Thank you. Mr. President, Ladies and Gentlemen of the Chamber, I am rising to explain a situation that happened yesterday with a bill of which I was the chief sponsor. If you’ll recall, Mr. President, at the commencement of our actions 4 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 here on the Floor yesterday, there was a bill called - House Bill 1107 - of which I was the chief sponsor. When I got up to present the bill and Senator Demuzio assisted me in that, we presented to the Chamber the provisions of a bill that was not 1107, but a bill I’d thought was. I’d become confused with the House bill numbers. The bill that was explained yesterday and the Chamber ultimately passed was a totally different piece of legislation. It was a piece of legislation that was on the agreed bill list in the Education Committee and provided for, in certain emergency circumstances, a school district could go forward with emergency repairs under twenty-five thousand without the State Superintendent’s okay. I -- as soon as I realized my error, Mr. President, I filed a motion to reconsider, hopefully to keep the bill in the Chamber, so I’d give the Members a chance to revisit the vote. The bill had already left the Chamber, is in the House of Representatives now on the certification process. So, I wanted to let the Membership know. I apologize for doing that. It was obviously unintentional. I hope that we can get to the Martinsville bill later today. Obviously, I will be available to talk to the Members about the bill that they actually voted for yesterday and its provisions. So, with that, Mr. President, again, I apologize to you and the Body and appreciate your time.

This is simply in response to the former Governor’s use of tollway plaza signs to display his name. This passed unanimously out of committee. And I know of no opposition. It permits the Technology Revolving Loan Program to make grants to non-public schools, just as we do today for the Textbook Loan Program. The Committee on Education raised some concerns about competition for those dollars. So the amendment provides for a clear priority for public schools that apply early. And it also makes sure that there’s a -- a reclamation process to take that technology back. I ask for your Aye votes.

This bill is an initiative of the Cook County State’s Attorney, which has been investigating people who dispose of vehicles because stolen vehicles are being submitted to scrap processors. They want to update the law to keep up with the practice of disposing of stolen vehicles through scrap processors. I know of no opposition and move its adoption.

It does this by expanding the number of offenses for which relief may be granted. It also expands the relief that can be granted by the circuit court to include relief from forfeitures and removes the Prisoner Review Board from the certificate process. There’s another provision of the bill that requires the Department of Professional Regulation to provide -- promulgate rules that permit a person with a criminal record, who seeks licensure or certificate in an occupation which a criminal record is not expressly a per se bar, to apply to the Department for a non-binding, advisory opinion to be 28 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 provided by the Board or body with the authority to issue the license or certificate in question as to whether the applicant’s criminal record would bar them from licensure or certificate, if all other requirements of licensure or certificate were met.

House Bill 4075 is intended to bring a close to a -- over a decade-long issue that has been pending in my district. Over the last decade, the Department of Natural Resources, in an effort to create a bike and walking trail, has been purchasing property along an abandoned rail line in the Arcola/Arthur areas of my district. Because there’s been so much consternation and public opposition, they have given up on that endeavor. This bill simply conveys that property from the Department of Natural Resources back to the local governments, whether they be municipalities or local townships. I’ll be happy to answer any questions.

If there is ever a conflict between the provisions of the Department of Veterans Affairs and the Nursing Home Care Act concerning an Illinois veterans home, then this provision of the Department of Veterans Affairs Act applies. Several years ago, the federal government said they were no longer going to inspect State veterans home, but they 46 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 have continued those inspections. So House Bill 4237 exempts the Department homes from various fee provisions of the Nursing Home Care Act. Thank you very much. This House Amendment No. 1 now becomes Senate Bill 2012. It accelerates the collection of a sales tax increase that was approved at a referendum for the Village of Orland Hills. In the election of April 7th, 2009, the voters of Orland Hills approved a non-home rule sales tax of three-quarter percent. Current law requires that because this tax was approved after April 1st that the Department of Revenue will not start collecting the tax until January 1st, 2010. If the approval would have come before April 1st, the collection of 51 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 the tax would have begun on July 1st, 2009. The bill simply accelerates the collection of this tax to July 1st, 2009. And this will only apply to Orland Hills and, I also found out, Litchfield. So I ask for a favorable vote.

Specifically, if a fine is imposed upon a riverboat for knowingly sending marketing or promotional materials to a person enrolled in the Gaming Board self-exclusion program, the Board shall distribute fifteen percent of the fine to local government in which the riverboat is located for the purpose of awarding grants to nonprofit entities that assist gaming addicts.

