House Bill 62 amends the Sex Offender Registration Act by increasing the penalty from a Class 4 felony to a Class 3 felony for a sex offender who knowingly gives false information. It also amends the Sex Offender and Child Murderer Community Notification Law by providing that sex offender information must be made available, free of charge, for public inspection to any person, no later than seventy-two hours or three business days from the date of the request. The bill also provides that this request must be made in person, in writing, or by telephone and that the person inquiring must be -- be given access to a facility to copy the information with a maximum charge equaling the actual cost of the copies. Also, it provides that the inquirer must be allowed to copy the information in their own handwriting and that the sheriff or police department must allow access to the information during normal public working hours. This bill STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 34th Legislative Day April 26, 1999 amends the cooperative high school attendance center provisions of the School Code. It changes references from "cooperative high school attendance centers" to 'cooperative high schools". It requires joint operation of cooperative high schools to be taken for twenty, instead of five, years. It provides that a district may withdraw from a joint agreement only if the district is reorganizing with one or more districts under other provisions of the School Code. Changes references from "advisory boards" to "governing board". States that the governing board shall administer the cooperative high schools and sets out its powers, which are expanded. Deletes the provision concerning pupil transportation. Removes provisions stating how the per capita cost of educating students is -- is to be computed and provides that this shall be set in the agreement. States what the school boards of each participating district shall do. Sets forth provisions concerning employment and transfer of administrators, teachers and support staff, and it includes other miscellaneous changes. This is a bill that I think would be good for smaller school districts who are wanting to form together for a high school -- cooperative school.

It says that a person that is at least seventeen years of age who posts on an adult obscenity or child pornography Internet site a person's name, address, telephone number, or E-mail address has committed the offense of posting of information on the Internet. If the information posted was that of a person at least seventeen years of age and without their consent, creates a Class 4 felony. If the information posted was that of a person under seventeen years of age, has a Class 3 felony. I ask for a favorable vote.

Senator Molaro, this -- this basically come from our Will County State's Attorney. If you remember, this is somewhat the same information that Senator Halvorson and myself, in Senate Bill 94. We had a case in Joliet where a young lady, who was only nine years of age, a neighbor was posting obscene material on the Internet and the family literally had to move out of Joliet to a different area because they were receiving phone calls in the middle of the night from men and pedophiles. And so -- and what we also included in this, with the amendment that I put on, was that we are making it a Class 4 felony in regards of somebody posting on an adult that did not give 'em permission.

The amendment to House Bill 254 was prepared by the DNR and we believe addresses the questions that were raised on the bill, as -- as it came over from the House. Basically what it says is that if you are -- have a hunting or a fishing license revoked or suspended in Illinois or any other state or the Dominion of Canada, you cannot participate in activities revolving around that particular activity in the State of Illinois. I'd be glad to answer any questions on House Bill 254, as amended.

Is the purpose of this bill to expand it beyond just applying to truck drivers, to -- to individuals who give somebody a ride and charges 'em a fee?

As I stated, Senator, in introducing it, it applies to a driver of a commercial motor vehicle. Senator, I think what you're doing here is noble. I guess what my question would be is: Why are we doing this? There appears to be nothing in the bill that says that if there is a problem with the hearing of the child, that we plan on doing anything about it. All we're going to do is gather information and then -- gather the information and hold it for what purpose?

Thank you. You are right. It does not mandate intervention; however, early intervention, which presumably would follow once a hearing deficiency has been identified, is very, very effective in STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 34th Legislative Day April 26, 1999 helping children attain normal language development. In fact, when hearing loss is detected in the first six months of life and remediated, these kids have normal language development by forty months. And the average age currently of detection is not until twenty -- between twenty-one and twenty-six months. So they will be referred to an audiologist, but the parent will have to follow through.

Thank you. I would just hope that -- 'cause I think it's a good bill, and I would just hope that, in the future, we -- we go beyond that and figure out some way to help those kids that are born in those areas.

Okay. And this bill's a good idea, but I can't read -- can the hospitals do that without the parent's consent or do they have to get consent?

I'll re-ask it, 'cause maybe I wasn't clear. I know it STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 34th Legislative Day April 2 6 , 1999 requires a test to be conducted, but does the hospital have to ask the parents first before a test can be required, or do they do this and -- even if the parents don't want it, the hospitals have a right to do it, against the objection of the parents?

Thank you. There is only one objection allowed for and that is for religious reasons. I don't believe it states in here that permission has to be requested first; however, this won't be effective until 2002 and we maybe should take some time and take a look at that.

I certainly appreciate that, so we'll get off that. The other thing is did you ever -- can we find out -- and, again, we certainly have time, as far as certain HMOs or other health plans, is this considered -- if there is a cost, is this considered in most plans an insurance-covered cost, or will the parents have to pay for this out of their own pocket?

Thank you. That's a good question and one that's been raised by a number of folks. There is no insurance mandate in this bill; however, the cost of the test is about twenty dollars. It's very inexpensive. So, obviously, the insurance company would be billed, the parent would be billed if the insurance company didn't pay, and if it wasn't collected, it would be handled like any other bill.

When a telecommunication carrier is granted authority to issue short-term debt for aggregate periods exceeding twenty-four months, a fee for issuing the long-term debt is applied. If this bill passes, that would not be the case, so it saves not only the utility -- the telecommunications company but also their -- their users that extra money. So, this is a waste of taxpayer money, a waste of legislative time, and another boondoggle on the Illinois taxpayer.

