Thank you, Madam President. I wculd like for the Body to just consider for a moment what we are about to do w ith Mr . Malocf . And let me say from the outset that I found h1m to be a very nice 10 STATE OF ILLINOIS 90TH GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 58th Legislative Day May 29 , 1997 gentleman , a nice person. But a 1ot of controversy has a rlsen eo question his appolntment this particular position . Yesterday : Senator Carroll and voted Present in the committee , and I promised that would no t vote No against this nominee until I did further research . Sc T got on ehe phone and I made some calls to Peoria , Where Mr. Maloof is the former Mayor, for twelve years . Very well liked , highly respected . And I also began to get phone calls from a number of people in Peoria . And came up wtth a particula r picture of Mr. Maloof that was rathe r mixëd and disturbing . While everyone agreed that he was an excellent ambassador, a fine person r loves people , they also said maybe he loved a little bit too much , hugged and kissed a little b it toc much . And perhaps, sometlmes in his zest to show h is love , he may have placed his hands in some areas where women - most women - just did not want them to be. Now, if he was being nominated for M ines and Minerals or Nuclear Regulation or Gam ing or Economic bevelopment, fine, no problem , but this is the Commission on Human Rights . Mr . Maloo f Was charged with sexual harassment as Mayor of Peoria . He was also charged , along with the government of Peoria : with a number of discrim inaticn abuses . Now , in my phone calls , I - - it became clear to me that he 's not a racist . This is not the allegations about race kere -- just didn't buy into those. I said: ''No# I -- doesn't come over like that to mem'' So I just d iscarded those charges . I said , ''No , it 's no t a racist don 't that he 's a racist.'' But everybody , even his suppo rte rs , kept saying that he 's from another era r Ehat he 's a nice guy r but he 's from another era . And I 'm tryin: to figure outy is that the ho rse-and-buggy era? Is that before women had the right to vote?. What era is he from? And they say, ''Wellr he's from another culture .'' And in their culture , women are not seen as women are seen in America . Well, this is America . Mr . Maloc f also indicated in comm ittee that his fo rmer sec reta ry , who filed 11 STATE OF ILLINO IS 90TH GENERAL ASSEMBLY REGULAR SESS ION SENATE TRANSCRIPT 58th Legislative Day May 29 r 1997 cha rges against him , was now in suppo rt of his nomination. That ca rried a lot o f weigbt in the comm ittee . People sa id : Well, his secretary files sexual d iscrimination against him and then dropped it, or -- I mean -- welly she didn't drop it, it was settled , but now she ls supporting his nom ination , well : maybe he 's okay. He mislead the comm ittee . His former secre tary is noe supporting his nom inaticn to th ts Commission . Now , it's very important to understand what she was willing to do . He had a retirement party . She supported the retirement patty . She organized Because -- I guess she figured, wellz he's going to be gone , he can 't harm anybody . But when she looked at this sensitive position of a person who 's going to be hearing cases of sex dlscrlm ination and a:e discrtmination and civil rlgh es discrin ination and violaticns, she sald , ''No t that spo t.'' called -- spoke w ith the Governor 's people . I said , f'No t this pcsition'' Another position, yes, but not a position where you 're dealing With issues of which you just don't understand. He just doesn 't get 1t . As of this moment , he still dces not believe he dld anything wrong. Now hoW can you honestly and adjudicate cases like this that are going to come before hlm , if he was involved in a case like this and still believes he d id absolutely nothing w ronq? Let me close by saylng r the one th tng that rea lly put me over the top , saying that we had to stap this pa rticular appointment by our Honorable Governo r if we could and z Madam President , if I could . I -- I know late , but can ha rdly hear myself. PRESIDING OFFICER : (SENATOR GEO-KARIS) can hear you . SENATOR HENDON : That 's because you have such excellent hearing ... But, please , Ladies and Gentlemen , I think it -- it should be important to every Senator in this Chamber, what happens to women and how women are treated . If it 's note continue With your conversations, and 1.11 just talk a little louder. But made a comm itment wasn 't going to scream and holler, by your advice , Madam President: three yea rs ago , and I haven 't . don 't Want to do now . But this is important . We 're talking about a Woman 's right to be treated like a man , to be -- èa rn what a man makes. makes no sense at al1 tc put this gentleman in this very sensitive position. Something else , M r. Governo r, yes , but not thls . In conclusion, a young lady called me in support of Mr. Maloof. She spoke eloquently about him . But asked her one question . I said , ''What about the sexual discriminaticn cha rges?'' This is what made me clear that we had to stop h im . She said , and quote , ''Because of the fact that he was sued and came under ehese charges, he is betfer qualified, because he 's had the expe rience in handling these issues .'' think that is abso lutely outragecus. In other words, a convicted Ku Klux Klansman is up for the Civil R ights Comm ission , give it to him , because he knows a1l about hanging people .

