Thank you very much, Madam President and Members of the Senate. Amendment No. 2 to House Bill 901 is the agreed-to amendment that we talked about yesterday in committee, and it does apply a -- a seven-year sunset to this legislation. And I would move for its adoption.
(SENATOR DONAHUE) Is there any discussion on House Amendment No. -- or Floor Amendment No. 2? Senator Welch.
Senator, why are we putting a -- a sunset on -- on this bill? It seems to me that these leaking underground storage tanks have been a problem now for fifty years. We finally got up the courage a few -- several years ago, in fact, to put a tax on gasoline to pay for the cleanup. It's obvious this is going to continue for another forty years in the future. I don't see any -- any benefit to putting a sunset on that seven years from now. What that's going to do is force another Legislature to meet to -- to pass an inevitable fuel tax at that time. It seems to me that in order to avoid that, we should just pass this bill without any -- any sunset on it.
(SENATOR DONAHUE) Senator Maitland.
Thank you very much, Madam President. Senator Welch, I -- I understand your concern and that -- that concern has been voiced to me by a number of people. Our concern is this is eight-tenths of a cent per gallon. We support very much the legislation and think it needs to happen. As you know, the rules and regulations that we -- that we will use for the whole program have been 28 47th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT May 11, 1995 altered greatly as a result of -- of Senate Bill 300. We don't know really the amount that's going to be needed. Could be more at some point; could be less. But this is a seven-year program now, eight-tenths of a cent per gallon, which costs a lot of people a lot of money for a long period of time. I'm prepared - and I won't be here -- but others should be prepared to revisit this in seven years to see if it's needed or possibly more is needed, perhaps less is needed.
PRESIDING OFFICER: (SENATOR DONAHUE) Senator Welch.
Well, my understanding, this amendment comes through the -- through the drawing of the Farm Bureau. A few years ago when we passed this, we exempted all tanks under eleven hundred gallons, which was designed to take care of the Farm Bureau at that time, and they were happy at that time. To me, this doesn't make sense for them to jump back in this when they have already been taken care of. This is an eight-tenth of a cent per gallon tax; however, earlier in this year, we also eliminated the joint and several liability provision that allowed cleanups of many of these gas stations. Now what you're going to have is this: If you've got a gas station -- and let's say it's Phillip's 66 leaks, you've got joint and severable liability. The Joe -- "Joe Six-pack" or whoever, who owns the gas station, is going to be ninety-five percent responsible. Phillip's 66 may be five percent responsible because of the tort reform that we passed earlier. It seems to me that -- that it's inevitable that we're going to need a lot of money to clean these up, and there are so many underground tanks that are still being found, it doesn't, to me, make sense to put this amendment on at the behest of the Farm Bureau, which has almost no -- no coverage under the bill in the first place.

Number one, a farmer's tanks are exempt from the the clean-up issue if they're over a thousand gallons. a two-thousand-gallon tank, we are -- we are included. right: eleven hundred gallons. But we pay the tax. tax anyway. That eight-tenths of a cent is paid by truckers and everybody across this State. And we are simply saying that -- and we support the notion. There's no question about that at all. We believe it ought to be done. If I have a leaking underground tank, I have to pay to have it cleaned up. don't get the benefit of the -- of the -- of the tax at all, and I to take to that's fine; I'm willing to pay that. But the point is, why just put a tax on forever - forever - and -- and, you know, not even have any clear-cut knowledge of how long it's going clean up these -- this underground storage problem? I think it's the proper way to go. Yes, Farm Bureau is supportive of this, but there are many other groups that are supportive of it as well.
PRESIDING OFFICER: (SENATOR DONAHUE) I'm going to ask you, please, one more time, to keep your conferences down so we can hear the discussion on the bills before us. Senator Mahar. Excuse me, Senator Welch. Senator Welch.
Well, it just seems to me to be unfair that when the Farm Bureau got the exemption from this -- and that was a contested bill, as I recall. It was at one point five hundred gallons, not eleven hundred. It also exempted all above ground storage tanks as well, at their request. And now, after they've gotten these two exemptions, to come back and say, "Well, on top of getting the exemptions and not be included in the Act, we don't want to pay 30 47th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT May 11, 1995 the tax either," it -- it just seems to me to -- to strike me the wrong way that they -- they were able to not be included in being required to clean up where they have spills and now they don't want to contribute to spills where -- where there are gasoline stations, usually in municipalities. It just -- it just -- well, that's exactly where most of the gas station spills are, are in cities, in inner cities. We've got situations in my area where ice cream stands that we didn't even know were gas stations, when they go to sell them they do the environmental impact study. They found out this used to be a gas station with a leaking underground tank. Now, that's going to happen throughout Illinois.
PRESIDING OFFICER: (SENATOR DONAHUE) Senator Maitland.
Well, Senator Welch, I don't know whether you're confusing everybody else as much as you are confusing me. The farmers are paying the tax. The farmers are paying the tax. If I have a leaking underground tank on my farm -- and I have -- I don't get the benefit of the cleanup. I have to clean up that leaking underground tank myself. So I'm -- I'm paying the tax and not getting any benefits. That's okay. I'm prepared to do that. But -- but you tell the farmers in your -- in your district that you're going to put this tax on forever, as this bill does -- and keep in mind, Ladies and Gentlemen, the -- the existing three-tenths of a cent is still on. Why just add a tax with no with no future at all? Just -- just -- let's give it seven years. Maybe we'll need more; maybe we'll need less. That's what I'm prepared to tell the people who I represent.

