Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 2630 addresses bullying prevention in schools. It allows school districts to include bullying prevention instruction within existing courses of study at all grade levels. Allows school districts to collaborate with community agencies to provide bullying prevention curricula and - - and it also allows the State Board of Ed to assist in developing instructional materials and teacher training programs. I know that during this debate in committee that there was some concerns from some colleagues on whether or not there was any data to show that this was needed. And, actually, I did have some information that was provided to me by the Illinois Center for Violence Prevention and it indicates that one in six students are actually victims of bullying, that frequently bullied kids are more suicidal, and that boys who bully are more likely to commit crimes. I’d be happy to answer questions.

And these records will be held in confidence unless the victim or the victim’s guardian allows them to be released.

Senate Bill 2770 requires the Department of Healthcare and Family Services to apply for an appropriate waiver of federal law and regulation in order to provide medical assistance coverage for home and community-based services for children under the age of eighteen with autism. This bill arises from the Health and Human Services Committee. We held a hearing on the autism report which the society presented to us in October of last year, October of ‘05. The greatest thing in that -- the report said that the single most important thing that we, as the State of Illinois, could do for autism would be to apply to the federal government for a waiver to include autism as one of the covered illnesses under Medicaid. And I ask for your favorable approval.

The problem was, when the law was changed in 2004, there was a July 1 sunset included, which turned out in retrospect to be a mistake, because unless we eliminate that date, the Department of Insurance loses its authority in regulating these annuities pursuant to the Code. So they want the -- the authority back by eliminating the date. That’s all it does.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Senate Bill 2966 amends what the definition of “public official” is in Illinois law. Under the provision, it makes it a crime to threaten a public official. For years, State’s Attorneys across the State, including those in my district, have prosecuted under that statute assuming that a police officer or sworn peace officer fell under the definition of “public official”. The Fifth District Appellate Court ruled last year that a police officer is not a public official according to that -- according to their reading of the definition and overturned a conviction. This bill would explicitly make peace officers public officials for -- purposes of this statute. A good point was raised in committee by the Chair of the Judiciary Committee, Senator Cullerton, with regards to the requirement that an individual knowingly threaten a public official. So, in an instance, a hypothetical, where an individual threatens an individual who happens to be a police officer who’s wearing plain -- is in plain clothes, there’s no way for that person to know they’re a police officer. They would not be guilty of the offense under the way that we’re defining a “public official”. Happy to answer any questions, as long as it takes, Mr. President.

This is a 46 STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 76th Legislative Day 2/16/2006 recommendation of the Department of Human Services. Under the Abused and Neglected Long Term Care Facility Residents Reporting Act, there’s no penalty for -- for requiring reporters who failed to report an allegation of abuse or neglect to the Office of Inspector General. We do, however, have in other Sections of the statute, for example, the Nursing Home Care Act, we do have a -- a -- a penalty if someone fails to report. So, this bill simply conforms with those other Acts by including a penalty for failure to report when you have this obligation in the statute already. Thank you, Mr. President, Ladies and Gentlemen of the Senate. This bill would remove bond requirements for boiler inspectors and is an initiative of the Illinois State Fire Marshal’s Office. Background is that during yearly audits, auditors will cite the office for not collecting the bonds for boiler inspections. This Section of the -- of the statute was passed in 1951, and since that time, there’s been a revamping of accounting and fee collection procedures. Also, the inspectors are now State employees. This flew out of committee and I ask for your favorable vote. Thank you.
