Senator Weaver, Chair of the Committee on Rules, reports the I following Legislative Measures have been assigned: Be Approved for Consideration - Motion to Concur with House Amendment 1 to Senate Bill 368, Conference Committee Report 1 to Senate Bill 441, the Motion to Concur with House Amendment 2 to Senate Bill 1975, and House Bill 4659.

Thank you, Mr. President. There will be a Republican Caucus immediately upon adjournment in Senator Philip's Office.
PRESIDING OFFICER: (SENATOR WEAVER) For what purpose does Senator Jones arise?
Yeah. Thank you, Mr. President. A query of the Chair. You -- the Secretary read into the record the report of the Rules Committee. But I see the Rules Committee was absent the motion that was made on Senate Bill 1047. Now, I know Senator Demuzio did make that motion and your Members voted it down. This deals with the contract for correctional officers, which was part of the collective bargaining agreement. This is the pension portion. And I do see many members of Department of Corrections that are here today. And we should be moving on this particular issue. But I see -- perhaps you can explain to the Body and the Members why you refused to let that motion be heard or why did you vote it down in Rules Committee. This is something that your Leader, myself, Speaker Madigan, the Governor, Lee Daniels, we all supported this package. And -- and this is pension benefits for correctional employees. And so, Mr. -- Mr. President, as Chairman STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day January 8, 2001 of that Committee, could you explain to the Body why you would not let that proposal out on the Floor as you did the other provision?

Yes, thank you, Mr. President. Mr. President, for the information of the Body, at the Rules Committee, there was no second; therefore, there was no motion that was seconded and there was no action and no vote taken in Committee.

I know you can hear quite well, Mr. President. I just wanted to remind you, I see a couple of Members over here who had their lights on who wish to address the Chair. And I -- I know you can see quite well, just like I can.

Well, thank you, Mr. President. Senator Dudycz is right. I did, in fact, make the motion to allow for the concurrence motion on Senate Bill 1047 to go to committee, in the Rules Committee, STATE OF ILLINOIS 91ST GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 111th Legislative Day January 8, 2001 and in fact, there was no second, including himself. And I was just curious, if he has a change of heart, I'd be glad to request that we go back to Rules so I could get a second, so I could get a -- a roll call on Senate Bill 1047. Otherwise, I think that it's -- behooves us, at least, to send this bill -- this concurrence motion to committee. So -- at least, we only have two days left in this Session, and once we adjourn here today, we only have tomorrow. It seems to me that we ought to afford ourselves the opportunity to go to committee, keep this issue open, and see if we can't come to some reconcile of -- of the issue between now and the time that we adjourn tomorrow sine die. So I would, again, make that request that -- that you consider Senate -- the motion with respect to concurrence of Senate Bill 1047.

Thank you, Mr. Chairman. I was just rising to ask if you were going to respond to Senator Demuzio's request. And if so, did you have a timetable which we could take up this matter?

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Just a point of inquiry, if I could. By the failure of -- of this Body to act and to codify the agreement that was negotiated by the -- between the Governor and AFSCME, with our failure to act on this negotiated agreement, are we, in effect, negating that agreement and sending it back to the Governor for further negotiations?
