Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 1785 is an initiative of the Attorney General’s Office. It –- it simply clarifies and simplifies the procedures by which the Attorney General enforces the Whistleblower Reward and Protection Act to improve enforcement and bring the text of the law into conformance with the actual practice. It is not intended to alter substantively the -- the power of the Attorney General to investigate. I -- I do not have the analysis in front of me. My recollection is that it passed unanimously out of the Judiciary Committee, and I’d ask for a favorable vote.

This is a usual, ordinary and customary bill that provides for the Auditor General a transfer of specified amounts that are in the bill for various special funds to the Audit Expense Fund for use for the Auditor General in auditing those special funds, and I know of no opposition.

Mr. President and Ladies and Gentlemen of the Senate, I want to call attention to the Senate to an incident which happened in Madison County a few weeks ago in which three young children were taken out of a mobile home in the -- in the 6 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 23rd Legislative Day 3/21/2003 Nameoki Township area, and I have photographs of the home and it was -- they -- the home was used to -- the mobile home was used to manufacture methamphetamines. So we have Exhibit A here today - the reason for this bill. Thank you.

Would you be willing to take the bill out of the record and put an immediate effective date so that it’s in its excellent shape when it goes over to the House and we can just expedite this?

Well, Senator, isn’t it clear that -- that if your desire is to have this law put into place as soon as possible in order to take care of the problem that Senator Haine has -- has mentioned, and is an urgent problem, wouldn’t the fastest way to do that be to take it out of the record, put an amendment on it in the Senate? That way it doesn’t have to come back to the Senate and the Governor can sign it immediately. Isn’t that the best, fastest, most expeditious way to make sure that this good idea is the law of the land as soon as possible?

Well, Senator, you know, it does seem -- you -- you can’t have it both ways. I mean, if -- yeah… Someone on your side of the aisle said, “We’re Democrats!” Here’s my point: If your desire, Senator - and I think it’s a good idea, everybody here thinks it’s a good idea - if you want to have this become law quickly -- like Senator Haine pointed out, this is an urgent problem. I think your testimony in the Judiciary Committee was that this was not a plague, but -- but a -- a very urgent problem in central Illinois. It seems to me that if you want to have this become the law of the land immediately, as fast as possible, you would -- you would take the bill out of the record, you would amend the bill here, and then it can go to the House. It doesn’t have to come back here. You don’t waste any days, so there’s no crimes that can get committed in the meantime that wouldn’t be subject to this law, and you’re going to end up accomplishing your purpose promptly, more cleanly and more efficiently than if you send it to the House. Heaven only knows what’s going to happen over there. They may not amend your bill, Senator. They may -- they may pass your bill and then there’s this enormous lag time in the bill that you’ve drafted, and it’s not going to be in place in the time. Right now you’re totally in control of the bill. Right now all you’ve got to do is say, “Mr. President, take the bill out of the record.” You file your amendment. Your staff over there calls 8 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 23rd Legislative Day 3/21/2003 a Rules Committee. Bada bing, bada boom. It gets amended and it’s all clean. That is the way to solve this problem, and I would urge you to do it.

Yes. Thank you, Mr. President. Just some, I guess, friendly advice to a freshman Senator who’s -- who obviously is struggling with this. And you’re getting a lot of advice from people who are now in control and it’s a macho thing over there. You know, “Shove it down their throat,” “Go get ‘em.” I mean, that’s kind of the attitude we’re seeing over there right now. I mean -- my suggestion would be, why don’t you just do the right thing. Do the right thing. Get the bill in the manner in which it ought to be. And -- this is not malicious. I’m not -- this is not malicious at all. File the amendment, put it to the Rules Committee, bring it onto the Floor. Doesn’t even have to go to committee, as far as I’m concerned. It’s just getting the bill in the manner in which it ought to be. And just -- then we can pass it, it goes over there and you’ve got the bill in the form that you want it. So, I don’t think that it’s really -- we’re not asking -- but I can see -- I can see the testosterone, at least in some of you. Not all of you have testosterone over there. But I can see the testosterone in a lot of your Members over there who are wanting to try to, “Cram it down their throat.” That’s the attitude that I see. And -- and -- and, Senator, I -- I really think that you ought to just -- common sense ought to prevail here. Take it out of the record and amend it in the -- way it should be, and -- and then we support it and there’s no problem.

And I believe this is Senator Sullivan’s first bill. I think we’ve tormented that poor kid long enough. Yes. We did consider in our committee an amendment that would make this, as Senator Roskam was talking about, have it become effect right away -- immediate effective date. And that language, as Senator Roskam knows, is “This bill shall take effect -- becoming law.” So we debated that, whether or not we should add that language. And then we realized that when you consider whether or not this bill should take effect -- becoming law, we said, “Well, how else can a bill take effect, other than upon becoming law?” And we said, “That’s very confusing. This - - this is way too confusing, especially for a guy who is not only not an attorney, but a auctioneer.” And so, we figured maybe the better way to do it is to see if he knows how to play softball, have him do his closing argument on this bill as an auctioneer would do it, and we then would be entertained, we’d be done with it and we could, you know, get on with the -- the business of the day. So, that’s what -- that’s what we decided in the committee. So, you guys raised some very good points, but I think what we should do is just look forward to this auctioneer giving his closing argument. Thank you.

