This is a proclamation from the Executive Department, State of Illinois. (Senator Watson reads and presents proclamation) I want to take this opportuniky to introduce now the Majority Leader of the -- some call him the Assistant Majority Leader, but we all know he's the Majority Leader of the Senate, Stan Weaver, who's been a good friend of Dike's for a long period of timer and I'd like for Stan to say a few words.
Thank your Frank. Dike and I go back many years. I played football against Dike in 1941 and '42. Yeah, they beat us. We were in the U.S. Army together in Miami, Florida in boot camp . Dike was out on the beach conducting physical training. I was just a buck private in boot camp. After the war, we b0th came back to University of Illinois, and then shortly after that we did a little officiating together. Didn't we, Dike? So we go back a long time, and I want you all to know that this is one of the greatest guys that's ever been a product of Illinois and the University of Illinois. Dike, can we get a few words from you?

However, the revised portion of this bill Was -- a difference was made in the language at the request of Senator Raica and Senator Donahue, which requested that we took out a provision that all applicants would be recipients of this training, the parental skills training. Thls bill states essentially that only the recipients will be tbe beneficiartes of the parental skills trainlng . And I ask for its adoption.

Yes. Thank you, Mr. President. I appreciate you going back to this order cf business. This is Department of Public Aid's Medicatd reform package. It involves allowing the Department to conduct certain demonstration programs so that the Department can match Department of Unemployment <sic> Security ls information on whether someone has actually had earned income. This Will actually help the recipient plus the Department. They will be asked to report their earned income on a quarterly basis rather than monthly. This creates a violation of an unauthorized use of a Medicaid card. If someone gives another individual their Medicaid card, currently there is no violation for that. This creates penalties for that type of activity. Another prcvision excludes post -- education prosrams from the requirement thaE literacy and -- that an individual would be -- the test for literacy and English proficiency - there's no reason to test someone if, in fact, they're obviously in a post-secondary education program. Right now there's a requirement that they do that. Thisz again, we think is a recipient benefity but also will help save the Department considerable money. There is a limitation on an education program for two years. This says that an individual must be out of the program within two years, but this does not apply to high school enrollment, only 25 ' u. .. - . STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 51st Legislative Day May 17, 1995 post-secondary, and they must work while they are involved ln a post-secondary program. IE allows a private employer to be lncluded in the work experlence program . Prevlously private employers were not allowed, and it was only for public employers. We think by opening up this to the private sector, this will also increase benefits and the possibility for those recipients go to work. This allows the Department of Public Aid to sanction voluntary participation in employment programs if they do not meet progran requirements without good cause. And finally, Mr. President, this allows the Department to assign unemployment AFDC recipients Eo the unemployed parents work experience component of the Jobs Program. This is a package that think involves many reforms in which will b0th help not only the Department, but also those recipients, and then hopefully help them become productive members of society.

