Thank you, Mr. President, Ladies and Gentlemen of the Senate. The Conference Report for House Bill 1462: The first Senate amendment brings State law into compliance with federal preemption of interstate trucking. Senate Amendment No. 3 allowed counties more flexibility in the use of the Motor Fuel Tax dollars. House Bill 1462 passed the Senate by a vote of 48 to 6 to 4. The House concurred in Senate Amendment No. 1 and non-concurs in Senate Amendment No. 3. The Report has the Senate recede from Amendment 3. The repeal of the national maximum speed limit of fifty-five miles an hour has resulted in a statutory speed limit of sixty-five miles an hour on -- on -- on county and township roads that are not posted for lower speed limits. Because -- because of this, we have added to this House Bill 1462 the following language: The Conference Committee Report amends the Illinois Vehicle Code to set the statutory speed limit at fifty-five miles an hour on State two-lane highways and county and township roads. Those four-lane highways under the jurisdiction of the Illinois Department of Transportation and the Illinois State Toll Highway 9 STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January 24, 1996 Authority are left at sixty-five miles an hour. This amendment also includes the local option language, which allows townships and counties to lower their speed limits without IDOT approval. Thank -- thank you, Mr. President. I rise in support of House Bill 1462, Conference Committee Report No. 1, and would only add that -- one other thing that this Report does is to codify the fifty-five-mile-an-hour speed limit that the Department announced 10 70th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT on the State two-lane roads.

January 24, 1996 Yeah. That was going to be my question. But I'm -- I'm a little confused, 'cause unless this Conference Committee Report that we have in front of us is incorrect, this appears to be establishing also a speed limit on our interstates and also on our -- on our other two-lane roads, other than just county or township roads. Am -- am I -- do I -- am I looking at the wrong conference committee report or am I not?
Senator Parker.
What this bill does is allow a fifty-five-mile-an-hour speed limit for all the township and the rural roads at fifty-five miles per hour. And the four-lane highways, as I explained, are sixty-five miles per hour. The townships and the counties can choose not to raise the speed limit, but they can choose to lower it, if they feel that that is necessary under their jurisdiction.

So -- and also one other question, which becomes a -- a little vague in here. It's only counties and -- that can make that determination of doing any lowering without a study; municipalities cannot do that. Is that correct?

How do you define "a way around"?

Well, the museums and the Zoo are being negatively affected by the tax cap. Is -- is that correct?

In -- in 1992, the General Assembly authorized the Brookfield 14 70th Legislative Day STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT January 24, 1996 Zoo to sell twenty-seven million dollars in -- in bonds, to do capital improvement projects. In 1993, the General Assembly approved legislation for the museums to sell a hundred and twenty-eight million dollars in -- in bonds, to do various improvement projects. Now, these -- these projects were underway and, indeed, the tax caps, when they were passed, affected these projects. And all we want to do is be able to help out the museums and the Brookfield Zoos by -- by allowing them to -- to sell these bonds.
Senator Hendon.
Well, I -- I -- I most certainly understand that. As a former member of the Forest Preserve, as the treasurer, I sympathize with the Forest Preserve and the Zoo. I just want to be clear, for the record, that this is a way around the property tax caps. And if that's what we're going to do, then let's -- let's go ahead and do it, but -- and -- and no sense of playing games. Let's admit that the tax caps, there were problems with it. We should have dealt with that initially, and if you want to do something good for the Zoo and all of that, at least be man enough to stand up there and admit that this is a way around the tax caps. And I certainly pray that there's no garbage or incinerators or anything like that for the Flood Brothers included in this bill.

Mr. President, Ladies and Gentlemen of the Senate, I speak in favor of this Conference Report, and I might remind my esteemed colleague on the other side that the -- this includes the help to the Adler Planetarium and the Art Institute, the Chicago Academy of Sciences, the Chicago Historical Society, the DuSable Museum of 15 STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 70th Legislative Day January 24, 1996 African-American History, the Field Museum, Mexican Fine Arts Center Museum, the Museum of Science and Industry, and the John G. Shedd Aquarium. As I said, we have had exceptions once in a while. We made an exception for life safety bonds for schools in Senate Bill 368. I think this is a very worthwhile exception for the culture and development of -- and education of our people in the State of Illinois, particularly in Chicago, with all these fine facilities available. I speak in favor of it.

Thank you, Mr. President. I, too, want to rise in support of this bill, and point out that the bond funds are required to be matched by private donations. There was a question asked about whether there were buyers. So if we do not pass this, we lose doubly, because donations that have been pledged and that are to match these funds will also be lost, as well as losing the project. So I think it's extremely important that we pass this bill.

Yes. Senator, you mentioned museums; you mentioned Brookfield Zoo. Does this also pertain to the Chicago Park District?

That is the only way in which it pertains to the Park District. But otherwise, it doesn't.

So there are no hidden agendas in this authority with the Chicago Park District to do something, for instance, with Soldiers {sic} (Soldier) Field for the Chicago Bears or any other capital improvement such as that?

Let me -- let me just read a -- a list of the institutions that are involved in this legislation: the Brookfield Zoo, the Adler Planetarium, the Museum of Science and Industry, the Art Institute, the Shedd Aquarium, the Chicago Academy of Science, the Chicago Historical Society, the Field Museum, the Mexican Museum of Fine Arts and the DuSable Museum of African-American History.

See, I wasn't even kidding, 'cause we happen to have the Indian Boundary Zoo, which is the offshoot of the Lincoln Park Zoo, and I think it is entitled to some money. Thank you.

Any time you have a major piece of legislation, like the tax cap was, and a major piece of legislation which, I think, was indeed good, you are going to have to see how the legislation affects people and affects various institutions. We, I think, hurt the museums and the Brookfield Zoo in a way that we did not intend to, and all this does is give them the pre-authorized authority to -- to sell these bonds, and I'd ask for a favorable vote.