Thank you , Madam President. You know respect you , Senator Hendon, bu* really took lt personally when you wanted to compare Mr. Maloof to someone with the Ku Klux Klan . Now find that absolutely ridiculous and I resent I 've known M r. Ma loof was very instrumental in getting the first black, A frican-Amerlcan , appointed to the -- be C iey Manager in the City of Peoria, of which that perscn still is the City Manager. And this was abouu six or elght mohehs ago. When Mr. Maloof , who ran for office three different times , Was running for the thlrd tlme , this lawsuit was in the Helght of its emo tions in the City of Peoria. It was a major issue in the maycral campaign. There were so many uomen walking around w1th a button tha t says , ''Hug me , Mayor . I want you to hug me , 'cause I love Well, this tells me something . He 's also the person Who orig inated, many years ago . alon: with Danny Thomas ' the St. Jude m idwest affiliatez Which I 'm sure you dre fam iliar with that it helpedz trea ted and eured many , many ch ildren W ith leukemia . He originated that in Peorla , and it 's p robably 'the largest affiliate ln this country . And I want to correct something : Neither myself or Mayor Maloof said that h is former secreta ry suppo rted his nominatton. Now , if -- and I talked to M r. Hendon . We 've talked to some people . NoW if we if th is was implied in any of our ' statements , that was not the intent . What was said Was she volunteered to chair his retirement party about five or six weeks ago . You know , sometimes when you fre ln public life , and I'm sure you 're a1l aware of 1t, that the longer you stay , the mare baqgage you p ick up , and people will always remember When you stumble , ' but never the hund reds of times that you do right . Mr . ' Maloof is not proud of the fact that he waé cha rged in th is discrimination suit, but the details were never let out. was settled a year and a half, or a year aqo, and a lot of it -- and personally , would have liked to seen it go to tria l so that everybody would have the details . But the City decided to settle because the attorney fees Were becoming to great fo r 'em and they thought that they ought to cut their losses . And so no one Was either found guilty or not guilty and no onè knew who did what: and I thlnk it Was inappropriate . He is also -- he is also supported very strongly by the active Jewish community in our -- in our City. They support him extremely kell. 'Hels a well-liked person, and I 'm not saying that eve rybody likes him . don 't think everybody likes us, but we hope fifty-one percent o f 'em do when go vo te . We 're not challenging how gcod of a public servant he was ; what we dre challeng ing is what I th ink Was best written in the Peo ria Journal Star this morning . I don 't : . know how many of you have had a chance to read the Peoria Journal Star, but I would like to quote just part of one paragraph. It says r ''The problem is that Maloof 's nomination comes less than a yea r after the City of Peorla settled a sexual discrim inatlon lawsuit that involved fifty city hall female employees . Maloof r as Mayorr was sued by his secretaryy who aecused him of subjecting her to unwanted hugs, kisses and comments about her anatomy .'' She . was no* alone . There were fifty female employees in the Ciey of Peoria that brought forward that suit : a su it that that Ctty settled fo r tWo m illion dollars . Whlle I would not question, certa ënly, the wo rds of my friend and colleague , Senato r Shadid r it would seem to me, as a forme r city council nembery that no city casually settles unless they thlnk there's reason to settle . This City settled , fo r two m illion dolla rs , a suit brought forward by flfty female employeesy settled less ehan a year ago . T think we have to ask ourselves what kind of messaqey what kind of signal are we sending, to put the very lndividual who has been subjected ' to a suit and that sult has been settled , on a small commlssion that judges a large issue - a thirteen-member commission that judges critical issues facin: countless human beings across this . State . I Would no t stand here and qua rrel, if we appointed Mr. Maloof to a comm ission that overlooked machine ry , land , m ines, minerals , whatever other comm ission appropriate that he m ight be ccnsidered for. But let 's not appoint him to a commission that will judge the very kind of suit that the City of Peoria has just settled: for two m illlon dollars, with fifty female city employees . Thank you , Madam President , Members of the Senate . tco , happen to have served on the comm ittee and listened to the b rief discussion - brief discussion comm ittee . And had and I have grea t'respect fo r my colleagues from Peoria , b0th of'whom are supportive of Mayor Maloof , and had a nice chance to meet with the Mayor and have some very good dlscussions with him . Also , I've heard from leadership of the Peoria Jewish community r who a re truly, as Senato r Shadid said , very suppo rtive . Having sa id al1 ehat, no< comes the howeve r. And the hovever is , unfortunately , and don 't blame anybody for this, the appa rent rules in the comm ittee d id not allow a real hearing on the issue . And it Was not rules just for this particular nomineer and maybe it's something we ought to , very seriously , do something about ; it 's a rule that also affected a nominee in the pasty vho , in that pa rttcular instance , the cha irman happened