This expands the Whistleblowers' Reward and Protection Act, which now lt permits State colleges and universities, school districts, public community distrlcts -- college dlstricts, municipalities, and other units of local government to elect to adopt the provisions of the Whistleblower Reward Act. It -- it sets up a fund where the monies will be distributed one-sixth to the Attorney Generaly one-sixth to the Department of State Police and two-thirds to pay awards and attorneys' fees and expenses. House Bill 323, as amended, represents the compromise between the House version and the senate version lnsofar as a solution to the retired teachersl health insurance problem that of us have somewhat of a passing interest in. Let me try to explain some of the hlghlights of 1t. First of all, CMS will take over the administration of the health tnsurance from TRS effective January the 1st, 1996. TRS Will nat -- ory the health insurance retirees will not be part of the State plan. They will be a self-lnsured plan administered by CMS. The seventy-five percent subsidy will continue for the TRS annuitants, unless managed care is avallable and they opt not to choose managed care and desire an indemnity plan. that case, their subsidy be reduced by twenby-five percent to fifty percent. Additionally, there are some who are on the TRS retired teachers ' health insurance that have a very short period of time of service in that system. This bill prospectively provides that in the future any retirees that desire to come onto the plan have eighE years of creditable service with the Teacher Retirement System . Active teachers will contribute a half a percent of Eheir payroll towards *he cost of this plan. Finally, lt raises *he mlnimum annuity for Chicago teachers and downstate retired teachers from four hundred and fifty dollars a month to seven hundred and fifty dollars a mcnth. We've done it with a lot of pension I sweeteners over the years But if we should have learned any . 1 1 ' lesson from previous generations, is that we can't afford to I I constantly be increasing Stake spending and socializing all costs I I that people have in society and putting then on the backs of our 1 taxpayers. At a time when the federal govecnment is ttying to cut I i its budget and cut entitlenent spending, we here in Illinols are 1 I just about to ccmmit ourselves to gigantic future liabilities from I I which it will be very hard, lf not impossible, to ever turn back. l l I think very highly of the retired teachers of thls State . I have I I I spoken to their groups on many occaslons. I fought very hard to I I try and help get their penslon system fully funded. But we're I i struggling just to fund their pension system, and we barely have I I the money to do lt. In fact, we can only afford to fund thelr I pension overfiftyyears. AndwhatWe'redoin:herenowiswe're 1 promising to pick up, commlt ourselves to, neW spending ehat we don't have the money to do it. Now, al1 of my constituents Would lave it if the State government would agree Eo pick up their healEh insurance. They 'd love it if we'd agree to pick up their electricbtllsandtheirmortgagebillstoo,butwe can't afford 1 I it. And you know what? Many of the retired teachers of this 1 I State don't Want their grandchildrgn to be saddled with tbe debt i I that our State poEentially ks imposing on their grandchildren by 1 I committing to such spending. Ialsofeelthat Senator Fitzgerald is j being consistent in his viewsr and I compllment him for that. There's no questlon that this is golng to cost the State twenty-two million dcllars in the first yearr and it's something which is a publlc policy decisionp which we are making, that we feel that we ought to dc this so that their health insurance continues. I only point out the fact that it only applles to the rettrees from the systems other than Chicago. The Chicago Teachers - the way that's funded is by a prcperty tax levy Which is imposed on the City of Chicago. We obvlously don't have in thls bill a property tax levy for the rest of the State to pay for their health insurancer so we 're taktnq it out of the General Revenue funds. It's a publtc policy declsion. I happen Eo support it. I thlnk Senator Fitzgerald Was very articulate in expressing hisoppositkon,butIfeelit'ssomethlngWhich,given the fact that they are out of money, we have very llttle l ' alternative. There is contribution - an increased contribution - requlred of the -- of -- pardon mey of the active teachers to contrlbute one-half percent of their salary as part of the -- the compromise on the bill. Unfortunately, must be dreaming because I do hear that there are other propcsals that may very well be the works, but I want to rlse as a cosponsor to support this program. The fact of the maEter ls is that thls is the only State retirement system that We don't contribute one nickel toward health insurance to the reclplents. The fact of the matter ls is that the State Retirement System came to us in 1983 and said: Give us authorizing legislaticn, that we want to pay up to twenty-five percent of the total health care costs for those individuals who were in the program . At that tkme, the cost was around two hundred thousand dollars. 1993: they came back and sald: We want to up that to seventy-five percent. We the Legislature gave them the authority to do that. We haven 't given them one red penny, not one dime, to -- to allow them to have that opportunity that the other pension systems in Illinois have. The fact is now that we're going to make the active teachers pay. The fact that they have gcne to managed care, they have themselves taken a number of -- of strident and -- steps, stringent steps, to reform their own system. I think this, ln factr is public policy that we ln this General Assembly established ln 1983. We ought to own up to our obligationy or we ought to repeal the Act.

