Senate Bill 2487 amends the Department of Revenue Law by allowing investigators of the Gaming Board, the Racing Board, the Liquor Control Commission, to -- to exercise police officer powers if, in the course of their enforcing -- in the course of their duty that they discover a violation that creates a threat to life or safety to anyone and they’d notify the local 25 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 3/23/2010 law enforcement agency. As you may recall, we passed this out last year. It passed out of the Senate 58 to nothing, but it was stalled on the Order of Concurrence over in the House and it was referred back. So we’d like to send this back over to the House. There’s some questions about training, firearms. Representative Lang has already been in negotiations with the agencies about the procedures on this. So there will be some amendments and we’ll probably see this coming back after the –- it’s been worked out with the departments.

Thank you. Senator DeLeo, you mentioned that Representative Lang has indicated to you that the bill will - thank you, Mr. President - that the bill will need further work over in the House and it pertains to training requirements. What is your understanding of the difference in training requirements between police officers as we would commonly recognize that term and the people to whom you want to extend those law enforcement powers to in this bill?
PRESIDING OFFICER: (SENATOR HARMON) Senator DeLeo. SENATOR DeLEO: Thank you, Senator Righter. As you may recall, when we 26 STATE OF ILLINOIS 96th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 101st Legislative Day 3/23/2010 took these powers away from, like, the Liquor Control Commission agents, they had police powers and they had weapons and they were able to make actual arrests. We took -- took those away - for what reason, I don’t know - five or six years ago. So, if we’re going to restore police powers and we’re going to give them weapons back, having the use, we expect them to go through the police training board, the whole academy or whatever training that they need to carry weapons. Senator -- Representative Lang had some concerns about some of the agents, the training, and that’s what we’re working on now over there.

So, as the law stands right now, in order to be a member of the Illinois Liquor Commission or Gaming Board -- not a member, but one of the enforcement officers, you need not be a sworn peace officer. Is that accurate to say - or at least not having gone through the same training as a police officer would?
PRESIDING OFFICER: (SENATOR HARMON) Senator DeLeo. SENATOR DeLEO: That’s correct. And as you know, I would say ninety-five percent of the current people at the Racing Board and at the Illinois Liquor Control - they are investigators - are retired police officers. I’d say almost a hundred percent are. So, most of them have been actually through the -- through the training board procedures; they’d have to get recertified. So I don’t think it -- that would be a major problem.
