House Bill 5204 removes the requirement of an out- of-state salvage buyer to be licensed by the Secretary of State if a person is currently licensed in -- in the other state or jurisdiction. The salvage and auto parts buyers on these wrecked vehicles from insurance companies, now, is no longer locally. Ninety percent, I’m told, is done by the Internet purchasing, so people are purchasing the -- these salvaged cars from all over the United States. It’s -- when you have a lot of people purchasing, these -- out-of-state salvage buyers, it’s good for the consumer.

House Bill 5595 mandates insurance coverage for the treatment of children under nineteen years of 22 STATE OF ILLINOIS 95th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 163rd Legislative Day 5/28/2008 age with congenital, genetic, or early acquired disorder as long as a physician diagnosed the disorder and determines the treatment to be therapeutic and the treatment is administered under the referral of a physician. It also provides that the coverage required by this legislation is subject to other general exclusions and limitations of the policy. And under request of the insurer, the provider must furnish medical records, clinical notes, or other necessary data to allow the insurer to substantiate the treatment as medically necessary. The bill is a product of a lot of negotiations with insurance providers to clarify the scope of this new law and how it would interact with other existing insurance laws. And over the last weeks, we’ve worked on the language that we believe was fair to the insurance companies and businesses and also to ensure our kids get the therapy that they need to fully develop to their potential. I would like to just take this opportunity to thank everybody who has come together to work on this legislation. I think we’ve come to a real good and fair bill and I would be willing to answer any questions.

What is this subsection intending to accomplish?

Thank you very much. The intention is to maintain the status quo as the services that are paid by insurers and services that are paid by government. Currently, there are services in our schools that are educational in their purpose and currently are paid by the State or the federal government. If the service has a medical purpose, then it’s paid by an insurer if the individual is covered by a health insurance plan. This provision is intended to keep the balance of what entity is responsible for the payment of the service, as currently the practice.

Current law will continue where, if a small employer has a coverage under Section 370, services covered by that Section will be paid under the policy subject to any limits that may be in the policy. The way this bill passed out of the Senate, it was an initiative of the DuPage County State’s Attorney. It had to do with cases where there was an injunction granted to a government agency relative to enforcing a statute and defendants were using a delay tactic by filing a meritless motion. And so that’s what the bill did as 53 STATE OF ILLINOIS 95th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 163rd Legislative Day 5/28/2008 it passed over here. The House thought that it was such a good idea that we should expand it to all and broaden it to cover all types of injunctions. And as a result, it came back to our Judiciary Committee today.
