Mr. President and Ladies and Gentlemen of the Senate, we want to thank the St. Louis Regional Commerce and Growth Agency for sponsoring our annual Peter Miller charitable ball game last night. And I want to tell you that -- that State Representative John Fritchey, who predicted that the House would win the game, I would urge him to start taking Viagra, because he was a total disaster last night. I want to thank Mr. Valenti from the St. Louis Regional Commerce and Growth Agency for all their wonderful help, their food and the shirts that they gave the ballplayers. And I want to thank the two cocaptains, Frank Watson and John Cullerton. And I'd like to tell you, all these players that we had, that they were good. Kirk Dillard forgot his books and actually hit a couple of balls and got on base, and he actually caught a couple of balls. Senator Molaro, didn't do so badly. In fact, he came through in the pinches. He almost had to get pinched a couple of times. But -- and Senator Syverson broke a finger as first baseman, and I wondered why he dropped the ball, because I thought that might be disastrous for 'em. And Senator Walsh did very well. He caught one backhanded, way out in the field, and he did some good hitting. And the Most Valuable Player was none other than our own Senator Rickey Hendon, of center field. And he was awarded the -- the trophy as Most Valuable Player. Rickey came in when the Senate, in the first inning, had bases loaded, and Rickey hit a home run. But Rickey is very fast afoot. In fact, he was so fast afoot, he overran his base and he got called out, in one instance. Carl Hawkinson was hit the first pitch he -- he pitched, was hit in the hand and really got hurt, but he carried through and did a great job pitching for us. And Senator Sullivan, my seatmate, and let me tell you about this STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 12, 1999 young lad. He caught two in the big, big left field, and I can tell you he caught 'em when we needed them the most, and he even got on base a couple of times, which I commend him for it. For -- for a freshman, he did darn well. And, of course, Watson sat there -- Senator Watson, who is a cocaptain, very happy to see his boys really hitting, and they really hit. Burzynski didn't do badly at all. I think he dropped one ball, but outside of that, he didn't drop two, so he's safe. But anyway, he was in right field. And Senator Shadid provided the caps for all of us. I don't know why he didn't get in the game. He probably could have hit. And Senator Silverstein, whom I was calling Senator Silverman, actually got on the base, but he had a little trouble hanging onto his balls. But -- and Senator Duane Noland did very well. He got a hit. And so did Senator Sieben. And Senator Petka was a great catcher, and he did his -- his part in the ball game. And so did Senator Lauzen. He really ran fast and got on the base. And so did Senator del Valle. I don't know if I've forgotten any of our Senators, but I want to tell you they did an excellent job. We won by the score of 13 to 2. And I want to congratulate our team. And I congratulate Watson and Cullerton, the captains that did a great job. I think it was great and the weather held out and we finished the game without getting rained out. So congratulation, fellows. Let's give 'em all a good hand.

STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 12, 1999 Thank you, Madam President. This bill comes to us from a unusual coalition. It's an initiative of the Illinois State Medical Society. It's supported by the Illinois Hospital Association and by the Trial Lawyers -- the Illinois Trial Lawyers. It deals with the question of immunity on medical review committees. Right now, there's an absolute immunity, and the doctors, hospitals' groups and attorneys are all in agreement that there are limited situations, such as intentional discrimination, whether economic or -- or based on ethnicity or race, that are improper and that ought to subject others on that committee to liability, where they can prove that it was willful or wanton. The immunity is also expanded from the committee to individuals employed by the hospital. The University of Illinois hospitals were originally opposed, but they have withdrawn their.opposition because they are unaffected by this Act. However, Cook County Hospital is still opposed. I'd be happy to answer questions, otherwise ask for an Aye vote.

Yes, thank you very much, Madam President. As stated by the sponsor - if I could just comment a little bit - the County is opposed to this legislation, and -- and based on these points, if I may just add to the record; one, to protect the taxpayer burden of additional litigation expense. A change in the standard from statutory immunity, excuse me, to include an exception of willful and wanton conduct will make it virtually impossible to dismiss even a frivolous case without the cost of trial. In the case of Cook County Hospital, this increased cost of defending such lawsuits will be imposed on taxpayers. In addition, since Cook County indemnifies its doctors for liability arising from their employment at county hospitals, any compensatory damages and STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 12, 1999 litigation costs arising out of such liability will also be imposed on taxpayers throughout Cook County. This does not necessarily protect doctors from personal exposure due to inability to indemnity. Cook County indemnifies its doctors for liability arising from employment at county hospitals; although, if doctors are made liable in cases involving willful and wanton conduct, they will be personally exposed to possible punitive damages because the County is prohibited from indemnifying employees for punitive damages. And for these reasons stated, the County is opposed to the legislation. We...

