Today is a very significant day today in the State of Illinois with all of the Black Greek organizations coming together once again for Legislative Day. And the -- the -- the Greek organizations are called Divine Nine. And you have over four hundred African-American male and female Greek organizations here in Springfield. And I’d like to read their names, if I’m permitted to do so, Madam President.

Thank -- thank you, Mr. President. In the State of Israel, a horn is blown and the whole country comes to a moment of silence. I’ve never experienced it; I’ve seen it on TV. My children have seen it. People get out of their cars and have a moment in silence. Today, thanks to the auspices of the Jewish Federation, a memorial service was held at the Old State Capitol. Unfortunately, we always say never again, but genocide is still -- raises it’s head in today’s society. I’d just like to read an -- excerpt from the book Night from Elie Wiesel, which really summarizes what happened in 1994 {sic} when he arrived at Auschwitz. So I’m going to read this passage and I’ll make it very short: Not far from us, flames were leaping up from a ditch, gigantic flames. They were burning something. A lorry grew {sic} (drew) up at the pit and delivered its little load of {sic} children. Babies! Around us, everyone was weeping. . . . Thank you, Mr. President, Members of the Senate. This bill is designed to make college education possible for immigrant children. It would allow Illinois residents with a valid taxpayer ID number to invest their money in either one of our two college savings programs, Bright Star {sic} (Start) or -- and Bright Direction {sic} (Directions), which is administered by our State Treasurer, or to purchase a prepaid tuition through the College Illinois! program, which is a pre-paid college tuition program. Secondly, it would also create the Illinois DREAM (Fund) Commission, which will provide scholarships to the children of immigrants; but these scholarships and programs will be funded by private funds and not by State funds. Lastly, it would expand the continuing professional development requirements for school counselors to include activities that address the needs of children of immigrants. Illinois has been a progressive state in assisting our non-resident -- our resident children of immigrants. Back in 2003, we overwhelming passed a bill to provide in-state tuition rates for these residents. I believe that it’s a bill that -- whose time has come to encourage our citizens to -- and make it easier for them to go to college and get an education. Be happy to answer any questions and ask for an Aye vote.

Today could be a very historic day here in the State of Illinois, for we are being able to give young children, young adults, the opportunity to go to the university, which will be funded privately. There will be no taxpayers dollars involved. You know, when you look at the -- at our young peoples up here in the gallery, out there in our -- in our -- in our communities, they want the opportunity to be able to go to a university and become great professionals. Let’s give ‘em that opportunity today, here, by passing this bill over to the House. I want to just commend Senator Cullerton, President Cullerton, for a great job and being able to bring this to the forefront. This is about our young men and women becoming great people of society, great professionals that are going to be there to serve our communities. And I -- I stand here in strong support. Let’s give our young people, yet again, the opportunity to go to the university and help continue to strive in this wonderful world that we live in. I urge an Aye vote. I want to see fifty-nine lights light up this for the sake of our young people.

Yes. In order to qualify, Senator, the student would have to obtain a valid taxpayer ID number, which is issued by the Internal Revenue Service. And if they receive one from the Internal Revenue Service, then they would be eligible, and they have to, of course, be residents of Illinois.

PRESIDING OFFICER: (SENATOR SULLIVAN) President Cullerton.

These are students who are already entitled to go to our universities. They already are in our universities. They’re paying in-state tuition rates. Now, all we’re saying is, they can avail themselves of the same programs that the citizens can avail themselves of right now. So I would argue, very clearly, this does not take anybody’s place in college; they could already be there. They just have an easier way of how -- of being able to afford the college that they’re -- that -- with their own money that they’re going to college with.

Well, we -- we appropriate money to higher education, yes. When we start up our discussion on our budget, we can discuss that specifically. But, yes, we do help fund higher education. And, as you know, we have some of the finest schools in the nation in our State of Illinois, which helps promote our 23  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 business climate and our reputation as a business community, so that we have a highly educated workforce. These children of immigrants certainly fall into that category of bright young people who deserve to have this opportunity to go to those universities.

PRESIDING OFFICER: (SENATOR SULLIVAN) President Cullerton.

Senator, I think you’re discussing or debating a different bill. That would be a bill that would -- you might want to advance to say that these children cannot apply to the university. That’s not what this bill does. We say that they are now in our universities; they’re entitled to go. We’ve even said that they don’t have to pay out-of-state tuition; they pay in-state tuition. So the children of immigrants are in the colleges now. This bill says that they can avail themselves of these three State programs. And it does not cost the taxpayers any money. The fact that they’re in college, are you saying 24  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 that costs taxpayers money? Well, then, if you don’t think they should, you should put a bill in to say that they shouldn’t be entitled. I wouldn’t vote for that. I’d think they should be entitled to be there and I think they should be able to avail themselves of these programs, so it’d make it easier for them to afford it.

