Their parents are Judy and Larry Linman, who own a number of McDonald’s in Kankakee County that I had a lot of fun at during our political activities. They actually let me serve food out of the window and surprise people through the drive-thru. But Josie and Amy are here because they both really like public service. They’ve participated in Youth in Government. They enjoy tennis, art. Amy is a Sunday school teacher and a part of the National Honor Society. Mr. President, Members of the Chamber, this is a relatively simple bill that some members on the Prisoner Review Board asked that I put forth for your consideration. Following the administrations of George Ryan and Rod Blagojevich, we passed some very, very strong and tough ethics laws, which were much needed, but those laws did a clean sweep that basically prohibited any member of any of the five standing boards to do anything outside of their work on the specific board to which they were appointed to. This prohibited members and -- and gave the members a mandate, really, to give up some of their teaching positions. We had one member teaching at the Police Academy in Chicago. Another one teaching at a community college, some night classes. This bill would only insert that all prohibitions remain except for that of teaching at a not-for- profit or professional board thing, in addition to their work on the PRB. Would ask for your consideration and a Yes vote.

But my understanding is, is, in fact, as a Senate sponsor, this is in fact your first piece of legislation. And so I guess the first question I would have, isn’t this just a -- a -- a -- a crony bill for all your cronies on the Prisoner Review Board? Isn’t that why you’re pushing this? In…

You’re confirming some of my worst fears. Senator Murphy, actually, this is a Democrat bill that was handed me to carry on behalf of my two Democrat colleagues on the Prisoner Review Board. And I always like to carry bills for the Majority.

But one other issue I -- I saw with this bill. Doesn’t this blatantly allow and encourage double-dipping?

Double-dipping presumes that you are probably a Member of this Chamber or the other Chamber and you then decide you also want to serve on a board and you want to teach and you want to do all these other things. These are poor people who are serving the public on our service boards. The Prisoner Review Board, which is probably one of the most important boards in this State, they have a lot to offer to the students at the public universities and to the police academies.

On its merits, this is indeed an excellent bill and I’m going to support it and I am delighted that you’re here -- I -- I have the opportunity to work back in this building with you once again. I have additional incentive to support it and that’s because I think Senator Murphy was entirely out of line. I think Senator Murphy, once again, was looking for a cheap headline. Last week, he gave Senator Mulroe a hard time. Senator Murphy, if you may recall, gave Senator Mulroe a hard time about his first bill, and giving Senator Mulroe a hard time about his first bill, he was suggesting that thousands of senior citizens were going to lose the potential to have their property tax breaks. Isn’t that correct, Senator Mulroe? This from a man whose hometown wants to secede from Cook County altogether. So, I think, Senator Johnson, you are -- when we reissue the book Profiles in Courage, they should have a special chapter for you for enduring not just the ridicule, but from the pressures and criticisms within your own caucus, to reach across the aisle, albeit in a highly suspect manner, in order to pass a good bill. Congratulations. Thank you.

I don’t know. I think some of ‘em do. I never did.

I believe that they do. So my question is a serious one, again, because I know that that side of the aisle is always grilling us on double-dipping and on -- and on -- on having more than one pension, since we are trying to do much more pension reform and this kind of questions that we keep debating here in this Chamber. So they will be allowed -- by you -- by you -- by this new -- by this new law, we’re going to, yet again, allow them to go and seek outside employment and be able to pay into 15 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 another pension system. Is that correct?

Not correct, because, at best, they would only be able to work an hour a day at teaching or something and that would never qualify them as a full-time employee or even part-time to get themselves an additional pension.

Okay, then, if that’s what this bill will do, then I definitely will vote for your bill, even though you don’t vote for mine. So, to the bill.

I just wanted to make sure that this Chamber understood that, again, you know, we’re talking about pension reform. We’re talking about the double-dipping. We’re talking about making sure that we don’t continue to see this happening in our pension system. So, this is a good bill. It’s to work one or two hours while their real job is the Prisoner Review Board. I feel -- I feel good about this bill, so I’m going to vote Yes.

