about, well, they could get cheaper cars, but I don't know if a cheaper carz frankly, could go a hundred and fifty thousand miles. And that's the reason they have the -- the more upgraded car. I think we're -- wedre being very penny-wise and pound-foolish When we take this small amount - it's twenty seven thousand dollars, for crying out loud from an aqency like this. I am doing this at the request of the former Speaker and -- and I would ask your support.

While normally, Senator Pawell, it is a minor amount and I wouldn't even bother to oppose it, think it's just -- I have to for one simple reason. We cut about six thousand, this adds back twenty -- almost twenty-two thousand. They are, fact, going to be significantly above - though it's a small agency '9l spending, which would treat them significantly different than all the other agencies. They would have aboue nlne percent growth, and lt's just somethinq we should not be doing, and there's no reason -- I mean -- 1ot of people have a 1ot of needs - we all understand that - but to almost quadruple that which we cut, think would be a mistake to do at this tlme and truly send a bad signal to a 1ot of other agencies as well. I am not at a11 pleased with the proposed amendment, for the reason that there was some discussion some years ago as to whether or not - or some speculation, at least - as to whether or not the State oughk to invest in and purchase St. Anne's Hospital on the great West Side. It was then thought by the Governor that he really didn't wish to do that, for a whole host of reasons. But the fact is I donft think there's anybody at least that Idve spoken with over the past couple of years - that Won't readily admit that the patient care and the research that currently goes on at ISPI simply canft, theydre going to do a proper renovation job. And so there Was a plan to literally move ba: and baggage and patients into . this facility. just think to stop this at this point is not -- is not Well-conceived. We really ought to afford the -- the Department the opportunity to pursue their original plan. There are some who quarrel with the amount. Frankly, was surprised when I read in the paper What the proposed amount was. Yes, indeed, the State of Illinois could have purchased that property for apparently less than will be ultimately spent in terms of renovation and rent. That was a decision that was made, in my judgment, very consciously; but one that we ought not now summarily discount at -- at risk -- at the risk of -- of these patients that are so ably served in that institution. I would like to see thls amendment defeated.

We were originally promised that all of this could be handled with eight hundred thousand dollars. I don't know, indeed, that there is a plan. I -- I mean, I know Representative McGann and I have -- have turned this over ta the Legislative Audit Commission - Webre moving in that direction. I have not heatd from the Direetor of Mental Health on -- on letters I have written him sayingy 'IWhat are you going to do about this?'' I know the Governor is upset by 1t, but really does not have a plan, except what do we do? Thàs is like throwing good money after bad, until we really know What is going to be happening over there. It is a wholesale mess. And T think until we do that, this money would be better spent fn other direetions in Mental Health .

We only did not get stuck in the elevator through the grace of God. But uslng it -- it jerked tWo or three times, and I understoody very frankly, that it was not uncommon for the patients to get stuck in elevators. Now these are -- these are very -- psychotic, yeah, patients and to be -- to be eonfined in - - in a stuck elevator is certainly not doing much as far as the treatment is eoncerned. What they are planning on doing is taking down a skairwell. There is a -- a wall that you can see as you go down this stairwell, Which is on about a forty-five degree angle: because it's bulging out. And there seems to be differences of opinion why. We were told that it was a structural deficiency in the building. To keep this kind of patient inside a building like thak while they are taking down asbestos, removing stairwells, and doing all the other things that have -- that they have to do, is crazy. We should move these patients. I agree with Senator Rock. Unfortunately, it's going to cost more than We thoughtr but k think we ought to do it.

Unfortunately, . the costg everyone agrees, is rather staggering: but there's no way you -- what you should -- that What you should do now is adopt this amendment and stop this in the progress that it's proceeded. You know, you talk about mental health and the Hea1th Code of this State, and the hospitals in this State. St. Anne's closed down, and it Was a very good hospitak. And unfortunately, the West Skde of the City of Chicaqo -- that facility did not provide the medical care that it dld in the past, because of the reimbursement rate. So now we fknally get the State to assume their responsibilities to mental health. Welre asking them to do the riéht thing, and because of the cost - not because of the hospital or the neighborhood or the patients - we're saying now wedre going to stop this funding. I -- I think that this program ks -- ks worthy of the State keeping its aqreement in terms of rehabbing this -- this facility. This facility is now -- has now been taken over by probably one of -- of the agencies -- social service agencies in this State that has ' 89 r  STATE OF ILLINOIS 87th GENERAL ASSEMBLX REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 21, 1991 I probably the highest credibility in terms of their productivity in provlding social service programs and, also, a great track record as it relates to going out and forming various partnerships with private financial institutions and foundations in order to ralse money to provide very critical services in the area. I think that they took over this hospital with the understanding that the State Would, in fact, contribute to this rehab portion of this facility, and that this facility, once they got out of it - ISPI got out of it - would: in fact, be an asset to -- to the community. And I think we should keep that agreement.

