Thank you, Madam President. Senate Bill 2202 is intended to eliminate barriers that keep working early childhood practitioners including prekindergarten teachers’ aides and paraprofessionals, in public schools, from obtaining teacher certification. Senate Bill 2202 makes two changes regarding preparation and certification of early childhood teachers. First, it clarifies that a certification candidate’s required student teaching experience may include supervised work with children younger than six. And second, the bill allows student teachers who have been employed by a school or a community-based organization for at least a year to be paid and receive credit for student teaching with their current employer as long as the experience meets the requirements of their student teacher preparation program. And we have several groups, including Ounce of Prevention and Voices for Illinois Children, that are in strong support of this legislation. It’s meant to increase the number of certified early childhood ed teachers in the State of Illinois. I’ll be glad to ask -- answer any questions.

Senate Bill 2286 is a simple bill that adds some language to the Speech-Language Pathology Act with regards to schools that have had an Illinois Community College Board- certified class in that specialty. The case arises from the fact that after a group of students from Lake Land Community College in my district graduated from their program, the State changed the -- the -- the requirements for being licensed in that area. The requirements that were changed put the student -- put that goal beyond the student’s reach by two hours of general education credit. This bill would simply add to the statute and allow for licensure if, in fact, you graduated from a Community College Board-certified program, which Lake Land College and all the community colleges that offer this specialty are. It is designed only to -- to fix this particular problem and not designed to -- in some other way to expand the Community College Board’s authority in any other area. And I’ll be happy to answer any questions.

This bill is where the appropriate registration fee will be with a special license plate fee, where forty dollars of the original issuance of the plate and at renewal, where twenty-five dollars of the plate and additional original -- issuance fee and thirty-eight dollars at renewal, will be deposited into the Illinois Professional Golfers Association Foundation Junior Golf Fund. What this license will do, will help different foundation organizations, such as the - I’ll get that right away - as the Hooked on Golf, the – I got it right here; excuse me one second - and the First Tee Program, which is a statewide type of program that we have in various parts of the entire State. And I know there are -- some here are pretty -- are concerned about the number of plates we have, or different plates, on the road. So, I just want to bring it to your attention, this is another one of those bills. I suspect Senator Rutherford will probably want to speak to this bill.

Thank you, Madam President. To be consistent from my days in the Senate, and actually since 1995, I’ve opposed all of these bills, because in 1995, the House and the Senate -- signed into law was the charitable license plate provision in which the underlying purpose I know, for Senator Link’s interest, is -- is a good cause. But there are multiple good causes that we could create efforts for. Law enforcement has too many issues to deal with and the proliferation of specialty plates is one more problem there. As of today, the Secretary of State of Illinois has not promulgated the rules to allow the legislation that went into effect in 1995 to create the universal charitable plates. 18 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 72nd Legislative Day 2/8/2006 And I understand that some people, you know, will find this difficult to support or oppose this bill. I’m going to be a No, as I have been now for the last decade, and would encourage the Secretary of State today, and maybe a future Secretary of State will do it if this one doesn’t, to create the rules and regulations for the charitable plates.

Thank you, Madam President. I understand all those nice speeches and I understand political speeches very well, because we’ve all heard ‘em and said ‘em, but I think one of the things is, regulations are already intact with charitable plates. The amounts of plates have to be intact. I think it’s roughly eight hundred and fifty plates have to be obtained prior to the issuance of this plate. That has to be maintained every year. The Secretary of State has gone above and beyond the duty of making sure that this amount of plates were in effect, and that law enforcement has not slipped this bill on charitable plates of being opposed to this. So, I think law enforcement is very capable of making sure of understanding what an Illinois plate is and understanding what the numbers are on those plates and I think it’s a way of helping charitable organizations without going to the taxpayers of the State of Illinois, and I would ask for an affirmative vote.

Amends the Banking Act to allow banking commissioners to authorize banks organized under the laws of the United States to operate in Illinois during times of emergencies: such as floods, earthquakes or perhaps any other kind of thing that could happen to us in Illinois, such as a terrorist attack or, God forbid, something worse. I ask for your favorable consideration.