To the appointment, Mr. Chairman -- Mr. President.
PRESIDING OFFICER: (SENATOR HARMON) To the Appointment Message, Senator.
You know, I believe that this appointment has a -- a problem for -- for two main reasons. I believe that this is pure pay-to-play politics and I believe that this appointment and his new position will be a conflict of interest with his current role as Chairman and President of Personal PAC. I have some examples of that that I want to briefly describe. Terry Cosgrove, in his role as President and CEO of Personal PAC, did many things which a lot of people know about. He sent out mailers. He sent out e-mail blasts and he sends out robocalls to support and to oppose people that he feels are either in a conflict or agree with his positions. When I ran for office in 2008, even though, obviously, I was not in office before that, he sent out an e-mail blast and here’s a copy if anyone would like to see it. And it states that “Dan Duffy is against abortion even in cases of rape and incest. Dan Duffy is leading a fight in the Illinois Senate for a law that would outlaw abortion in Illinois and make women a criminal if they have an 28 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 abortion.” And, of course, that’s completely dishonest and untrue. First off, I don’t oppose abortion in cases of rape and incest, and secondly, I wasn’t even in the Illinois Senate, nor did I know any Illinois Senators at that time. I was just starting to meet them. So that was a completely false e-mail that he sent out, which I discussed with him today in the committee, and he did not deny doing this and his -- his explanation was that politics is a rough and tumble place and that things happen in politics that we all have to get used to. He also sent out another e-mail blast and referred people to a website. The website he referred people to, and it says, “Please go to wwdanduffy.net {sic} to hear Dan Duffy tell Democrats about his positions.” Now this website was a website that he created or people that he knew created. That’s why he put it on his e-mail blast. This was a completely false website that had a picture of me. They came and took a picture of my home and put a picture of my home on there. And I have five kids, but they didn’t want to use minors, so they had five fake, stand-in substitute kids that they put on this website. And then on this website, they completely distorted all my positions and where I stood on all issues, not just abortion. So that was really crossing the line, because that website isn’t just the typical rough politics or, like he described, the “rough and tumble” politics; that website, now we’re falling in the line of identity theft. He‘s stealing my identity and -- and talking about things that aren’t true. Also, another example I’d like to talk about is, as you know, Terry Cosgrove -- one of his other e-mail blasts - and I’m sure you’ve all seen ‘em - but is about -- it says, “Have you ever wanted to represent your 29 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 community by serving as a State Senator or State Representative? Please join Personal PAC in a -- in a session” - and this one was on April 25th - “to learn about how to transform yourself from a concerned citizen into serving the General Assembly.” So what that means is, as his role is Personal PAC, and you can see if you go to his website at personalpac.org, that he also trains people and committees, just like he might have trained some people in this room and their campaign managers on how to run for office. And then finally, Mr. President, and thank you for the leeway, as we all know, Personal PAC gave over four hundred thousand dollars to Governor Quinn in the final months of his election. As we all know, Mr. Cosgrove really felt that that really made a difference, because when he did an interview recently with the Windy City Times, he stated in that that getting Quinn elected to office was one of his most satisfying accomplishments. So knowing this and knowing that -- the problems that we’ve had in Illinois all these years, knowing what we went through with Governor Blagojevich, and knowing that all the talking that Governor Quinn has done about ethics reform, are we really now going to appoint someone to the Human Rights Commission that has this past, that has spent hundreds of thousands of dollars to get the Governor elected, and now we’re going to support that nomination by approving him? I hope not. I hope that we’ve learned something from the past in Illinois and I hope that we all vote No on this appointment. Thank you.

Two problems. I -- I had met with Mr. Cosgrove in my office a few days ago and was unaware of - as I told him in -- in committee - was unaware of his large donation that his PAC had given to the Governor within the last five months. And while it may not be illegal, we -- while it may not violate any ethics law, I think we have a duty and a requirement that we should avoid the appearance of impropriety and I think this does not meet that standard. The other thing in committee that he -- he answered to my question if he would still be involved with his Personal PAC, he answered that indeed he would continue on with that, which I believe is also -- would be a conflict, and the gentleman that we just appointed prior to this appointment, Mr. Costigan, was willing to give up several associations that he has in order to take a position with the State. So I would encourage a No vote on this appointment. Thank you, Mr. President.

