Thank you, Mr. President. I wish to table the motion to reconsider the vote by which Senate Bill 1063 passed. I wish to table that motion.

Thank you, Mr. President. Floor Amendment 3 retains the underlying bill and allows a whistleblower to seek the advice of counsel before making a claim of discrimination. The amendment deletes the Class B misdemeanor penalty for an employer who fires an employee and would also lower the fine of an employer from five thousand, proposed by the bill, to twenty-five hundred dollars for discrimination against an employee. Also makes a technical change. I would move do adopt.

Thank you, Mr. President, Members of the Senate. This amendment clarifies that an employer is not obligated or required to pay an employee at a workplace in a certain county wages that are equal to an employee who has the same or different job in another county. In other words, we’re trying to make clear that equal pay relates to people living in the same jurisdiction. And for purposes of this bill, we’re using county as that jurisdiction.

Yes, Senator, you are correct.

Yes, Senator Rutherford, you are correct. Thank you for mentioning that.

Thank you, Mr. President. Amendment 5, in addition to making technical changes, clarifies that the three-year statute of limitation goes into effect when the employee learns that they were underpaid.

Thank you very much, Mr. President, Ladies and Gentlemen of the Senate. This is the videotaping bill that we’ve been working on for quite some time. We appear to have arrived at a broad consensus between proponents and law enforcement, and I’ll be happy to discuss the details on 3rd Reading.

Thank you, Mr. President. The amendment becomes the bill, and it’s the product of negotiations and lots of hours of -- of discussion? I’ll be glad to talk about the bill on 3rd Reading.

Thank you, Mr. President and Ladies and Gentlemen of the Senate. Basically, Senate Bill -- or, Amendment No. 2 to Senate Bill 132 deletes all and makes it a vehicle bill. We’re working on some language that is going to address the issue of impact fees on -- on schools and for the Realtors and -- and Home Builders, and I’d be more than willing to discuss the bill in -- on 3rd Reading.

Thank you, Mr. President. This amendment only will change the date for the crisis referendum for next year. I’d be happy to discuss it on the 3rd Reading.

27  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 Thank you, Mr. President, Members of the Senate. Basically what happens in 334, Floor Amendment No. 4 basically states that if a manufactured home -- it should be Floor Amendment No. 4, not -- not 2.

I don’t want to do anything with Amendment No. 2. I -- I want to deal with Amendment No. 4. Table it.

Thank you, Mr. President, Members of the Senate. Senate Amendment No. 4 just basically provides that if a manufactured home or mobile home is placed on a single-family lot outside of a mobile home park, it will be placed on a permanent foundation and will be taxed like any other property in that -- in that community.

Yes. This amendment really makes it where the Foundation Board will have the approval of the full Senate. It’s been worked out. I’ll be happy to discuss it on the 3rd Reading.

Thank you, Mr. President, Ladies and Gentlemen. What the amendment does is we’ve gutted the bill and it now becomes a shell, and we’ll hopefully send it over to the House and see if they can work out some agreement. Thank you.

Thank you, Mr. President, Members of the Senate. This amendment merely clarifies language, an agreement that was reached to -- with the Illinois Restaurant Association to support this bill. It just states that the Director of Labor has the authority to set the minimum wage.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Amendment 2 to 609, a Floor amendment, removes the preemption of home rule in the original bill, makes a couple technical corrections. Requires the Illinois Building Commission, as directed by the Capital Development Board, to make available implementation materials and adds a Section for CDB to obtain input from interested parties. This is a bill that’s still a work in progress. I’d like to adopt the amendment, move it to 3rd and keep discussions going.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. I would like to move to table Floor Amendment No. 2.

It’s -- it’s too late for amendments, but I will hold this once it goes on 3rd to have discussions with you.

Thank you, Mr. President and Ladies and Gentlemen of the Senate. The purpose -- this -- this amendment now becomes the bill. The purpose of this bill is to allow speech pathologists who meet certain requirements the opportunity to obtain a school service personnel certificate which would allow them, then, to work in schools where there’s a shortage of speech-language pathology services. And the bill would also create a temporary license to be issued to candidates receiving their supervised professional experience.

Thank you. Amendment No. 1 now becomes the bill. It would require hospitals to develop a community benefits plan. It also requires them to file with the Attorney General, and it applies to nonprofit hospitals with more than a hundred beds located in a metropolitan area.

34  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 Thank you very much, Mr. President, Members of the Senate. If I can just have everyone’s attention…

Thank you very much again, Mr. President, Members of the Senate. House Bill 2660 is the -- the Governor’s innovative plan to refinance and restructure our pension plan here in the - - State of Illinois. It does several things. Many of us -- I know we’ve talked about this for the past couple of months, but specifically what it does, it increases the State’s general bond authorization by ten billion dollars; it dedicates a ten-billion increase specifically for State funding; it amends the State Finance Act and creates the Pension Contribution Fund as a special fund in the State treasury, and it locks in sums of three hundred million for FY’03 and 1.86 billion dollars for FY’04. And, Mr. President, I’m available for questions, if there are any.

Not in detail. I understand that he will be doing that on April 9th of next week.

