Thank you, Mr. President and Ladies and Gentlemen of the Senate. To refresh the Body’s memory, this bill was a sweeping series of reforms that have -- that impacted contracting and investment decisions. The Governor’s -- it was the direct byproduct of successful negotiations with the Governor’s Reform Commission, as well as among the various legislative caucuses. 5 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 67th Legislative Day 10/16/2009 The -- it’s my belief that the Governor’s amendatory veto exceeds the authority of that office. But let me tell you what three consequences of the amendatory veto would be. So -- this provides further -- further strengthens the argument as to why we need to override the Governor‘s veto. The first has to do with how it would -- potentially compromise the independence of the internal auditors. Secondly, it would inadvertently weaken the procurement officer for IDOT - the change that was being made - and we don’t want to do that. And then -- and then finally, there -- it would shift the resources away from those independent auditors if they were to be moved to another agency, and that would have the net result of weakening our capacity to police how taxpayer dollars are being spent. I believe there’ll be a follow-up trailer bill to this as well, that can hopefully move forward to greater progress. And I’d urge your support of the motion.

It amends the Liquor Control Act to allow the City of Chicago to issue a liquor license to a restaurant within one hundred feet of the -- the school as long as the restaurant is located in a five-story building that has ten storefront properties and they use three out of the ten storefront properties. I -- I have -- 9 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 67th Legislative Day 10/16/2009 this is a new -- a new restaurant in my district. It’s going to create fifty jobs in my district, especially during these hard times. I have talked to Senator Righter about the letter from the principal of the school that’s nearby. We did receive the letter from the church, so we’re just waiting for the letter from the principal. All parties have been notified. CPS is going to forward this letter to us. I’m just hoping to pass this bill over to the House, hold it there. I have a commitment of holding it there to make sure we can get that letter and see that we can get this bill passed so I can open up this restaurant in our district. I’ll be happy to answer any questions.

Senate Bill 760, as amended, again, reflects Senate Bill 231, which we passed out of the Senate unanimously, which allows -- which clarifies that an incarcerated individual that was eligible for medical assistance benefits prior to entering the Illinois Department of Corrections will remain eligible for such assistance upon their leaving the Department of Corrections. The Governor’s amendatory veto of Senate Bill 231 extended the implementation date beyond the time that thought -- that would seem reasonable -- seemed to be reasonably within his authority. So we’ve incorporated that amendatory veto into this bill.

Yes. Thank you, Mr. President and Members of the Senate. Senate Bill 1682, which amends the Illinois Funeral or Burial Funds Act and the Cemetery Pre-Need {sic} (Pre-Need Cemetery) Sales Act regarding the transparency and disclosure to consumers placing funds in trust, what the Governor did is to -- his veto -- the Governor’s recommendation is to change the effective date 19 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 67th Legislative Day 10/16/2009 of the bill from January 1, 2010, to January 31st, 2010. His reasoning being that presently there is a task force that they are waiting for the results of and this would give them about a thirty-day window to see if there were any other things that needed to be added or changed.
