I know a lot of us understand that she’s extremely talented and she has a wonderful artistic eye. So I wanted to invite people to stop by my office. She took a picture - a gorgeous picture - of the inside of the dome in the Capitol and it is really a piece of art. We blew it up and it’s on the wall and it is -- I wanted to say, you know, if I needed to use my office as a gallery, I could do that because she is so very talented. So I wanted to just take a moment to say congratulations to Ms. Renfro on her work and for how well she serves us. Mr. President, yesterday I got the sad news of a loss of a good friend. I think a -- a loss of a good friend to people on both sides of the aisle - James Tyree.

5 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 I got to know James Tyree as a in-house attorney at the City Colleges of Chicago while he was Chairman. Later found out we were fellow parents at the same school. Tyree was the CEO of Mesirow Financial. And in -- in addition to his great leadership as a great corporate leader in Chicago, he was a great civic leader as well and served on numerous boards, including the Chicago Chamber of Commerce, which he served as Chairman of. He’s a great White Sox fan. When the -- you know, you Cubs fans suffer from the Bartman ball. Well, there is an interesting story about Jim when the White Sox won the World Series. And I don’t know if you recall, the game was in Houston and the -- the pop-up went down the sideline and -- and, you know, unlike the Bartman ball situation, there were a group of fans in Houston that backed away from the ball. That was James Tyree and his entourage, because they were White Sox fans. Last year, when the terrible earthquake hit Haiti, he called me up and he was quick to -- to -- to respond - like -- like he was always quick to respond to -- to good causes. He was a champion in a fight against juvenile diabetes. Just a good man. And it’s a great loss for the City of Chicago, a great loss for the State of Illinois. And I’d like for -- to ask for a moment of silence.

We need to extend that to December 31st, 2012. Senator Althoff and I are co- chairing that task force. We’re going to start having meetings as early as April 6th. We’re going to gather that data and report back to you all by December 31st, 2012.

Thank you very much, Mr. President, Members of the Senate. Senate Bill {sic} 29 presents the Senate’s revenue estimates that we will be using in our budgeting for the upcoming fiscal year, fiscal year ’12. As you all will recall, in our new legislation that we passed last year for budgeting for results, we require living within our revenue streams. This will set the revenue estimates that will then guide us as we develop our budget estimates. We are going along with COGFA, the Commission on Government Forecasting and Accountability’s suggested revenues less a certain amount for a piece of a six-hundred- million-dollar revenue source that we would have to take legislative action that -- to implement, which we have not done. Thus, we’re using COGFA’s number minus six hundred million, and that gets us to thirty -- thirty four billion two hundred and eight-two million dollars as the revenue estimate for fiscal year ‘12. 16 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011

First, let me commend the sponsor and -- as well as Senator Kotowski, for a collaborative process with myself and Senator Althoff on this and -- in effort to try and get on the same page, much as the House was able to do. I appreciate that. I’m not sure whether we are going to get there, but I do appreciate the effort. But I guess the specific question, first, would be, how -- do you anticipate being able to navigate the approximately 1.1-billion-dollar difference between the House figure and the figure in this resolution?

The figure in our resolution, we are sending it to House; it’s a joint resolution. They can determine whether or not to take it up. This will be the revenue estimate that guides our budget developments here, and if we end up having different budgets in the House and the Senate, we’ll go to conference committee at the end and resolve our differences.

17 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 To the resolution, and I guess I would specifically request a roll call on the resolution. But, first, let me say, I do not find unreasonable your reliance on COGFA and the -- the figure you’ve gotten to. I don’t think it’s an unreasonable number. I don’t think the process by which you got there was unreasonable. I would note, though, given the backlog of bills that we have, given the information we just got today on income tax receipts, particularly for the month of February, not meeting expectation, that an abundance of caution in this regard I think would be reasonable. I don’t know that we need to go all the way down to the 33.2 billion that the House did. I’m not sure that’s an entirely defensible number. That being said, I think we -- we could stand to get a little bit closer. The 33.9 that GOMB came up with is in the neighborhood of COGFA, but has the -- and -- and the number you’re using, but also has the benefit of being slightly more conservative. And -- and the -- the best-case result is, is if we plan a little lower and the 34.3 ends up being accurate, we’ve got another four hundred million to pay down a backlog of bills. So, while I appreciate the effort, I look forward to continue to work with you. On our side of the aisle, we feel that this revenue estimate is a little bit higher than where we ought to be. And so, for those of us on this side of the aisle, I would urge a No vote.