Thank you. And thank you, Mr. President, for bringing this legislation forward. I just want to touch on a couple issues that were brought up from the other side, for clarification purposes for all those in attendance. The ITIN number, which is the individual tax ID -- individual -- I’m sorry, the individual tax ID number, that is -- is had by an individual by the Department of Revenue because they’re working and they’re paying taxes. Is that correct?

PRESIDING OFFICER: (SENATOR SULLIVAN) President Cullerton.

That’s my understanding. They would apply for a valid taxpayer ID number so that they can report their income and pay taxes to the government.

PRESIDING OFFICER: (SENATOR SULLIVAN) Senator Delgado.

Thank you. And at this point, to the bill, Mr. -- Mr. President. I, too, rise in strong support of this legislation. We have pared this legislation so that we can make sure that it’s palatable for all those here. The individual tax ID number means that they are taxpayers. The family is paying taxes. They’re employed, regardless of their current status. They may be on their way to citizenship, they may be in the first stage, 27  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 but they’re paying taxes. If there -- if there’s classroom constraints that folks would have a legitimate concern about, and I understand that, many constraints are based on the academia and the ACT score or LSAT {sic} (SAT) scores on why they -- a student shouldn’t be admitted. And that history is very clear. At the same time, since they’re paying taxes, Mr. President, they’re not going around the bend and consuming lessons and curriculum and labs that -- that otherwise are paid by the taxpayers while they’re -- if they have an ITIN number, they’re participating in having taxes taken out, although they don’t enjoy the -- the -- the status of citizenship. And so it’s very important that we don’t throw the baby out with the bath water. This is a very clear human rights and public health attempt to create a transparent process towards citizenship for these populations. Now, we are now talking about children, who perhaps didn’t even choose to come to this country, but who are here and who are contributing to our society by paying taxes and by becoming educated. We simply are saying they should be treated the way other children are, who want to go to college, avail themselves of some college programs, a DREAM Commission that will help them with private money for their scholarships, and as a result, we will make a better society for all of us. I talked to the Senate President about that. This is -- I wouldn’t take this as any kind of a -- a slight against you. We just present it as a five-percent reduction of our own. If your -- we will more than happily take up a vote on a bill that reduces your budget by five percent as well.

The fact is -- if you can also look -- I’m going to draw you to the number under COGFA that we have in the budget. There’s a reduction of about three million there, that’s already appropriated to other areas, that we’ve backed out under that budget. So, it is a reduction. And -- and just to get back to this issue, I think, this is very, very important to know that we are working together. I reached out to my colleague, the spokesperson in -- in -- who we’ve worked with on an earlier bill, Senator Althoff, to make sure that we have a reduction coming from your end. Historically, so you know, different caucuses are basically in control of the money of their own caucuses. So we wouldn’t -- we wouldn’t, you know, pretend to know how much you were going to reduce from your own caucus. We give you the right to do that. So, we -- we obviously want to work together on this. It’s a spending reduction. I think it’s very important we maybe follow the lead on what happened with the -- the Speaker of the House. Federally, they cut their budget by five percent. We need to show the public that we’re cutting our budget by five percent. Look forward to working together with you to make sure that we achieve that same goal, either through a, you know, future amendment or a separate bill. That’s what we’re focusing on and I appreciate your points.

Think you’d know that if you were a part of the appropriations process, what we’ve been endeavoring to do this whole time. You know, we’re making cuts. This is a spending cut. And the fact is, there shouldn’t necessarily be hesitation here. You’ll have an opportunity to introduce your own separate bill. You can have your own news conference, or anything. I’ll come and join and say “We did this together.” I mean, this is -- this is a piece of legislation that’s reducing spending in the State budget. It’s important. So, that’s why we’re advocating for this. This is -- I encourage you to vote for it. And -- and the other thing is this, we’ve been doing this for months. We’ve known that we’ve done that. There’s great opportunities to introduce amendments. But as I said, I brought this up to Senator Althoff’s concern today and she -- we talked about addressing this. In this budget, from the -- the first amendment, you know, we establish what the Governor’s budget recommendation had been for Fiscal Year ’12, then we reduce the -- like we’re doing for many of the agencies, we’re reducing the personal services lines and the operation lines by five percent and the contractual lines by seven percent. Also want to point out that there was a -- a change in the OSF-funded 52  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 program, the grants to establish health care systems for DCFS wards. This line had originally been -- has, to date, been in the Department of Human Services. As the Governor’s budget had, in a number of cases, moved programs out of the Department of -- Human Services to a number of different agencies, we are moving those back and just keeping them at the Department of Human Services. So this budget also transfers an item from the Department of Children and Family Services back to DHS where it currently resides.