It's certainly within the proviso of the Members of the General Assembly in seven years to handle this -- to revisit this for one very simple reason: This fee is going to generate forty-six million dollars a year. That's a heck of a lot of money, and it's going to be paid for by all the consumers here in the State of Illinois. And we should -- make sure that we get back to it and see if maybe we don't needed forty-six million dollars. So I would hope that we would all support this amendment.

What Senate Resolution 32 does -- does is to hold four public hearing. Each hearing -- I'm sorry. It's so long. We didn't know you were coming to this, Madam President. What this resolution does is direct the Senate Revenue Committee to continue the study and effectiveness of tax expenditures in general and also directs the committee to study fees imposed by State agencies.

May 11, 1995 It seems to me that if it is truly to be a committee that is going to review, and particularly if it is an oversight committee, it would seem to me that there would be bipartisan support in the appointments. As I see this, it's six Members: two appointed by the President of the Senate and the Speaker, and one each appointed by the respective Minority Leaders. If you want true oversight of this significant problem, it seems to me that there ought to be the equal number of -- of Senators and House Members from each political party represented on this committee, if it is to have the credibility that I think that you wish it to have. And I would suggest that if it is of the nature that I have mentioned in terms of your objective, to -- to truly oversight and truly review, I would suggest that it ought to have equal representation from both the -- both Chambers and both parties and would ask that if that is your notion, perhaps we could amend this and make sure that we do have the equal number of Members that would give you the credibility that I think you're seeking on this committee.

Yes. Well I'd just like to point out for the Body what's what's happening here. The two major issues that we've been facing this year have been the Medicaid issue and funding education. On each of these issues now we've created tasks force to advise the Legislature what to do. If you look at the Calendar, we also passed a resolution earlier directing the Senate Revenue Committee to -- to continue a study. Down farther on the Calendar, we've got a resolution -- we've got a committee on the Illinois electric energy policy to tell us what to do. It seems to me that -- that we're taking all of the authority of the 42 47th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT May 11, 1995 Legislature and it's devolving upon commissions and committees and outside groups instead of Legislators themselves handling these issues. This just seems to me to be the wrong way to go. I think that we should use the Senate committees themselves as the structure to -- to review this policy. Certainly the Medicaid policy is one of the most important ones we have, and it -- it just seems to me that we keep shifting the responsibility to these commissions. Maybe in a -- in a rush to get out of there by this new deadline -- the end of May -- that's necessitating this. But, to me, it seems to be a trend that we're facing that is not a good one.

In fact, you actually opposed both of those bills. Do you expect this committee is going to, in any serious way, consider how this State, finally, is going to catch up on its old Medicaid debt and to bring it down to a screeching halt, rather than the approach that we've been taking?

I hope this task force is going to be serious about seeing how this State, finally, is going to catch up on its old Medicaid bills. We had testimony in the Appropriations Committee just a few days ago by the Director of DORS who admitted that while she hoped it wasn't true, that some Medicaid bills could be as old as those services that were conducted in July of '93. I think the Medicaid deficit continues to grow, and I hope this task force is serious about doing something, since we've not achieved anything yet by way of committee.

I rise to express my concerns about this resolution, because as a co-chair of the Democratic Leaders' Task Force on Medicaid and Welfare Reform, we would like to have equal input as the sponsor of this piece of -- of this resolution should be able to provide in this legislation. I'd also like to point out that earlier during the Session, Senate Bill 1170, which was sponsored by Senator Jones, which was defeated in committee, would have provided for equal representation on such a task force, and that's why I would urge the Members on this side of the aisle to vote Present on this matter.

One of the Members talked about the balance of -- of the committee; another suggested it should be the makeup of the committees, which certainly isn't balanced Republican and Democrat. I view this as a very nonpartisan, bipartisan effort. I think it is -- is something we ought to move forward with, and I would seek the support of the Body.

We recognize that the Medicaid situation in Illinois is not a partisan issue and that's -- that's why we put forth legislation to set up a bipartisan oversight commission to deal with this on a ongoing basis. And it came out of our task force, but unfortunately, I believe on your side of the aisle you saw fit to -- just to bury those things in Rules Committee. It is a ongoing problem, and -- and it's very unfortunate that you have made a partisan problem by -- by appointing a larger number of Republicans to the commission than you do Democrats. What it basically states and restates for the Members of Congress is the Tenth Amendment. It reminds Congress that they should not be sending mandates back to the State, such -- such as rules that we're going to deal with, for example, in -- in a resolution sponsored by Senator Mahar -- I believe it's the succeeding resolution -- but basically is a restatement of the true relationship between states and the federal government. The resolution has its impetus from a Supreme Court case in 1992 in which the United States Supreme Court held that Congress does not have -- should not commandeer the regulatory processes of any state and substitute its own judgment. But in this one, what -- what is the point, if you're not doing more than restating the Tenth Amendment to the U.S. Constitution?

What we are saying here in -- in the State of Illinois, hopefully, with this resolution is: Look, for forty or fifty years, you've sent -- sent us mandates that are unfunded, you have passed legislation which has required us to challenge you in a court of law. Let's just stop the -- the nonsense. Let's get back to, really, the relationship of the states. You are, in essence, not our master but our agent.

Seems to me that what this issue is is an excuse or a prop to allow the the lawyers for the State of Illinois to go into court with more ammunition saying that, well, we don't have to follow the motor-voter law because we've got a resolution saying we don't have to. And when the when the Republicans in control of Congress balance the budget, they want to eliminate Amtrak. Now, how can a person have voted both to balance the budget and vote for this resolution and be consistent? I don't -- I don't see, Senator Madigan, how a person could do that. If you're following -- if you're a follower of Senator Watson, I think you would probably have to vote No.