Mr. President and Ladies and Gentlemen of the Senate, Senator Peterson and I talked to hundreds of retlred teachers in our area, and ' I can assure you, they would like this bill passed . Furthermore, the present teachers will bp contributing .5 percenk toward this fund. And the reason the Chicago teachers have much more money in their retirement fund is because of the tax situation they have in Chicago. But we don't have the funds, because I think the federal government said We couldn't use the lnterest from those funds that we did have to apply to the medical bllls. This is a good blll. It's -- we -- we started -- we gave our word on thisz the Leglslature did. We can't go back on our word now. You give your word, you've got to keep it. And I think it's only fair that we support this bill and be fair to those retired teachers who rettred early on the basis of this. Many of them are very i11 and really are stuck. We can't be inhuman. There's such a thing as being more human, and I believe in I supporting this bill.

We have a lot of retired teachers in my area who -- who taught a lonq time ago and taught me# as a matter of fact and - that was a long time ago - and they -- they're trying to live off four hundred and fifty dollars a month. That's the minimum that retlred teachers receive. What's happened now is the Teachers' Retirement System has sent a letter to those -- to al1 teachers in the System acknowledging the fact that, yes, indeed, if somethlng isn't done by the General Assembly or lf there isn't a means by which the System is taken care of financlally, they wlll have to bear the burden of the health lnsurance on their own. In many cases - in many cases - these teachers who live cff four hundred and fifty dollars a month - that's all they're getting; that's it - are going to be asked to pay that and posskbly more for the coverage of thetr health insurance. Nowr I don't think that's What -- I don't think that's what government's about. I don 't Ehink that's what we're about here in Springfield. I think that we have a responsibllity, as Senator Geo-Karis mentioned, to maintain the integtity of the System, a system in which, Senator Demuzio mentloned, we established by giving them the seventy-five percent. We established that here by a record vote of the General Assembly and a signature of the Governor, realtzing, of course; that that Was several years ago. But we do have an obligation and a responsibility and we should live up to that, and We should support Senator Madigan in his efforts. Thank you. .

These people have -- have been entrusted wlth the most precious resource we have - our children - to try to prepare then for the future and have absolutely dedicated their lives to this. And then for us to expect them to live on four or five hundred dollars a month is totally wrong. You know, I -- I thknk thatr really, the State should be picking up a hundred percent of this cost. The State doesn't pick up their fair share of the cost of education anyway, but thls is the best we can do . But I think we have a responsibllity and we owe thls Eo the retired teachers of this State to see that they are able to live their later years in -- in halfway ccmfort. Just briefly. I think Senator from Lake County hit it on *he head. I mean, we -- wedre doins this not because it's -- everybcdy's happy about health insurance - hpalth insurance costs are skyrocketing - but we gave our word, so there are people out there who are depending on us. What we dre goln: to do in the future, that's where Senator Fitzgerald is absolutely rlght. I don't know where this is going to go. Hea1th insurance costs are skyrocketlng. I have no idea what we're going to do. But the best part of this bill that nobody 's mentioned is it takes it from the pension fund, put it to CMS. This is pension funds and the business of pensions. These trustees should know about pensions. They 're not health insurance experts. Let's take it away from the pension funds, give it to CMG. It is a good 39 . What We'çe being asked here is that people in Chicago should help pay for doWnstate teachers' pension health insurance. We have to do it 'cause we gave our word. But just be aware that Chicago has to pay for its own with no help from downstate, but Chicagoans are now asked to help foot the bill for some of the health insurance costs of downstate teachers. But I still stand in support of the bill.

