Thank you very much and, Ladies and Gentlemen of the Senate, it’s really a great honor for me today to bring to you the Carl Sandburg High School, located in Orland Park, the AA State Championships {sic} of the wrestling team. So as they start to file in, members of the team is Jon Morrison, Mike McAuliffe - not related to the Mike McAuliffe, but he -- Mike McAuliffe is here and -- and has said that he’s sure that they’re -- they’re related. We have Matt Schmeski, Jake Holler, Kevin White, Billy Crowley, Brandon Precin, Tyler Le Pretre, Conrad Polz, Derek Sallas, Matt Cusick, John Doyle, Sepehr Nikpouri, Eric Pretto, Ben Friedl, Clinton Polz, Jeff Richards, Glenn Hurt, Cameron Miller, Eric Rettke and Craig Olson. As -- as they’re all around me here, they finished the season with a perfect record of thirty-three wins, no losses and a fifty-one match winning streak. They finished number one in several tournaments throughout the year, including Wheeling Invitational, the Dvorak Invitational and the Clash National Duals. And they were Conference, Regional and Sectional champions as well. They’re here today with their Head Coach, Mike Polz, and Assistant Coaches Eric Siebert, John Polz, Mike Klutcharch - that I went to grammar school with his dad and his aunt - Tony Siebert, Dan Polz, Tony Pretto and Paul Campos, and the school’s principal is Debbie Boniface that I taught with at Southwest Coop. There’s one thing that I want to mention and, you know, so many times we -- we see in the papers about coaches and -- and records, and kids’ achievements, but the one thing I want to talk about Mike Polz, the coach at Carl Sandburg High School, is that he is -- the National High School Coaches Association selected him as its National High School Wrestling Coach of the Year 2006. Coach 5  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 Polz is the NHSCA’s first selection for 2006. There were twenty winners from the fifteen different states in 2005. He is honored as Coach of the Year at the Coaches and Officials Championships Banquet in Pittsburg, Pennsylvania, on Thursday, March 23rd, of just this year. He also was a two-time State qualifier at Riverside Brookfield High School in the mid-1970s, and he’s a graduate of Eastern Illinois University. Go Panthers. Coach Polz has coached for eighteen years, four at Providence Catholic High School and the last fourteen at Carl Sandburg High School. Again, please welcome them and I ask Coach Polz to come up and just say a few words to the Members of the Senate. Coach.

Thank you, Madam President. Good afternoon, Ladies and Gentlemen of the Senate. Today marks the thirty-eighth anniversary of the assassination of a man that meant so much to history of this nation.

PRESIDING OFFICER: (SENATOR HALVORSON) Excuse me, Senator Hunter. Could we please get everybody’s attention? Thank you.

Today marks the thirty-eighth anniversary of the assassination of a man that meant so much to history of this nation, Dr. Martin Luther King, Jr. Dr. King would have been seventy-seven years old today. We all are familiar with Dr. King and his legacy. During his time, he was among the principal leaders of the civil rights movement. King was an advocate for direct action, nonviolent protest. He challenged segregation and racial discrimination in the 1950s and 1960s, and became a symbol 6  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 of protest in the struggle for racial justice. Equally as important, Dr. King was a fighter in the freedom movement, standing up for -- not just for African-Americans, but for -- but for wherever he saw wrongdoing. King spoke out on the Vietnam War and lobbied for America’s poor, speaking out on economic inequality in America. The day before he died, King gave a speech in which he said, “I’ve seen the promised land. I may not get there with you. But I want you to know tonight, that we, as a people, will get to the promised land.” Dr. King is no longer with us and we have not made it to the promised land, but he is a major reason why we are moving in the right direction. Today I ask that Members of this Chamber recognize Dr. King -- Dr. Martin Luther King, Jr., for his strength, courage and wisdom, and to keep him in your minds today as we go on with our daily business. I, also, would like to say a few words in reference to the impact and the influence of Dr. King on my life. I think anyone who came out of the sixties -- the sixties was a time of -- of tragedy, as well as triumph. And I would be remiss if I did not give credit to Dr. King. I consider Dr. King my philosophical mentor, and one of the reasons -- or one of the factors of -- of me deciding to go to Harvard Divinity School was the opportunity to study with a King scholar, Dr. Preston Williams. I wanted a intellectual understanding of the man, not only as a social justice advocate or a prophet of peace, but to understand him as a theologian. And one of the reasons that I stand here as a public servant is because of the model that Dr. King set as far as how do you bring faith into the public square and have a discussion about our values and the role that God plays in policy, in public policy. And Dr. King was able to impact public policy from a position of faith, a faith tradition, whether or 7  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 not it was the anti-Vietnam War position he took or the position he took on poverty, the anti-poverty campaign, or the Voting Rights Act of ’64 and ’65. So I would like to close with one of his sayings that sort of defines my political framework of how I view public service. He said, I have the audacity to believe that people everywhere deserve three meals a day for their bodies, education and culture for their minds, dignity, equality and freedom for their spirits. I thank Dr. King for his witness. I thank you -- I thank him, God, for his walk, and I also ask that God gives me the grace to uphold the tradition of moving policy to benefit all in society.