Thank you, Madam President and Members of the Senate. House Bill 2351 amends the Vehicle Code relating to penalty for false reporting of a vehicle theft. The bill is just making a false report of theft or conversion of a vehicle to an employee of a law enforcement agency is -- a Class 2 felony. Currently, it's a Class 2 felony for a person to knowingly make a false report of the theft or conversion of a vehicle to a police officer. This bill would put reportings of police department employees in the same category. There's no known opposition at this time. I'll try to answer any questions.

Reserve a corporate name. Upon the filing of an application for a permit to organize, an applicant may request the Commissioner to reserve the name of the proposed bank and then affording them the opportunity to transfer that name to some other person. Can a person go in and file for a hundred or two hundred names and then later on decide to sell one of those names to some other bank that wants that name?

So that means now that you can be -- you -- you can come in, own the bank here, and not have anybody from the community or anybody from the State of Illinois serve on the board of directors. It could be complete foreign ownership of a financial institution in Illinois with nobody -- no resident whatsoever serving on the bank. Proposes that a tax of 1.25 percent be imposed on the purchase of a vehicle at the lease inception by the lessor, which would reduce it from the current six and a quarter percent. The Department of Revenue would distribute the tax to the appropriate unit of local government. The bill also proposes to tax leased vehicles at a rate of five percent of the gross monthly receipts of the lessor under the lease. If the lessee elects to purchase the vehicle at the end of the lease term, a tax of 5 percent of the residual value of the auto would be imposed. If the lessee does not purchase the vehicle at the end of the lease, the sale of the vehicle would be subject to a six-and-a-quarter tax rate. Ask for support of House Bill 402.

Senator, what this bill does is to bring in compliance and to bring in much of the same language that we passed last year, with the advanced practice nurses, relative to the type of collaborative agreements they need with physicians in order to be able to provide anesthesia services. So this is an agreed-to bill. It's a bill that's been worked out, the language, between the doctors, as well as the nurse anesthetists, in order to provide services here in the State of Illinois.

The parcels, which -- which will be used, in this instance, for the construction of -- of certain government buildings, is also adjacent to a park district golf course. I would move for its adoption.

This bill amends the Vehicle Code and provides that if a vehicle dealer gives a customer a loaner car or allows someone to test drive a vehicle, the dealer's insurance does -- does not provide the coverage unless the permitted users have no liability insurance of his own or the permitted user has insurance but the limits are less than the minimum required under the mandatory insurance law. The -- the dealer -- the insurance companies were concerned that if an employee was driving the car of the dealer, that they would not be covered by the dealer's insurance and it's the legislative intent that the -- indeed, the dealers would cover their own employees driving the cars.

And it also allows the sheriffs and municipal police departments to publish photographs of sex offenders in the local newspapers if the victim of the sex offender is under the age of thirteen. This bill is in response to the Seventh Circuit's decision dealing with gifts that are made by assignment of beneficial interests in a land trust. The practical effect of that decision would be that a favorite device of farmers in the State of Illinois, that is, using a -- placing the family farm in a land trust, for all intents and purposes, would be eliminated. This legislation not only clarifies but overrules the way that -- or, in my opinion, clarifies what has been uniformly thought to be the -- the law in the State of Illinois. I know of no opposition and I would ask for its adoption.

Thank you very much. I appreciate that courtesy. This legislation will make assessments of federally subsidized Section 515 rural rental housing facilities uniform throughout the State. Since the limited income restriction significantly affect the market value, this bill directs local assessors to use the income approach in determining value, rather than cost. This approach is already used in some areas of the State and it'll just -- this merely standardizes the practice. I know of no objection.

