Thank you, Mr. President, Ladies and Gentlemen of the 37 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 25th Legislative Day 4/7/2005 Senate. Senate Bill 459 amends the Illinois Vehicle Code. It would allow the Secretary of State to waive the fee charged to governmental agencies for vehicle and driver data that is used to update and verify traffic citation and drivers’ records. Circuit court clerks are currently purchasing this information at a cost of five hundred dollars per request and then -- to avoid re- entering data when a traffic citation is issued by a police agency. Senate Bill 459 would allow the Secretary of State to waive that fee charged to local governments for this type of information in cases where the data is being used to improve accuracy and transmitted back to the Secretary of State for their own data improvement. Under the provisions of the bill, the Secretary of State can waive the fee at his discretion - so it is discretionary - and I ask for a favorable vote.

That’s very disconcerting, but that’s probably something for you to deal with locally. Hopefully, you may change your attitude as the election draws near. But it also strikes me, this might be something against traffic safety if we’re trying to take money away from, maybe, you know, DUI funds and road -- road checks. I’m not sure, as your first legislation, you really want to be hurting traffic safety on the roads of Illinois, Senator. Could you comment on that?

I -- I certainly can, Senator. And two things: One, the five hundred dollars that is being charged currently will be waived. So there will be a savings to Will County. What Senate Bill 463 would do is transfer the -- most of the powers and duties of the State Board of Election -- State Board of Education - I’m sorry - regarding the high school equivalency tests, or GED, to the Illinois Community College Board. Currently, the community colleges offer most of the instruction for GED and they also fund community- based organizations to provide the instruction. The regional offices of education would continue to be the test administrators. The Community College Board would hopefully propose more satellite sites. This would streamline the process, and this is, in fact, a issue that the Illinois State Board of Education -- or a -- a duty they would want to relinquish to the Community College Board. I know of no opposition and be happy to answer any questions.

It provides that in a -- a situation where a township is coterminous with a village and property is annexed by the village, which means it automatically goes into the township, the officers of the township that happen to live in this area can complete their terms. Be -- and not be ruled ineligible to serve. Secondly, it provides a timeline for payment of any taxes that may be due from the village that are lost to the township which is affected.

Senate Bill 475 is a bill that 48 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 25th Legislative Day 4/7/2005 come after a -- stressful eight months. Many coal miners in Southern Illinois have lost their health care due to the decision of a federal bankruptcy judge. On August the 9th, judge granted the request of Horizon Natural Resource to avoid its contract with a union. This move canceled the health care benefits for thousands of families across the nation. Many of those families lives in Southern Illinois. I contacted the office of Illinois Heath Insurance Plan - CHIP - and they told me that it was possible to get benefits for these hardworking families. I have worked hard to iron out details and we now have a bill that will help these families. With this bill, miners affected by the judge’s decision can get assistance in purchasing health care insurance. They need to create a State subsidy -- subsidy for the affected miners to get heavy discount insurance through the State. I urge this bill’s passage. If there’s any questions, I’ll try to answer you.

First of all, Senator, I -- I certainly appreciate the thrust of what you’re trying to accomplish with this bill and it’s a very important need to fill. Can you give the Senate an idea of how large this need is? I’m under the impression that the coal industry -- I mean, stock prices are going up seventy- five, seventy-eight percent. The -- the alternative -- the cost of energy, petroleum-based energy, is much higher. I would think folks are going back to work. So, can you tell us the size of the need for this and what the cost will be to the CHIP program?

There’s about three hundred -- three -- three thousand employees that’s worked all their life for health insurance. And up -- up to a judge that can do a pencil mark and say they lose 49 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 25th Legislative Day 4/7/2005 their health insurance, I don’t think this is right. And the cost of this is going to be about three million dollars. And this probably -- cost could run up to maybe, if the people live another twenty years or something before this three million dollars. So it’s not a three million dollars overnight cost. It’s just something that’s going to help these people out to have health insurance they deserve.

Is there -- is there a problem -- so you’re saying that this is a response to a judge’s decision? Is this in Southern Illinois, a local judge’s decision, or is it a federal judge’s decision?

It was a judge from Kentucky that done this. So, it would - - had to be a federal judge.

And then, the -- the last question is, the -- is this a matter of a company that promised insurance benefits now reneging on that promise?

This is a company that now has stock in other coal mines and that -- and -- and have other coal mines working. So, that’s why I think these people should have health insurance. Now, if these people went broke, they didn’t have any money, I could understand that. But here they are, they got stock in other coal mines and they got coal mines operating under a different corporation.

Thank you. Thank you. And this is the final question. Thank you very much. And it would be more of a statement. I mean, I understand that United Airlines is going to shift the obligation of their pensions over to taxpayer-funded funds and I think that we have to draw the line someplace and it’s everywhere where this kind of thing happens. The private industry needs to fulfill its obligation. So, thank you very much for your work to try to help these people who are affected. I hope, though, that the effort is to make sure that the private organization fulfills its responsibility, rather than saying, “Oh, that’s okay. The taxpayers and everybody else who will be squeezed out of the CHIP program, that they’re -- they’re secondary, that the taxpayer will solve the problem.” Thank you.

