Good afternoon. Good afternoon, Ladies and Gentlemen of the Senate. If I may have your attention for a moment, please, I 3 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 17th Legislative Day March 27, 2001 would be most grateful. I'm here today to honor the Girls' State Championship Basketball Team from Fenwick High School. And -- if I may, I'd just like to offer a couple of quick remarks about Fenwick and introduce a few folks. Fenwick High School is a truly unique and special institution. It's located in Oak Park, Illinois, but it draws students from far and wide. Was established in 1929 by the Dominican Fathers, who lead the school today. There's nearly twelve hundred students. And let me tell you, Fenwick boasts a loyal and distinguished alumni of Fortune 500 presidents and CEOs, leaders in the military, Major General Healy, Astronaut Dr. Kerwin, Pulitzer Prize winners, Olympic Gold Medalist Ken Sitzberger, and Heisman Trophy award winner Johnny Lattner. Today -- today we recognize the greatest girls' high school basketball team in Illinois history. That's right. Look at the statistics, look at the facts. Most points ever scored in a season. Most points ever scored in a final. Most -- largest margin of victory in most games ever won in a season. This really is a very, very special team. Thank -- thank you, Madam President. House Bill 258 amends the Public Community -- Community College Act, which basically provides that we will stagger the terms of the trustees, beginning in 2003. Currently, what -- what happened, when we changed the law and eliminated odd-year elections in November, then we didn't have an opportunity to redistrict -- we didn't have an opportunity to redistrict the community college board trustees in my area for -- for college -- Community College District 522. All other community college districts elect their trustees at large; these are elected by district. And because we eliminated the odd-year November balloting -- or, voting, there wasn't sufficient time for this -- this time, on April 3rd, to redistrict or redraw the community college trustees' districts. So what we're doing is for those who have four-year terms and six-year terms, in 2003, those who elected April 3rd in 2003, we will -- begin their new ten-year cycle. And -- because then they will be allowed -- there will be sufficient time to redraw those districts. So, basically, we're correcting a mistake that was -- that -- that resulted as a result of us eliminating the odd-year elections. And they will be elected in 2001, April 3rd, based upon their old district, and then we will change their new districts for 2003. Senate Bill 800 is a proposal that we allowed the local township road commissioners to be able to assist subdivisions that have nondedicated private subdivision roads to be able to get their roads up to standards that would meet the county Code. If you'll recall, for some of us who've been here a long time, we had this bill that allowed up to ten percent of their taxes that are used for the local roads to be used to assist them. The townships have come to me and the subdivisions have asked if we could extend that time, and also to increase the amount that they can withhold up to fifty percent. This is only for the collar counties -- the townships in the collar counties, so it doesn't affect downstate at all. The townships are in favor of it; the subdivisions are too. And I do ask for your support. Amendment No. 1 did have a sunset provision that we put in there for ten years, which would end. So I'd ask for your support on the bill.

Senator Klemm, I'm -- I'm unclear as to what taxes can the road commissioner collect from the subdivision. All taxes or just certain real estate taxes or certain -- the appropriation for the road commissioner himself?

They're the -- part of the -- the taxes for the township road program. They have the permanent hard road, and then they have the road and bridge. It's part of the permanent hard road tax that they use to fix all the township roads up. It's part of -- it only comes from what is the subdivision area alone.

So -- so this isn't a tax increase; you're just accumulating the taxes that are paid, similar to a TIF district. Is that kind of the idea?

Is there a -- a reason? I mean, do we do this now in downstate counties? And -- and shouldn't we apply everything equally? I mean, why are we just doing it for the collars and not the rest of the counties?

Well, it's -- it's current law that it's only for the collar counties, and so -- nobody from downstate had asked for it. It's not a problem if downstate wants to get involved. But since the current law only accounted for those areas -- and the reason why, probably, Senator Demuzio, is because years ago, in the twenties and thirties, when the lakes and rivers up in that chain of Lake County, McHenry County, Kane and Will and that, they had a lot of subdivisions of -- of little summer cottages. And what's happened -- they just put a gravel road in and sold lots. Well, what's happened is they've made those summer cottages full-time homes now, but they're still gravel roads. It doesn't really apply as much to downstate, but I didn't have any problem if somebody wanted to do it downstate. But this bill does not direct that, nor does current law.

And according to the Department, the Attorney General represents the medical vendors and health care staff that the State directly contracts with but not those individuals who are -- work as subcontractors. Public Act 91-0439 amended the applicable tax Acts to transform the prior sales tax exemption available for organizations that presented live musical or dramatic performances on a regular basis into an exemption for cultural arts organizations. However, there is no statutory standard saying that these organizations must devote any specific portion of their activities or purposes to cultural arts support programming or services in order to qualify for the exemption. The Department requests that the term "primarily" be inserted in the applicable sales tax Acts in order to remedy the -- the situation.

Okay. Just to clarify. This -- this does not talk about whether or not they're exempt from property taxes. This is -- this is an entity that -- that can file -- I think they file a form saying that they're exempt from having to pay sales tax. And what -- I -- I know I have a lot of these in my district. That's why I'm interested. And the Department of Revenue normally is -- comes forward with bills to try to, you know, protect the State's revenue, which I can understand. I'm just wondering if we're -- we're not changing the law such that someone who is now getting an exemption, it's being taken away as a result of this piece of legislation. Can you tell me whether or not they told you whether or not that's possible?

Nearly seven years ago, I had the opportunity to spend almost five weeks in the summer in the excruciating process of working with then Chief of Staff Jim Reilly in crafting the MediPlan Plus Bill, which was supposed to revolutionize and -- and change the way we did business in the Medicaid program. Seven years later, we've never, ever used that carefully crafted program in statute, and this is my third opportunity to bring in a repealer for that Section of the Statutes. This year it is recommended and brought by the Department. It has the support of the Governor's branch. It's a technical clean-up repealer. Gets rid of a program that, unfortunately, we never had the need to use. I'd appreciate favorable support with this critical part of my legislative program.

The armories generate the revenue through rental proceeds, et cetera. So when they say modified per capita, they're -- they're basing it on the per capita at each armory - what they generate per capita.

Ladies and Gentlemen of the Senate, Senate Bill 879 is the result of work from Senate Bill 359, in -- in our previous General Assembly, and that -- what that legislation did was -- was create the Illinois Insurance Fraud Task Force, which -- which was charged to investigate and make recommendations to the Governor and the Illinois General Assembly concerning insurance fraud. That committee has come forward and made its recommendations and Senate Bill 879 is a product of that. I think it's important for everybody to keep in mind that insurance fraud is a big business in the country. In fact, it is estimated that it amounts to one hundred and twenty billion dollars per year, and the people who pay for the insurance fraud are basically the law-abiding consumers of this country who buy insurance. What Senate Bill 879 will do is increase the reporting of potential fraud to the Department from the current claims reporting requirements in the casualty and property lines to -- include additional lines. It'll also expand the reporting requirement beyond claims reporting to the reporting of -- application and premium fraud. It would create the Illinois Insurance Claims Fraud Prevention Act, modeled after a similar law that is -- is in existence in the State of California. Would provide a significant monetary incentive to insurance companies, individuals, and local State's attorneys and the Attorney General to bring civil suit against persons who seek to defraud insurance companies. It would also provide protections and recompense to any employee who is discharged or otherwise discriminated against by his employer because of lawful acts he has done in the -- 43 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 17th Legislative Day March 27, 2001 seeking action under this -- this law.
