Thank you, Mr. President. For the Body’s -- as you know there’s been a lot of debate between the -- where -- beer and wine industry. I -- I will tell you, there is -- they -- they have an -- there is an agreed compromise that has been worked out between both sides and been heavily negotiated. I want to thank -- personally thank Senator Link. That compromise is sitting in the House. Unfortunately, we couldn’t get the amendment filed because of the deadline we had. And I just want to make the same representation I did to committee to the Body. I’m asking that we adopt Floor Amendment No. 2 today. I’m -- I’m not going to call the bill as it is right now. I am hopeful that there will be a -- a Floor amendment coming out would make -- makes it identical to the House bill over -- over on the other side which all parties have agreed. So, I will not -- I’m asking that we move this to 3rd. I will hold it until that Floor amendment comes out. If it doesn’t, then we’ll just have to deal with -- deal with it when the House comes -- House bill comes over. So, I’ll take any questions.

Yes, but there’s been a little tweaking. But like I said, I’m not going to move this amendment out for final passage. It will be with the -- I -- maybe I’d call it a trailer amendment that will be on the House. They’ll be -- come out -- when we go to the Floor amendment, it will come to the -- the Senate Floor. It will be identical to whatever is in the House, ‘cause that’s the deal they had. The worry is that, let’s say, the House bill comes over here; for some unknown reason, it doesn’t get out of Rules, which I don’t know if would ever happen. So, that -- that -- that’s the intent. But I’m not moving this until that bill and everyone is comfortable with it, Senator.

Yes. Thank you, Mr. President, Members of the Senate. At the suggestion of the committee, I provided some changes to the original bill which is on 2nd Reading. We increase the penalties for someone to violate the Act. We lower the amount of plants that a person could possess from twelve down to eight. And we increase the penalties for -- for transferring these plants to someone else. We also limited the number of caregivers that a person could have. We limited the number of dispensaries that there could exist throughout the State and in -- in general made it a much better bill. So, be happy to answer any questions and ask for an Aye vote.

Senator Cullerton, we’re having audio problems with Senator Geo-Karis, but basically I can hear. Her question is, what is the essence of the amendment? Could you quickly redescribe the amendment, sir? Could we have some attention, please? Senator Cullerton.

Thank you very much. What it does is to tighten up the bill that came out of committee. It reduces the amount of plants that a person could possess from twelve to eight. It limits the number of dispensaries that could exist throughout the State. And it creates a criminal penalty for someone to violate this Act by not using this medicinal purpose cannabis for themselves. If they transfer it to somebody else, we actually increased the penalties for what otherwise would be against the law -- what would be against the law. So, with that, whether you are for or against the bill, I -- I think this a much better bill as a result of this amendment. And would ask for -- that it be adopted.

The amendment provides that when a forfeitured conveyance, including an aircraft, vehicle or vessel, is returned to the seizing agency or prosecutor, the conveyance may be used immediately in law enforcement of criminal laws of this State. Requires that upon disposal of the conveyance, all proceeds from the sale of the conveyance be used for drug enforcement purposes. It also allows the proceeds to be used by law enforcement agencies for security cameras that prevent or detect violence. It’s effective immediately.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. The amendment becomes the bill and would allow -- would modify a Section. It’s Section 18-165 of the Property Tax Code and will allow for -- any parcels of five hundred acres or more, it would allow a tax abatement, not to exceed thirty-eight million dollars and not to exceed twenty years in duration. I’ve had extensive discussions with colleagues on both sides of the aisle. This is supported by every taxing body that would be affected in Wilmington. It includes the City of Wilmington, the Wilmington School District, as well as the Wilmington Fire Protection District. I’ve had the opportunity to get letters of support from each of these bodies and I’ve shared those with all members of the committee. This would simply allow for this tax abatement, up to thirty-eight million, would only be for the former Joliet Arsenal, which is currently being developed. The Elwood portion of that arsenal has been developed by CenterPoint and it’s created one of the most successful intermodal facilities -- intermodal facilities in the country, certainly in Illinois. This will allow for a big developer, ProLogis, to come in, develop the southern end of the arsenal in Wilmington and create an additional one hundred and seventy-five thousand dollars in the first year of the abatement, only for the school district. And then by year ten of the -- the abatement - it’s a ten-year abatement - that would result in one million three hundred thousand going to Wilmington School District, which is very, very -- a poor school district. I had the opportunity to tour that district and they are in dire need of the revenue and they are fully supportive. The superintendent was in Springfield this morning. I’d be happy to answer any questions. I appreciate the work of my colleagues on the other side of the aisle, especially Senator Althoff, who had a meeting in her office with me and the superintendent this morning. Yes. Thank you, Mr. President. Senator, this development - - the current state of the law would only allow for twelve million dollars of tax abatement for parcels of five hundred acres or more. And the reason why this development needs an additional, I think it’s twenty-six million in tax abatement dollars, is that they had it formulated. They did the math and we heard that in committee. Mr. Neal, who drafted the legislation, did the math, and in order for this development to be successful and to get the tenants that they need for the eleven million square feet of -- of -- of the logistics and distribution space that will be built at -- in Wilmington, through that formula, they need the thirty-eight million dollars in tax abatements to allow for the developer to come in and actually start building these -- these facilities and these logistic centers. So that without this abatement, they simply won’t come to this part of the arsenal.