The -- then the -- the question: By using the income approach, which -- rather than comparable market values, and when we use the income approach, it's revenue from the rental properties minus the expenses. My understanding is that this is a bill that has to do with how assessors locally will assess a piece of property and they'll be able to use the income method. Again, if part of what is used to -- to deduct the amount of income a property earns is the interest on a loan, it would seem to me that the more you leverage a piece of property, the more you can drive your assessment for property taxes down.

Thank you very much. This is the intermodal bill. Intermodal are those trains that have the boxes, steel boxes, and then they are placed on the chassis of a -- of a trailer. Basically what the bill says is that the person that owns or leases the equipment of the chassis is responsible for the maintenance of that chassis. For the purpose of legislative intent, I would like to say that this bill in no way means to relieve the driver of a truck from adequately inspecting a vehicle before he leaves the railroad yard. Additionally, nothing in this bill would prevent a railroad and a motor carrier from agreeing to a different allocation of responsibility for compliance of the vehicle's safety requirements, or remove any provisions concerning contractual agreements for long-term leasing of equipment and the maintenance of such equipment. We have been meeting with the railroads. In fact, we met with them for two hours again this morning. I think they finally understand the problem. The problem really is not with railroad equipment or with trucking equipment. As it turns out, the problem lies with the ships -- the shipping. Quite often these are foreign corporations that buy these chassis. They are not maintaining them, nor are they having anybody inspect them. We are trying to get to those ship owners and tell them, you've got to maintain this equipment because it's going out on our roads in poor condition, and -- and we are trying to get to the source of the -- of the problem with this bill.

It deletes the entities who contribute money, goods and services to the grantees and contractors from the provisions of the bill, which was asked for by the providers, as was the other that deletes the words of "directly or indirectly" from the definition from -- of the "State funds" and throughout the bill, those words were -- were taken out. It also deletes the provision allowing labor organizations to file civil actions on behalf of the State of Illinois. And I ask for a favorable vote.

By reading the statute, it would -- appears to us that the fiscal note can only be applied during the house of origin -- on 2nd Reading of the house of origin. So the -- the Section is 25 ILCS 50/1 that says, "Every bill, except those making a direct appropriation...to require the expenditure of their own funds...or to increase or decrease the revenues...shall have prepared for it prior to second reading in the house of introduction a brief explanatory statement or note which shall include a reliable estimate of the anticipated change in State, local government {sic) (governmental), school district, or community college district expenditures or revenues..." It is our feeling that this should only apply to the house of origin, not on the house after it passes out of the house of origin. So we would ask that the bill be moved to 3rd Reading.

It also requires that a person who does not reside within the ward to reside within that ward within twelve months following the election, or the alderman will be considered to have been removed from his residence from the ward.

Senator, did you -- did you want to debate this on 3rd Reading, or did you want to debate this on 2nd Reading? And if it's 2nd Reading, if we're going to have a roll call and everything, maybe you could explain what it does again. I -- I assume you just thought that we were going to move it -- adopt it by a voice vote and go to -- have the debate on 3rd Reading, but since there's been a request for a roll call, perhaps you could just explain what the amendment does, please.

What we're trying to do is continue the status quo. Right now the Illinois Commerce Commission has a universal fund for small, rural telephones, and it's about an eleven-million-dollar fund. And there are about forty-four small, rural telephones and they're under thirty-five thousand lines. In fact -- by definition. In fact, I think the most we have in Illinois, at STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 12, 1999 this point, is sixteen thousand lines. What this does is try to give the authority to the ICC to continue doing what we're doing now. And the conflict is between -- we're in the telephone wars, unfortunately, and we're being middled between the long distance and the local operators. So what this amendment does is just give the ICC the authority to develop and to meet federal regulations on the development of a -- of a universal telephone fund, which already exists right now.
PRESIDING OFFICER: (SENATOR MAITLAND) Senator Cullerton.
So, if -- if I understand it, your intention is just to keep the status quo. This fund that funds these rural telephones is now paid for by the long distance carriers that pay into this fund, and I understand that there's a -- a certain -- the people that take from the fund -- the people that take from the fund are small phone companies that have -- that serve the rural communities. And I think that the concern is, even though you want to keep the status quo, is that apparently the language in the bill is written such that someone could read it to believe that maybe even the big phone companies, like Ameritech or another -- GTE, could access this fund, which now they can't. And so since your intent is to make sure that it's supposed to be the status quo, could you indicate to me how you want the bill to work with regard to the issue as to whether or not these larger companies can take from that fund? Because if they did have the ability to take from the fund, I take it that fund would have to be increased dramatically in order to compensate those bigger companies. And that seems to be what the issue is. So maybe you could address that.

