Yes. Thank you very much, Mr. President. We have our staff lined up here, and we’re ready to just take over. We’re just going -- we’re going to -- we’re going to charge, and we’re going to just take it over. Well, this is -- this is, obviously a day that we knew was coming, but no one, especially did I, 5 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/10/2003 relish what I’m about to do in -- in that course. And I think most of -- most of you, at least certainly on our side, we know what -- what’s going on, and I don’t know if -- if you, on the other side, know this or not. But our Chief of Staff and our Deputy Chief of Staff - Carter Hendren, of course, is our Chief, and Tom Taylor, the Deputy - put in for early retirement, and -- along with several other of our staff, which we’ll have to deal with later. But today we have to deal with these two. And anyway, you know, you -- when -- we’re in this business, and we -- we’re -- none of us are irreplaceable. None of us. You know, we like to think maybe we are. But these two are as about as close to irreplaceable as anyone I’ve ever known. Carter Hendren’s been with us for twenty-two years on the Senate staff, and he’s been employed in State government for twenty-eight years. And Tom -- Tom’s been twenty-six years State service and twenty-three years on our staff. So we’re losing a great deal of history and institutional knowledge, and -- but more than that, we’re just losing two really, really good people. And I think the fact that you see the staff here. I -- I know they’re all here. Carter hires ‘em. Tom is involved. But -- but the respect that -- that the staff has for their chief and their deputy is -- is remarkable, that -- that -- that they’ve gathered this kind of respect. And I -- I really appreciate it. Now, I can’t say enough of what I know the Members feel about this on our side, especially -- and I’ve worked with Carter when -- all the years I’ve been here, twenty-some years now in the Senate. And -- and I -- it’s like I told him, I said, one thing about Carter which I like, and Tom’s a lot the same way, but Carter may be more than -- than most, is that Carter has a -- a way about him that he tells you what he thinks is right, and very direct. He’s very political, very analytical, very knowledgeable. But you know, he’s generally right. That’s the - - that’s the thing about it. And -- at least for our side of the aisle, he’s -- he’s that way. And -- and we are going to miss them both. They -- they will be leaving as of tomorrow, their last day. And they’re going to go out on their own and do their own thing, and we certainly wish them well. And -- and I just -- I appreciate all the work and dedication, years of service to -- to this Body. And I know that both of them have a 6 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/10/2003 certain knot in their stomach, I know, when they walk out tomorrow, that this has been a big part of their lives. And they’ve been very successful in what they’ve done, and we certainly want to wish them well and -- and thank them for all the years of service to Members of this caucus and -- and this staff.

Well, that’s the bad news, and it truly is. We are going to miss them. But the good news is we’ve got a very able replacement, and that’s Brian McFadden. Now, I don’t know -- where is Brian? Step out, Brian, so… All right. Brian used -- was on our staff -- for eight years, he was on our staff. Then when Karen Hasara got elected Mayor, he went over and became chief of staff for the City of -- of Springfield and for the Mayor’s Office, where he’s been until just recently. And we are very fortunate, obviously, to have him now take Carter’s place, and -- and he will be formulating the -- the rest of the staff. And -- and we look forward to working with Brian, and -- and I know you will, too. He’s a -- he’s an awful lot like Carter, and that’s -- that says a lot for him. Says a lot for him. So, anyway, Brian McFadden.

Mr. President and Ladies and Gentlemen of the Senate, Carter was my mentor when I first started running for the Illinois House. That’s 1973. And I probably gave him an awful hard time, because you know how independent minded I am, but he survived. And he did a darn good job for me there, and I was successful. And I’ve known him -- since then, so we’ve -- I’ve gone back thirty years that I’ve known him and he’s done an excellent job. You can’t beat him in politics. He should be running for office himself, but he -- he knows better. But I 7 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/10/2003 want to say that we haven’t always agreed, but I have always found him to be a very intelligent, very dedicated person. And he is -- did an excellent job for us. I am sorry to see him go and I wish him the best, because he is one fine gentleman who is very worthy of our trust and our faith in him. And God bless him. And that goes for Tom, too. Tom is his right hand. And I -- I wish both of you good luck and good health and happiness.

In the gallery on the wrong side, or the Republican side of the -- the Chambers, we have a group from our Quad City Chamber, which includes three mayors. I -- I don’t know if Stan’s there or not. I can’t see over there. But we have Mayor Schwiebert, Mayor Moreno and Mayor Leach, and then of course we have with us also in that same group, County Chairman Bohnsack. So I’d like to have the Senate give ‘em a warm welcome.

Well, I -- I just wanted to respond to some of those things that Senator Watson had -- said.