Thank you, Madam President. Senator Jacobs, during committee we had a discussion in regards to defining what an emergency may be and there was a suggestion that perhaps it’s something declared by the Governor, something declared by the President of the United States, some kind of a process that we have an objective standard to define that. Where are you with regards to trying to clarify that in the language?

As you -- as you -- as you eloquently suggested, we should give that to the Department and allow them to develop rules, and if the rule standard’s not strong enough for you, then we should amend that in the House to include a definition. But I think most of us in Illinois understand what an emergency is. An emergency isn’t -- allow a -- out-of-state bank to come into Illinois and set up. An emergency would be, in my area, would be the hundred-year flood, or for that matter, the flood of 1963 or the flood of 1984.

Understand, Senator, I -- I support the bill. The concern, I think, that we expressed in committee, and if you’re attempting to address it by this -- this dialogue or if you feel staff has 20 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 72nd Legislative Day 2/8/2006 already given you assurance that you feel that the appropriate agency can promulgate rules, then I’m willing to -- to suggest then -- then -- then we’ve hit the nail on the head. I just don’t like -- I don’t think you nor I want to have a completely subjective opportunity for an administration for some procedure to call something in a -- an emergency. I think it is going to be necessary to have rules in place on which everyone will know what is defined in -- as emergency, whether it’s, you know, again by -- by the federal government or the State government. So, am I hearing you say to me that you believe that the existing language allows for and will direct the agency to promulgate rules to define an objective standard of emergency?

Thank you, Senator. What I’m suggesting is that anybody in this building understands what an emergency is. And that ought to be called by the Department when there’s an emergency. I don’t think there’s anything in this -- in this legislation that would suggest that an Illinois institution controlled by this Body is going to declare an emergency in a situation that’s not an emergency. So, I think this is a red herring, Senator. And I think we ought to move the bill. It’s not a -- there’s no known opposition. So, I’d suggest we move the bill.

Senator, I’m trying to help in regards to have something be a positive standard established. You’re sitting here -- I’m -- I’m -- I’m for the bill. Let’s move it. But the fact of leaving an arbitrary decision of what is defined as emergency may not be something that -- that you would want to have put into place. An emergency could be enough dust out of a grain elevator in a small community. That’s an emergency because of people with asthma in certain parts of the State. I’m just suggesting to you that it’s going to be imperative, and I -- and I -- this is not a partisan thing, Senator. This isn’t because of anything more than -- than -- than trying to help good public policy. And we’ve been able to do this, I think, in a fashionable and good way out of the 21 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 72nd Legislative Day 2/8/2006 Senate Financial Institutions Committee. I do stand in support of the bill, Senator. And I would encourage my colleagues to vote for it. But as this thing moves through the process, I hope that we do have clarity in defining an emergency rather than an arbitrary or subjective decision by someone that happens to sit in a cabinet position on a certain day in a certain administration.

…I greatly respect my colleague’s seniority and wisdom and I assure you, if that’s a concern of this Body, we will amend that in the House. It seems like a simple amendment and a simple change, and I’d agree to it.

As Chair of the Senate Financial Institutions, when the legislation came through - and I concur with my colleague, Senator Rutherford - I was very uncomfortable with the generic and the broad definition of what an emergency really constitutes, and I want to just say, I was waiting for a ruling from my staff whether or not it could be addressed by -- by rules. And I’m very uncomfortable. I’m even uncomfortable moving it forward today without some kind of reading. And so unfortunately, I have to stand -- and I support the legislation, what -- the attempt, but I’m uncomfortable in passing it through without some kind of clarification. I would take it out of the record until we get that. That was the agreement in the Financial Institutions Committee and I think we need to uphold our agreements made on -- in committee. So, I ask my colleague to take it out of the record and -- and to follow through with the promise made in the committee.

Senator, this Senator made no such promise. The simple fact is, as you made suggestions, I have the right to take your suggestions or not take them. And it’s a good day and we ought to move forward. I have faith in the people in Illinois to do the right thing. I don’t believe that a -- an agency is going to declare for another bank from out of Illinois to come into Illinois on any kind of false basis. I take people at their -- at their words and their ability. And I do think that this bill should move forward today, and if we need to fix it, we’ll amend it in the House.

In other words, if the Banking Commissioner simply made a declaration, whether if it’s a good idea or a bad idea, there’s nobody else, not one other person, who’d be able to counter that. Is that right?