If I’m not mistaken, from the testimony in the committee yesterday, the Governor’s Office of Management and Budget is about nine hundred and fifty million dollars lower of an estimate. So COGFA has come in with their estimate, which you’re proposing that the Senate vote Yes on. The Governor’s Office, where they’re -- they actually have to execute on this, they say “Oh, no, it’s going to be nine hundred and fifty million dollars less than that.” And then the House group, from what I’ve -- understand, is even a hundred and sixty eight million dollars less than that. Could you share with the Senate -- and -- and I recognize that no one knows for sure what this number’s going to be. We will be in error no matter where we peg it. But if we’re going to err, doesn’t it make more sense to err on the side of caution? So what is the public policy advantage to guessing high?

Let me respond to some of the questions that have been brought up by the last two speakers. So, first of all, COGFA is the group, the Commission on Governmental Forecast {sic} (Government Forecasting) and Accountability that’s charged to report to the General Assembly. It’s comprised, let me remind you, of three Republicans and three Democrats from the House and the Senate. Senator Murphy himself serves on this as well. It’s charged to develop revenue estimates for us each year that we are to use by legislative statutory authority in developing a 19 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 revenue estimate. So we’re -- we’re simply following what we are charged to do here. When we met with COGFA, they themselves believe that they have been very conservative in their estimates, as we’ve heard. There had been some discussion about trying to split the difference. There’s two primary factors that are distinguishing the difference between COGFA’s estimate and GOMB’s. And -- and let me also remind this Body that in eight out of the last ten years, when you look at the revenue estimates, COGFA’s been much more accurate than GOMB. So if you want to go on what the track record is, this is what COGFA does and they have a real track record of being very close in their projections. The two big differences that drive it are timing and payments of the income tax, where we -- they predicted we’d have a delayed implementation of the new tax increase, and that’s exactly what we’re seeing in the January and February projections. Here is what COGFA had predicted, which is why they have higher taxes to be generated in the next fiscal year, ‘cause they knew there would be a delayed timing on that. And the second aspect was a little bit different growth rate that they projected, 3.1 percent versus 2.7 percent in the GOMB numbers. Even if we split that difference, it would be an eighty-eight-million-dollar difference, which is just .02 percent of our overall revenue estimates. It’s hairsplitting. So there’s no reason for us, I don’t believe, in this Body to try to second-guess the trained economists that we have in COGFA.

Let’s see, it is our job to second-guess everybody - on Executive appointments, in the Executive branch running the government, and even economists. So I can respect the process that they’re going through, but in the end, we really are responsible for own estimates. Can you address the impact that you’ve put into this or that COGFA has put into this estimate about gas prices, the effect on these budget estimates or these revenue estimates of gas prices going through the roof? The Japan nuclear crisis? And then, when we asked yesterday what impact did you put on the growth estimates of the Illinois economy for the sixty-seven percent increase in the income tax and -- personal income tax and forty-six percent income tax increase on -- businesses, their answer was we did not factor an effect into that. But can you address what your thoughts are on those three areas: gas prices through the roof, Japan nuclear crisis, and then that we would say that sixty- seven percent income tax increase has no bearing on our estimate, which is a billion dollars more than the people who have to actually implement the policy?

Thank you, Mr. President. Yes, when COGFA was asked these questions yesterday, I do believe that these are inherently built into their projections based on fifteen-year trends of revenue estimates that’s included two recessions. And they believe they were very conservative in the way they’ve done this. When you look at the previous recessions, when you’re coming out of the recession - which when you look at our 21 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 projections, we are out of the recession and we have been for a year and a half - we actually have projected revenue growth -- well, actual revenue growth in -- after those trough years of like 5.6 percent. They only went with 3.1 percent. They feel very confident that these are reasonable and conservative estimates.