On this side of the aisle, we want to wish Tom Taylor a lot of success in his future endeavors. I can tell you that he has been a really great person of wisdom as to how to run the Rules Committee, and we’re doing our best to see to it that we run it the way he did. And, Carter, I -- I’ve outstayed both of you here, I guess. I can only say that I had always argued to Pate and to Phil Rock, and to everybody, that the Chief of Staff of our respective caucuses, that this should not be a dead-end position. However, you proved me wrong. Most of our chiefs of staff have gone on to bigger and better things. And I know that you’ve had, over the years, Tom, the opportunity to do that. 8 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/10/2003 And I know of your love for this Senate. And I know of your love for the Members on this side of the aisle, too, because we see it every two years. And I understand Phil Weber’s leaving, too. Well, good, take him with you, too. Will you? I don’t think we’re really truly going to miss you; I have an idea you’ll still be around. And for all of us who’ve kept files on you over these years, now’s the time to get ‘em out and dust them off, because I know you’re going to be knocking on our doors. We wish you well, and we say that you’ve done a fine job for the people of Illinois and for your side of the aisle. And I respect what you have done, and I’m sadly -- sadly to say, that I’m going to miss seeing you every day. And I -- I truly mean that. So, congratulations on your -- on your next endeavor.

I, too, would like to respond to the Minority Leader regarding the Chief of Staff. The Chief of Staff is a very, very important person in our operations. And over the past ten years, in the meetings we had in the Governor’s Office dealing with the budget, when Carter was there, Carter was the one who had the in-depth knowledge of not only the budget but government operations, and he’s a good political person equally, as well - worthy adversary. He’s one who I know you will miss because of his deep involvement, the long hours that he put in. Chiefs of staffs work very, very hard. They are the ones that really run the operations. And I know how important Carter was to your side of the aisle. A very worthy adversary at times, whom I respect, whom I borrow something from, from time to time. But with Carter leaving, perhaps I can give up the habit. I can’t go to him anymore. But we do wish him well in his new endeavor. I don’t know if he’s going to get a gubernatorial appointment. Yeah, you may have to come back to us, you know, for a confirmation: Tollway Authority, Pollution Control Board, maybe 9 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 4/10/2003 Labor Relations, you know. But we do wish you well in your new endeavor and we look forward to seeing you again. I’ve always respected you, even though I disagreed with you. And I recall in the meetings in the Governor’s Office with the former Senate President, Pate Philip, and Carter would always position himself opposite of Pate. So, when decisions had to be made, Pate would look up, then he’d look to Carter and Carter would do this here. Governor Ryan even quipped a couple of times, said, “Wait a minute, now. Who’s the Senator? You, Carter, or Pate?” But Pate respected him and I know you respected him for his in-depth knowledge and decision making, and chiefs of staffs are very, very important. And I, too, would like to wish both of you well in your future endeavors. And, Senator Hendon, if he appear before the Executive Appointment Committee, I’m quite certain that you will give him a fair hearing, just the same way you’re going to do with Senator Hartke -- or, Representative Hartke. Oh. But we do wish you well, Carter, in your new endeavors, and my door is always open to you. Good luck. Godspeed.

Thank you, Mr. President. House Joint Resolution is a resolution to rename the State Library after the great Illinois poet laureate Gwendolyn Brooks. Gwendolyn Brooks’ poetry inspire the nation, inspire the people, inspire the world. She was a great poet. She’s one who has educated many generations of young people from all walks of life through her writing, her creativity. She’s one who -- whom the State Library should be named after, being one who won the Pulitzer -- Prize for her literary skills. Gwendolyn Brooks was respected by all, not only in the State of Illinois, but all in this nation. The State Library, just across the street from us, on Second Street, would be a great, great tribute to a woman who inspired so many young people through her -- through her writing and has been respected by all, a great poet laureate. And I urge the adoption of House Joint Resolution 11 to see to it that we fulfill this mission.

We have a number of resolutions here which deal with the Governor’s task force on the -- the death penalty. A number of the recommendations that the task force made are -- are recommendations that could only be implemented by the Supreme Court, rather than by the -- by statute. And so the -- the next series of resolutions are for that purpose. Recommendation -- or, Senate Resolution 17 refers to Recommendation No. 39 of the Governor’s Commission, which suggested that the Supreme Court establish a committee of trial and/or Appellate judges to compile and manage relevant case law and other resources to trial judges who are responsible for trying capital cases. I would urge its adoption.

Senate Resolution 20 urges the Supreme Court to adopt Recommendation No. 71 of the Governor’s Commission on the death penalty, which would urge them to amend their Supreme Court Rule 3.8 of the Rules of Professional Conduct. And the resolution specifically says that we suggest that their rules would read, “Following conviction, a public prosecutor or other government lawyer has the continuing obligation to make timely disclosure to the counsel for the defendant or to the defendant if” he -- “if the defendant is not represented by a lawyer, of the existence of evidence, known to the prosecutor or other government lawyers {sic} (lawyer), that tend {sic} (tends) to negate the guilt of the defendant or mitigate the defendant's capital sentence.