Well, thank you -- thank you, Mr. President. Let me just say that this Wasn't a decision by a bunch of us sitting in the Appropriations 11 Committee to cut the budget by 3.3 million without any background information. We had two separate hearings an this issue that -- one hearing. went on for two hours. We brought them back the following week. We went on for another hour. And what happened was there was an expert group that went through this hospital and decided, in agreement with the original contractor hired by the State, that the hospital could be repaired while patients remained in the hospital. NoW if we're going to use as a criteria that the elevator gets shaky when you ride in it to evacuaEe a bullding, we had a1l better ge* out of this building, because those elevators back there get shaky every now and then. That is -- that is not much of an argument for vacating a building. The experts Went through. Arehitects and Realtors and surveyors all agreed that the building could be repaired without moving the patients out. The original contractor said the difference in cost would be 2.4 miklion, if we left the patkents 90  STATE OF ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 2l, 1991 in and repaired the building, as opposed to evacuating the patients and moving them to another spot. What we've done now is ended up spending millions and millions of dollars more than we should have. And if we spend this 3.3 million dollars to move the patients to St. Annez wefre going to be faced with renovation costs, the cost of moving, and ever-mounting costs. I thtnk we should nip it in the bud right now - not spend the money to move the patients to St. Anne, and let the Department go abead and fix the building they are in at this time. Basically what I Would -- the point that I would like to make here is that by the guidelines that we have established and implemented here within the Senate in dealing with the budgets of each one of the constitutional officers, is to appropriate in FY'92 an amount equal to Fï'91 expenditures. Of a11 of the constitutional officers there is only one exception to that -- to that guideline and this is the -- the appropriatlon bill for the Attorney General. So what this amendment Would do Would brin: this spending level down, in the AG's office, down to PY'9l levels, and I would move for its adoption.

I I do rise in opposition to this amendment. And Senator Etheredge is partially correct/partially incorrect. No# he's not the only constitutional officer who sought an increase in his budget; the other happens to be the Office of the Secretary of State. Office of Secretary of State, though basically now raiding the road funds: - with our permission - found himself in the same bindv and that is that a budget in '9l insufficient to handle normal '92 operations. As wedll :et to the Offiee of the Secretary of State, we found that his predecessor left him with no lieense plates - also, he claimed, no postage. We dve agreed those are things that have to be done. Here We find that because of first time union agreements, unlike the other constitutional officers who already have these very same unions in their agencies - and We in fact gave them the increases when they first were unionizedz who are now into several years in those other constitutional officers; this is a first - we have to, in fact, fund it as we've done with ASFME here in many instances, et cetera. Addltionallyy certain funds are in the supplemental appropriation on the Governorgs desk that, in fact, impact the '91 budget. This would take '92 below a reasonable level foE that. Some of that may have been covered in this amendment, but it's takes them below an essential level tc maintain operations. And the reason that I am standing in opposition is that the proposed new program was found by the 11th Circuit Court of Appeals on May 24th of this year that a Florida program similar to this violated the Federal Edueation of the Handicapped Act. The case was Jenkins vs. The State of Plorida. The letter that was sent to the Florida Department of Health and Rehabllitative Services, the offices of the General Counsel of the United States Department of Education stated, and I quote, ''Part B of the Federal Education of the Handicapped Act requires that a1l handicapped children have available to them a free, appropriate public education. Thereforey for education reasons, public funds to which a parent or child Would be entitled, regardless of the l18  STATE OP ILLINOIS 87th GENERAL ASSEMBLX REGULAR SESSION SENATE TRANSCRIPT 48th Legislative Day June 21, 1991 child's residential placement, cannot be used, without parental agreement, by the public agency to maintain the ehild.'' It kould appear to me that the proposed change, as stated as being a new initiative by Senator Maitland, should be opposedê number one, as being a new proqram in a year when we are not doing many new proqrams, and secondly, because the Federal Court is going to declare it unconstitutional in any event. So I would urge Senator Maitland to withdraw the amendment, or not, I would urge a No vote.

I think you could bring third party providers in. think you could bring a 1ot of concerns in here right now. I have talked to the State Board as recently as this morning, and told them of my further concern and I knew of your coneern. My request would be that we allow this to stand, to stay here for now. This is a mateb with loeal funds, slightly dltferent than the Florida situation. In other words, we are matching these Medicaid dollars with local funds at a time when school districts around the State are facing a serious fiscal dilemma as we are. This is an attempt to capture some dollars to assist them with their problem as well. The funds assessed would then be matched dollar-for-dollar by the Federal Government. The federal matchin: dollars along with the original assessments would be returned to Cook County in the form of an additional Medicaid payment. No State funds would be involved and the amendment is budget neutral to the State of Illinois. It's based upon Senator Rock's bill that passed this Chamber a couple of weeks ago. Another provislon of the amendment would -- would permit the Department of Public Aid in Cook County to enter into an agreement whereby the Department Would provide services to the county, Which the county Would pay for. Any funds which Cook County pays to the Department of Public Aid under such an agreement would be eligible for federal matching dollars. This provision would also be budget neutral to the State. And it also reduces General Revenue funds below the Fiseal '91 spending level, actually reducing the operation of this agency belok that which they had last year. And I just think that it's counterproductive to a speedy system of justice of crlminal justice. Ify in fact, we lowered these people, then appeals Would take longer, rather than shorter, and it just does not make sense. I would urge a rejeetion.

