With me today is my better half, my wife Nora, but she also has with her all the students at -- it’s a… It’s Student Nurse Lobby Day. And these are the senior students from the Methodist College of Nursing in Peoria. So, if the Senate would please help me welcome ‘em to Springfield.

I’m joined today here in the Capitol by some residents of Champaign County here lobbying on behalf of motorcycle riders in the State of Illinois. And would ask the Senate’s help in welcoming them to the Capitol.

With me today I have my three children who are on spring break and I wanted to introduce them to the Capitol. There is Paul Jr., who is twelve and a half; Camryn Taylor, who is ten and a half; and Ryan, who is eight and a half. Would you all join me in welcoming them to the Senate?

Thank you. Mr. President, I’m honored to be joined today by my Page for the Day, Alex Brandt. Alex is a sixth grader at the Maple Middle School in Northbrook. His interests include math. And in fact, I had him read the State’s revenue projections from the Commission on Government Forecasting and Accountability. When he finishes his memo, I’ll share it with you, Mr. President. His interests include math, chess, science and politics. He someday says he wants to be President of the United States. I’ve already told him that there’s someone who used to sit in the back row who did just that. So, if you could please welcome Alex and his parents, Tim and Rachel, and his brother, Adam, who are in the gallery directly behind the Speaker’s {sic} Podium, I’d appreciate it. Today I’m pinch-hitting for our friend and colleague, Senator Kotowski. We are joined here today by the North Park University School of Nursing. And with them is Peggy Kotowski, the sister-in-law of Senator Dan Kotowski. I’d like to ask my colleagues for a warm Springfield welcome.

Floor Amendment No. 2 has three main changes from the underlying bill. First, it adds a legal description of the properties subject to quick-take. Second, it shortens the period for which the quick-take is in effect from five years, beginning January 1st, 2009, to one year, beginning June 1st, 11  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 2009. And lastly, it clarifies that the property is to be used to build streets, roadways, or other public improvements to serve in the I-57/I-80 TIF District.

Mr. President and Ladies and Gentlemen of the Senate, I move to waive all posting requirements so that House Bill 289 and Committee Amendments 1 and 2 {sic} can be heard in the Senate Committee on Executive this evening. This was a last minute request. I apologize to the Body. But it was a request that came about in the last few days, so we couldn’t anticipate the full requirement of the postings. So I apologize. Hope that it doesn’t happen in the future. But this is an important measure and I think the Leadership on both sides of the aisle is aware of what it’s for. And we would hear this in Executive tonight so that we can vote on it tomorrow. So I would move to waive the posting. Thank you.

Thank you, Mr. President. Floor Amendment No. 2 changes the definition of “plumbing” so that the use of recycled water for lawn sprinkler systems does not fall under the definition of plumbing. The amendment also replaces the term “non-potable” -- I’m sorry, “non-potable” with “indoor” so only plumbing units using recycled water fall under the Plumbing Code.

Thank you, Mr. President. This -- this bill is the 21st Century Scholars bill. We had an extensive and productive discussion in committee about this. But there are some major issues, not the least of which are financial issues concerning this bill. So the amendment simply shells the bill and we’ll keep the discussion going.

Thank you, Mr. President. It basically requires that -- exempts out those -- those businesses that already exist in a enterprise or TIF zone from the prevailing wage.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. Floor Amendment No. 2 reduces the tax rate for the proposed cigarette tax to a fifty-percent increase in year one and a one-dollar-percent -- a one-dollar-per-pack increase in year two. This is a compromise in order to lessen the sticker shock as a result of the change in the federal tax that takes effect tomorrow.

Thank you. This is an amendment that was provided by the Department of Public Health and it basically removes the definition of foundation for a manufactured home and replaces it with a definition of manufactured home and mobile home.

Thank you, Mr. President. Under this amendment, one of many {sic} occupy a newly constructed commercial buildings {sic} in any part of the State that does not have a building code in place, unless certain conditions are met.

Thank you. Floor Amendment No. 2 amends the bill and applies to facilities enrolled in and subject to a provider agreement under a medical assistance program, such as Public Aid. It requires the Department of -- of Healthcare and Family Services to notify the nursing facility of the final decision on 23  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 the application for services by its residents for medical assistance.

