Thank you: Mr. President. Senate Bill 214 deals With a procedure by whlch someone who has an environmental spill can go to court and îet permission to go onto adjoining land to clean that up. And the bill provides that in granting that permission, the court may assess damaqes caused by the entry. This amendment clarifies that the damages to be assessed are those that would be caused by the entry to do the eleanup, and not those that might be connected unrelated to the entry, such as the spill itself, and would move the adoption of Amendment No. l to Senate Bill 214.

This legislationp Senate Bill 5lr is the marching band legislation, and maybe -- hopefully many of you received letters from marchtng band instructors, parents, hopefully sehool adninistrators, in support of thls legislatlon. What this will allow -- what this legislation Will allow is for local schcol boards to exempt high school students from freshman to senior year fram physical education if they participate in a marching band program for credit. Now: Why do We introduce such legislation? Well, if you have recelved lgtters -- and I -- llke I say, I hope most of you have, you'll find that scheduling is a big problem for students in high school today. There are just so many hours in a day in Which we make available for curriculum in their hiqh sehools. Marching band -- and I've got a -- a letter here from a junior high lnstructor wbo says that she has an 8  STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 21st Legislative Day March 2, 1995 outseanding program and -- and she's excited and the kids are excited about participating in band, and once they ge* Eo high school, because of the limited amount of time that's availabler they drop out, and for whatever reason, lose interest in band and music. I see that as a problem, and see this as a pcssible solution. Now this is not a mandate. We 're not telling them they have to do This allows the school board to exempt those students, and actually the student has to ask. So it's a situation in which if the student dcesn't necessarily want to get out of -- of physical educationy they don't have to . If the school board doesn't want to allow it# they don't have to. So this just simply says that if you're involved in marching band for credit, you w111 not necessarily have to participate in physical education if your school board so wishes. 1'11 be glad to answer any questions.

So what we are doingr in essence -- We pre doingp in essence, is giving certain categories waiver from the mandate, as such. Only thing I'n saying, Senator Watson -- I knok what you are trying to do, but what I'm saying, it becomes terribly confusing to the school boardsr the students and the admintstrators if we contlnue to pass piecemeal legislation, when we so indicated that we want the school boards to be able to act and control at the local level. Now we are, again, passing more legislation and, you knowr I know what you're attempting to do, but I don't think it's in -- in the best inkerest of the students that and the school systems, if we continue to pass piecemeal legislation.

Well, seems to me that the results of that electlon are Mezy clear/ that people don't want that on thelr tax return. It seems to me to be a waste of time to put it back on there. You know, we keep *hrowing these thlngs on the tax return and cluttering it up. You know, I think that we should reduce the amount of paperwork that we have and eliminate some of the bureaucracy and cut down cn the -- the printing costs for the State. And I think a gacd way to do -- do *hat is *o keep thks off of that ballot. I think that that sounds lkke good ideaz especially after November Bth of 1994.

I was just curious as to whether or not you can give such a raise to this type of a board during their term of officey and my understanding is that they have a four-year term. Is there any provlsion that specifically indicates that they can't be qiven any kind of -- not a pay raise, but a -- a salary during thelr current term?

So this legislation authorlzes a more active role for *he exis*ing water management agency and the -- the salaries are small enough for the members of the board and the chalrman to be very conscionable.

When we started this agency, we -- the requirement was that they Would receive no salary, and we put a ten-year sunset provision on this for the very reason to flnd out if, in fact, an agency such as this could do -- wiEh local control, could take care of an area that, I might add, is the world 's busiest locksy in McHenry - have more boat activity than any other locks in the World, and that's pretty -- a busy plaeer as you know. Seventy some thousand boats go Ehrough there every boating seasan. When we talked to the voters about renewing the approval of this, voters overkhelmingly saidy yesr let's continue the work on Ehls. And when we talked to the people we said, well, we want these board members who are elected - three from , believe, Lake County and three from McHenry County and a chairpersan to represent the two areas - that we should at least allow those people who have been spending neetings every week to at least get a stipendy and that's the reason we put in a limitation of what i: could be, of only three thousand now, in a whole year's pericd. Now the meetings they had in one year alone, believe, was like thirty some meetlngs one year, which is -- almost minuscule when you think of hcw much they would get. So we felk thaE it was a reasonable eost of doing buslness, Eo try to preservq what is one of the biggest recreational areas and eeonomic developmenk areas in the Cbain 0 9 Lakes areas of Lake and McHenry County, and going down to Mane County too. Some of the areas we did r and I -- Eo answer your question - How do they get the funds? It prevents us and has helped us from taking State dollars continually, by allowing them to work with local government an working with the State to do what we think is one of the busiest waterways in the World. This is really a well-thought-of bill. It -- worked on it all last year. This is two years of trying to draft that to meet a11 the concerns of everyone. I think it certainly deserving of everybody 's support, to preserve this natural resource.

Senator Watson, the purpose of -- of CHIP was to make available an insurance plan for basically middle class who could not go out and get their own insurance but didn't . want to go on Medicaid in order to get State coverage; they Wanted to continue working. This will allow the -- what we put into laW of the hundred and thlrty-five percent of a normal premium to be Waived in certain limited instances, but only if the funds are available.