It also requires the Court of Claims to notify a claimant that the claim has been initiated and whether or not the information filed is sufficient to fully adjudicate the claim. So, Senator Bond, given that it’s just a study, I think that’s all the more reason why we ought to be able to say, at least at the start of the process, that, you know what, we’re going to have an equal number of both parties on this commission. So, given the precedent that’s been set with the Deficit Reduction Committee, why do you feel like we need to step backwards like this?

This bill came over 73 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 from the House of Representatives, which is almost equally Democrat, as a bipartisan measure, and then the sponsor decided at -- either on his own volition or at someone else’s behest that we had to change this and make it about partisan politics. It is just a study, but it is a signal to those who are interested in this issue that the commission is going to be interested in putting forth a recommendation, but, quite frankly, it’s going to be a recommendation that one party likes better than the other. There’s an opportunity here, Mr. President, to come out with a report that both Republicans and Democrats agree equally with. That -- that opportunity is now being thrown away under the provisions of House Bill 85. Reluctantly, I rise to oppose it. Thank you, Mr. President.

In short, this was brought to my attention due to the fact that there were -- a -- there was a misunderstanding or some statute -- in the statute, it was not covered that an uncle or an aunt living within the home or having sexual relations with a member of the family was in the 77 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 statute. And what we’re doing is adding uncle/aunt and extending this time. There was no prosecution that could have been done under this particular incident. Basically, this allows for the Winnebago County Forest Preserve to be separated out from the county board starting in 2010, allows for elections at large, specifies the number of commissioners, et cetera. The Winnebago County Board approves of this and is requesting this, as well as the voters in the district passed a referendum, an advisory referendum, with over seventy percent of the vote saying, yes, they wanted to split it out. House Bill 564 provides that city council members in 92 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 municipalities that are coterminous with a township may permit a township supervisor to preside over portions of city council meetings when the city council is exercising powers that would ordinarily be exercised by the township board. There are instances in the State of Illinois where members who are elected as city council members also serve as township trustees. When this occurs, they have a city council meeting and the township supervisor, which is elected, is unable to preside over any meeting - it’s a separate meeting - unless we pass this legislation. It just clarifies a specific statute. And it happens in the Township of Zion. And it passed out of committee unanimously and I’d ask for an Aye vote.

House Bill 606 extends the Addison Creek Restoration Commission. The repeal date is currently set for January 1st of 2010. We’d like to extend that to 2015. They need to complete the design and construction of the engineering in order to acquire the site for a new reservoir. I’m not aware of any, Senator Murphy. This actually helps seven communities. They’re Bellwood, Broadview, Melrose Park, Northlake, North Riverside, Stone Park and Westchester. So there’s a collective effort of all seven mayors. Addison Creek flows through all of their districts. It’s causing huge flooding in their communities. Their property values are lowering. Their insurance premiums are rising. And we’ve been working to try to just address this particular issue. I’ve not known of any opposition over the years that we’ve enacted this Commission. They’re actually in the process of securing funding from the Metropolitan Water Reclamation District, the Department of Natural Resources here, and from the federal government to help them with the finalization of this project. I -- I have no idea what the opposition is about in the House.

Just -- just one last question, Senator. Do you know why the -- the Commission has not completed its report in the originally allocated time? What’s the rationale for needing the extra five years?

And from my understanding, they need additional time so that they can do three major things: One would be to complete the design and construction engineering; the second would be in order to acquire the site for a new reservoir; and the third is that they’re looking to order and complete the reservoir construction and channel improvements. So it should take them a period of time to not only gather the dollars that they need, but to complete the engineering, to identify the reservoir, to build the reservoir, to stop the channel from overrunning, and et cetera.

House Bill 629 keeps the fee for the National Pollutant Discharge Elimination System, or better known as the NPDES, permit applications received before January the 1st, 2010, at five hundred dollars, but for applications received on or after that date, the fee is changed to two fifty if the application applies to less than five acres and seven fifty if the application applies to five or more acres. The fee is currently one that is paid on an annual basis. And currently, we’re looking at the -- the fact that the date would be changing and the fee structure would change.

Okay. So, right now, it’s five hundred dollars for everybody one time every year. What you’re proposing is two hundred and fifty dollars for below five acres, seven hundred and fifty for above five acres one time a year. Is that correct?