In my Appellate Court District, Which is the 2nd District, an Appellate Court judge normally works on a month twelve to fourteen cases. You know what the caseload is for those Appellate Court public defenders? Two to four cases. thatds the best they can do, it's a joke. We ought to all abolish the whole office, as far as I'm concerned, and Iî11 ask for your favorable consideration.

Amendment -- Amendment No. and I'd just say this out loud beeause this is a very substantive amendment. So, if anyone's interested in very substantive amendments, I just want to warn you - this is one. As everyone knows, tbere is a lawsuit against the State's school funding formula riqht now. The Legislature, thus far, has been somewhat inert on the subject, and we really have not been able to come baek with a response. We've had a commission who's been working on it that hasn't qulte been able to come back with a response. This amendment is a response to that. One of the difficult problems is many of the districts are spending so much that the State is simply incapable of bringing the other districts up. I mean, We can't raise taxes enough to do that. What this amendment says in two pages 1411 say in one sentence. Any school district that accepts no State funds can ignore every State mandate but two: special educationg 94-142 of federal; and the teacher certification. Those two issues they are completely bound by. But if they will aecept no State money, every other mandate - and, you know, the mandates are: you know, this Ehick - they can say, ''Good-bye.'' NOW, they have to do it a public meeting. Their school board must meet in public, discuss this public andg in a public vote: vote to do this. So# they'd be relying a hundred percent on property taxes and they must file 135  STATE 0F ILLINOIS 87th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT . 48th Legislative Day June 2l, 1991 sixty days before the beginning of the school year so the State Board has plenty of noticey and they can reconsider it every: single year. As said, this is a fairly substantive amendment. People allege it Would take and again, there's no way to estimate accurately because, until the school districts decide, you don't know - but it could take as much as fifty to a hundred million dollars of new money at no cost to the general taxpayers and shift it from the suburban school districts thae are spending from seven to eleven thousand per and send it to the school districts that are spending more like three thousand per. would go straight back into the formula without any other program. There are limitations to the amendment. There can be some arguments about how it's implemented. But by doing on an annual basis, we hopefully overrtde some of those. With thatz I would offer -- see if anyone has any comments or thoughts. I have offered it to Senator Berman and he seemed extremely excited, and I'm sure he'd be glad to comment. A great number of parents and school board members in the areas that are the higher spenders but are higher spenders based upon property taxes, not based on State aid. The ldea comes from the dozens of meetings with parents and school board people who are very frustrated With the State but recognize that our level of spending really is difficult for the State to handle because they can 't come up With the money to bring the bottom schools up.

- - I think really, Senator, you have oversimplified this by -- you mentioned only two mandates that they had to provide. There are many other that they dre going to be responsible for. Indeed, every school in this State, including the wealthiest in your district, gets State dollars outside of the tWo mandates that you've already mentioned. So, it Would be a substantial - even to the richest school district - a substantial reduction in dollars that they get from the State and that would obviously be transferred to the local property tax owner. I Would suggest to you, senator, that we already have a system in this State that does this, and it's called prlvate schools. And there is always that option available to every parent in this State. And think this is an idea whose tkme has surfaced today and probably ought to sink today.

Thank you. I would say to my learned colleague seven steps to my right - you're right, but think you misunderstood. And because you had not read it: I do not blame you for misunderstanding. You're right. It did oversimplify the proeess. We abolished the process. We abolished it. We simply said if people are willing to pay a hundred percent themselves out of their property taxes or whatever source they decide to use other than State funds: well then, we'll leave them alone. You 're right. You can't get simpler than that. We leave the tWo mandates: special ed 94-142, which is the federal - and we really cannot walk away from that; and the teacher certification. It is that simpler and it must be done in public in full discussion with the parents. But I would say, as much as I would like to move this, because my Education Committee Chairman, who is truly a Gentleman and a scholar, has said, ''Pleasey not on my billy'' will gladly Withdraw the amendment, but We Would like to make sure that this is something being considered because many of the schools that are at the top end of spending can buy this program and have said, publicly and privately, they're very interested in this concept.

And it changes the date when annual returns should be filed on investment tax capital. Allows employers to file W-2 and W-2P via magnetic tape, and.records from optical disk storage can be considered as original documents. We have enabling language to permlt taxpayers to file by electronkc fund transfer. Specifies that property -- used in Illinois by businesses that moved into the State shall not be subject to use taxes. Excludes Circuit Breaker checks sent to the Comptroller from the requirement that any State mailing of fifty thousand or more conkain a CUB enclosure and revises the law with reqard to taxation of business in interstate commerce or business that cannot be taxed due to the Constitution and Statutes of the United States.