The -- the abatement is for ten years. And in year number one of the abatement, it’s a ninety-percent abatement, and then in year ten, it’s a ten-percent abatement. And then, obviously, in year eleven, that -- that abatement will -- will no longer be in place and the taxing bodies will get one hundred percent of the revenue of the real estate taxes.

They think it’ll run customers away and have other issues with “Big Brother” overlooking you while you order your crab salad, or something like that. So, this bill is to make sure that that does not happen and that no municipality can just force the businesses in their municipality to put cameras all over to spy on their cooks, busboys and people who come and use their business. However, the parents contacted myself, who was -- who was the sponsor, and they’d like to have me extend that to a five- year because they had students in school and they wanted them to continue for the next couple years to get their education. Senate Bill 1086 -- the intent of the legislation is to inform the truck drivers, the commercial vehicle drivers, of which roads and streets in the State of Illinois that they may legally travel. What we are asking is the municipalities, townships, local governments to give that information to IDOT so that it can be made available to the trucking industry so they know which roads they can legally drive on and which ones they cannot. 56  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 82nd Legislative Day 3/1/2006 Basically what this bill does is that vehicles that -- it holds -- holds that a vehicle that has been repossessed by the lienholder that has -- shall be considered to be salvage only when the cost of repairing the damage of a vehicle would be greater than fifty percent, rather than greater than thirty-three and a third percent of its fair market value. The bill also makes it -- similar changes to when a vehicle is part of a fleet of more than five commercial vehicles or a vehicle in -- in submission in water. I’ll be more than happy to answer any questions. I know of no opposition.

Thank you very much. Senate Bill 1183 really -- removes a provision in the Parentage Act of 1984 that requires a court to assess a minimum child support payment of ten dollars on a non- custodial parent regardless of the parent’s net income. The Department has brought this bill to me because they have stated that failure to resolve this conflict between the federal law and our law could result in a loss of federal grants. There is already action to recover back child support available for situations where parents have not given any support. In committee when we discussed this, I think the -- the main thing is it’s something that we have to do -- just to comply with the federal law, otherwise we would lose some funding in our child support. It is going to go on -- I’m hoping, after the vote today, that it will go on in the House and I have said that there will be better clarification of this bill and some of the -- the questions that we had in committee and that will be taken care of in the House.

Under forty -- I can only tell you what I know to get from the Department. Under 42 U.S.C., Section 667, each state shall have a rebuttable -- rebuttable presumption concerning child support awards. According to the Department of Healthcare and Family Services, this Section of the compiled statutes violates the federal law because it is an absolute determination of an award with no discretion. The Department states that failure to resolve that conflict would jeopardize federal grants.

But there will be an effort to make everyone pay, but just that -- that automatic ten bucks will be removed? So there will be an effort. It’ll be in the bill when it comes out of the House, I presume, that the -- that it will be changed to such an extent that it’ll be the intent of the law that we have people pay who are non-custodial parents.

That is correct and I just want to make sure on the record, this does not change anybody’s child support orders or the way in which we conduct the -- the taking of -- or the collecting of child support payments. All it does is -- on the determination of it being ten dollars, it’s going to be better clarified in -- in the House. But it does not change anybody’s orders or stop anyone from paying the amount that the courts have already ordered a non-custodial parent to pay.

We - - we just added that to try to balance this off to allow those minority investors to -- for that applicant to be considered since they did lose money.