If some of my colleagues had had the opportunity to attend hearinçs where you have eighty-two- and eighty-three-year-old retired teachers living on a minimum pension of four hundred and fifty dollars a monthr no Social Security, and lookinq at the potential Of having their health insurance go up to over four hundred dollars, I don 't think anyone in this Chamber Would consider this to be a Santa Claus btll. It is disgraceful to think that these people Who dedicated their lives -- and many of them are not vested in Social Security: because they were not abLe to -- to parttcipate (n Social Securlty as schoolteachers. And many of us had a mandate in our contract that we could not marry. So the unmarried ones couldn't even get the benefit of their husband 's Social Security. And on the first Saturday nigh: of that particular school year, the new student transferrtns into Hinsdale South High School tragically shot the football mascot to death. Through that tragic incldent - and I believe manyr many types of things that have come along in the State of Illinois with respect tc juvenile crime - we discovered that oftentimes new schools are not aware of the past disciplinary prcblems of incoming students. And What I try to do here is establish a one-page form that would be sent from the o1d school to the new school to warn the new receiving school whether they have a problem student coming. There's another companlon bill on the Calendar that deals with 1aw enforcement officials notifylnq schools of problem students also comins ? and this unfortunately, Ladies and Gentlemen, reflects a -- a sad state of affairs, but reality: Where schcol officials need to know that somebody new is coming in with a disciplinary problem. It makes it on a one-page sheet, and I have the bellef and faith in the State Board of Education, which -- with whom Wedve worked extensively on this bill, that the school districts out there will know that this requirement is there, like they know of the currene records going to a new school today. It's simplistic. It's easy. And I believe that the neW school districts or these school dlstricts will -- w111 clearly understand this is there. It's simple. It's a one-paqe form . I do have some problems i with this. When I was teaching school, just as an example, as an : Engllsh teacher, we dld notwantstudents to read the same book 1 for four years of their hlgh scbool careerr so We developed a form where teachers Were obligated to wrlte down the books that students read and we passed this from year to year. Unfortunately, that form became also a means of commenting on students: and 1'11 never forget the one comment I got on a student's report that said this child ïs Latvian and lazy. And I thought that that was totally inappropriate. And I'm wonderlng, what part would this form play in this child fs life? From this point forwardr how far does this go, and how much does this become a part of his permanent record: when, yes, the -- the problems may be difficultg but we are Ealking about ycung people whom we would hope would change as time goes on.

Thank your Mr. President and Ladles and Gentlemen of the Senate. This legislation comes from ISAC. It's designed to allow them a little bit more flexibility in funding of the MAP awards program. And basically, in the pasty ISAC'S had a tough time judging how much revenue it wl1l take to provlde the scholarships that are awarded during the course of the year. Basically: this bill does establish a reserve fund. It creates the -- Monetary Award Program Reserve Fund in the State Treasury and allcws for up to two percent of those reserves to be placed in the fund. This does have to come through the appropriatlons process, however. Be more than happy to answer any questions.

The bill defines a hospice residence as a building at which hospice services are provided to building residents. It limits the number of persons livlng in a hosplce residence to sixteen. It requires the Illinois Department of Public Health to establish standards for haspice residents, and it also sets the standards. And it requires that a licensed full hospice must own or operate the residence and provide the hospice services. I know of no opposition to the bill, and I'd ask for a favorable roll call.

Yes. I rise in support of this bill. The part about being able to do the bonding - there is this debt out there. We're getting short-term loans on it. Itls costing us money. The short-term loans cost us more money than the bonds would. This is very, very narrowly drafted just to talk about an existing loan that's out there that we cannot get rid of that has to be paid off. And instead of paying anywhere from seven-, elght-, nine-, ten-percent interest, we would get a much lower rate. So I agree With that. The part that Senator del Valle just brought up - this tax levy ls just something that's reported to the City so they could put it on the tax bill. To let -- 1et the City of Chicaço aldermen gek up there, be able to debate this and micromanage the City Council system -- ory the city co/munlty colleçe system I think would be wronq . The existing Section is poorly drafted, and a reading of two reported Illinois appellate level decisions concerning this Section produces contradictory dates from which the cancellation period commences. And that happens a 1ot with the appellate courts; they don't check with each other very often. One decision implies that the cancellation period runs from *he recordins of the declarakion, and the other decision implies that it runs from the date that the contract is entered. But under either scenarior the cancellation perlod could expire prior to the turnover of the control from the developer to the unit owners, which is inconsistent With the intent of *he fectlon.