Excuse me. Thank you, Mr. President. Ladies and Gentlemen of the Chamber, I am a new member of the Senate Executive Appointments Committee. I served for just a very brief time, I should say, when I first was elected to the Senate and then was -- have not been on it for years before the beginning of this General Assembly. But it’s always been my view that the Chief Executive deserves a measure of leeway in picking his or her team. Those are the people that the Chief Executive has to work with and they have to follow his guidance and he needs to feel comfortable with his team. And so I always feel like there’s a -- there’s a set of parameters within which if the Chief Executive works, then that’s legitimate. But the Senate has a constitutional role in this process. And so those lines, wherever they are for each Member, we -- our job is to make sure that the Chief Executive does not go outside of those lines. And for all of us, those lines are different places and they’re there for different reasons. But, surely, one of those for everybody has to be the integrity of the government in which we serve, and particularly the Chamber in which we serve. Now, a few weeks ago, this Governor appointed and submitted for approval to the Senate a former Member of the House of Representatives, who had campaigned adamantly against a tax increase, lost the November election, came back to Springfield, voted for a tax increase that was literally twice as large, and then was given a job by the -- the Governor at a pay that was at least fifteen thousand dollars more than she was making at the time. And this Body, Republicans and Democrats, stood up, Mr. President, and said, no, that does not pass the smell test. 32 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 That is outside the parameters of where we think the Chief Executive should go. I would submit to you that to the people who we represent, not the circle here around the rail or in this Chamber or over there and certainly not on the second floor - I’m talking about the people back home who look to us to do the right thing, who are paying for us - this does not pass the smell test either. This falls outside of those parameters that the Chief Executive must operate within. Mr. Cosgrove’s organization donated - donated - over four hundred thousand dollars to the Governor’s campaign, the person who’s giving him this job. Mr. Cosgrove and his organization were integral players in making sure that he kept his seat as Governor. That does not pass the smell test back home. That is outside of the parameters that this Chief Executive must work within. And I don’t care what label you attach to it, “pay for play” or -- or whatever, that -- that’s not the point. That’s not the point here. We’ve got a bigger duty than that that you can slap a political label on and it’s a duty to the people back home, and this is outside of those parameters. One other point that I must stand in opposition to this appointee, Mr. President, and that is, during the committee hearing, and Senator Duffy talked on this, Mr. Cosgrove himself admitted that someone during Senator Duffy’s campaign fabricated a website that they purported to be his website, candidate Duffy’s website. And while Mr. Cosgrove denied that Personal PAC had anything to do with creating the website, he did admit that somehow he came up with the address for the website and he and Personal PAC made a decision, knowing - knowing this was not the candidate’s website - knowing that - they nevertheless made a deliberative 33 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 decision to drive voters to the website so as to make them believe that what was on the website was what the candidate believed. I asked Mr. Cosgrove whether or not he thought, personally, that was right. To which the original response was, “You now, politics is a rough and tumble business.” Well, that’s not an answer. So is government sometimes, and that’s not the attitude I want sitting anywhere near the Human Rights Commission. He told me then -- he told the committee that he would do it again. Look, every one of us in here and everyone in the House have been involved in campaigns that were difficult, that had mistruths, that tried to -- where one side or the other tried to foster misperceptions to one degree or another. We’ve all been involved in those, haven’t we? But isn’t there a standard, just like there’s a -- parameters without which the Governor shouldn’t operate? Isn’t there a standard? Isn’t there a base line somewhere where we say, “You know what? No, that’s not right. That’s out of bounds. We’re not going to accept that.” And I would submit that driving voters to a website that you know falsely represents the candidate’s views is beneath the minimal standard of -- conduct that even we should expect, even in these days of politics. We can do better. Mr. Cosgrove on his résumé may be very well qualified, but we can do better than someone who’s engaged in this kind of political activity. I would urge a No vote. But I will tell you, and I do know Mr. Cosgrove, and I -- I met with him for numerous hours during, you know, pre-campaigning, actually, and felt very comfortable talking to him and telling him of -- of my feelings about the issues