I would like to just note that this does, in fact, 55  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 represent a decrease to General Revenue Fund spending of .5 percent from Fiscal Year ‘11 spending, a much larger decrease from what the Governor’s budget -- Fiscal Year ‘12 budget recommendation had been. I would urge an Aye vote. I -- I also just want to note that this is a department that’s under -- been under -- consent decrees. So, it’s one of those areas that while we’re looking and doing real cuts, there’s a real need to keep protections and the services we’re providing due to consent decrees and other constraints. This amendment appropriates 52.3 million from the General Revenue Fund, 167.2 million from other State funds and 32.4 million -- 32.4 million from federal funds, for a total of 251.9 million to the agency. This includes a five percent cut from the Governor’s Fiscal Year ‘12 introduced amount for GRF personal services, five percent cut to operations, and a seven percent cut to contractual services. This amendment eliminates all appropriations to the Partners for Conservation Fund. I’m more than happy to answer the questions. Just to focus on this 57  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 -- give you some real numbers, when you’re talking about the -- the decrease -- the decrease of 8.1 million from the Governor’s introduced budget, but also a decrease of -- from 2011, actual appropriations of 9.7 percent, which is about two hundred and seventy-nine -- sorry, about 2.7 million.

I’m getting confused by the debate. Are we increasing spending over last year’s level in this bill, or are we decreasing spending in this bill? This is a bill for a specific State agency. Are we spending more money or less money? Because I know the -- we just adopted an amendment that reduced the Governor’s proposal. So, is it more money or less money? Could you give me the exact numbers?

If you look at the -- the bill, the total amount that’s appropriated as Fiscal Year 2011, was two hundred and seventy-eight million nine-hundred and ninety-one, this presents a reduction of two hundred -- down to two hundred and fifty-one million eight ninety-two. So there’s a significant reduction. I mean, the Governor’s intro was two fifty-nine, which is a reduction significantly from the previous year. We reduced it even further by eight million dollars, which is an additional reduction of 3.1 percent.

Thank you, Senator. Let’s just take you through this thing for the appropriations and we’ll go through this over the -- the last few years, even starting to Fiscal Year ‘10. We’ll use that as context, 26.3 down to 25.7. The Governor introduced at 25.5 and then we corrected it, we corrected it down to 24.9. So, we’re making corrections and modifications and spending reductions so that we can have a balanced budget. The fact is, we’re making significant reductions, we’re cutting the cost of government, and we’re going to save taxpayers money.

I -- I’m glad you brought that out. Glad you brought that out. The fact is, we’re -- we’re using that number because we’re determining that that’s an overspend, that’s too much money. And we’re looking at making reductions, as we have throughout the past, in ways in which we can save money. So, if we look historically -- the reason why I gave you the historical number is to show you how spending has decreased in that area. And we’re continuing to decrease it, right? Even if it’s something that hasn’t been the best performance possible, we continue decrease spending in that area. And that’s why we’re -- we’re using that.

Yeah, the -- the number that we have, and I’ve been giving you the number that we’re using to guide for Fiscal Year ‘12. I gave you the overall number. And you’re -- you’re right; I gave you the overall number, which represent {sic} a significant decrease of 9.7 percent. In looking at the change that we have, it’s a -- what was appropriated in GRF was about fifty-one -- fifty-one million. So we’ve revised it to basically -- for the most part, for it to be static. So, but the reality is the overall decrease in the State budget, the overall decrease, is - - in that budget, in DNR is about 9.7 percent. What we looked at, what we looked at, and I think this is important to know, where we could make significant cuts is five percent cut from the personnel {sic} (personal) services, five percent to operations, seven percent cut to contractual, and we even eliminated the Partners for Conservation Fund.

Yes, thank you, Mr. President, Members of the Senate. Members of the Senate, last year we did a lump-sum 66  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 appropriation. We had a problem finding out, because of that, how much money was spent on individual agencies, because it was up to the Governor to do so. We asked the Governor in his budget to ask -- give us a budget that told us how much money he spent last year. And he did so and it’s out of whack. So, we are in the process of reducing it. So it’s very likely that we are spending less money than we did last year for the Department of DNR. Now, I would say, though, if you need to have us hold this bill to have the Republican approach to the budget for the Department of DNR, I’d be happy to wait for it. What do you want us to do for the Department of DNR? We’re cutting the Governor’s proposal and you’re criticizing it. So, it shouldn’t be a long night; it should be a real short night. Just give us your amendment, your alternative, to the Department of Natural Resources and we can vote on it. We’ll facilitate the vote. But, if you don’t want to do that, if you don’t want to go to the Reference Bureau, then let’s just vote on these bills, start passing a budget over to the House, and start to continue to cut, so that we can have a balanced budget.