Thank you, Madam President, Ladies and Gentlemen of the Senate. This bill is a cleanup amendment to the Medical School Matriculant Criminal Records Check Act {sic} that we passed last year. The -- as the bill passed out of the Chambers, it asked for -- State Police must furnish information about a matriculant’s fingerprinted information to the State Police. I’m sorry, it said that -- I’m sorry, let me go back. It said that all medical schools must submit the matriculant’s fingerprint and information to the State Police and to the FBI to be checked against the FBI and State Police criminal databases. We since found out that private institutions don’t have access to FBI databases. So it’s really to remedy that and just specify that it was to -- to conform to the State Police criminal database.

First of all, it creates the Ambulance Revolving Loan Fund, which would be created under the State treasury. Secondly, the -- the program -- the fund and the program will provide zero-interest loans for the purchases of ambulances for fire departments, fire protection districts, township fire departments, or nonprofit ambulance services. The -- the -- the loans will be made subject to appropriation. I'll be more than happy to answer any questions.

Thank you, Madam President. It is a privilege and an honor to sponsor Senate Bill 626, which -- which renames Illinois Beach State Park the Adeline Jay Geo-Karis Illinois Beach State Park. Geo has been a trailblazer all of her life. She graduated from Northwestern University and went on to get her law degree at a time when women just didn’t do things like that. She achieved the rank of Lieutenant Commander in the United States Navy, again, breaking stereotypes. She was the first woman to practice law in the Lake County courts and the first woman to be an Assistant State’s Attorney there. She was the first woman to hold a leadership position in the Illinois Senate. Given Geo’s record of trailblazing, I think it is very fitting that Illinois Beach State Park, with it’s 6.8 miles of trails, will be named for her. Since the park is in Senator Geo-Karis’ home district, giving it her name will forever tie Geo’s dedication to her own community with her service to all the residents of the State of Illinois.

Thank you, Madam President, Members of the Senate. I just wanted to comment. Some people have contacted me recently since the -- this amendment was out there -- and -- and -- because a portion of this park is already named after a cousin of mine, Bill Cullerton. So about six years ago, the -- there was a dedication where the park, the marina and the nature conservancy was dedicated to and called the Cullerton Complex after my cousin. My cousin at the time certainly was surprised at this honor - a very modest man, was a very famous fighter pilot in the Second World War. Ironically enough, he was so famous as a result of his efforts during the war, in the 1947/48 era, there was an effort to name Orchard Field after him, after -- what -- what later became obviously O’Hare Field. They were going to name it after him, because -- but because he was so young, they didn’t do it. So this complex was named after him. I called him over the weekend, told him of this resolution and he is very happy to have the Cullerton Complex remain, obviously, there, as well as have Senator Geo-Karis’ name affiliated with the State park. It’s going to be a very great honor for both of them to have these -- these facilities named after them. And I know that there are some people who expressed their concerns about this to me, but I -- I want to reassure you that my cousin has no problem with it. I have no problem with it. I think it’s a great idea, and I would be very happy to support the -- the bill.

Senate Bill 680 adds fire protection districts to the list of taxing bodies that must be notified in the event that a property’s assessment changes by more than one hundred thousand dollars. Currently, property -- currently, the property owner must be -- must notify municipalities, school districts and community college districts. This adds fire protection districts to that list. I’ll be more than happy to answer any questions.

Under current law, a school needs a certificate of approval to do business and, as a part of that, must submit an application that includes, again under current law, a surety bond. This bill would provide an alternative that the school may post a certificate of deposit in an amount sufficient to guarantee its contractual obligations, including prepaid tuition. There is a similar expansion of the requirements for a sales representative for that school. They must obtain a permit and post a surety bond. Here, too, they would be permitted to post a certificate of deposit. This has been negotiated between the State Board of Education and one of the schools affected. I’m not aware of any opposition and I ask for your Aye votes.

Thank you, Madam President. Senate Amendment 1 to Senate Bill 927 would register tattoo and body piercing establishments throughout the State of Illinois. The Center for Disease Control and Prevention reports the risk of HIV and Hepatitis B transmission if tattoo and body piecing instruments are not properly sterilized. Because they -- these are not regulated in any way to ensure -- proper sterilization in Illinois, a person cannot donate blood for up to twelve months after having a tattoo. This has created a hardship for blood centers and tattoos are the number one reason for high school and college students, who are some of the biggest donators of blood, for not being able to -- to donate blood. The -- the blood centers estimated they’re losing -- could be losing up to a hundred donors a day as a result of this. I think this is good public policy in the sense that it increases safety and it also provides a greater supply of blood, which is in great need. I'd be happy to answer any questions.

I have not personally talked to the blood centers, but they maintain that the reason they can’t accept the blood is because of the -- they are not aware of what techniques -- whether the sterilization was used from one -- from one tattoo parlor to the next. This will ensure that those safety precautions are in effect, and therefore they could accept the blood.