We can all create imaginary horribles, but at the end of the day, we have to trust people who work for us. You know, the bank -- the Banking Commissioner seems like the proper person to decide if another bank outside of Illinois should move in on a temporary emergency basis to solve a problem.

…as long as -- as long as you brought it up, one of our duties, one of the things that we’re called upon to do, is to create ground rules. What -- what your Chairman is suggesting to you is that we -- you’re asking us to abrogate our responsibility and that is to create a clear rule. What your Minority Spokesman, who’s bending over backwards to be gracious to you on the Senate Floor, is suggesting to you, not trick-bagging you into saying that you made a promise, but suggesting to you… Why? Is there somebody in the gallery that you need to hear from? I can wait if you need to talk to ‘em. All right. So, you’re with me? What these two people who are really well-respected here, your Chairman and the Republican spokesman on the committee, are suggesting to you is that maybe the more artful way of approaching this, Senator, is to say, “You know what? Yeah, maybe we give it a definition, or maybe we tether it to something else. Maybe we make the Governor, who’s an elected official, make the declaration of an emergency. Maybe we tie it to a national emergency and that’s what the President does.” But to sit here and basically say, “Well, yeah, you know, let’s trust the people that work for us without giving ‘em a groundwork, without giving ‘em a definition.” There’s no definition in your bill. There is nothing. Your bill is silent. It is completely a declaration by your own admission, Senator, by one person. One person has to sign a piece of paper that says, “I declare an emergency. Therefore it exists.” That, Senator, in the words of your own Chairman, is a bad idea, if I could give you the subtext of what she was saying.

Everyone will have the influx. I think it’s a good bill we ought to move. You know, we can sit around and debate who’s going to do what, who’s not going to do what. I think the bill is clear on its face. It’s not anything that’s going to cost the State of Illinois any money. It’s just an opportunity to make sure the people in my district and your districts are protected when these cases happen. And I would point out to the recent hurricane in -- in my area that’s caused a lot of destruction. And the people need to be able to get their money and their banking, and I will clear this up in the House. I ask for a favorable vote.

I -- I rise in support of Senator Jacobs and his desire to get this out today. He’s given his word that he will amend it in the House if there is any problems. And I just want to remind everyone, the Commissioner of Banking was -- did come up for confirmation and was voted -- approved unanimously by this Chamber. So, we have to have some confidence in the Commissioner and to belittle his position and -- and decision-making authority, I think, is the wrong thing to do. And I strong -- stand strongly in support of the Senator’s bill.

Well, thank you very much, Madam President. I, too, rise in support of the gentleman’s legislation. We’ve discussed this. We know what the issue is all about. We know the importance of this if we do have an emergency. I would also mention to my colleague from -- from Rock Island that we do not have an emergency here today. We have several weeks before we reach -- reach our 3rd Reading deadline, so I would encourage the Senator to consider the suggestions, the thoughtful suggestions from both sides of the aisle, that we can take a good bill, a good idea, and make this better. And I think, as history would tell us about this Chamber, we have an obligation to send the best possible bill over to the House. We don’t always have control of 25 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 72nd Legislative Day 2/8/2006 what -- what happens to our legislation from the Senate when it gets to the House. So, we do not have an -- emergency here today. We have time to strengthen this bill. Your example in your opening remarks about the hundred-year flood on the Mississippi River. Well, I -- my district borders the Mississippi, too. And we may have that hundred-year flood, but it may not be an emergency in Rock Island County because we have several bridges that cross the Mississippi River. However, it might be an emergency in Quincy, as we saw several years ago, when there’s only one bridge across the Mississippi River in Quincy. So, there are some questions here about the appropriate process of declaring… The legislation is good. I plan to vote for the legislation at the appropriate time, but I would encourage the Senator to give it a little more thought. We don’t have to pass this today. We’re still doing committee hearings. We’ve got several more weeks before we have a 3rd Reading deadline and we’ll have plenty of time to work on this bill a little bit and, I think, address these concerns and I would encourage him to reconsider his -- his thought. I admire you for your tenacity and fighting your -- for your bill and wanting to move it over to the House, but there may be a better vote on another day. Thank you, Senator.
