Thank you, Mr. President, Members of the Senate. This really is only a technical bill requested by the Secretary of State. It applies to the cases where a new resident whose license is revoked in another state applies for a license in Illinois. The position of the Secretary of State, that these people are not eligible for a license or a restricted driver’s license permit under the provisions of the Driver’s License Compact. However, there is a current circuit court decision that says, even though such an applicant is revoked permanently in Florida, the Secretary of State must consider the new resident of Illinois for driving relief after one year has elapsed from the date of the Florida revocation, if permitted by law. The circuit 4 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/10/2005 court found that there was no Illinois law providing -- prohibiting issuance in this case. This bill is an attempt to correct the situation, providing the continued practice of prohibiting the issuance of a license to these new residents whose license was revoked in their former state. This bill is also an initiative of the Secretary -- State’s Office, and simply permits any nonresident or former Illinois resident who has met all requirements for restoration of their license to be released from the Illinois proof of financial responsibility requirement if they are -- reside outside Illinois. In other words, if this person is not living in Illinois, then why should this person have to prove to Illinois that they have insurance before they can obtain a license elsewhere? This would still be required to meet all judgments in Illinois. The bill does not change that. If the person returns to Illinois within three years and cannot show proof of insurance during the period of nonresidency, then the requirement is re-imposed; their license would, once again, be revoked. It’s now becoming - - they just constructed two new buildings and what they’re doing is building a multilevel parking garage, and on the first floor, there’s going to be about sixty thousand of retail space for lease. And the University of Illinois is putting out bids and requests for a Houlihan’s or a -- one of those big chains to come in and they need the exemption for the liquor for that establishment. Actually, Senator, that’s the exact opposite. The reason we brought this bill was that when the park districts actually did the background checks and submitted the fee and the -- fingerprints and everything to the State Police, they were given no information back because the person under seventeen is a juvenile. In fact, one of my park districts that was one of the premises for this legislation actually had an incident where one of their employees was stealing money from them. And when they went to the local police department to prosecute the person, the local police department said, “Oh, yeah, this person’s got a rap sheet a mile long.” But they could not get that information through the normal sources.

Senate Bill 416 expands the definition of pecuniary loss in the Crime Victims Compensation Act to include the first month’s rent and security deposit for domestic violence victims, thereby allowing domestic violence victims an option other than returning to their abuser. In many cases, domestic violence victims are reluctant to report the crime because of their financial dependence on their abuser. This bill would provide such victims with the opportunity to free themselves of such dependence and begin to rebuild their lives free of the cycle of violence. It’s largely technical in nature. It’s primary function, other than housekeeping, is to provide an administrative review process to provide a forum for tobacco manufacturers which are nonparticipating manufacturers to challenge a decision by the Attorney General’s Office not to list them. This -- this part -- right now, the current Act and rules only provide for an internal review and don’t give them the opportunity to challenge a decision from the Attorney General's Office. This is based on the model complimentary agreement that has been executed in over forty states. I know of no known opposition. I'd ask for your support.

Thank you, Mr. President. Generally, by April 1st of each school year, school boards make a determination of the status of administrative staff and nontenured teachers. What this bill would do is state that the principal, if their contracts are not renewed, have a right to be reclassified. It does not grant principals an absolute right to a teaching position, but simply puts them back into a situation where they would be if they were a tenured teacher.