Thank you very much, Mr. President. Floor Amendment No. 1 to Senate Bill 53 {sic} amends the Municipal Code. The bill provides property owners with an option to finance energy efficient improvements to their homes. Municipalities and homeowners could voluntarily agree to contractual assessment for the installation of distributed generation renewable energy sources or energy efficiency improvements that are permanently fixed to real property.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. This is a gut and replace. We expect an amendment that will be what is agreed to between the Creditor {sic} (Creditors) Bar Association and the Bankers. So it’s not quite soup yet.

Thank you, Mr. President. Senate Bill 1089 specifies that title companies must attach either a certificate or {sic} (of) compliance or exception {sic} (exemption) to a mortgage for the mortgage to be recordable.

Thank you. A few years back, in ’07, we provided rate relief in the amount of a billion dollars. And basically what this bill does, it allows the credits that were given to customers to transfer with a ARES or a new supplier that the consumer may be transferring their services to.

Thank you very much, Mr. President. Senate Bill 1095, the amendment amends Civil Code -- the Code of Civil Procedure. When landlords foreclose on a home, some tenants are being served with eviction notices even though the eviction is through no fault of the tenant. Senate Bill 1095 allows courts to expunge these evictions, which can be a detriment to obtaining future housing and credit.

Thank you, Mr. President. What this amendment does is take the Illinois Racing Board out of underneath the Department of Revenue.

Thank you, Mr. President. This allows the Illinois Racing Board to adopt rules -- about advance deposit wagering.

Yes. Thank you, Mr. President. I wanted to bring to your attention that if you had skipped over Senate Bill 610, I would like to have you go back to that at some point. And I’d like to move it forward.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. This amendment is as a result of negotiations with the fire sprinkler interests as well as the fire alarm interests. And -- and I -- it’s a minor amendment, but it takes care of those interests.

Thank you, Mr. President. The amendment makes it unlawful for any person to charge another person or family for assisting in completing an application for enrollment for the ALL KIDS Program.

Thank you, Mr. President and Ladies and Gentlemen of the 34  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 Senate. Floor Amendment No. 2 basically is language established by the negotiating parties. And -- and all the language does is make the bill agreed upon and establish an external review appeals process for consumers when there is an adverse determination or final adverse determination.

Floor Amendment 1 deletes 35  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 one sentence concerning the business district commission to make it clear the business district commission is strictly an advisory board.

Thank you, Mr. President, Ladies and Gentlemen of the Senate. This is the Illinois High School Association initiative relative to tort immunity. But, if you can believe it, the 36  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 lawyers don’t totally agree yet on each side of this issue. Language will be submitted today, though, I do anticipate all interested parties will agree to. So the amendment simply shells the bill and we move it over to take care of it.

Thank you, Mr. -- Mr. President. Floor Amendment No. 1 gives school boards the authority to modify the requirement for expulsion for students to have been -- who have been determined to have brought weapons to school.

Thank you, Mr. President, Members of the Senate. Floor Amendment 2 deletes -- deletes all and becomes the bill. And this makes various changes to the Victims’ Economic Security and Safety Act, or VESSA, which allows victims of domestic violence to take time off from work.

Thank you, Mr. President. This is the Quad City {sic} (Cities) Regional Economic -- Development Authority. The amendment was to take out the State moral obligation.

Thank you, Mr. President. This amendment simply adds the counties of Rock Island and Whiteside County to the proposed 45  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 port authority.

Thank you, Mr. President. Floor Amendment No. 2 to Senate Bill 1796 is -- becomes the underlying language for the IHOPE Program. This is a program, with our efforts, to re-enroll high school dropouts. There was quite a few technical changes that were proposed by the State Board of Education that would 46  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 simply strengthen the legislation. And it also makes this bill -- or clarifies the bill to be subject to appropriation. We’re hoping to be able to actually draw down quite a bit of the stimulus support dollars for education and use it hugely in this effort. We have a statewide Task Force on Re-Enrolling Students Who Dropped Out of School, and we’ve based a lot of our information on the findings of this group over the past couple years. I’d be happy to answer any other questions when it’s appropriate.

