Thank you, Madam President, Ladies and Gentlemen of the Senate. The legislation under Senate Bill 635 creates a task force to explore ways to better coordinate this State's library system. The Floor amendment that is before you would require that the appointments to the task force be made to the -- by the Secretary of State, subject to the advice and consent of the Senate; that the appointments shall be made prior to September 1, 2001. The issues that are to be studied by the task force are outlined in the amendment and also provides that those hearings of the task force shall be statewide. The findings of the task force shall be submitted to the General Assembly, the Secretary and the Governor by January 1, 2003.

It provides that the Department of Employment Security, before September 30th of each year, will issue a written advisory notice to each employer that reported wages paid to a hundred or more individuals with respect to any quarter in the immediate preceding calendar year. This essentially relates to the WARN Act, the federal legislation that requires notification prior to layoffs or plant closings. Thank you, Madam President, Ladies and Gentlemen of the Senate. Senate Bill 722 deals with the issue of vacancies in the offices of regional superintendents. Many of you may recall the debate that we had on the Floor here not too long ago where there was issues that were raised, questions that were posed, about the two different policies, one policy in the County of Cook and another policy in the rest of the State. Senate Floor Amendment No. 2 deletes everything after the enacting clause and deletes the Committee Amendment 1 which had the content of the policies for downstate vacancies. It rewrites the provisions for filling a vacancy in Cook County, the office of regional superintendent, and it provides that if a vacancy occurs on or after August 7th, 1995, the vacancy shall be filled by appointment of the township committeemen of the same political party as the incumbent in that educational service region. This model is the same model by which we, as State Senators, would be -- a vacancy in our office would be -- would be filled. We felt that this provides a tried-and-true method for filling vacancies and addresses the problem in -- in Cook County. I'd ask for your favorable consideration.

Senate Bill 55, as amended now, extends the deductibility rights of bad debt provisions from the retailer making the sale to third-party proprietary financers {sic} in the course of business. It brings us into line with the practice in most other states. Quick example: If you go to a store and -- and buy a recliner and 48 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 22nd Legislative Day April 3, 2001 they agree to loan you money for thirty days and you never pay the balance on that recliner, the amount you don't pay is deductible from the amount that the retailer has to calculate his sales tax on. In most states, if the retailer hires a proprietory credit company to -- to run a revolving credit card form, as like Menards does and other people, if there's a bad debt related to the purchase, they get the same deductibility. In Illinois, we have not generally extended that right of deductibility to a holder in course of the commercial debt. This is -- the estimates for the -- the annual cost are anywhere between one million and three million dollars. The experience in California, I think, was about 4.3 million when they reformed their practices. Most states treat it as this bill does. I'd be happy to try to answer questions.

That very first year, in 1996, the people that were trying to apply for school bus drivers included a hundred and fifty-seven criminals, including six convicted murderers, six convicted rapists, nineteen armed robbers, an assortment of prostitutes, arsonists and drug pushers. What this bill does is allow for people who have been grandfathered in previously to 1995 to also have the more thorough background check, which would include fingerprinting. This legislation provides that a person appointed to fill a vacancy in the office of regional superintendent of schools shall serve the remainder of the term unless more than twenty-eight months remain in the term. It actually arises from a situation created when the regional superintendent of schools for Grundy-Kane-Kendall-Will counties resigned with over two years left in his term, and it provides for a midterm election. So it's not stated and this actually makes the regional superintendent of schools exactly like other county officials and like anyone in the Senate. Thank you, Madam President, Ladies and Gentlemen of the Senate. Back in the mid-1970s, Illinois set at twenty-five years the definition for what is an antique slot machine in our statutes. And we did that twenty-five years ago because the technology of slot machines was more mechanical and it wasn't computerized like it is today. Today, a slot machine, as used in 54 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 22nd Legislative Day April 3, 2001 a casino or a place where gambling is allowed, the life of that slot machine is probably five to six years maximum because of technology and because of computerization. In the United States, there is a pretty large industry of selling used or antique slot machines and Illinois statute at twenty-five years is very much on the high end. And now that we have riverboat casinos in our State, as these slot machines are retired, they go elsewhere, to other states, to be sold and other states get the sales taxes on the expenses for the sale of these very expensive machines. An antique slot machine is -- is not to be used for gambling purposes. It's prohibited in the law. It's only to be used for amusement. There are also collectors who keep these things in their basements and recreation rooms. So based upon the change in technology of these machines, that a machine only five or six years of age is now obsolete for purposes of real gambling - and, again, antique slot machines, it is illegal to gamble with these; they're for your amusement only - and because of the underlying sales tax revenue that we're losing, it is thought that we should drop the age to be more realistic in the definition of an antique slot machine. We cut it in half from twenty-five to twelve years. I'd be happy to answer any questions, and I'd appreciate a favorable vote.