Just a final to the bill. I also agree with Senator Murphy, that we have enormous respect for the work that was done on this committee, and certainly I’d like to express my enormous respect for the sponsor of this resolution. I would submit, going to the bill, that we are -- let -- let me just say that a great chunk of the three hundred thousand people who I represent back home are not out of recession. We have historically high unemployment rates. I think that we -- we all need to be humble when we’re trying to predict the future. We’ll know what the facts are in about, you know, nine to fifteen months from now. So, I recommend a No vote. I would have -- I -- individually, representing the folks back home, I would have liked to see a lower estimate. I’ll be voting No. But none of us can guess for sure the future. I would, Mr. President, ask for a roll call vote on this at the appropriate time.

You know, on a -- on a day when we as Republicans are rolling out a plan to live within our means, reduce spending, and we’re asking for everyone to get serious about this, we’re -- we’re calling for a reality check, this is not the day to be inflating revenue estimations. I urge a No vote.

Thank you, Mr. President. To the resolution: First of all, I want to take exception to the last -- I’m -- I’m speaking in favor of the resolution. And -- and I want to -- before I take more detailed exception to some of the earlier comments that were made, there are a sufficient number of newer Members who are here, so maybe a brief primer is in order. The Commission on Government Forecasting and Accountability, which was formerly the Economic and Fiscal Commission, has not only historically provided more conservative and more accurate revenue projections, but over the years, we’ve expanded the scope of responsibility for this commission significantly. And its net effect has been that we are able to hold everybody more accountable for the data and projections that they make. We’re able to ensure a greater degree of accountability for the health insurance contracts, which we all vote on. We -- we provide a more accurate reflection than any administration, Democratic or Republican, to the rating agencies on the State’s 23 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 creditworthiness and its status of the bonds. And in short, its function for us - it’s our institutional equivalent of the General Accounting Office. It’s been a bipartisan safe haven. So now, in order to get fifteen minutes of fame, we’re going to take a -- a legislative institution which we use to provide us with a truer measuring stick of the status of our economy, of what the situation is with our insurance, our pensions, our bonds, and we’re going to discredit that -- try to discredit that. For what? So, to say inflated -- that when this commission, which, by the way, had a hearing, a public hearing, on the projected revenues for the coming fiscal year and not -- no one discredited it then. No one objected to any of the premises. Now, it’s not just a bunch of people who came out of nowhere to make these projections; the Commission hires some of the top economic firms -- consulting firms in the country, like Moody’s Economies dot -- Economy.com, to assist our staff in making all these projections. So, to make these claims that -- so I just want to exercise -- or, urge people, especially newer folks here, to exercise a word of caution, because we always turn to this commission as a way of providing us with the truest information that we’re going to get out there. And I obviously say that from a position of bias. I’ve been privileged to be the Senate co-chair of this body. I have a House counterpart. And it has worked historically quite well for providing us with a truer guidepost on what we should do. I -- I want to actually -- I -- I want to pick up on something Senator Lauzen said, ‘cause I think he -- why I took -- differ with some of the things he said. He was spot-on about one thing, and that is, you should just -- we all should just assume that this is a 24 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 snapshot in time. The third-largest economy in the world has stopped. And it could conceivably get worse. So I think we need to take a step back in some of our rhetoric on how we’re characterizing this resolution and the larger budgetary debate. We don’t operate in a vacuum. Yes, there are certain things within our control. I’m fearful not -- not just about the human toll that’s taking place in Japan and these horrific tragedies which continue to grow with every passing hour, but on the overall impact that it could place on our country’s economic recovery and the economic recovery of our State, which historically lags behind the rest of the country when it comes to bringing about an end to a recessionary period. So, in closing, a word of caution - maybe we need to come back off the ledge a little bit with some of the rhetoric. And certainly I think that some of the arguments that have been made in opposition to this would be far more credible if, in fact, we had a more detailed series of cuts that are being proposed. None of us here, Democrat or Republican, have any appetite for building into the base spending borrowed money. We’ve been there, we’ve done that, we don’t like it. It’s not going to happen. There’s none of that here, so therefore I would urge not only an Aye vote, but keeping your powder dry on some of the statements you’re going to be making today and going forward. Thank you.

