Any ékudent found to be a nonresident may be charged tuition by the school board. It provides that any person who knowinqly enrolls, or aktempts to enroll: a studenk who is not a resident on a tuition-fee (sic) (tuition-free) basis shall be guilty of a Class C misdemeanor. Senator Parker, I understand there was some opposition to this billy in that the argumenk was made that ik's too narrowly defined as far as who is the custodial keeper of children. Has -- have you had any discussion? My analysis shows that you were going to hold it on 2nd to have a meeting. Has the meeking gone forth?

There was a concern between -- they had SCOPE and School Management Alliance on the one concernp and the okher was with a ' legal atd lobbyist and Department of Public Ald. They did meet. The have come to an aqreement. And what it was is that we added on, as an amendment, we added on two separate additional clarifications for residency. One was custody exercised by an adult caretaker who is receiving aid under the Illinois Public Aid Code for the pupil who resides with khat adulk for reasons other than having access to the educational programs of the district. . I So that -- helped Public Aid. So it has been amended and everybody is in agreement.

Some of the previous opponents: such as the Legal Asaistance Foundation, the Association of School Social Workers - they are on board now, and I'm pleased to see that their concerns Were responded to. urge an Aye vote.

House Bill 3436 came to khe Senate on a unanimous vote by the House, because lt dealt with the stopping of motor vehicles on railroad tracks. And *he changes were supported, and are supported, by the School Bus Transportation Association and the Illinois Railroad Association. In committee we added several amendments. 0ne was ko require all school buses, whether theydre in charter serviee or not, to stop at railroad crossings. We had I a amendment that would allow Ehat school pre-trip inspections could be done by mechanics, rather than the driver, because l they're better acquainted and better qualified to do so. We also ' had changed the vehicle widths as created by the National Highway I System . That was supporked by IDOT. We closed a loophole in the ; railroad grade crossing law, and ik's supported by the Illinois Commerce Commission. And the last amendment Was requested by the Township Officials, which dealt with khe commercial drivers' ! license Act about the drug and alcohol abuse testing for small townships under three thousand population. This bill would allow that district and a couple of others for one year to use the prior-year EAV, which would not make up khat difference, but would allow them to make up some four hundred thousand dollars under the fornula. I know that this would come from the rest of our districts who benefit under khe formula. It is not without precedent. We have done it in former Senakor Rigney's district, and in a number of other districts over khe years.