I -- I just want to be clear with what we’re talking about here. We have started from the beginning of this process with an identified revenue number, identified revenue, and identifying the revenue, then we backed out this fixed cost, and what’s remaining will require us to make significant cuts, which we are, from the introduced budget. They’re going to be significant cuts that we’re making - and we are making. We’re moving forward in that direction. The fact is, if you look at the budget, you view this budget, there are reductions, cost savings, going after contracts, personnel items, admin line items, and we’ve been working on this for several months and we’ve met with these departments. We focused on them in areas of performance. We focused on areas where we can make the reductions. I think it’s very important to know that and we’re building on this. The train’s leaving the station when it comes to voting on cuts. Either get on the train or get off the train, but we’re making these cuts. And you follow with us, great. And we’re going to keep on doing it and we’re going to do that till we have a balanced budget and it’s going to balance with the revenue. Thank you.

Senate Bill 2414, as amended, makes appropriations totaling thirty-one million forty -- forty-six thousand dollars, all funds, for Fiscal Year ‘12 to several of our smaller human services agencies - for the Illinois Council on Developmental Disabilities, the Deaf and Hard of Hearing Commission, the Guardianship and Advocacy Commission and the Department -- the Human Rights Commission and the Department of Human Rights. The 73  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 -- the Council on Developmental Disabilities, we have not made any changes to it. The Deaf and Hard of Hearing Commission, we did make a reduction to the general funds lines, as well for the Guardian {sic} and Advocacy Commission. The Human Rights Commission, as well, we made a reduction. They had asked for an increase in staffing. In the Department of Human Rights, they’d also asked for an increase in staffing. We’re holding them to their current year’s staffing levels and doing a reduction of five percent, like we’ve been doing for other agencies. In total, there’s a reduction of 1.9 million dollars, or 5.7 percent, from the Governor’s introduced budget.

Yes, I just want to point out that, you know, we are -- these budgets are, in fact, doing a reduction from the Governor’s introduced level. I understand that it is a slight increase from Fiscal Year ‘11 spending. Just want to note that in the Republican plan, the fiscal reality plan, the way they were also introducing and suggesting going about it was reducing from the Governor’s introduced budget. In every case and every department, how they went about suggesting cuts was based on the - Governor Quinn’s Fiscal Year ‘12 budget proposal. We’re doing the same thing and coming up with our overall budget reductions based on the Governor’s introduced proposal. I would urge an Aye vote for this. This is another one of our steps in accomplishing and bringing back down that spending to live within our revenues that are available.

Senate Bill -- Amendment No. 1 to Senate Bill 2424 is a page and line amendment zeroing out the Agency’s appropriation for the Partners for Conservation Fund and replacing the personal services component of that appropriation with the General Revenue Funds, while eliminating the Illinois Clean Lakes Program grants. Reduces the Agency total appropriations to 287.6 million, all funds, including an increase of 622.6 thousand GRF for personal services and expenses, which represents ninety-five percent of the Illinois Clean -- Clean Lakes Program’s Fiscal Year ‘11 enacted appropriation for personal services. And let me be clear on this, the reason why there is an increase in the GRF is we pulled it out of other State funds. We pulled it out of the transfers out and then we reduced it by five percent. So we pulled it out so it gives us an opportunity to better review it in the appropriations process instead of having automatic transfer. So it’s better reviewed in the appropriations process, better evaluation, plus the fact we’re reducing that -- that appropriation by five percent. More than happy to answer - - answer any questions.

I should note the appropriation also includes a -- a hundred and four million forty-three thousand dollars from GRF, 78.2 thousand from other State funds, and 571.9 thousand from federal funds. We’ve done a number of reductions in here, including a number of things that had been suggested as well, by -- with our Republican colleagues, such as getting rid of, a hundred percent, all of the funding for the East St. Louis Financial Advisory Authority. In total, we’re reducing all funds in these agencies by 19.5 percent over Fiscal Year ‘11 spending. Happy to answer questions.

First of all, I want to commend you, Senator Steans, for the work that you’ve done in trying to reduce our deficit and close the gap, but I have a question in reference. I’m just looking at the Violence Prevention Authority. I see there’s a reduction of at least thirty-seven percent. Can you tell me the programs in which those programs {sic} have been cut from?