Because I assume that all of us have gotten calls in our district offices that people can’t get on the program because the program’s out of money. Will this create a faster diminishment of the funds in that program and, therefore, keep more of the people who are already eligible from getting on the program?

Thank you, Mr. President, Members of the Senate. This bill was -- I was made aware of the need for this bill by the Heartland Alliance and it’s a very significant problem we have in our country. It deals with the issue of human trafficking, which is really a modern-day slavery. The federal government has addressed this. They’ve defined this issue as either forcing an individual to perform labor or sexual acts against their will. It does happen in the United States. There -- they estimate there could be as many as fifteen thousand individuals who are trafficked in the United States. The federal Trafficking Victims Protection Act was passed in -- in 2000, and as a result of that, the victims of -- of this crime are eligible for special immigrant visas and social services and benefits available to refugees and medical care. The feds, at the time, actually encouraged, through a resolution, state legislatures to also pass similar human trafficking and slavery -- antislavery bills. That’s what this bill is in reaction to. We can assist victims of trafficking by updating our Criminal Code language to include the crimes of trafficking. And, as a result, these services will be made available and -- and prosecutions will take place. It’s a very important piece of legislation. I urge you to vote for it and be happy to answer any questions.

Thank you, Mr. President, Members of the Senate. Senate Bill 513 provides for a State tax holiday for “Energy Star” appliances. No use tax or retailers’ occupation tax shall be imposed for the nonbusiness purchase of a clothes washer, dehumidifier, dishwasher, refrigerator, freezer, room air conditioner, ceiling fan, programmable thermostat, ventilation fan, compact fluorescent bulb, or residential light fixture purchased during the tax holiday period of April 22nd, 2006, through April 28th, 2006, or April 22nd, 2007, through April 28, 2007. The loss of revenue to the State is estimated to be 1.3 to 2.2 million dollars.

It says, “Any discount, coupon, or other credit offered either by the retailer or by a vendor of the retailer to reduce the final price to the customer shall be taken into account in determining the selling price…” Is it your intent to cap the expenditure level of any of these, as some of these other credits -- or these holidays or credits sometimes do?

I guess I’m asking, do -- can you -- can you give me anymore detail on what the criteria is? I mean, I would assume that manufacturers, now that they’re not going to have to charge sales tax if this became law to people who are buying these appliances, would be very interested in getting their appliances on the list. And there would be an aggressive push toward doing that. And I wonder, if that were the case and they were successful, that’s going to drive the -- the cost to the State treasury up. So do - - do you know how -- how stringent it is, how difficult it is to get on the list?

Thank you, Mr. President, Members of the Senate. This is a bill that was suggested to me by a judge out in DuPage County. It has to do with substitution of judges in civil cases. We have a statute that deals with substitution of judges for cause in criminal cases, but we don’t for civil. It’s the same scheme. What happens is, if you think that the judge in your case is prejudice, you file a petition with an affidavit. And what would happen is, that hearing would be determined by a different judge to determine whether or not the judge should be substituted. The judge who’s named in the petition need not testify, but he can -- or she can submit an affidavit. If the petition’s allowed, the case would be assigned to a -- a different judge, and if it’s not allowed, it goes back to the original judge. No controversy. Happy…

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 517 amends the Jury Act to provide nursing mothers with an excuse from serving on jury service. In committee, Senator Righter asked me if this was a real problem in Illinois or if we were solving an imagined problem. As if by magic, days later I received a letter from Julie Doyle who lives in Manito, in Senator Shadid’s district, telling me her story, “In 1994, I was called to jury duty. At that time I was breastfeeding my newborn. I experienced considerable anxiety at the prospect of leaving my daughter who had yet to suckle from a bottle with an unfamiliar caregiver so that I might fulfill my civic responsibility as a jury member. I was frustrated that the court system viewed my request to be excused as an attempt to manipulate the system.” She was eventually excused but did experience a great deal of anxiety in that process. This bill clarifies the -- the excuse, to make it clear that a nursing mother may be excused and does not need to rely on the general excuse for health.

Thank you, Mr. President, Members of the Senate. I should just clarify that it is true what Senator Dillard said, that I did grow up in DuPage County. Most of my family still lives there. But just to indicate, Senator Pate Philip asked me to leave and that’s why I don’t live there anymore. This -- this bill was interesting in that it’s a response to a letter from a constituent. And it was a lady who -- who noticed that we have - - in our statutes the word “illegitimate” children. And what this bill does is to change the statute so that the word 66 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 25th Legislative Day 4/7/2005 “illegitimate” is replaced with “born out of wedlock” and would change “legitimate” to “lawful”. It’s the -- the request of the constituent, who said that it’s needed to show the respect and honor for the children of Illinois, children who have parents who have chosen not to marry or for whatever reason are not married, it should not be visited upon the child. So, for that reason -- it’s a very simple, straightforward issue. It -- something which I think we should have done a long time ago. Ask for an Aye vote.