he’s concerned with. I serve on the Executive Appointments as the Vice-Chair. It’s been very difficult seeing folks come through that committee and I have my opinions on many. But we’re talking about qualifications of a human being who brings a lot of controversy to State government, but he’s very well defined with a history on the Human Rights Commission in Champaign County, having been, I believe, the Chairman. Mr. Cosgrove brings a unique style and an open way of living and that is what America I knew was all about. As we continue to close the picture window on America’s freedoms, we are at the -- open democracy and able to have these open debates in committee and it was a wild one this morning. I thought it was exciting and it really motivated me. But let me say that at the point of Mr. Cosgrove - I think someone on the other side of the aisle pointed out very well - his résumé is very qualified. This is the Governor’s choice. I didn’t back this Governor in the primary or the -- well, in the general, we were there, but I didn’t back 38 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 this -- a little Freudian slip almost came out of me there. But what the -- what the -- the reality is, is that I support Terry Cosgrove. For the love of God, forty-six thousand dollars a year, part-time, to serve as a member - not as a chairman, a member - hundreds of thousands of dollars given away to who? Well, guess what? He would have had a pick of the low-lying fruit, but he’s going to be a member, a member on something he has a strong passion about, not politics. We don’t -- we have - - when have we heard about the politics on the Human Rights Commission? This is clearly political in this Chamber today and I respect the frustration. I’ve been in some nasty campaigns of my own - within the Democratic primary. They had me saying that I had a fictitious child in the State of Florida and that I was a deadbeat father when I only had two biological children and a wife who I’ve been with for thirty-seven years, my high school sweetheart. I’ve been there. The person who did that is one of my best friends now, because I understood the politics, and as long as my wife forgave him, I forgave him. My children forgave him. And who we talked about is now in Heaven. But I had to sit there today and I voted on his credentials and Mr. Cosgrove is highly -- highly qualified for this position. And let his politics roam, let him be free, because that’s the America I know. Let’s all make sure we respect the decision of this Governor. We have vetted this gentleman to the maximum and I would ask that we -- put our small politics aside till the next campaign. And contrary to popular belief, we can be statesmen. So let’s do the right thing and help Mr. Cosgrove move on and let him practice what he preaches and let’s see exactly what he does, because he’ll have to come up for another appointment and 39 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 we can -- we -- I -- I’m not inhibited to say that I have confidence in all of us and you to be able to -- if we don’t get him in the wash, you can get him in the rinse. Thank you very much. You know, Terry Cosgrove has dedicated his life to the issue of human rights. At -- it was a very personal issue for him; when he was a young man at the University of Illinois, he and his partner at the time went into a bar locally and were dancing and were told they were not allowed to do so and had to leave. Now, many people at that age may have just dropped it, but he did not. He went and worked with Lambda Legal and brought a lawsuit and got that bar to, in fact, change its policy and to allow same-sex partners to participate in what was happening there in the bar, just dancing. He went on then and turned that into his work in Champaign-Urbana and was asked to serve on the Human Rights Commission -- Human Relations Commission in Champaign-Urbana. He passed, working with Republican mayors in both Champaign and Urbana, two ordinances that were at the time the strongest human rights ordinances in the country that included protection for 40 STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 26th Legislative Day 4/7/2011 both source of income as well as sexual orientation. And ever since, you know him most well now for his role in Personal PAC and this is a person of principle and belief. That is what drives the organization. It’s issue-driven. It is about supporting bipartisan, Republican -- or candidates who support pro-choice. And he is fiercely independent and is getting appointed as an independent, in fact, and has a real track record at Personal PAC. Their policy is very much to support people across both aisles as long as they support pro-choice issues. He, of course, supported Governor Quinn, because Governor Quinn is a pro-choice Governor. The -- any allegations of this being a pay for play is preposterous. This has been an incredibly issue-driven organization. That’s been his entire track record and Terry Cosgrove could not be a person of higher integrity and moral character. I’ve had the pleasure of knowing him for years, well before I got into politics, and am very proud to be able to sponsor him for the appointment to the Human Rights Commission. And appreciate an Aye vote.