Thank you, Mr. President. To the resolution. I just want to echo the sentiments that were previously stated by Senator Murphy about the collaboration that’s existed with Senator Murphy, Senator Steans and Senator Althoff, and I, and the members of the committee. There’s been a -- a group engagement in this process and I think it bodes well for the future in how we determine the best result for the price of government that we have right now. So I want to thank him for his comments. I also want to say that this represents one piece in the plan, the initial piece in the plan, to end the reckless spending policies of the past. We’re going to identify revenue first, which means that we can’t spend more than the revenue we have - that we have to live within our means. It’s going to require a severe tightening of our belts, because we’re moving away from a cost- based budget, which only begets more cost, to revenue- based/performance-based budgeting, which means we’re going to evaluate programs. And we’re doing that right now in the Appropriations Committee, based on their performance. But the first step in the plan is to identify the revenue. And I know there’s been some stated difference of opinions that were -- were respectfully stated, but the reality is the COGFA estimates look at about fifteen years and are reviewed by economists and they -- they basically have estimated 3.6 percent growth over those fifteen years, and that’s included two recessions. So I think that’s important to note. The other thing that’s important to note is, part of the law that we passed last year requires that we have quarterly reports on cash on hand and also expenses. So that will inform our process as we move forward. 26 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 I think this is a very responsible way to go and I think it’s very important that we’re taking the politics out of the process by relying on a nonpartisan component of government to develop the estimates and to work within those. So I commend the sponsor on her work on this. I think it’s very important that we start with our revenue first, ‘cause it’s going to lead to our tightening our belts; it’s going lead to our reining in spending, and say that we’re only going to spend the money that we have. And it’s the most reasonable estimate that we have right now from a nonpartisan group, the COGFA, within State government. Thank you.

I just want to clarify, I don’t think anyone on this side was questioning or -- or criticizing COGFA or the work that COGFA does. I’ve been a member of that commission for many, many years. I think the question is, should we be -- more cautious in light of what has been happening in the last month 27 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 since COGFA put those numbers together. So the issue isn’t questioning COGFA’s numbers, but does it make more -- does it make more sense to be more conservative with the uncertainty of what is going on with Japan, the uncertainty of the gas prices that are rising dramatically and affecting individuals’ disposable income. And so I think that’s the only question raising and -- does it make more sense to use a conservative number? And if we’re wrong, that’s great. We have more money left over. If we -- if -- if we’re -- if we’re right with this and we’ve ended up budgeting for a higher number, then we’re getting back into the same problems we’ve had before. So, again, I don’t think anyone on this side was questioning COGFA; it’s just should we be more conservative in light of where we’re at. Thank you.

If I could just bring a little more clarity of why we are here today doing this particular joint resolution. If you go back to the statutes, and Section 4 says “The Commission shall publish, at the convening of each regular session of the General Assembly, a report on the estimated income of the State from all applicable revenue sources for the next ensuing fiscal year and of any other funds estimated to be available for such fiscal 28 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 20th Legislative Day 3/17/2011 year. The Commission, in its discretion, may consult with the Governor’s Office of Management and Budget in preparing the report. On the third Wednesday in March after the session convenes,” which was yesterday, “the Commission shall issue a revised and updated set of revenue figures reflecting the latest available information. The House and Senate by joint resolution shall adopt or modify such estimates as…appropriate. The joint resolution shall constitute the General Assembly’s estimates {sic} (estimate), under paragraph (b) of Section 2 of Article VIII of the Constitution…” We are clearly doing what we’re supposed to do as a General Assembly. And as we go forward, we will continue to look at the projections, no hard numbers, as we craft a budget for this fiscal year. And, sir -- and I ask for an Aye vote.