to have been personally against, and also d id not allow people whc were against the opportunity to testify . And that, I think , bo thered me the most . Because maybe if we had a full hearing , we 'd have a better understanding of the cha rges of that lieigation. As Senator Severns pointed out , of fifty employees ln Peoria settled fo r two million dollars just a year or so ago. There Were people in the room . Nobody made an issue out of it, because tha t committee people have not been allowed to file witness slips and g ive testimony . And I do believe if khat 's what the rules provide , and I don 't really think they do , the re should be a cla rity of tha t, that that 's the purpose of a comm ittee meeting . And as has been said, say to those who are the judges of cases of discrimination, a two-million-dollar settlement, by one of those judges, of charges of discrtmination by that judge, should give anyone pause if they were going to appear before that comm tssion . To those of us who have to apprcve those who Will be the judges, I am not pleased that we have the know ledçe With which to approve a person who , though only charged I admit it was not a conviction a two-million-dollar settlement fo r fifty people is a lot of money . And maybe , had we had a full hearing , these questions could have been fully answered . I think we have to ask the President of the Senate to make sure that that rule is changed forever. Committee hearings are for the public to come in and give testimony . didn 't happen , and again r no fault of the Cha ir; it d idn 't happen past hearings, either. Then, maybe we could decide more intelligently . W ith the limited informationy I cannot be supportive of a person who was charged W1th not only sexual d iscrim ination, but g lass ceiling , and for Whom his City pald two million dollars. unfortunate for him , because th ink he has proven himself to be a good mayor and Would be a gocd appo intee to many State boards, just not this one, with the information We have .

I'd like to know Who in the wo rld told him -- told her, somewhere along the line , that - - that for the last thirty-five yearsy she 's been workin: for somebody who 's been sexually ha rasstng he r. Maybe they should have told her thirty-five years aqo , and she could have found another job. You know, somebody actually is sexually harasslng somebody, 1 agree that persan is despicable. But for scmebody to go up and hug somebody or -- or say they -- they apprectate what she 's doing through touching her ln appropriate Ways, there's nothini wrong with that. . . . stand up the second time, but I just wanted to make sure that everybody 's aware that : was go ing to clarify that thirty-five years of secretartal work. I believe Mayor Maloof hired her in his second term . So r he -- she was With him for five or six years as his secreta ry , and she 's been now elevated to a different positionr a much better paylng job. But, I'd like to clear up something that -- before everybody thinks that a1l fifty women were suing Mayor Maloof. He was not being sued by al1 fifty women. And it 's too bad , and I 'm no t a lawyer, but too bad that this didn 't go to trial, so everybody would have seen who exactly did what . But in many cases r in respcnse to Senator Severns, a city and When I was the sheriff, we would settle things out r because the cost got too high and the insurance company says , ''We11, this ls as far as We 're going . You 're on you 're oWn .'' And so that 's When they settle these cases out , and I 'm sure she 's well aware of tha t. This is wha t's impc rtant . I 'm not a lawyer, but the lawyer's fees became too big and the City took the easy way out , I feel , because most of the citizens, me included , wanted to hear exactly what took p lace and Who did wha t. The first part of the bill, the original bill, had to do with unsold m ineral rights . There were some problems that the title companies exp ressed after the bill passed from the Senatey and they were addressed the Conference Committee Report . And the other part is the Auto Leasing , Occupation and Use Tax , which the Department of Revenue had some more concerns about and wanted clarification . This ls the language agreed to by the municipalities so there 's no shortfall in their revenues , and I ask fo r a positive vote on the concurrence motion .

One is to amend the Sectlon of the Crim inal Code that deals w ith p rovldlng for a trlal absentla and extends that to lnclude m isdemeanors . Right now lt only covers felonies . The second issue deals with the issue of elig ibility to run for office . A person who 's been convicted of a felony , right ncw , can run for offices like State Rep resentative , State Senator and statewide offtces , but they can 't run for municipal . What this bill says is that convicted felons cannot run for any office the State of Illinots. And does make an exception, however: if you have been elected . you have been a conviction -- have a felony conviction and you dve been elected , you can run for reelection , but reeleetion only . Be happy to answer any questions and ask fo r an Aye vote .

Thirty years pass, and I have been an outstand ing cltizen in those thirty years, and I want to run for Senato r'for the State Senate from the near north side of Chicago . Why shouldn 't the voters of my district decide whether that felony should o r should not , by voting no, disqualify me, rath/r than this disqualifying me?
