Thank you, Mr. Presldent. House Bill 347 came to us from the House as the agreed Illinois State Bar Association clean-up bill for the year. Passed unaninously in the House. Does a nunber of things and was fureher amended with four amendments in the Senate. The Virst one was an agreement between the Department of Public Aid and the Bar Association reqarding the restoration of the two-year Statute of Limitations for claims against non-probate estates. The second amendment is at the request of the Admintstrative Office of Illinois Courts and lmplements a Supreme Court rule change allowing attorneys to organize as limited liability companies and for the court to collect fees for limlted liabllity companies. Amendment No. 4 was offered by Senator Cullerton and provides that any real property or interest in a land trust held in tenancy by the entirety shall not be liable to be sold upon judgement entered against only one of the tenants unless the property was transferred into tenancy by the entirety in order to defraud creditors in violation of the Uniform 9 j STATE OF ILLINOIS 89TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRTPT 102nd Legislative Day May 7, 1996 Fraudulent Transfer Act. House B1ll 907, as amended, would allow municipalities ip Cock County to regulate or prohibit the keeping of carrier, raclngz hobby or show pigeons. This arose from a problem that We had in the Village of Schaumburg where somebody was raising carrier pigeons and the vlllage was not able to regulate the raising of these pigeons. I talked to Senator Madigan, who I çuess is the defender of the carrier , Racing, show, Hobby Pigeon Act of 1983 (sic), and he said he didn't mind what I did in my own county. so have introduced this bill. There is also an amendment on this bill, supported and sponsored by Senators Rea and Woodyard, which changes the conflgurablon of *he -- one of the coal development boards, and I would defer to Senator Rea for any questions with respect to tbat amendment.

And what this bill does: One, it allows the Colleîe to start up, instead of July lst of 1996, June 1st, where the trustees can come on board and begin maklng the decisions that are needed to begin implementing educational programs, hiring staff, and making other administrative decisions. Also What this -- thts bill does: It allows the transfer of the current property from Illinois Community Colleqe Board to -- to the new College for one dollar. I would ask for a favorable vote. This takes State Community College out of being an experimental college into being locally ouned (sic) and controlled.

The first proviston dealt with the -- the Professions Indirect Cost Fundz which allows that Fund to retain any interest that Would accrue in I that Fund, and. that Would be retained by that Fund. And the I second provlsion dealt with Meals on Wheels, insofar as people who ! are worklng on those diet or nutritional support provisions needed to be licensed with an -- one exemptlon, that those people worklng 1 in diet or nutrltion support positlons in hospltals would be 1 regulated by the Department of Public Health, rather than DPR or l the Department on Aging. 1

It authorlzes the township suburban supervlsors kithin Cook County to serve on the Cook County Townships Public Aid Conmitteer which hears a11 the appeals for public aid. They currently do thatr and this would ! clartfy that they may continue to do so. It also allows the I election at an annual town meeting to add additional agendas to f that agenda by a three-fifths vote. What I want to brlng everyone's attention to is the Committee Amendment No. 1 that was offered in -- in committee, and explain it in sone detail. It deletes a CHA provision fron the bill which exempted housing authorities from the requirement of paying required fees to the respective circuit clerks. This is the same provision that has already passed the Senate in the forn of Senate Bill 1624, which my last report indicated was on 2nd Reading in the House on Short Debate. Committee Amendment No. 1 also changed the CRA summons language in House Bill 3227. As it arrived frcm the House, this language permitted members of a housing authority police force to serve summons for forcible entry and detainer actions upon tenants. Committee Amendment No. 1 changes the language by permlteing police forces and housing authorities in counties with three million or more inhabitants to serve process for forcible entry and detainer actions commenced by the housing authority while also permitting the housing authority to execute orders of possession for the authority. It does happen. You see them. couldn't understand why they didn't stop the fightz because they were so bloody. They stop everythlng else. If it's a basketball game and you see blood, they stop, take the man out of the arena or off of the playing fleld. And also, the Medical Soclety supports this. But, yes, there -- the injuries are nuch more serious than in other types of sports.