I found out that thirty-four states have already adopted this bill and it’s really a -- a kind of a win- win. It has to do with the ceiling and removal of -- of open wine bottles from a restaurant. What the bill says is that -- I first should say that right now, in Illinois, you’re not supposed to take an open wine bottle out of the restaurant, because that’s a violation of open liquor statutes that we have on the books. So what this bill says is that a restaurant licensed to sell alcoholic liquor in this State may permit a person to remove one unsealed, partially consumed bottle of wine for off-premise consumption provided that the patron has purchased a meal and consumed a portion of it -- of the wine with the meal on the restaurant premises. A partially consumed bottle of wine that is to be removed from the premises shall be securely sealed by the licensee or an agent prior to removal from the premises and placed in a transparent one-time use tamper-proof bag, like the one I’m holding up here. The license {sic} or agent of the licensee shall provide a dated receipt for the bottle of wine to the patron. And then the point of this is, if you order a bottle of wine in a restaurant, you won’t feel the pressure to finish and consume the entire bottle of wine and then get in the car and drive home. This way you can take the bottle of wine home to -- 39  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 to your home to finish it. So it’ll actually cut down on having people with higher blood alcohol contents driving on the highway. And the Restaurant Association hasn’t weighed in yet, but I’m sure they’d be in favor of it, because as people know, a higher quality of wine frequently is sold in bottles of wine, rather than by the glass, so people would be able to -- to buy a higher quality of wine, drink one or two glasses and then take the remainder home. I think it’s a good idea. I know a number of states -- as I said, I believe thirty-four states have already done it, and I think we should do it in Illinois. Over the past couple years there’s been a trend in the amount of women - African-American women - disproportionately affected by the virus HIV and AIDS. And we’ve taken some strides to add some support to the population. There was a study done in -- that was highlighted by The Washington Post just this last -- February that indicated two out of three women, that’s sixty-six percent here in Illinois, of women affected by the virus is African- American. And so what…(microphone cut off)…would do is provide a response fund that is created for the State treasury’s department. It would allow for the opportunity to include service delivery systems, HIV and AIDS prevention and treatment, and the creation of the -- establishment of the treasury fund in the Treasurer’s Office. And the proponents of this legislation is the Illinois Planned Parenthood Council, Alcoholism and Drug Dependency Association, the Alliance for Community Empowerment, Let’s Talk, Let’s Test Foundation, Bridging the Tys to Jordan, the Jo-Ray House of Chicago, and Vision House of Chicago. Yes, thank you, Madam President, Members of the Senate. This is a Senate bill and it took us some time to reach an agreement on this bill. So I’ll tell you who the players are. It -- it was an initiative of the AARP, the Office of the Attorney General was involved, as well as lobbyists representing major 53  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 reporting agencies - TransUnion, Experian and Equifax. The current law allows for people to get a freeze on their credit report if they can show that they’ve been the victim of identity theft. What this bill would do would be to allow for a person to freeze their own credit report and in -- in anticipation or to avoid being the victim of identity theft. The negotiations involved how much money can the reporting agencies charge for the freeze or the removal or the temporary lift of the freeze. The negotiations involved allowing for up to ten dollars per freeze to be charged, and keep in mind there are three of these major reporting agencies. So if someone wants to do this, they can do it, but it would cost them ten dollars to do so times three. The AARP and the other participants agreed to a -- a -- a wavier of the fee to a consumer who’s sixty-five years of age or over to place and remove a freeze. And of course the victim of identity theft who is -- who is already -- is already covered by the law to not be charged. So that’s what the agreement is. It’s -- again, I don’t know of any opposition. Well, not surprisingly the AARP was interested in trying to provide a benefit to people, and one of the things we talked about was providing for poorer people the opportunity to have the freeze not be charged for. And we talked about the -- the -- the people who are eligible for Circuit Breaker. In fact, I quite frankly would have thought that would have been a better way of 54  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 doing it. It would have been a smaller universe, but the reporting companies, surprisingly enough, were the ones that said it would be easier for them to check a person’s age, rather than check their eligibility for the RX program. So that’s where the negotiations went and we obviously said that since they’re the ones that are waiving the fee, if that’s what they want, we might as well let them do it. There are a number of senior citizens who are very wealthy who would benefit from this. The theory was to try to help those who are less well off, but the reporting agencies themselves were the ones that asked for that. So that’s what we went along with.

Thank you, Madam President, Ladies and Gentlemen of the Senate. Senate Bill 2654, in one form or another, has been before the Senate at least five times before this. It dissolves the Suburban Cook County Tuberculosis Sanitarium District, following the City of Chicago, DuPage County and many others in abolishing the special purpose tuberculosis districts. It transfers responsibility for the care and treatment of TB to the County Department of Public Health and offers the hope for more holistic and comprehensive treatment. Importantly, it abolishes the tax that’s levied by the district and permits the county to 56  STATE OF ILLINOIS 94th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 96th Legislative Day 4/4/2006 expand the scope of services to include emerging respiratory diseases like avian flu and SARS. I’m not aware of any articulated opposition to this bill, and I would ask for your Aye votes.