It is primarily from the program Senator Murphy was just referencing, the Neighborhood Recovery. It’s also from the Safety -- Safety Net Work {sic} (Works) program. And again, ten percent reductions there. We also -- there were some programs that had been moved to the Violence Prevention Authority that we’re moving back to DHS and moving some of the funding that we cut from there into them, like Teen REACH and the Rape Crisis Centers.

So, let me just understand, the Teen REACH program and some of the programs that I would be concerned about because of the 88  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 summer approaching and the safeguards that we have to keep in place in these communities where violence is very high, those have been somewhat -- ten percent reduction or they’ve been placed in another category under DHS?

We -- we are keeping Teen REACH at DHS. The Governor’s proposed budget had them in the Violence Prevention Authority. Based on recommendations from the Human Services Commission, we are keeping them at the Department of Human Services. So these reductions are not impacting Teen REACH. In fact, the Governor’s Office very much reduced it. We are putting money back in. But that’s not in this budget; that’s in the Department of Human Services budget. So these reductions are really from the Neighborhood Recovery program and -- and -- and the -- the -- the new program that was just started last year by the Governor - we’re reducing that ten percent.

Just to follow up to a previous point that was raised. One of the reasons why, I think, some of the funds was able to be dispensed quickly and effectively is because of the fact that they had organizations that are well established, had solid infrastructure in place, like Children’s Home and Aid Society of Illinois, who served as the administrative service organization for the disbursement of funds in the communities, where they 89  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 evaluated the performance of these grants. So they’re able to do a better job of monitoring and getting directly to the -- to the communities that are most impacted by violence and crime in the suburbs -- I’m sorry, in -- in the summer. So that’s -- think it’s very important to know that, that some of the due diligence was put in place and -- through the Illinois Violence Prevention Authority. Barbara Shaw had set an infrastructure in place and been trying to do something like that for a couple years, so when the funds were available, is -- able to be dispensed quite quickly and effectively. Yes, but you are cutting ten percent out of that. This is one of those programs, I just believe, that to cut a program of this nature in this environment -- this economic environment, I think would -- would put more impact, a negative impact, on society as a whole, and I -- and I just believe that’s -- this is one of the wrong ways to do it.

Thank you, Mr. President and Ladies and Gentlemen of the Senate. I just want to -- this is a -- the budget for the Department of State Police. And just so we’re clear in the beginning of our discussion here, GRF appropriation for the State Police in Fiscal Year 2011, two -- two hundred and seventy-six million five hundred and fourteen. What’s being proposed here is two hundred and sixty-two million, which is a reduction of twelve million dollars. So this is a spending 93  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 reduction of twelve million dollars from Fiscal Year 2011. The -- the amendment also includes, again, personal services reduced by five percent from 236.7 million to 224.9 million, contractual services request was reduced by seven percent, from 9.9 million to 9.2 million. And also, after these reductions, the group of line items will total 234.3 million, which is down from the 246.6 million in the Fiscal Year ‘12 introduced budget and down from the Fiscal Year 2011 enacted levels of two hundred forty- four. So, I wanted to address the second amendment on this, which essentially focuses on the Shared Services Initiative, and that reduced the Fiscal Year 2011 funded level, 1.6 million from 1.7 million for 2012, and the Nursing Home Identified Offender Program funding is reduced by {sic} seventy percent of the increase requested by the department from -- to five hundred and ninety-five thousand from eight -- eight hundred and forty thousand from the -- the -- what was requested in the introduced budget by the Governor.

We’re cutting costs and that’s adding up. So, I know we’re hearing feedback back there that’s saying it’s not enough, but there’s a lot of bills we’re going through and each bill that we’re focusing on that -- making reductions, it’s happening. It’s happening and we’re voting on it. So let’s be very clear about this. We’ve looked at this, we’ve analyzed these budgets, and we’ve presented significant budget cuts. This is twelve million dollars. A twelve-million-dollar cut. Thank you.

The -- the Senate Bill 2475 appropriates 13.8 million dollars -- a increase of the GRF 96  STATE OF ILLINOIS 97th GENERAL ASSEMBLY REGULAR SESSION SENATE TRANSCRIPT 36th Legislative Day 5/4/2011 appropriation -- excuse me, 13.8 million dollars, from 132.3 to 146.0 million GRF dollars. Personal services and operations are decreased by five percent; contractual services are decreased by seven percent. The appropriations for stipends for the State’s attorneys and public defenders have been added back in as well. The Governor, in his introduced budget, had proposed to move those stipends to the Supreme Court appropriation. So we’re just moving those stipends back from the Supreme Court to these budgets.