That would be correct. It’s a five hundred and two -- and seven fifty one time a year. There’s a period of time that the permit is issued. Under the existing law, construction-site storm water permitees must pay five hundred dollars initially and five hundred each subsequent year, except if a permit is issued during the months of January through June. Under the current law, if the initial fee is incurred in the period between the months of January through June, the EPA may prorate the initial annual fee. Under the terms of this bill, 629, this becomes a one-time fee of two fifty for acres under five and seven fifty for plots of five or more.

There must be an estimate of how many of these applications there are versus the cost of each one of those. And I thought that Senator Murphy asked the -- you know, the -- the illuminating question of, generally, will this generate more revenue. You mentioned that it was your understanding -- do we have any -- perhaps a study from -- you know of -- who -- who is actually taking a look at this to do the calculation? Is this a fifty-percent fee increase in many cases or isn’t it? I mean that’s a pretty big question for some of us who, you know, don’t support, you know, larger, more expensive government.

As with orders of protection, House Bill 693 makes a first violation of a stalking protective order a Class A misdemeanor, subject to a penalty of three hundred sixty-four days in jail, two hundred -- twenty-five-hundred-dollar fine. A second or subsequent violation is a Class 4 felony, subject to a penalty of a jail sentence of one to three years in jail and twenty-five thousand dollars’ fine. Ask for an Aye vote.

Senator Link, in committee -- in the Elections Committee, we had a -- a vigorous discussion - I think you’d agree - on this. And this bill -- House Bill 723 sets up a proposition, and that is, do you believe that a candidate who did not go through the -- the petition and filing process in the fall should have to do that in the spring or do you believe we should be able to continue with the system whereby if a major party does not have someone go through that process in the fall that they should simply be allowed to appoint a ballot -- appoint a candidate to the ballot in the spring without getting any petition signatures whatsoever. Would you agree with the characterization that that’s the choice that this bill provides?

Well -- well, it -- that’s what -- that’s what the present law provides right now. What we’re doing is changing that somewhat, in that the fact is, as I said in my opening remarks, that they have to -- they still can appoint that person after the primary if there is a vacancy, but that person would have to get the same required signatures as that person who filed for the office and ran through the primary procedure. So, in the case of like a State Senator, who is required to get a thousand signatures, that person that is appointed would still have to get a thousand signatures also.

This is a bill that’s received a great deal of bipartisan support. House Bill 1099 does four things with the Metropolitan Water Reclamation District regarding their pension fund: It makes a technical clarification so the annuity would begin on the first day of the month following an annuitant’s death; secondly, it has the child’s annuity payments are increased to five hundred dollars per child per month up to five thousand for all children, rather than the five hundred for the first child and three hundred and fifty for every additional child and up to twenty-five hundred; thirdly, the bill makes a change regarding application for duty disability benefits, eliminating the requirement that the application be submitted by {sic} the Board within ninety days; and lastly, it addresses refunds, that the bill clarifies that those refunds to heirs who die in service are paid benefits in the same manner as annuitants.

This was a concern that many shared after learning that many superintendents had ballooned salaries. On record, it shows that their income is over four hundred thousand, which was one of the Niles Township School superintendents. And so this legislation is just to provide more information for all of us on the reporting of public schools and public institutions of higher ed to report the base salaries and the benefits of all teachers, faculty and administration on or prior to the 126 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 49th Legislative Day 5/15/2009 beginning of each fiscal year. I know that there was a question in committee of me whether or not coaches were considered as administration. And I have learned that, in fact, coaches would be included because the salary is fifty thousand or over. And we all know most college coaches makes well over fifty thousand dollars. I know Senator Cronin had worked really hard on this same subject. He’s passed similar legislation - Senate Bill 2270. Our legislation differs in a couple ways. His did not include higher ed. We discussed including the ROEs and public consumption. And his actually put it on-line. This bill will require the guardian of an adult disabled ward to obtain an order from a court before the guardian consents to sterilization of the ward. And it provides the standards by which the court will either grant or deny the guardian’s verified motion. I don’t -- there’s many proponents. I don’t know of any opponents to this bill.

House Bill 2351 removes a provision that permits a county from transferring and expending excess indemnity fund monies to the benefit of owners in real property in the county as the county deems appropriate. The dollars will be transferred to the Cook County Lead Poisoning Prevention Fund. That’s where the dollars will be directed. And it’s estimated between one to three million dollars of excess funds will go into this lead-free program.
