I Thank you, Mr. Presidentr Ladles -- of the Senate. At this ! @ time, Mr. Presidenty I'd like to make a motion to resolve 1 ourselves into Committee of the Whole for the purpcse of i discussing the -- the budget. I think for the past couple of weeks we've heard from both sides of the aisle, including the -- the Leadership, or a1l four Leaders. I think the Stater our constituents, have a right to know where we stand right now as far p i as what would be holding the budget process up and how far we are away. There is rumcrs that Speaker Madigan had a press conference this morning at 11 o'clock to give his point on the budget, on where he stocd. And there is a possibllity -- a rumor that the House would not be in next week, and not return t11l July 6th - 7 what could be rumcr - but I just feel, as a Member representing my district y that I make a motion to resolve ourselves into Committee ! of the Whole to discuss the -- the current budget proposal and what possibly cculd be holding up this Body from -- from adjourning by June 30th.

Well, I don't know if I wculd be out of order. I would -- I would speak for -- ask for a ruling of the Chair, but before T do that, I would like to also speak to his motion. Certainly doesn't make sense to me, beinq a freshman Senatorr Ehat we 're here for two or possibly three days this week, two or three days next week, spending about eighty-thousand dollars a day. That's a quarter of a millio n dollars for a three-day -- that's just -- that's just . I for our per diem, and that's for our expenses as far as getting I here and back. Not talk about phonesr electricities, everything else that we're doing. And the sad part about it is that when I'm I ln caucus, I only hear our side. r have nc idea what the f Speaker 's up tor Minority Leader over therez President Philip. I have to find out what's going on from reading the neuspapers the next day. Seems like we -- what's goingon With riverboat j gambllng, the budget - we have no idea, and we're down here doing absolutely nothing. And I think a Ccmmittee of the Whole may E solvethat At least, as Senators, we 'll know what's going on in . 1 I the process; otherwise, let's save the quarter of a million dollars, and -- and we'll be at our -- our distrlct offices to find out what's going on. So I think the best way to do it would ! be to entertain Senator Raica's motion and have a Comnittee of the Whole. Can we have a roll call on that notion, please?

I think that this is an issue that has been *oo long in coming. The resolution's not a question here. checked the rules of the Senate, and it says when our rules are silenty Robert's Rules enter in effect. There is no rule provlded for calling the Committee of the Whole. Under Robert's Rules, Section 51r Chapter 16r a Member has a right to call -- or make a motion to call a Committee of the Chair <s1c>. So that at this point, the -- actually my resolution is not up. It's just that what I'm saying is our rules are silent on a Committee of the Whole. I'm referring to Robert's Rules, and - - if we're going to overrule the Chair, I'm just asking that -- simply that the motion that I'm maklng to convene a Committee of the Whole, you lre voting with me to call a Commlttee of the Wholez it is to 1et our constituency back home know exactly What we 're doing in Springfield, and what budget proposal seems to be lacking and What we can do to further the process. And House Amendment No. 2 amended the Corporate Fiduciary Acty Which provides that certain investments by a corporate fiduciary and an affiliaee do not have to be collateralized if the corporate fiduciary or the affiliate has a surety bond for the benefit of the ownersr settlers or beneficiaries of the investment issued by a licensed insurance company approved for that purpose by the Commissioner of Banks and Trust Companies. Amendment No. l basically gives the Treasurer -- the Treasurer must cooperate With jurisdictional authorities in putting banking services in State buildings or on State propertyz basically maklng the Treasurer in charge of banking services. Amendment No. 2: It amends the Deposit of State Moneys Act and authorizes the use of other obligations issued, assumed or guaranteed by the State or a similar agency as collateral for deposits that are not insured by the federal government. And that apparently has no problem. Zverybody's signed off on that. No. 3 becomes the bill; reinstates the bill with all of the original language, which got lost in some of the hubbub that was gding on in the Housey and brings it back to its original form . It deposits the State -- it amends the State Moneys Act; authorizes the Treasurer: with the approval of the Governorr tc lend any securities acquired under 14  STATE OF ILLINOIS 88TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 135th Legislatlve Day June 22, 1994 the Act, in accordance With Federal Financial Institution Examination Couneil guidelines, tf securities are collateralized at a level sufficient to assure the safety of the securlties. And finally, No. 4 says that the Treasurer basically must cooperate with jurisdicticnal authorities in putting banking services in the State buildings or on State properties. think the bill has finally been worked out. has managed to live through some hashing that went on in the House. It has come back to us in a form that's acceptabley and I would ask for the adoptlon of these amendments.

It agaln applies only to the State of Illinois Building, where there are existent ATMS that are being run by currency exchanges and by credit unions, and they -- we wanted to give them both equal status so they could see through thelr current lease.

Well, I can understand where you have a -- a lease. But Why 1 I not give the consumers a ehoice? Here you have individuals having to pay the high rates for currency exchanges to cash their checks, instead of going to a ATM machine, where they can delay any payments for a month. I don't see Why we're giving favorable treatment for currency exchanges once again.

The entirety of the bill, Senator Welch, gives them all equal status. So that, indeed, you Would be correct, and that is what we are seeking: that they a11 have equal status to be able to compete for ATMS in the sane buildings.

Ik -- it 7 permits a credit union to serve as a remitting aqent for public moneys to transmit vehicle taxes, license and fee moneys from the ' ! k public to the State. The House: in their great wisdomr added a ; couple of amendments. One creates the Transmitters Money Act <sic>; permlts the Department of Financial Institutions to regulate the business of transmitting money. This was basically clean-up language that the Department of Financial Institutions needed. The second one was expands the Comptroller's authority to I I make electronic direct deposits of State funds without I I ! accompanying warrants. The third one permits a bank to make reverse mortgage loans for any purpose, rather than just for mortgages. And the fourth was -- changes the formula by which khe interest is calculated on mobile home security deposits fron a flat five percent to a passbock rate charged by the State's I I largest bank as of December 31st of the preceding year. This does not apply to moneys collected on behalf of lessees cf facilities of the Department of Agriculture, which are located on the Illinois State Fairgrounds in Sprinqfield or Duouoin. The Leglslative Audlt Commission has been thrashing the Department of Agriculture on a regular basis that it is bartering tickets for State events -- State Fair events with local radio statlons for advertising tlme promoting the fair. They apparently do not have ! the authority to do thls. This gives them the authority to do this. We 've al1 agreed it's a good ideay because lt saves the State money and it works. And I would ask that this -- this amendment be concurred in.