Senator Rauschenberger, no, he has not. However, this bill, House Bill 2660, is addressing the issue that we now have -- the first time in forty, fifty years, have an opportunity to refinance our -- our bonds at historically low interest rates. As we’ve heard and we’ve all talked about in our various caucuses and you’ve read, as you’ve intimated, that this just makes good business sense, which is why we’re moving forward with it today.

Those details haven’t been given to us; however, again, in this bill, House Bill 2660, by freeing up these dollars, by getting three hundred million dollars this year and, of course, having 1.86 billion dollars next year, we can certainly pay 37  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 that. Since we would not have to pay into the pension plan, those dollars will be there to help -- help us alleviate some of the problems that we are foreseeing, because we know the pressures are going to continue to be there.

Thank you, Mr. President. I would just like to say that I think this is a excellent way to try to resolve a crisis that we found ourself in. Whether the projected deficit is 2.4 billion or 4.8 billion, regardless, we need to find the money to fill the hole. Whether it’s done by cuts or by bringing in money, such as this pension proposal of the Governor, we have to do it. What this does is free up 2.1 billion dollars for -- that we would have to raise otherwise. It doesn’t suddenly land in our General Revenue Fund, 2.1 billion dollars, to be spent as we 39  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 wish; it merely means we have less cutting to do. The Governor has promised to give a Budget Address next week. The Budget Address goes directly to the Appropriations Committee. We’ll prepare the appropriations bills, and at that time we can debate how this money is going to be spent. But there certainly can be no doubt that we have to get some money into our coffers. We have to bring money into the State of Illinois to avoid the drastic cuts in education, in health care, in safety, all those programs that we all here have worked for years to try to build up, that we all agreed were necessary, that we needed those programs. Now all of a sudden, today, because it’s a new Governor, we’ve got to say, “Well, let’s hold on. We can’t trust him.” Well, we’re trusting ourselves. We do the appropriating. He can’t do anything without our votes, so it’s still in our hands. What we’re doing now is trying to take advantage of market conditions. The interest rates are at the lowest they’ve been in decades. There’s even a projection they may go lower. Now is the time to strike, not next month, not two months from now, not after we see the budget. Now is the time. Now is the time to vote Yes. Now is the time to make sure that we give the Governor the chance to succeed, because if he succeeds, all of us succeed. This isn’t a partisan issue. This is the people of the State of Illinois, Democrat and Republican both, coming to all of our district offices, saying they’re cutting our programs, they’re cutting education. Every one of us has schools saying that we need more money. We don’t ask if they’re Democrat or Republican; we just say we want to try to help, and this is the way to do it. Instead of saying we can’t do anything, tonight you can cast a Yes vote and show that you mean to do something. It may -- may not be the greatest way out of this, but it’s the only way we have right now to raise this much money. It’s done in every other state. It’s a good way to raise funds, by taking the debt and bonding it out, because we have to pay it anyway and it ensures payments this year and next year to the pension fund. This program has a lot of good things going for it. You can always look at the negative side if you want to, but I think it’s time to look at the sunny side and vote Yes and make sure we get Illinois back on the right track. The answer to the question, about ten billion.

Yes.

That’s correct. Those have been -- by our actuaries, those are historic -- historical benchmarks that have been set. Correct.

Looking at the -- the rate of return over the past eighteen years, those are the numbers that our actuaries have agreed upon that we assume you can make. Looking back as far as 1983 up to the year 2000, we have actually performed -- our State Universities performed at 14.5 percent, our Teachers Retirement at 13.3, and the State Employees at 14.3 percent.

We have an obligation to pay those -- pay into the pension plan. But dealing with the numbers that we have, we’ve had bad years in the past eighteen years, and you ask why we go back eighteen years - ‘cause eighteen years ago, in 1983, is when we separated our pension funds from the plan. And looking at that track record, the numbers are there, and we’ve had bad years. As a matter of fact, in 1984, we had less than 5.1 percent in our returns that we had. We also had, in 1988, less than 2.2 percent. So, it’s there. What we have here is a -- a forty-five -- or, we have a thirty-five-year program, starting fifty -- or, started a fifty-year program in which we have basically spread 42  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 out our -- our payment cycles, as well as looking at those bad years as well as the good years.

The volatility of the market area -- era we’re in. Back in 1995, when this General Assembly first acknowledged that we had some of the highest unfunded liabilities in the country, we did take a stand. We said that we were -- by 1996, that we were going to have a continuing appropriation, and we have led up -- or, have lived up to that responsibility of paying into that budget -- or, into the pension plan. However, as -- as you just pointed out, we’ve had some wonderful years. We went from 53.2 percent for funded liabilities -- or, ratio, to -- to seventy- four percent. In the last two years, that twenty-five percent there has dropped us back down to fifty-two to fifty-three percent. So, you’re absolutely correct. It does happen.

If your -- question is making reference to ’05, sir, then what happens is the dollars then come back out of General Revenue funds. That’s the way we’ve done it all along. What these dollars do, that we’ll be getting, just frees up dollars so, in fact, that we do not have to take dollars out of the General Revenue Fund and we can dedicate those dollars to paying for some of the -- the many pressures that we have.