I think this bill has worked extremely Well the Way it is written right now . For us to try and expand this, at this point, is -- is very foolish. It has worked. It -- it is covering people who have had heart attacks, who have had lupus diseasee that type of disease, who don't want to go bankrupt, who -- Who can afford some insurance if, indeed, they could get it. The problem was no insurance company would give it to them. I've had a teacher, for lnstance, who was perfectly willing and able to work, bu* nobody i would hire her because of a past medical condition. Once she got the CHIP insurance and saldp HThis will take care of khe problem'' they were more than happy to -- to put her to work. This is a good program the way lt ls right now. First of all, this is a recommendation of the Comprehensive Insurance Plan board. is no* something that I developed or conceived ofy but rather as a member -- nonvoting membery like Senator Madigan, of that board, we have always trled to accommodate the board members on what they think. But let me just take a minute, can, to read the new language. And that is: it merely allows the board to ''establish conditions and procedures'' -- Mconditions and procedures under which *he plan may, if funds permit, discount or subsidize premium rates that are paid directly by certain plan participants who meet a means test and other qualificatlons.u So the point of is, again, you're trying to impact those niddle class vho are trying to eork and have no insurance and have one af these preexisting conditions but do not have enough money to afford the four or five thousand dollars in premium and want to stay working and not go on public aid. If the money is available within the amount suggested by the Governor, passed by *he General Assembly and signed by the Governor, then they can, in fact, allow this to happen. I think it's a good ideay and I would suggest a favorable roll call.

This one creates a incentlve to people involved in the Public Aid Medicaid systen to step forward and give us ideas on how to save money for the State and the federal governnent, since we get a match, and to do so by bringing forward to us thetr ideas on how we can save money, and if accepted and if within the budget we actually save money, we give them a very small percentage of what *he first year's savlngs is. This ls very similar to that which I created probably a decade ago in the Employees' Suggesticn Award Board that has Worked very effectiveky in getting employees to step forward and flnd us ways where we can save money and we allow them to participate in a small Way in those savings. This saying to the provlder community, do likewise, particularly at the middle and lower levels of the provlder system. Come up with some ideas that can save us some money, we will gâve you the benefit of those creative ideas in a small way and save the taxpayers a lot of Roney at the same time. Currently, the -- the rank of serseant or above kncluded. Basicallyy this bill applies to the Chicago Police Deparkmenk only and would qive approximately two thousand peace officers -- police offlcers the right tc collective bargaining. Currentlyr in the City of Chicago , there are about thirteen thousand patrolmen and detectives of the Chicago Police Departmenk that may join the collective bargalning unit, Which is currently the Fraternal Order of Police. Once a police officer is pronoted to sergeant, lieutenant or to captain, State 1aw prohibits h1s membership in this -- in the Fraternal Order of Police. This also -- this prohibition is also applicable only to the City of Chicago. Every other municipality, every -- every other clty in the State, the police officers above the rank of sergeant -- or patrolmen, including the rank of sergeantr lieutenants and captains, can join collective bargaining units. This bill would allow police officers in those ranks to continue thelr membership and to agree on working conditions with the City. This affects about fifteen hundred police sergeants and four hundrqd lieuEenants, and forEy-nine captains whlch are nonexempt in rank. And it's my undêrstanding, *hê captains are -- *he captain rank ls going to be slowly phased out in the City, so there Will be -- affectin: only khe sergeants and the lieutenants. Historically, police officers over those ranks have been given parity; they have been given equal treatment by the Cëty of Chicago whenever the collective bargainln: agreement was reached With their subordinates. But for some unknown reason, and recent history shows, that the City has been nonresponsive Eo Ehose officers. The leadershlp of the the Sergeants' and the Lieutenants' Association came up Eo me and they sakd Ehat Ehey really didn't want to go forward with this bill if the City would at least communicate and have a dialogue with them . They would be exenpt from this. But the police officers that are not exempt the captains, lieutenants and sergeants would be included in here. And they are not in policy-making decisions; they are in policy-enforcing decisions.

It's a bad precedent to do thlsr and when we talk about local governments having to follaw the dictates of the federal government, follow the dictates of the State, and -- and you, Senator, you sponsored the tax cap even though it was very limited. It didn't hit the Ckty of Chicago properr because maybe this bill would not -- maybe you would not have sponsored thls bill. But What I'm saying to you -- what I1m saying to you, as -- as it relate to peace officers to collective bargatn for their working conditlcns, they are sworn personnel. We 're not talking about security guards, as such. We are Ealklng about someone who is out there to serve and protect. And if theydre going to sit down and bargain for the type of -- those type of rights as related to the citizens of the City of Chicago, then I donlt think -- I don't think that you are -- this bill is in the best interests of the people who ïhey are committed to serve and protect as peace officers. BuE it does carry wëth it -- it does carry with it a fiscal impact, because lf they sit down and say, ''I want a ten -- ten-percent incrqase in my salary'' the City may decide Ehat, ''We only want to give you five percentd'. If youdre going to glve them under colleckive bargalning, it does carry a fiscal lmpact. It's an impact on the homeowners and Eaxpayers of the City of Chicaso, and this bill should be defeated.

Hello? Okay. Working conditions not only mean a fiscal impact or -- cr when you're talklng about collective barqaining, yousre not talking about just the salaries of thP police officers. The lieutenants, the sergeants and the -- and the captains are not disputing their salaries. They admit that they are very well paid, and they are not complaining abcut the money. What they are are concerned about are their unit assignmentsz their shifts and the seniority. Many times they are being transferred, arbitrarily; they are being assigned overnight, across the City. And this is nothing -- has nothing to do With fiscal responsibllity. This is allowing the police officers above the rank of patrolman and detective to be able to bargain collectively with the City. Like I said earlier, it affects just the City of Chicago and gives them the same rights that every other municipality has in the S*ate, and I would ask your affirnative support.