So there'll be a list of vendors that'll -- that will comply with -- with the -- with the -- the printing and the minting of these medallions, and then she will -- they will establish the cost. And a -- and a part of the proceeds, part of the profit, if you will, will go to some not-for-profit corporation that's been listed. So if it's a charity or some group, so there is no cost to the State, and that's to be determined by rule. And also, Madam President, the Treasurer can limit the number of commemorative medallions. So, to Senator Welch's concern, in the legislation, she can limit -- the Treasurer can limit how many will be awarded annually.

Again, that's not really our concern, because number -- that's the concern of the organization who's asked to have the medallions printed. The State bears no financial risk, other than the cost of the resolution. So that's our only -- that's the only cost to the State of Illinois. The Treasurer will -- will arrange for Carlinville, if you will, Chamber of Commerce to -- to meet with some vendor and then they can -- they can publish -- print as many "Senator Demuzio Outstanding Citizens" medallions as they want. And that's the cost to the Chamber of Commerce, not to the State of Illinois.

But this bill makes it a Class X felony to gunrun illegally to any child under the age of eighteen in Illinois, and this is just one of many issues stemming from not only the school shooting in Colorado, but those throughout the United States. And I'd appreciate a favorable roll call, but when you're looking for answers like I am for the senseless shootings out there and what we can do, one of the things is we can certainly make it a Class X felony to illegally give weapons to anybody under the age of eighteen. At the present time, the Code does not make any provisions for electro-convulsive therapy for minors. This legislation says that if the recipient of that therapy is a minor, that the recipient's parents or guardian are authorized to provide consent for the minor and -- but only under procedures that are already in place for adults. In addition, it says that two licensed psychiatrists who have examined the patient must concur in the determination.

Thank you, Madam President. The federal government has enacted sex offenders registration and community notification legislation and what House Bill 2721 does is to incorporate those changes. There's a number of changes. Let me read them very briefly, if I can. Amends the Sex Offenders {sic) (Offender) Registration Act and (Sex Offender and) Child Murderer Community Notification Law by adding the definition of sex -- "juvenile sex offender", "sexual predator", "out-of-state studentw and "out-of-state employees", and imposes registration requirements of those persons. It takes in consideration a crime or a conviction under laws of other countries, and subjects sexually violent persons to the same requirements as sexually dangerous persons. This is proposed by the Illinois Dental Society and is something that they've been working on now for three years and have come to agreement within themselves. It would -- the legislation that could come forward through this study would allow public aid patients to receive low-cost basic dental services, and in return, dentists who had student loans could, through their work, have their student loans reduced. Again, this is an initiative of the Dental Society. There is no cost to the -- the State, and allows the Dental Society, of course, with appointments made by the Senate President, Senate Minority Leader, Department of Public Aid, et cetera, to look into this area and come forward and make recommendations to us.

Well, thank you very much, Madam President. This particular resolution, Senate Joint Resolution 29, does exactly what the -- the Calendar says. It renames the Poplar Street Bridge, which is a bridge that crosses the Mississippi River from Illinois to Missouri. It renames it Mark McGwire Bridge in honor of Mark McGwire, who hit seventy home runs last year and broke the Major League record for most home runs in a season. Just so happens that 1-70 is the bridge -- or, is the highway that goes across the STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 34th Legislative Day April 26, 1999 current Poplar Street Bridge and 1-70 being, obviously, seventy home runs, and we think it's appropriate to rename the bridge. The issue that we have to deal with here is, of course, Illinois only has half the bridge. We are hoping that Missouri - and we've talked to the people in Missouri - we are asking them to consider renaming their half, also, after Mark McGwire, and -- and in -- quite honestly, we won't do it unless -- unless they cooperate. But they're -- they're interested and they're looking into it. So that's -- that's the resolution, Madam President.

I represent the Wrigley Field district in my district and I would point out to the Senator: It's actually in the State of Illinois where Sammy Sosa plays. Okay? Where all the people from throughout the Midwest come and spend money in our State, sales tax revenues, all the like, which finds its way down here so we get to appropriate it. Now, if I understand this correctly, you want to name an Illinois -- half of an Illinois bridge after a baseball player who plays in Missouri and who attracts our Illinois money, as a matter of fact, over to Missouri where they spend their money in another state. And that state hasn't even, in their own legislature, named their half of the bridge for Mark McGwire. So I think, at a minimum, we ought to wait and see what the State of Missouri does. And I think the best way to do this would be to have the State of Missouri name their half of the bridge after Mark McGwire and we'll name our half of the bridge after Sammy Sosa.

Let's see, that's a pretty good question. I'm trying to think of the other names. McKinley's a bridge. Martin Luther King Bridge. Jefferson Barracks. I don't know. There's -- I'm not so sure that they have, but, you know, and I -- to answer Senator Cullerton, the economic impact that the St. Louis baseball Cardinals, the St. Louis Rams, the hockey Blues, it is incredible the economic impact that has in Illinois. And we, in Illinois, haven't paid one dime, one red cent, to build a stadium, to do anything over there that they have to do in order to attract teams. But we do benefit. We have hotels, motels, gas stations, people that benefit a great deal from the -- from the -- the St. Louis sporting -- pharmacies, sure. Right. Anyway, there's a lot -- there's a lot of benefit on our side of the river.

As you know right now, Mark McGwire is not leading the Major Leagues in home runs. In fact, he's not even leading the St. Louis Cardinals in home runs.