No. Enlighten me, sir.

Wasn’t a question, but it’s unfair for us to look at New Jersey and their plan. What they did was one of the biggest 45  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 errors that you do when you’re in this kind of market, and that is, you buy high and you ended up having to sell low. They bought when the market was falling out from up under ‘em. So in looking at that plan and looking at the timing issue, certainly the much higher -- the interest rates were much higher. What happened is, they did it wrong. But, however, they also have a thirty-year plan. So to say that it’s actually a failed plan is -- is a bad characteristic of something that has to be assessed over thirty years and not just what happened in the last two years.

46  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 We have an obligation, constitutionally and statutorily, to make that payment. It’s going to be a 2.1-billion-dollar obligation if we do this or if we do not do this at this point in time. Just to address your issues of how do we know that the interest rates will not go up or -- or even go lower? We don’t. Which is why we need to do something now. This certainly -- as you know, the market is very volatile. Things can happen. This is the first time in fifty years that they’ve been this low, and it’s -- I believe it’s incumbent upon us to be at least fiscally responsible and do this deal right now.

Well, the interest rate itself is fixed in this -- the language that’s here.

We make it up through GRF. And when it does not make too much difference, as long as we meet our threshold of six percent, we can meet our obligations through paying into the 50  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 pension fund. And as we know, with each percentage that we have over, we actually get one billion dollars. So, the -- and again, looking at the actuarial records and looking at the interest over the past eighteen years that we pointed out, the - - it averages out, one, that it does go up to 8.5 percent. If that is not the case, then certainly we need to talk to our actuaries so they can set different benchmarks for us.

One, I didn’t know they had an S&P a hundred years ago. But if that’s the case and these are the facts that you’re -- are now articulating, no, I’m -- I wasn’t -- familiar with that. But also we had a time during that same period, a great depression. I mean, so there were a lot of factors that certainly had an -- some kind of input or at least impact on these -- those numbers that you just espoused.

Are you asking me would I personally write a check? I certainly could write a check, but it’d bounce. But -- but that is not the -- the essence of what we’re trying to do here. This is an opportunity that we need to take advantage of, ‘cause it makes good business sense. And you, as -- as one who studies numbers, and certainly understands -- no, it’s not your time. I guess, I’m on a Trotter rant here. You understand that. And you’ve read over this.

It’s -- it’s a thirty-year bond. But we have guaranteed one -- in 1996, when we guaranteed that there would be a continuing appropriation, that those dollars in obligation will be met through general revenue funds. Nothing will change if, in fact, we do not have the dollars at the time. We will have to find the money.

Thank you, Mr. President. I rise in support of this bill. Before I -- I became a Member of this Body, I was a bond lawyer, and in addition to giving me much to talk about at cocktail parties, it -- it gives me some ability to comment on -- on the 55  STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 28th Legislative Day 4/2/2003 matter at hand. There’s been much said about whether this is really a refinancing. We are not refinancing existing bonds. That is true. But we are financing an existing obligation of the State and we’re doing so on very favorable terms. It’s not just that interest rates are low; there’s really a collapsing of the tax taxable on the tax-exempt rates. It’s an anomaly and we should be able to take advantage of that. This would be a prudent investment, I believe, even if we had a budget surplus, but it’s even more so with our current budget situation. There’s been talk also of the rate of return and -- and whether it’s reasonable. The actuaries have based this on about twenty years of returns that included not only the go-go nineties but some down times in the late eighties, the early nineties and also of the last two years. Based on what I’ve seen, it seems to me to be a fairly reasonable assumption. The risk that we not meet that rate is really no different than if we don’t do this deal. If the existing assets of the pension fund do not grow at that actuarial rate, the State will still be on the hook to make payments from the General Revenue Fund. The fact is, even if the rates don’t meet the assumptions, it’s quite possible we -- we will be better off, because ten billion dollars invested today earning even four percent is better than zero dollars earning four percent. To close, it is important to do this now. As a bond lawyer, I will tell you that the market can move and move away from you quickly. It also takes a fair amount of time to structure one of these deals in -- in a way that is most advantageous to the State, and I would encourage that we give the Governor’s team the flexibility to start putting that into place now and to move forward. And I urge an Aye vote.

So, again, it’s simply cost-neutral language.

We’re talking about, one, again, giving a boost to our pension plan. We are front paying our payments through the pension plan with three billion dollars. What we’re at risk of doing here is losing out, losing out on an opportunity, the first opportunity we’ve had in over fifty years with the lowest interest rates in time. We’ll have -- there are no risk-free alternatives. We’ve heard many arguments or many things that were brought up, but there’s nothing risk free. This is the market. We have an opportunity, again, to do the right thing. They say there’s a time and place for everything. It’s time to do it now, and we are in the right place to do the right thing by pushing our buttons green.

Thank you. This is an amendment from Central Management Services. It is a clean-up amendment. It deals with mileage reimbursement. Apparently, in the law, that we were always provided for federal rate increases. There was a decrease in the amount that is paid for -- for mileage. We didn’t have that in the statute. This cleans up the statute, makes a technical change, and I move its adoption.
