Thank you, Madam President and Members of the Senate. House Bill -- 4651 is very simple, that it grandfathers in existing mobile homes that currently are not really being built anymore. It’s for the -- at the time that the law was passed that regulated these mobile homes - these are the single, not the double-wides - these mobile homes and the mobile home parks were in compliance. Since then, the law has changed and obviously development has progressed. We have double-wides. We have some that look like homes. You can’t tell the difference. But what this bill does is, it allows one of those homes that was built early on in the ‘80s, if it is damaged and it’s taken off that lot, then it could be put -- be repaired and be replaced and put back on that same lot. That’s all the bill does. In fact, I -- I’ve heard from different people complaining, but this is a quote from the Illinois Fire Chiefs Association, “To our chagrin, we found no code that addresses mobile home size and the respective separation between units. All code states that the manufactured homes shall not be closer than ten feet side to side”. And that’s currently what we’re trying to do, is just to make sure that if -- if one of these homes is damaged or needs to be replaced, it can be taken, repaired, and put back on the same lot.

Thank you, Madam Chairman and Ladies and Gentlemen of the Senate. This bill originally passed this Chamber with only 30 votes and it was vetoed by the Governor. And that’s for good reason. I don’t often agree with our Governor, but he is absolutely right on this particular veto. The passage -- if we override the veto, we are going to ensure unsafe conditions in mobile home parks across the State.
PRESIDING OFFICER: (SENATOR HALVORSON) 4 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 157th Legislative Day 11/16/2004 Excuse me, Senator Radogno. Please, I know everybody’s excited about seeing each other, but can we keep our conversations at a minimum? Thank you. Senator Radogno.
Well, as I started out saying, this bill barely passed the Senate to begin with and was vetoed for good reason. If we go ahead and override this veto, we’re going to be creating unsafe conditions in mobile home parks across the State. The fact of the matter is, what we’re dealing here -- with here is a -- is a safety issue, pure and simple. The proponents will cite that this is an affordable housing issue and that we have to maintain -- a stock of affordable housing. But, you know what? Tent cities would be affordable housing. Tenement slums would be affordable housing. And we don’t sacrifice safety just for affordability. The proponents say that this bill won’t change anything, and that’s not true either. The fact of the matter is, this will not allow municipalities who currently regulate distances between mobile homes to keep doing that. They -- this will also prevent Cook County from rewriting their mobile home ordinance, which they are currently in the process of doing. But I think the most telling thing is that this bill is opposed by the Illinois Department of Public Health, the Cook -- County Department of Public Health, the Collar County departments of public health, the entire public health -- community in the State. It’s also opposed by the Illinois State Fire Marshal and by the entire fire service in this State, including Fire Chiefs, Firefighters, Fire Protection Districts, and so on. It’s also opposed by the municipal leagues and the COGs and again, the reason is, it’s a safety issue. I know that many people have been lobbied very, very hard on this bill -- on this particular bill, and those lobbyists have been carefully selected in order to be people that you’re going to listen to. But the fact of the matter is, if you vote to override this bill, you’re really going to be voting to condemn many people in this State to unsafe conditions. So I would urge you to vote No.

5 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 157th Legislative Day 11/16/2004 Thank you, Madam President, Ladies and Gentlemen of the Senate. There’s been a lot of discussion about this bill, about what it does and what it doesn’t do. I’m -- I’ve heard a lot of different things. I’m going to take the word of the Elk Grove Township Fire Department Chief. This is a gentleman who has mobile home parks in his area in my district. He’s the expert; he knows what we’re really talking about here. I’m going to read his very simple letter to you. There’s one key sentence I’ll read here to you. It says, “I believe this bill will enhance the long-term safety of mobile home parks.” That’s coming from a fire chief in my district. He knows what he’s talking about. There’s a lot of misunderstandings about this bill. Rest assured, this doesn’t change the setbacks. It will improve these parks. It will make sure that their rents don’t go through the roof, because if you don’t improve these parks in this manner, those rents are going to go up. And take it from my fire chief, it will improve the safety of these parks. I urge an Aye vote.

Thank you, Madam President. I do, just a brief response. This -- this does not change what the National Fire Prevention Association says, that it doesn’t change the current law. In the current law, these homes are already in compliance. It’s just if you take them off, the law has subsequently -- the municipalities have -- subsequently changed the requirements for setbacks. But as they currently exist today, the mobile homes that are on the lot currently comply with all the ordinances and all the zoning. It’s only if they’re damaged, if you take them off and repair them, you now can’t put them back on. That’s all this does. So all -- for all those little old ladies, and -- and -- and people who’ve bought these homes, who live on these lots, and if they need them repaired, they want to be able to take ‘em off and put ‘em back on. That’s all it does. I would ask for your favorable vote.

Thank you. This bill has passed this Chamber -- Chamber, overwhelmingly, several times. This is an economic development bill. This bill also, for those who are opposed to TIFs, replaces TIFs without being a tax burden on the other taxing districts. Basically, simply, what this bill does is, you have to create a business district. In order to create a business district, you must have a public hearing to invite the public to have comments on -- on this business district. And what takes 7 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 157th Legislative Day 11/16/2004 place is, developers then can negotiate with the municipality and agree on, say for a -- a -- a -- in my district if this bill -- is signed tomorrow, in one area, it means about a hundred and fifty million dollars’ worth of new commercial development. And in that, the local municipality will probably give them about five million dollars -- allow them five million dollars for replacement costs for site clearance, preparation and so forth. And they will be able to impose up to a -- a one-percent sales tax until they recoup that five million dollars. And once they recoup it, it goes away forever. It’s only for that particular business that they agree to. I would ask for your favorable vote.

Thank you, Madam President and Members of the Senate. I -- I appreciate Senator Clayborne carrying this bill. I think it was brought up by an individual in my district. They are -- they have an interchange being put in. Would like to help pay for some of that infrastructure. I think it’s a -- you know, it’s a temporary thing that I think is good to -- for economic development in -- in really all areas of the State. So would hope to get some support to override this veto. Thank you.

Thank you, Madam President. Thank you, Senator Luechtefeld. And -- and, Senator Roskam, the real concern here is for all of those areas that have been left out. Some business districts in the south side of Chicago, the west side, those individuals who believe that TIFs have -- have abused -- been abused and those individuals who believe that -- that TIFs have taken away from the school districts. This allows for you not to TIF an area, and it’s only for that particular business. People can make a choice not to go there and support it. They’re not forced to go there. But what this does is -- like Senator Luechtefeld talked about, an interchange. Well, what happens on interchange? Most people traveling through the State would now stop and spend money at that place. If you think about it, if you impose up to one percent, you’re only talking an additional dollar on a one-hundred-dollar purchase. But what it does is, again, it creates jobs in the community, it revitalizes old business districts that have been decayed and there’s no money to help them -- help them -- make ‘em viable again. I would ask for your favorable -- vote. This is a jobs and economic development bill. And if you look at the supporters, you have the Suburban Mayors and Managers Association, the Illinois Municipal League, St. Louis Regional 9 STATE OF ILLINOIS 93rd GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 157th Legislative Day 11/16/2004 Chamber and Growth, Kelty Development, Illinois Retail Merchants Association, DuPage Mayors and Managers Conference, and the City of Chicago. And I say for my colleagues on the other side, those are a lot of your supporters who believe that this is a good bill. I ask for your favorable vote.