This is language that was in Senate Bill 878 in the 91st General Assembly to allow local taxing districts to abate their property tax on parcels owned by a historical society. It was limited to the years '98 through 2000. It was also narrowly defined to help the Adlai Stevenson boyhood home that had been recently acquired by the McLean Society -- Historical Society. Senate Bill 598 would permit a library district that -- that -- that is collecting property taxes from disconnected parcels for bonds that were originally issued while that property was part of the district. Last year, Senate Bill 1627 added a provision to include those parcels if the bond is refinanced. That provision will expire -- expired at the end of last year. This bill basically reenacts that language with the same safeguards that the new interest rate cannot be any higher, the term may not go past the original maturity date, the annual payments may not go higher. Library districts would have until June 30th, 2002, to take advantage of this provision. Given the language that is used, this could only serve to lower taxes. And it passed out of the Revenue Committee on the agreed bill list. I know of no opposition. I move its adoption.

Senate Bill 778 creates the Omnibus Charitable Gaming Act to provide for the operation of bingo, pull tab, jar games, Las Vegas Nights, and events qualified for nonprofit organizations. It allows for a three-year license. It covers bingo, pull tabs, charitable games, and moves the point of taxation on pull tabs from the charitable organization to the licensed supplier. Also, the amendment allows grandfathering in of a very few 501(c)(3) and 501(c)(4) organizations that currently hold bingo licenses under the Bingo License and Tax Act. This is the result of a couple of years of study of all these folks involved and these are their recommendations. So I'd solicit your favorable consideration.

The bill makes nine changes to the administration of the Cigarette Tax Act and the Cigarette Use Tax Act as follows: It modifies Section 5 of the Cigarette Tax Act to allow for acceptance of alternate methods of tax stamp indicia. It changes Section 9a and 9b of the Cigarette Tax Act to be consistent with the Uniform Penalty and Interest Act by changing the -- protest period from twenty to sixty days. It changes Section 13 of the Cigarette (Use) Tax to be consistent with the UPIA by changing the protest period from twenty to sixty days. It modifies Section 12(a) to allow private taxpayers, those not licensed as distributors, who acquire cigarettes on which tax -- Illinois tax has not been paid, to file a return with the Department within thirty days of acquiring such cigarettes, rather than the current three days. Modifies the Cigarette Use Tax Act to provide for electronic funds transfer. It allows the Department to stop selling cigarette tax stamps to noncompliant distributors, as approved by the rule making process. Imposes a civil fine for possession with the intent to sell unstamped cigarettes or improperly stamped cigarettes when they are found in a retail establishment, if the quantity possessed is at least ten packs. It eliminates obsolete language referring to coded stamps and allows the Department to promulgate rules, regulations -- or rather, regulating schedules to be filed using computer-generated magnetic media formats. The current statutory language does not provide for the magnetic media. Ask for your support of Senate Bill 856.