Well, actually it's an eleven-million-dollar fund, like I indicated. And I don't know how in heaven's name an Ameritech or a GTE are going to get a hundred million, two hundred million out of an eleven-million-dollar fund. And if you think for one minute that the ICC is going to increase the fund to be able to give money to Ameritech and GTE, you're being unrealistic. Because remember - what was it? - 1990, folks, when we had a -- the ICC put a fifteen-cent surcharge on? How quickly, how quickly, did we come back in here and change that? So it's unrealistic to think that's going to happen. The intent and my intent, everybody's intent, that it's for thirty-five thousand lines or less. It's for the small, rural telephone. And if we don't get this, the rates in those areas are going to go up a hundred to a hundred and fifty dollars. It could be outrageous. And so you say, "Okay, they can't afford it. We'll have a fire sale and Ameritech or GTE or somebody will come in and buy those lines. They'll still get their service.'' That may be true, but that's a long way off and I just -- don't let us get into this big fight between the big boys. These are just the little guys. We're just trying to do what we're doing now.

Well, I don't think there's any question that -- virtually everybody here wants to keep the status quo so that these rural phone users are -- continue to have the phone service and that the fund still remains there. I think, though, that what you indicated was that it's your belief that the ICC would never allow the bigger companies to take money from the fund and they would never allow that fund to be increased, but apparently, the way the language of the bill is drafted, it would allow the ICC to have STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 12, that authority. So i.t seems to mle, since we all agree on what we really want to do, and that is keep the -- the -- keep the status quo, I don't understand why you don't just change the language of the bill so that you can make the critics go away and keep the status quo. Because, you know, the ICC could - who knows? - decide that maybe it's not fair, maybe Ameritech should get some of this funds, and all of a sudden, those people who are not from the rural areas are going to have a line item on their phone bill that will be to increase, you know, the payments to this fund and then we're all going to have constituents complain about their phone bills, and why did you vote for this bill. So, I understand what you're saying with regard to what your intent is. I just think that you should be cautious and put the language in the bill to clarify exactly what your intent is.

Thank you. Senator Cullerton, I think you're more than aware of what's going on here, and I told you we are caught up in the wars of the big boys. You have personalities that are -- that are -- you have personalities here that are conflicting. You have companies that are fighting on all kinds of fronts. I am telling you what the intent is. I have told you also, in the beginning of my opening remarks, that this is not the final product. I do not believe that at this point. After our -- this amendment was' adopted, we had conversation since then. I believe it will be tightened up, but I can't guarantee that at this point, and I'm not going to move it and I'm not going to send it on to the Governor unless we have things the right way. Thank you, Mr. President, Ladies and Gentlemen of the Senate. I -- I would concur with Senator Donahue. I think this bill is still a work in progress. But -- but she's absolutely correct. You know, the -- the rural telephone users are getting caught in the cross fire of two big guys, or a number of big guys, that just truly don't like each other anymore. And I think for us to -- to not allow this amendment to get on and not to allow the bill to proceed would be a big mistake on our part. I would concur that the eleven-million-dollar fund is not going to grow. I think it was said best by the Citizens Utility Board in their testimony today, that they felt that a statement of intent would satisfy them and -- and most of the people involved.

It clarifies the term of office for all board members after the initial board is set up. It clarifies that if not all of the counties join the Metro-East Park and Recreational District, the board is only represented -- will only represent those counties which have elected to join. It changes the holders of the money in the Metro-East Fund from the county with the largest financial contribution to the district as a whole. It removes the service occupation use tax and the retailers' occupation use tax. It changes the word of the tax section to include Department of Revenue. Technical language regarding retailers' occupation and service occupation taxes. It exempts certain food and medical equipment from the operation of the tax under the Act. It requires the board to submit an annual financial report to the State Comptroller by the end of its fiscal year. It amends Property Tax Code to include all property belonging to a park district organized pursuant to this Act to list the park and the conservation districts be exempt from property tax -- taxation.