You are -- you are -- you are Minority Leader. I expect better conduct from you being Minority Leader in the House of Lords. This is the Upper Chamber. I have been taught to and -- and when I first got here I might have been a little rowdy like that, but I have learned that this is the House of Lords, the Senate, and -- and I’d appreciate if you’ll let me finish. We were all here when Rosemont was ordained, chosen, selected. Thank -- thank you. To address -- some of the concerns. Senator Lauzen, I, too, am proud of this country. I’ve had people who’ve served this country. But, Senator Lauzen, when -- when the founders said everybody was created equal, everybody wasn’t treated equal. In fact, they said that an African- American was three-fifths of a man in this country. And as a result, a lot of people in this country have been denied access to property, to the ability to -- to vote, whether it was minority or women. What has happened is, as Senator Hendon said, sometimes, well not sometimes, there are times that you must correct the wrong by trying to make people inclusive. All we’re saying in this process is that they will be considered. For whatever reason, you all have taken it that they’ve gotten a license already, but it’s just a factor in consideration. Maybe these people -- maybe these individuals may make a decision they don’t want to participate. Maybe they’ve been soured on the process. There’s not a given that they will get this license. There’s not a given. We have not specifically made that determination. All we’ve said is that they should be considered. You know, and -- and I guess it goes to the issue of how we look at things, how we view things, but when you’ve been constantly denied some rights, sometimes you want a little inclusion, my colleagues. You know, I can only think of what happened -- what’s happening in D.C. with a guy by the name -- name of Jack Abrahoff {sic} (Abramoff), where, I guess, you assume there’s a pay-to-play because what has happened, and I believe most of ‘em, or of your party that have participated in this process. So, maybe that’s why you have a jaundice feeling about that. But all this is, is just a consideration. It’s not a guarantee. I would ask for your favorable vote.

Thank you, Mr. President, Members of the Senate. The Illinois law has for a long time provided that a railroad operating in Illinois maintain a police force and have police powers conferred on it. There was a recent Illinois Appellate Court ruling that kind of questioned that statutory authority. So, this bill was initiated to correct that, and at the same time, there was some issues raised by the United Transportation Union. So, it does three things. It -- it does make clear that railroad police officers are subject to the same training requirements as all other police officers and restrict the authority to employ railroad police officers to rail carriers that are -- that are registered with the Illinois Commerce Commission. So, it has to be a registered -- with the Commerce 80  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 82nd Legislative Day 3/1/2006 Commission in order to have a police force. It would allow for railroads to adopt rules and policies defining the role of the railroad police officers in non-criminal employee investigations. And it says that they can exercise their power on their employer’s property statewide. And, as I said, it’s an agreement between the Railroad Association and United Transportation Union. It’s a good bill. I’d be happy to answer any questions and ask for an Aye vote.

Thank you very much. Senate Bill 2257 is a bill that has been passed out of this Body last Session. It amends the Children and Disabilities Article of the School Code regarding reimbursement for special education classes for children from orphanages, foster family homes, children’s homes or State housing units. It requires that if a child who is eligible to receive services is adopted and that child continues to receive support services from the Department of Children and Family Services, then that child shall continue to be eligible to receive the services. What it basically does, is for many of the school districts that have children that are foster children and when those children are adopted, it would allow our school districts to be -- still remain whole and those children would not be dropped off of the hundred-percent reimbursement that those schools are getting from those children who are needing those services. Many of these children have some severe disabilities and so for -- for us it’s a happy time for kids to be adopted, but for our school districts, they still have to provide the same services to that child when -- as he was when he was a foster child. So, this is just to make sure that our school districts are also helped.

Thank you. I would like to respond to some of the things that my -- my colleague has mentioned. You’re right. You will hear from your school board members, especially those members who are serving in school districts that will not receive reimbursement for providing the very same services to that same child only because now that child has been adopted. It will not take anything away from the foster kids that are -- already in the system because they are being -- reimbursed right now at a hundred percent. So, I would ask that all of you who voted for this before, vote for it again, because in the long run when the children are adopted and those school districts - all of our 83  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 82nd Legislative Day 3/1/2006 school districts - are still serving those kids that have some profound needs, that -- that district should not be penalized because of those children being adopted. So, I just ask that we still keep up the -- the funding on those children that were wards of our State. Thank you.
