This bill provides, for the taxable year 2001 and thereafter, that the assessed value of real property owned and used by fraternal organizations chartered by the State of Illinois prior to 1900, or its subordinate organizations or entities, that prohibit gambling and the use of alcohol on the property and those members provide direct or indirect financial support for charitable works such as -- such shall be frozen by the chief county assessment officer at fifteen percent of its 2000 or fifteen percent of the assessed STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 91st Legislative Day March 29, 2000 value of the years it qualifies or qualifies after the 2000 assessment level. It also provides that additions and improvements made to the property subject to the assessment will also increase by the fifteen percent of the value of the improvement. This is to -- this -- this legislation, which was passed six years ago, was placed on the books in -- in response to a peculiar situation within the legislative -- my legislative district, and Senator Walsh, dealing with Chaney-Monge School, which services Stateville Penitentiary. As a result, almost half of the school district has properties that are owned by the State of Illinois. This tax equivalency grant basically would permit, or has permitted over the last five years, a payment from the State to make up for the loss of revenues that would have been generated as if there was normal development in the area. Thank you, Madam President, Members of the Senate. 3859 is the -- where the railroad union and the railroad industry worked out an agreement that states that every Class I rail carrier, according to federal regulations, would submit a counseling program for their membership that's involved in accidents that cause great bodily harm or -- or that could cause any trauma. And all they have to do now - and the rail carriers are okay with this - is actually come up with a counseling program and submit it to the ICC for everybody to look at and to know that, in fact, these carriers have a program in place. This was a work in progress by some of the people involved. The United Transportation Union and the Brotherhood of Locomotive Engineers did a very, very good job for their membership and this is the product of their work, and I'd ask for a favorable roll call.

It provides for the establishment of special service areas for certain privately owned or maintained roads in unincorporated areas and subdivisions that were platted before January 1, 1959, that are under township organization -- in counties under township organization. It provides for the county to be able to plant -- do plantings along highways similar to what the State does currently. It also permits the county highway department to temporarily close roads for special events, basically the same as the State of Illinois can. And it also would allow the county engineer to develop appropriate standards that may be applied in the development of unimproved subdivisions that were subdivided before 1920s. House Bill 3995 is a follow-up to Public Act 91-246, which prohibited the affixing of a State tax stamp upon any cigarette package that did not comply with federal STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 91st Legislative Day March 29, 2000 labeling requirements. This was intended to address the problem of the gray market cigarettes, those that are manufactured for sale outside of the United States. Currently, we have a problem that's the reverse of this, and these are cigarettes that are manufactured in the United States but are intended for export only. They have different packaging requirements than we do in the States. They have p different warning label from the U.S. Surgeon General, and they are going out and then coming back and being sold without the proper tax stamps. And it is illegal, and this bill would address that and administer the appropriate penalties. I ask for your support of House Bill 3995.
