And as you know, we didn't do all that well, but we try to raise money for a local charity. One thing that was said about our softball game, and Tim Anderson, who used to work on the Senate side, now works for the Secretary of State, his young son, he's about four years old, came up after the game and he was all excited. "What a great game. What a great game. You guys really played well." You know -- and I said, "Oh, we lost." He said, "You only had one bad inning. The rest of 'em were all great," he said. "You played a great game." And you know, I said, "All right. I'll take that. I'll take that." We did have one bad inning. Scored nine runs on us, and unfortunately, we got beat. But I'll take Sam Anderson's perspective any day. This game has always been sponsored - the last ten years almost, now - by the Regional Chamber and Growth Association out of St. Louis. And they sponsor the game, they pay for all the expenses, and they do a great job. And John Valenti is here, who represents the Illinois side of the river when -- with the RCGA, and of course, John's very visible here in representing the interests of the Metro East area. And the House guys, even though they won the game, they give it -- to our charity. So we appreciate that. So we've got seven hundred and fifty dollars here to give to a charity here in Springfield. They help low-income families with rent assistance, budgeting services, referrals for medical and food and clothing, and emergency support services to people that are very, very needed. We have with us today Stephanie Campbell, who's been spearheading their fund-raising activities here at the Fifth Street Renaissance. And what it basically does is a reimbursement method from the State Treasury to counties that have a State correctional institution in them. It sets up a program of reimbursing the clerks that handle a lot of instances that -- cases that are filed from inmates within those -- within those correctional institutions.

Inspector General, after its -- his confirmation, shall serve a two-year term. There are provisions in here to indicate when, at what time, the successor is appointed, whether or not we are in Session, similar to other Acts that we have. House Bill 250 is the language that codifies the collective bargaining agreement that was reached between the Governor and correctional employees -- or, employees that are covered under the alternative formula in the State of Illinois. It creates a flat-rate benefit for -- formula for alternative formula employees who retire after the 1st of January of 2001. It increases the pension benefit for 20 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 17, 2001 alternative employees that are not covered under Social Security up to three percent. For those who are covered under Social Security, increases their calculation from 2.2 percent to 2.5 percent. I think all of us in the General Assembly who have been around the State of Illinois in the last year are certainly familiar with the language contained in House Bill 250. Earlier today, the House passed the zero tolerance language that this Body had been waiting for the passage to be effected over in the House and sent to the Governor's desk. As a result of that, we present House Bill 250 for questions and would be happy to answer those, and to ask for the approval of House Bill 250, which, again, would codify the budget agreement/employment agreement that was effected between Governor Ryan and the State employees last year.

This affects the duty death provisions of the Chicago firefighters' fund. I know of no opposition. It increases the permanent duty disability percentage to seventy-five percent of salary. It removes the earnings limitation on disability benefits. Increases the child's duty disability pension and occupational disease pension to one hundred dollars. Raises the minimum duty disability provision from fifty percent to sixty percent, and extends the three-percent annual increase to those born before 1950. House Bill 279 establishes an annual recertification requirement for EMS dispatchers that require twelve hours of continuing education. In the law, it says the Department of 26 STATE OF ILLINOIS 92ND GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 43rd Legislative Day May 17, 2001 Public Health shall have the authority to establish the annual recertification requirement for emergency medical dispatchers and the Department shall also have the authority to establish criteria for modifying or waiving EMS dispatcher requirements based on whether the previously attended dispatcher training program merits automatic recertification of the dispatcher. This is a nationwide campaign to provide some standards to the EMS dispatchers. And then it raises the bar for them, as well. It would also bring Illinois to a level of continuity care that will greatly benefit each and every citizen. Emergency medical dispatcher is the key element to emergency medicine because they are the first ones that gets the call. And it's those six and ten minutes that certainly can save a life, that -- that we need and we need to raise our State to the standard that they're trying to address nationwide.

Thank you, Mr. President. I support this legislation, Senator. But there are a couple questions I just wanted to, I guess, verify. Number one is, does this require that fire agencies employ emergency medical dispatchers and to use the emergency medical dispatch system? In other words, those communities that currently don't utilize this dispatch system, is that going to be required for them in the future?

Senator, to my knowledge, no, that should not require any districts that do not have these services to now get a service in place. We are still continuing to negotiate, but we are not there yet. And I can't say whether I'm optimistic or not optimistic that we can ever come to an agreement on a bill. But I would like to move this bill. It's -- it's a shell. There's a Senate amendment on it, so the House will have to go to some type of concurrence routine, and we'll probably go to conference committee on this. But I'd like to move this bill out as a shell. I've talked to Senator Obama and we'd sort of like to keep this alive for the next seven or eight days, as we conclude our business, and see what happens. But I can't guarantee anything will happen, but we're going to keep trying and I'd appreciate a favorable vote.

House Bill 418, as amended, provides that the Toll Road {sic} (Toll Highway Authority) may not enter into any agreement or understanding for the use or acquisition of land that is intended to be used or acquired for the toll highway purposes unless full disclosure of all beneficial interests in the land is made. If the Toll Road commences condemnation proceedings to acquire the land, the holders of all beneficial interests in the land must make full disclosure unless the court determines the -- that the disclosure would cause irreparable harm to one or more of the holders. The Toll Road must file the statement with the recorder of each county in which any part of the land is located within three business days after the statement is filed with the Toll Road. Agreements or understandings in violation of this Act are void. This bill seeks to solve those questions of whose land the Toll Road is buying. I'd appreciate favorable support.

There is a pending proposed rule by the Federal Railroad Administration requiring the use of train horns at certain highway rail crossings across the nation, which mean that they would be sounding their horns with automated warning systems here in Illinois at six to seven thousand crossings in the State. Because of this, there is a growing need to find a way to mitigate train horn noise without compromising the safety of the public. What this does is authorize a pilot project in Cook, DuPage, Lake and Will County to test the utility of stationary automated audible warning devices as an alternative to trains having to sound their horns as they approach highway-rail crossings. I would be glad to answer any questions, and ask for an Aye vote.

And it expands the Illinois Department of Public Health's authority to regulate swimming pools prospectively, with respect to swimming pools and aquatic type of -- of things like spas and water slides. And one of the things that I was astonished at are the number of deaths that are caused nationwide and in Illinois by people being sucked into the drains of swimming pools. And there are new standards that are coming out nationally for people who construct pools and water slides to have a dual drainage type of system. But this bill gives the Illinois Department of Public Health some additional teeth in the future to regulate pools to prevent deaths like have happened in Illinois and nationally. I know of no opposition. We've worked with the Hotel and Motel Association on this, and they are neutral. And I'd appreciate a favorable vote. Would answer any questions that anybody might have.

Thank you very much, Mr. President. Members of the Senate, House Bill 854 would allow domiciliary care only for eligible National Guards and Reservists after twenty years of good service. And these individuals are currently excluded from receiving care in our veterans' homes because they do not have one year of active duty or one day of war time service, and I think this amendment will correct this inequity. House Bill 854 also authorizes eligibility for domiciliary care or nursing home care to honorably discharged veterans who served in a hostile fire environment and were awarded a campaign or expeditionary medal. All of our veterans' organizations support this legislation, except one, and that was the AMVETS signed in opposition because they feel that if we're going to do -- expand any care, it should be skilled care for our wartime veterans. That's not what we're trying to accomplish. We have sixty beds at the Quincy home, and I believe four beds at Anna, that are eligible for domiciliary care only. They're not able to be skilled. And I would simply ask for your support of this legislation.