Thank you, Mr. Chairman. It’s a technical change converting “operating” to “of operating” on page 7, line 12.

Thank you, Mr. -- Mr. Chairman. This creates a new concept called STAR bonds, where there will be development in a certain area, and the development and the projects will be financed by the local sales tax and the State sales tax.

50  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 Thank -- thank you, Mr. President. This is a bill that has to do with residents who reside on a -- on land that is owned by developers. We took this through committee today. It passed unanimously. The amendment that we’re adding on is not what we believe we’re going to end up with. We will be speaking -- we will be in negotiation with the landowners starting on Friday and going through spring vacation. So what I’d like to do is get it ready to pass out of the Senate and -- and take care of it in the House. I’d be happy to answer questions.

Yes. Thank you very much, Mr. President. Floor Amendment No. 1 basically deletes everything to become the bill. As amended, the bill creates the 2-1-1 information system, which provides information on where to obtain assistance from local and national social service programs. The Illinois Department of Financial and Professional Regulation {sic} is authorized to designate an independent lead entity to manage the 2-1-1 system.

Thank you, Mr. President. This exempts riverboats from admissions tax when licensed owners of a riverboat have capital projects of at least forty-five million dollars.

Thank you, Mr. President. This is additional judges for the 19th and 12th Judicial Circuit.

Thank you, Mr. President. Floor Amendment No. 2 becomes the bill. The amendment corrected a flaw in the State aid 55  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 formula by simply taking those school districts that pass a limiting rate tax increase off the formula for the years that the taxpayers approve the rate increase and then go back on the formula once the period has ended. While off the formula, their general State aid would be calculated without consideration of the tax increase.

56  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 Thank you, Mr. President. Floor Amendment No. 1 to Senate Bill 2069 deletes all and becomes the bill. It inserts similar language to the underlying bill which addresses the eligibility and other criteria for the Illinois Cares Rx Plus program. It also outlines income eligibility limitations for the entire Circuit Breaker program for Fiscal Year 2010 and automatically adjusts the limits moving forward into 2011. This is -- as originally filed, it was -- this establishes a uniform income eligibility of two hundred and thirty-nine percent of the federal poverty level.

The bill requires DCEO to establish and maintain a program to award grants to emerging technology enterprises in the State from the Emerging Technology Grant Fund. The bill sets forth eligibility requirements, funding priorities for awarding the grants, terms and limits for grant matching, procedures for awarding the grants, and documentation requirements. It requires written contracts with performance guarantees are entered into with emerging technology enterprises prior to awarding of grants. It adds that qualified vendors -- investors in emerging technology enterprise may claim an income tax credit as certified by DCEO. I’d be happy to answer any questions.

It establishes the Hunger Relief Fund as a special fund in the State treasury. It also creates a tax checkoff as the fund -- funding source for the Hunger Relief Fund. I strongly urge all the Members here to sign onto this bill. It’s a darned good bill. Of course, otherwise I would not have introduced it. But it does so much good. So we believe that we are going to be able to settle the JCAR lawsuit. In doing so, we’ll need to pass legislation. So we’re not there yet with the language, but we need to do it soon. So the purpose is to send this to the House and have that -- that -- the House then put the amendment on it. It’ll come back to us for concurrence.

What 1560 does is bars developers from replacing {sic} restrictions in deeds limiting how a home may be constructed. Senate Bill 1560 does not -- does allow deed restrictions on 86  STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 33rd Legislative Day 3/31/2009 {sic} (or) restrictive covenants concerning the aesthetic look of residential structures if they apply uniformly to all residential structures in a subdivision. Deed restrictions or restrictive covenants may not prohibit or restrict industrialized residential structures on real property. Really what this is about, is that since, you know, the manufactured homes today are of a very high quality and recognized as very good housing, that that may not be restricted. The only restrictions are aesthetic in -- in terms of covenant restrictions. I -- I would urge your Aye vote.

There -- there’s -- the transfer of funds is no longer in the bill? There’s no State money whatsoever. Well, I was going to support it even with the State money in it, and I just wanted to point that out going forward so we can have bipartisan cooperation when it comes to the matters of money around this -- in this Chamber.