This bill is at the request of the Illinois Emergency Management Agency and it amends their Act and the Illinois Emergency Planning and Community Right to Know Act. Basically, the bill includes clean-up -- clean-up language for the Act. One of the changes allows for counties to consolidate their emergency management functions, if the -- if -- or emergency services and disaster agency. If the counties involved in IEMA would approve, they can consolidate some of the services. It narrows the focus of workers' comp coverage in the IEMA Act to exclude full-time employees. It gives IEMA the express authority for the annual review of county and municipal emergency operations, plans and exercises. And also, it does add an amendment which is a reflection of the recent concern about animal disease. It specifically includes "animals and livestock; seed and feed" in the list of items under the Governor's emergency powers authority. Thank you, Madam President. Senate Bill 932 amends the School Code to clarify an existing law that is ambiguous, as well as unfair, to a school district which contains under five thousand residents. This amendment makes the requirements for petitioning for a dissolution the same in districts under five thousand residents as is currently in effect for districts with over five thousand residents. It also allows for an election by the people, which is currently the case for school districts over five thousand. Specifically, it says by a petition of two-thirds of the registered voters in the district that wishes to be annexed and an affirmative vote of the board of education of the annexing district. If no affirmative vote of annexing district, then an election must be conducted and approved from the voters in both the annexing district and the district to be annexed. This legislation puts smaller districts on an equal footing with larger districts and requires more than a majority of valid signatures and an election if the annexing district is not in favor of the 79 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 22nd Legislative Day April 3, 2001 annexation. I think I asked this question in committee, but as -- as I understand what you are doing, is if there is a community of less than five thousand population and the school board in that affected area votes in the affirmative to join with an adjoining district by annexation, then the people would have the right by a two-thirds signatures of the registered voters of the affected -- the community with less than five thousand, filing with the -- with the regional board of trustees, that that would force a referendum. Am I correct?

No. The provision in the law that we're trying to change now allows a petition with just a majority of the registered voters can file that petition with the regional board and the regional board can just dissolve the district. It takes no action from either the state -- either the school board of the -- the one district that's being dissolved. It takes no action from the district being -- that that district is going to be annexed into it. It takes no vote of either district. It simply is a petition signing of the majority of the voters and a vote of the -- the regional board of -- of school -- whatevers.

Or is it the district that is affected has to vote by affirmative vote, as well as the absorbing district?

There are four -- there are at -- now -- now, in State law, there are four ways to dissolve a school district. By resolution of the governing board, presented to the regional board, this is the one that this law is -- is seeking to -- yeah, I don't know which provision in State law you're -- you're referring to, because there are -- there are four different ways to dissolve a district. The one we're trying to change is the one that says that -- that a petition of the majority of the registered voters of the dissolving district. You file that petition with the regional board of school trustees and they can just dissolve the district by -- just like that. Thank you, Madam President. I wasn't expecting us to move that quickly, but this is a compromise that the -- way back when, I don't know if some of us remember, we passed Senate Joint Resolution 77, which was about the Illinois Commerce Commission on their emergency rules pertaining to school districts of having to put their enhanced 9-1-1 telephone service in all the schools. And in that resolution they said they shouldn't do that. Well, talking to the school boards, they've said that they would like to make a compromise. And what this bill does now, 1289, says that only an entity which installs or operates a new private business switch service shall put in the 9-1-1 call. So what they're doing is saying that if they're going to put in a new system, they will comply with the 9-1-1, and I think it goes a long way in trying to resolve this problem with the schools. So I do ask for your support.

Thank you, Madam President, Ladies and Gentlemen of the Senate. Senate Bill 1348 is the Office of the Auditor General's transfer bill. Every two years we require an audit of each State agency by our constitutional officer, the Auditor General, and for larger agencies, we put the amount of the audit cost in the budget of the agency and then legislatively transfer it so we know what the costs of the audits are. You should have on your desk an analysis showing what agencies are going to be audited. This is the audit expense. It's almost exclusively used to hire outside auditing firms that perform the audits. I'd appreciate favorable roll call and be happy to answer questions.