Well, Mr. President, I thought this would be an opportune time to congratulate Senator Sullivan, but also to thank him for his help Wednesday night at the Sportsmen’s Caucus at our auction. He was very successful and he did half the auctioneering of the items that were donated for the auction. And to report to the Members of the Caucus, the most successful auction we’ve ever had, the Sportsmen’s Caucus. We raised over twenty-one thousand dollars for the Conservation Foundation that will go to youth activities. And over the ten years that we’ve done this, our previous high was about fourteen or fifteen thousand. So, Senator Sullivan, thank you for your help and contribution, and thanks to all the Members who donated items for the Conservation Foundation for our auction. Very successful.

We’re asking that the specified amount that is required to go into the Off-Highway Vehicle Trails Fund be changed from which is now sixty-five {sic} (sixty) percent of the money to eighty-five percent of the money, which would still leave sufficient funds to ensure that there was adequate dollars for servicing those needs as well as administrating them. Right now they’re spending about fourteen percent. The Department of Natural Resources originally was neutral on the issue and now are in support of this change. We had a good hearing in the Executive Committee, and -- but do you have a copy of the bill in front of you, or can your staff grab a 16 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 23rd Legislative Day 3/21/2003 copy, ‘cause there’s just a couple specific… You got it? Okay. Obviously, this is -- the purpose of the bill is approaching private entities, private corporations and so forth, and creating protection for employees. In -- on page -- page 1, Section 5, line 7, you define “employer” as an individual, sole proprietorship, partnership, firm, corporation, association, or any other entity that has one or more employees in this State - and then - except that an “employer” does not include any governmental entity. That’s -- that’s fine. Here’s my question: Section 25, which is on page 2, line 1, says this: “Report by employee of a government agency. A report made by an employee of a government agency to his or her employer is a disclosure of information to a government or law enforcement agency pursuant to Sections 10 and 15.” I think that’s a drafting error. It seems inconsistent to be referring to government employees. And I’m just wondering -- I know you had a number of bills - you introduced kind of a whole package - and I’m just wondering if maybe this was -- you know how sometimes that happens?

Floor Amendment No. 1 to Senate Bill 1997 becomes the bill and what it does is it recreates the Illinois Military Flags Commission. It’s established for the purpose of assisting the Adjutant General with his or her responsibilities under the law. The Commission is designed to advise the Adjutant General on how best to collect, preserve, and present or display to the public the colors, flags or trophies of war belonging to the State in order to disseminate information related to the history of -- of the Illinois National Guard. This -- this has been the law in the past. We’ve had a commission in the past. They’ve convened to come up with a strategy to save, particularly, the Civil War flags. The State of Illinois has the largest collection of Civil War flags in the nation. Many of these flags are deteriorating. They’re made out of silk. They’re biodegradable. Many of ‘em are hanging in the Hall of Flags on flagstaffs. That’s the worst possible thing we could do. They’re in the sunlight. They’re degrading. They’re falling apart, and soon they’ll be lost forever. The purpose of this Commission is to come up with a strategy to not only save and preserve the flags, but come up with a way to help show them off to future generations in the State of Illinois. So, I would ask for approval of this amendment.

These intermediaries are appointed by the courts to obtain information about genetically based medical problems without breeching the confidentiality of the adoption proceedings. 53 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 23rd Legislative Day 3/21/2003 Yeah. Thank -- thank you, Mr. President. As I look at the Calendar and look at the requests for fiscal notes, now these fiscal notes are just dilatory and trying to delay the process. Those vehicle bills do –- would –- which doesn’t have any substance in them cannot have a fiscal impact. So a request for a fiscal note for a shell bill is merely dilatory. Going to be my policy to go ahead and move those bills to 3rd Reading. So, the sponsor of -- of such bills, in the event it is a shell bill, we’re not accepting a fiscal note, or even a request that’s being made for a fiscal note waiting for the agency to get back, when that particular bill has no fiscal impact. So, therefore, the request for a fiscal note would not really apply. Agencies cannot really respond as such, which I consider dilatory. We’re going to move those bills to 3rd Reading.

I think what’s happened sometimes is -- is notes go on bills; they’re subsequently shelled; there’s a pending fiscal note; hence, the ambiguity. But I’m just not clear. Is -- is there a pending motion before the Body?

Let me clarify what I said, Senator. What I said, in essence, if there is a -- this is policy: If a fiscal note has been requested for a bill that is a vehicle bill that doesn’t have any substance, then -- then the sponsor of such bill, if they so desire, can go ahead and move that bill to 3rd Reading, even though the request may be there. But it’s impossible for a agency to respond to something that does not even exist.

I think the President was talking prospectively, if that should happen. If, in fact, however, we do -- move a shell bill to the Order of -- of 3rd Reading and then bring it back for a substantive amendment, that would be the proper time in which the fiscal note, in fact, at that point, could be -- could be filed. So I think we’re talking about something that’s nonexistent at the moment.

Thank you, Mr. President. Floor Amendment No. 1 basically removes a provision that investigators have police power only when enforcing the Illinois Security {sic} (Securities) Law of 1953. It states the Director shall only issue badges to investigators. I'd be glad to answer any questions.

My guess is, is that since folks arrive here not necessarily on time, we -- we may do some other housekeeping chores before we do that, but apparently it is our intention to go to the Order of 3rd Reading on Monday afternoon.