However, you start banning it on pay-per-view, that would be to the broadcaster or is there somethlng in the bill that -- What if sonebody had a satellite pickup and Was able to pick it up? Would they then be breaking the law? Would they then become criminals for allowing it to be received in the home?

If they can pick it up from a satelliter other than it being through a distrlbution system through a cable company, they can do it. But a cable company in Illinois would be prohiblted from using this for pay-per-view.

But I Want to get back to Senator Cullerton's comments on the prohibition of cable TV broadcasting. We're looking at page 5, liné 24, and basically we're using the language: Holding or promoting an ultimate fightlng exhibition, or participating in an ultimate fightin: exhibition as a promotqr, contestant, second, referee, judge, scorer, manager, trainer, announcer, or timekeeper, after the effecttve date of the rules required to be adopted under this Act. So we're saging that that in fact, that language would prohibit the cable TV usage.

I -- well, first of all, Mr. President, there kas a House amendment House Amendment No . - that specifically deleted that portion of the original House Bill that banned the cable television broadcast of ultimate fighting. That was taken out. This language that you just cited is number 20 on the list of things that the Department can take disciplinary action against someone for perforning. There's no mention in thts bill about cable televlsion. That was taken out. And -- really think that to clarify the intent of this bill, it really ought to be, perhaps, taken out of the reeord. And you can confer with the House sponsor just to verify What it is that you want to - - What you want to say in the bill.

Now, I would appreciate -- I'm not sure Why that amendment is on this bill. It is the amendnent: and it -- it bothers me because you're encouraging a breach of a very, very important civil protection that everyone enjoys, and that is a patient/physician confidentiality. What you tell your doctor, What your doctor finds with you, you know, in all cases, stays bekween you and your doctor. In this bill, by the amendment, the dockor or their staff can turn over that information to law enforcement people. Now, welre a11 in favor of law and order, but I point out to you that youdre choosing laW and order over a very important confidential right that every citizen enjoys. Firsk is, Illinois 1aw already allows police access to hospital blood-alcohol results; however: they are usually no* subpoenaed, because no kickek has been written as the police are unaware that the driver/patient was intoxicated. Second point, Illinois law already requires reporting of communicable diseases, such as TB, syphilis, et cetera, and child abuse. Third, Illinois law already considers a driver's license to constlEute consenk of breath or blood tests to approve the holder's right to be behind the wheel. Fourth, Illinols law requires physicians to report an injury resulting from discharge of a firearm. A car in the hands of a drunk driver ts nore lethal, or potentially more dangerous. So this is the same procedure thak we have now for all these medical reviews. There's no expedited review at all?

This, of course, is one of my very favorite topics because of the fact thak, first of all, even Argonne National Lab has recently informed me that the present Standards has no -- has absolutely no scientific basis behind it, and that the USEPA has gone absolutely crazy. The -- under the present Standards last yearz Which Was the Worst year in the history of the State of Illinois as far as weather was concerned, State of Illinols was out of compliance a total - the entire State - a total of twelve hoursy and for that, we will be spending approximately sevenky million dollars in a program. Now the USEPA, I guess because they have lack of nothing else better to do, has decided to lower these Standards even further so that pretty soon the entire State will be having little rods stuck up their tailpipes and we will be spending probably four to five times as much as the seventy million dollars. My only wish is that this resolution would have gone further and kold the USCPA, since the year before the State was in compliance, we should just forget this whole darned program. Seventy million dollars is a lot of money. We ouqht to think seriously about spending that money in other ways besides having people run around and stick little rods up tailpipes, which does nothing for the environment. So I certainly support this resolution, but I -- I sure wish it would have gone farther and told the USEPA to go take a jump in the lake.
